RECOMMENiDING STATUTORY AM~Dm'TT TO TIT WATER
RESOURCES ACT OF 1972 POSTPONING TP.RAlF1'ER OF
OKLAWAIIA RIVER BASIN TO ST. JOHNS RIVER WATER
MANAGEMENT DISTRICT


WHEREAS, the Southwest Florida r'ator management District, hereinafter called
"District," was created under Florida Statutes, Chapter 61-691 as amended,
.Laws of Florida, Acts of 1961; and

WfEREPAS, the Oklawaha River Basin, hereinafter called "Basin," was constituted
in and part of the District under Florida Statutes 61-691, Laws of Florida,
Acts of 1961; and

WHEREAS, the Basin under Chapter 373, Florida Statutes 72-299, Laws of Florida,
Acts of 1972 is constituted in and made a part of the St. Johns River Water
Management District, hereinafter called "St. Johns District," and is to be
transferred from the District to the St. Johns District on July 1, 1975; and

WIHEREAS, there are constitutional, legal and operational problems of implementing
the Basin's transfer to the St. Johns District that are not completely resolved
nor capable of being resolved by July 1, 1975; and

WHEREAS, the Basin Board is concerned and faced with the duty of continual
maintenance of existing facilities and the requirement of financial and staff
support of ongoing projects which cannot be undertaken by the St. Johns District
until the constitutional, legal and operational issues have been completely
resolved and the St. Johns District has become fully operational together with
all the necessary statutory rights, duties, powers and operating staff; and the
Basin's existing facilities and ongoing projects are handled by the District
and should remain with the District until the St. Johns District can assume and
maintain the existing facilities and projects; and

WHEREAS, the District's Governing Board has reviewed the Basin's request to
remain with the District and the recommendations of its staff that it would be
in the best interest of water management and conservation a duty of the District
that the Basin remain within the District until the Basin can be adequately
assumed and maintained by thoe St. Johns District.

NOW, THEREFOPE, BE IT RESOLVED BY THE SOUTHIWFEST FLORIDA WATER MANAGEIMENTf DISTRICT
GOVERNING BOARD as follows:

1. The Legislature for the State of Florida be urged to
introduce and pass a bill which would postpone the
effective date of July 1, 1975 under'the Florida Water
Resources Act of 1972, for the transfer of the Basin
from the District to the St. Johns District until such
time or date certain as will enable the constitutional,
legal and operational issues to be ultimately resolved
so that the St. Johns District is empowered to adequately
assume, maintain and support the Basin's existing
facilities and ongoing projects.

.> 2. The Governor of the State of Florida be urged to approve
a bill passed by the Florida Legislature amending the
Florida D.ater Resources Act of 1972 postponing the
effective date of July 1, 1975 until such time or date
certain as the St. Johns District is empowered legally,
financially and administratively organized, to assume
and operate the Basin's facilities and ongoing projects.

PASSED and ADOPTED this 10th day of April 1974.
