Drunk and ‘Muddy’St. Patrick’s Day festivities at the Devil’s Garden Mud Club, and a man couldn’t leave well enough alone and landed in jail. Lt. Angell, with the Hendry County Sheriff’s Of ce, responded to a call that someone was injured at the popular recreation destination. By the time he arrived at the campsite, he saw several people getting into the vehicle and rolling up their windows as if attempting to avoid him. He was able to make contact with them and noticed that the driver passed off an object, later identi ed as a bottle of Captain Morgan Rum to somebody outside the vehicle. Angell noted that the bottle was nearly empty. He was also told that no one needed medical attention. After questioning everyone, the lieutenant noticed that a Mud Club employee was having a heated argument with a male that he had seen in the vehicle when he rst arrived. Starting in September of 2011, the Florida Highway Patrol constructed a plan to improve the way traf c operates at this intersection. Using Ajax Paving Industries, FHP plans for project completion at the end of 2013. As an $18 million construction project, it is a worthy investment. The US 27/SR 80 intersection has earned a negative image to the residents of Hendry County with the alarming rate of accidents that have occurred due to its design and the risk posed to drivers. Currently, according to Debbie Tower, FHP Public Information Director, the project is approximately 30 percent nished from the six to seven months when it was initiated. “The accelerated pace is an advantage of the construction being away from traf c. Drivers don’t have to adjust to huge changes and construction workers can work more quickly and ef ciently,” said Tower. The program and entertainment that organizers had coordinated did not fail to keep the crowd clapping and cheering throughout the show. The announcers for the evening were Jesus Castro and Miss Latina 2005 Monica Herrera. With the show being in its tenth year, a presentation was made with the winners from previous years. They have large variety of calls that can be heard over long distances. They are commonly recognized by their loud gull-like “jay, jay, jay” alarm call which increases in speed if the bird becomes agitated. Blue Jays also make clear whistling notes and gurgling sounds. They frequently mimic hawks including Red-shouldered Hawks. One of their other calls sounds like an old squeaky handoperated water pump. Their rarely recognized “whisper song” is a soft quiet vocalization made up of clicks, chucks, whirrs, whines, and elements of other calls. This singing may last two minutes or more. Blue Jays are a large, crested songbird with a broad, rounded tail. They are smaller than crows and larger than robins. Their crest may be fully raised when they are excited or aggressive. The crest bristles up like a brush when they are frightened and is attened to the head when they are resting or among other Blue Jays. The oldest banded Blue Jay lived to be 17 years and 6 months old. These birds are lavender-blue to mid-blue w ith white or light gray under parts and white face. They have a black border behind the crest and U-shaped black collar around their neck. Males and females are similar in size and plumage. Their bills, legs, and eyes are black. Blue Jays prefer eating acorns, seeds, and nuts. At feeders, they often select sun ower seeds rst before eating other seeds. They also eat insects, bird eggs, nestlings, and small animal prey such as toads or rodents. Blue Jays are found in a wide variety of habitats and will build a bulky nest 10 to 40 feet above the ground in a tree. This nest is made from twigs, pine needles, Spanish moss, paper, and debris. The female will lay four to ve greenish, blue, or buffy eggs spotted with brown which she incubates for 17 to 21 days. Both parents feed the young until they edge at approximately three weeks of age. Blue jays will be one of over 135 bird species that photographers and birders look forward to seeing during their trips to area birding hotspots in Hendry and Glades County during the March 27 31 Big “O” Birding Festival. This festival will also offer workshops and programs at the Port LaBelle Inn as well as live Birds of Prey demonstrations, a silent auction, photo contest, and displays by local photographers. Attorney claims proposed changes in rules fall short of meeting Florida StatuteBY ERIC KOPPSouth Florida Water Management District (SFWMD) governing board members were presented a resolution Thursday, March 15, that claimed to bring their land leasing program into line with state statutes but, according to an attorney, it falls short of that mark. SFWMD Assistant Executive Director Robert M. Brown presented the resolution at the district’s March 15 meeting in West Palm Beach. He said the proposed resolution will make the district’s lease program “more transparent to the public.” But, does it? According to attorney Chester Brewer, the answer is no. As he addressed the board Thursday afternoon, Mr. Brewer alluded to a statement in the resolution that calls for the district to accept competitive bids for their property when an existing lease expires. The resolution then goes on to say: “... unless the governing board approves a waiver of competition.” In short, that means if the board wants a lease holder to remain a tenant, the board can waive the competitive process and the lease could be extended. “The statute demands competitive bidding with notice. The statute does not provide any exemption for the mandate that requires competitive bidding,” said Mr. Brewer. “That language must be taken out if you’re trying to comply with the statute.” Mr. Brewer was at the meeting to represent Glades County ranchers and property owners Mark Hunter and Patricia Pearce. “That just gives you the right to not follow the statute,” Mr. Pearce told the board. The district has come under re recently for renewing leases without putting them out for bid. Florida state statute 373.093 says the district can lease their land as long as it is consistent with the land’s intended use and “for the best price and terms obtainable, to be determined by the board.” Some 20 leases were