Dear Mr. Feaster:

Thank you for your letter of December 8, 1972, which arrived December 11,
You requested to have a reply no later than January 3, 1973, a period
during which our staff members had previously scheduled vacations.
Consequently, it is going to be very difficult to give it appropriate
consideration which a proper reply would deserve. We would appreciate
very much the opportunity to defer replying until at least January 16.
We hope this will not inconvenience you unduly.

The fact that your attorneys have advised you that a permit will be
required from Southwest Florida Water Management District is surprising
to us in view of the fact that you previously told us that no permit
will be required. It would appear that the change in your viewpoint on
this subject would indicate that there is at least a difference of
opinion within your own organization concerning the extent of the
District's jurisdiction. In view of this, I think it would be advisable
for our representative attorneys to confer on the subject in order to
exchange their respective points of view and bases for their respective
positions. By copy of this letter, I am requesting our attorney,
Mr. Wade Hopping, Jr. of Tallahassee, to attempt to set up such a meeting
with your Mr. Gibbons. It may be of value for Mr. Gibbons also to attempt
to contact Mr. Hopping directly. We think that this conference could go
on despite the vacation delay in getting the analyses of our technical

to find an equitable solution for the public interest which both of us
