Re: Proposed Diversion from the Little Manatee River

Dear Mr. Gardner:

Attached please find two graphs which depict our basic requirements
for approval of a permit to withdraw water from the Little Manatee
River for cooling water purposes. *^Ve believe that these requirements
will receive the general approval of our Alafia Basin Board.

The requirements are based upon a maximum pumping capacity
of 200 cfs and with pumping beginning when the river discharge is
above 40 cfs. From discussions with Mr. W. J. Barrow of Florida
Power and Light and Mr. Carl Fick .of Brown and Root we understand
that the pumps (pumping station) ,will not be capable of pumping less
than 5 cfs; therefore, in reality withdrawal will begin when the river
discharge reaches 45 cfs rather than 40 cfs -AiRe '%ing to
attached graphs: at river discharges of 100, 2006 and 400 cfs, 24,
32, and 36 percent of the flow could be diverted. A diversion of
200 cfs or 37 percent of the flow could begin when the river discharge
is 550 cfs. For an average year the diversion possible under these
restrictions would be approximately 13,150 cfs days or an average
diversion rate of 36 cfs. This amount of diversion is about 21 percent
of the long term average flow of the river and represents 125 percent
of the plant requirement of an average diversion rate of 29 cfs.

We are not agreeable to an automatic lifting of diversion restrictions
during the initial reservoir filling period. Our calculations indicate
that if filling were to take place during a recurrence of the most
severe drought of record sufficient restricted diversion would be
possible to fill the reservoir to a testing level of 53. 00' M. S. L.
within a period of eighteen months. However, should a more severe
drought or other act of God occur during filling and it became
apparent that additional diversion would be necessary to reach the

testing level by a pre-determined time we believe that the Board
would be agreeable to making reasonable adjustments in the
restrictions.

Your letter of November 17, 1972, requested the guarantee of
certain permit features -- that is -- binding recognition of reasonable
use -- allocation of use -- temporary suspension of limits or
restrictions -- automatic reissue of any permit -- and no further
restriction, condition or action on the part of Florida Power and
Light. These guarantees cannot be made because in many instances
such guarantees would require Southwest Florida Water Management
District to violate the equal rights of others to future use of a portion
of the water of the Little Manatee River as well as necessitate
our violation of the Florida Statutes under which we now operate
and/or will be operating in the near future.

In regard to one of the above discussed features -- temporary
suspension of limits or restrictions -- we view this in the same
manner as suspension of limits during; initial filling. We are not
agreeable to an automatic suspension of restrictions but should any
reasonable emergency arise we believe that the Board would be
agreeable to making reasonable, necessary adjustments in our
restrictions at that time.

The information presented herein will be the staff recommendation
to the Alafia Basin Board and will be presented to that Board at its
meeting scheduled for January 25, 1973. An Application for Permit
is enclosed and if the completed application is received prior to that
meeting we anticipate that the Board will take action and refer the
matter to the Governing Board for action at its meeting scheduled
for February 14, 1973.