renewed by the board in 2011. Among those were area leases held by Alisa Sherman, Elsie Lanier, James and Beatrice Prescott, Otis P. Clemons and the Old River Cattle Company. The lease held by Mrs. Sherman is on property in Highlands County and, according to records, it was advertised in area newspapers prior to it being signed on December, 13, 2011. However, no ads can be found regarding the other four leases. The proposal discussed Thursday would have no real effect on these existing leases. In response to that question, SFWMD general counsel Carolyn Ansay replied with an e-mail that said: “If the resolution is adopted, it will not unilaterally alter the legal rights or obligations contained within any existing lease agreement. Any existing lease agreement can only be altered or terminated pursuant to the terms contained within the document.” The resolution goes on to state that, in accordance with 373.093, the district will publish their intention to lease in a newspaper in the county where the land is located and other places as the board determines, which complies with the statute. Also, the proposed resolution would allow the district to give an existing tenant a right of rst refusal on the lease if the tenant: 1. has been in substantial compliance with the existing lease; and, 2. submits a responsive and responsible bid. “What is substantial compliance? That’s like being a little bit pregnant,” offered Mr. Brewer, in a phone interview Friday. The resolution goes on to state that before an existing tenant can exercise the right of rst refusal, they must agree to “... pay rent at 10 percent over the highest bid from another responsive and responsible bidder.” Governing board member Glenn J. Waldman questioned that part of the proposal. “They (existing lease holders) will have to overbid — it may be too much money,” he said. “Maybe we ought to think again about the right of rst refusal. This may cause someone to overpay.” While he didn’t necessarily agree that an existing lease holder should have to pay an added 10 percent, Mr. Pearce asked the board to leave the right of rst refusal in the resolution. “If I sell my property to the district and I get a 10-year lease but I don’t get the bid, then I have to leave. The right of rst refusal has to be in there,” he said. When his allotted three minutes were about to expire, Mr. Pearce looked over the top of his glasses and asked: “Is the district going to correct those leases that were done completely wrong?” No one answered. Crews also will widen approximately 3/4 mile of SR 80 to four lanes approaching the intersection, add a traf c signal at the overpass, and install lighting at the interchange, according to an FHP press release. Angell also saw that Jones was a small amount of blood around Jones's mouth. Jones stated that he had been injured in the day's activities and not a ght. Satis ed, Angell began to leave the area and Jones began to follow him. Angell order Jones back several times, with Jones eventually complied but did kicks some rocks and dirt at Angell. Jones was placed under arrest for battery of a law enforcement of cer, a third degree felony.‘Let’s Whoop their ... Run!’Hendry Sheriff of cers respond to a call to nd two men that follow through on their threats. The incident happened in the Harlem Gardens area on March 14 after Deputy Brown responded to a call that someone was being threatened. When he arrived he found the victims who placed the call. As he was speaking with them, a blue minivan pulled up with several men inside. Two men, later identi ed as 17-year-old Roytone Smikle and 28-year-old Antwan Harshaw, exited the minivan and rushed toward the victim and attempted to ght with one of the victims and bystanders. Brown got in between the victim and the two men, attempting to separate them. Harshaw and Smikle refused all commands to get back and began to threaten Brown. Smikle yelled that he would kill Brown if he didn't get out of the way. Brown attempted to restrain Smikle but he was able to pull his arm away. Harshaw and Smikle took up ghting stances, with Smikle saying, "Come on you nerd looking b----," as Harshaw was cursing, threatening, and attempting to incite bystanders to join in the ght. Brown radioed for back-up and Deputy Hainley arrived on scene. Harshaw and Smikle took off, with Hainley going after Smikle, the smallest of the two. Brown cuffed Harshaw and Hainley was able to grab Smikle, who was still struggling even after Brown came over to help. After being transported to the Clewiston Police Of ce, Deputy Beckford assisted with processing the two and was threatened by Harshaw with lewd comments and said, "I know where you live. I'm comin' over to whoop your a--." Brown noted that the two men do know where the deputies live since they all live in the same neighborhood. Harshaw and Smikle were each charged with three counts of felony Assault on a police of cer, two counts of felony corruption by threatening a police of cer, one count of felony inciting/encouraging a riot, and two misdemeanor charges.Creative Ways to Pay a TabClewiston Police respond to a call from the Tiki Bar where a man claimed he would selfinduce a seizure. This comical incident occurred on March 14 when Clewiston POlice of cer Malley responded to a complaint made by Laura Martin that a man, identi ed as 29-year-old Peter Tracy, was causing a disturbance. Malley arrived at the Tiki Bar and met with Tracey, who had the strong odor of alcohol on him and his speech was moderately slurred. His actions had been disturbing employees and bar patrons at the Tiki Bar. Martin informed Malley of what had happened before he arrived. Tracy had been gathering money to pay his bill by playing his ute for cash. When that didn't work, he attempted to pawn his watch off to the bartenders. When this failed, Tracey became irate and started to scream at patrons cursing at the bartenders. He screamed that he would self-induce seizure by shaking his head violently. When Malley had arrived, Tracy was in the process of attempting to do just that. Before Malley escorted Tracey from the bar, Martin informed the of cer that Tracey's bill of $23.67 had not been