i Re: Proposed Diversion from the Little Manatee River

Dear !Mr. Gardner:

Our attorneys have advised us that since the Little IManatee River is a iork
of the District a permit will be required from Flcrida Pow:er and Light for
your proposed diversion of water from- the Little Manatce River even though
the point of diversion lies outside the District boundaries. We have en-
closed for your use a copy of Chapter 16CB-1 of the Florida Administrative
Code and also an Application for Permit which you should complete and return
to us 0 request that this be returned as sjon as possible but no later
.,th.n January 3, 1273 in order that c' r.'ay present it to the Alafic River
Basin Board at its January meeting.

Referring to your letter of November 17, 1S72, it is our opinion that the
j amount of water you propose to divert is excessive and we will not issue
a permit for diversion in that manner. Wle believe that a more reasonable
Diversion w-hich would preserve the river environment and protect riparian
owners would be that which we previously reccr.'ended to you. We suggest
that your permit application follow our recommendations in order that we
I might expedite issuance of the permit.
