Dear Mr. Hodges:

Following extensive discussions with you and your staff regarding
the appropriation for the Water Resources Development Account, I would
like to give my understanding of the irrpact of the legislative intent.
As you are aware, Item 757 of the 1971 Appropriations Act appropriates
$2,805,000 from the General Revenue fund for this account. The following
proviso restricts the use of these appropriations: "P:ovided, further,
that in item 757 above the following will apply: Use these funds for no
other priority other than that specified; ...."

In addition to this restriction the following statement was made
relative to the legislative intent in the June 29, 1971 letter from the
Chairmen of the Senate Ways and Means Commr.ittee and the House Appropria-
tions Committee to the Secretary of Administration: "Funds provided by
the Legislature are to be used by the Southwest Florida Water I.:'-n--gener.t
District and the Central and Southern aFlridaa Flood Control DiCstrict in
the priority order of projects as submitted by those Districts during
legislative hearings, except for highway bridges provided for elsewhere.

The effect of the restrictions and the intent according to my
understanding of the listing referred to provides for the specific
projects as shown on the attached listing.

The problem with which you are faced, as I understand it, is that
in addition to those contracts shc:-n for the Central and Southern Fl.ria.
Flood Control District for which funds were provided there are additional

contracts totalling some $767,680 for which no funds were appropriated
given the restriction and intent cited above.

I know of no way that funds can be provided to continue any
specific contracts not included in the above listing. Should you
wish to discuss this matter further, please let me know.