paid. Tracy admitted that he did have credit cards on him. He was given the chance to withdraw money from an ATM nearby. After multiple attempts failed, Tracy admitted to Malley that he knew that he did not have the means to pay his bill when entered the bar. Tracey was charged with two misdemeanors including defrauding innkeeper and drunken/ disorderly condcut. Hendry County Rebecca Manning and Miss Latina of Lake Placid. The competition contained three categories: Heritage, Swim Suit, and Evening Gown. The Heritage portion had contestants dress up in out ts that celebrated their Hispanic heritage from the countries of Guatemala, Mexico, Peru, and Cuba. Pageant judges were looking for creativity when it came to this category. Several were very creative in their out ts, especially Marilyn Del Rosario's Inca royalty dress. The Swim Suit category followed with the contestants having to show off for the crowd. Judges were looking for con dence and health in the contestants. Many showed con dence with Alyssa Penton blowing glitter to the crowd. Thankfully, there were no wardrobe malfunctions during this portion. The contestants lined up on stage as the category came to a close with the 2011 Miss Latina Viviana Sierra and Miss Teen Latina Carolina Lombardo present for the rst entertainer. The crowd was treated to a performance by Ojeda, who recently appeared on the red carpet for Univision's Music Awards. He performed his hit single, "Bum, Bum." The nal category, Evening Gown, capped of the judging with the contestants walking down the runway looking quite resplendent in their gowns. After touring the runway and stage, they answered a question presented by the announcers. Another performance followed with music from the salsa band, Tairon Florida Beat, which had the crowd dancing as the judges tallied their scores. According to Milagros Navarro, pageant organizer, the judging was very close. She is happy with the judges' choices and feels that the new queens will represent the area very well. "The judges had a hard time and the points were very close," said Navarro. "We had many girls that night that would represent the area well; so will our girls that are heading to state." Three previous winners, Andrea Leon, Carolina Lombardo, and Viviana Sierra will be heading to Orlando on March 25 for the Miss Florida Latina Pageant, which is the preliminary to Miss Latina U.S. Pageant. Leon and Sierra will be competing against seven other contestants for Miss Florida Latina and Carolina Lombardo will be competing against eight other contestants for Miss Florida Teen Latina. This is a program that started in late 2010 and is designed to have employees nominate fellow employees whom they feel exemplify the qualities of outstanding Hendry County Employee. If you work with someone who you feel is an outstanding employee, you nominate them. The selection committee are C.A.R.E members, who are also county employees. Recently, emergency room services at Hendry Regional Medical Center have been less than desirable, in terms of customer service excellence and total patient turnabout time. The hospital has experienced a number of “growing pains” since transitioning to its new and beautiful facilities; however, we want the community know that we are diligently working to overcome various obstacles, and we’re making substantial progress in resolving them. We would like the pubic to know that signi cant progress and improvements are being made by: Changing emergency room physician staffing and recruiting experienced and professional, full-time ER doctors. These doctors are making great strides in taking ownership in delivering state-of-the-art emergency diagnosis and treatment in a caring and timely manner. Implementing Customer Service Excellence Training. All hospital staff is participating in ongoing patient/customer service excellence training. Employing quality improvement techniques to further streamline the ER patient care processes, so that our more seriously ill patients are treated without delays. Initiating hourly patient rounding in exam spaces and waiting areas to prevent potential delays in patient care, thus enabling us to inform patients of unavoidable delays. Adding several well-trained and experienced paramedics, along with our excellent emergency room nursing staff, to assist with the patient “triage (assessment) process.” Integrating a fully Electronic Medical Record System and Automated Medications System to assist in improving quality services/care and patient safety. Initially, these new systems reduced productivity and ef ciency; however, as our staff becomes more adapted to this new technology, patient care processes will be greatly enhanced, with added safety and security measures. It is also informative to compare our local situation with what is going on within the hospital industry/ERs nationally and throughout Florida. In many instances, emergency rooms and trauma centers are in crisis. It is not uncommon for Hospital ERs to go on EMS diversion, due to staf ng shortages, while at the same time being overwhelmed with increased patient demand. Volumes have increased dramatically, and many patients are using the ER as their primary care providers, due to lack of insurance and an inability to afford healthcare this results in care being provided in the most expensive setting. A number of hospital companies have begun turning non-urgent/emergent patients away unless they pay large, up-front deposits to receive care in their ERs. This problem and other pressures have led to an average total turnaround time of approximately seven hours for an ER visit in this country today. Hendry Regional’s average total ER turnaround time is currently three hours, but is sometimes longer for patients requiring complex diagnostic study results and those who are admitted as an inpatient to the hospital. In closing, please accept our sincerest apologies for having fallen short of your expectations during this recent period of conversion. Our ultimate goal is to deliver exceptional care, with a personal touch, in our emergency room. Please be assured that our staff’s earnest efforts will overcome these problems.
