Dear Dale:

Senator Hodges and I had a conference with Joe Cresse,
Hamilton and Revell of the Bureau of Budgeting on
Monday, June 22, 1970 to clarify the landowners'
attorneys and appraisers fee problem. Joe Cresse again
emphasized that the WRDA policy of November 7, 1967
would have to prevail unless the Department of Natural
Resources changed that policy. I acknowledged that we
all understood this and that we had only one group of
exceptions to the policy--your condemnation cases
approved by the Board of Conservation Subcommittee in
May, 1968. I explained that only two payments of land-
owners' costs remained under those cases--$3,973.00 under
SWD Resolution 363 and $440 under the SWD Resolution 376.

Joe Cresse stated that auditors would question paying
landowners' attorneys and appraisers fees in view of the
November 7, 1967 policy. I again stated that I believe
that all acquisition costs should be paid. I pointed
out that both our agenda item and the resolutions ex-
plained the payments and that these two remaining resolu-
tions were the last to be paid. Reluctantly he agreed to
these last payments as exceptions and emphasized that the
Head (Governor and Cabinet) of the Department of Natural
Resources would have to give specific approval for any
other exceptions in the future.
