.TECT-ON 1. Be it odined by the Mlayor*ahirt'Ioun.
k cilmen of the city'of Apala'cbidola, That from and
after th. passage.of lhis-ordinafice it'shall be unlawful
for any personal deposit in any part of said city any
animal or vegelaWe matter, or create or cause any other
nuisance which 'may. be injurious to-the health or tffect
-$he public morals of .said city, and any person so offend.
'i'ng shall forfeit'"and pay to the said city the sum of ten
dollars for each and every such offence.
Sec. 2.. Be it further nrdrined, That the Board of
Healli shmal..once a month, oi,Jif necessary, report in
writing,any'and all nuisances in c-aid city to the Mayor,
,whose duty it shall be to. notify the oci-upant of the pre.
mrises on which said nuisance may exist, to abate the
same'frtlhwnilh. and upon the neglect or refusal of said
iccupant.tLo-doso he shall forfeit and pay to the-eaid city
the sum of five dollars for each and every day he W,

sec. 3. Be it further ordained, That the report of
the said Board of Health to the Mayor as aforesaid shall
be conclusive evidence as to what shall be a nuisance
under the provisions of this ordinance.

duty ot the Mayor to have suits instituted against all
persons violating any provision of the foregoing ordi-
nance in any court having competent jurisdiction of tho
