PAGE 1 BY JUAN LOPEZ jlopez@newszap.comIn what had been heralded as a bene t to the community, the Clewiston Theater is now the center of a situation that has devolved into a war of words. At the heart of the matter: the owners of the Clewiston Theater, the Mann's, feel that the new operator, Russell Brannan, is misrepresenting himself. Over the course of nearly three weeks, several of Russell Brannan's new employees have quit. Dennis Mann, who leased the theater to Brannan, is wanting to make sure that this lease is voided as soon as possible. And other questions have arisen from a deeper look into Brannan's background.A questionable past In early November of this year, Brannan was the prime subject of an article by the Daily Commercial in Leesburg, Fla. He was highlighted for acquiring an old theater, The Tropic, from a local ballet company in order to have movies run from that location once again. Two weeks later, the theater shut down. According to the article, Brannan was quoted as the operator and owner of 44 theaters nationwide. The deal fell through because Brannan made several complaints that the owners he was leasing from, Rob and Terri Hicks, had not made critical improvements on the building, which resulted in safety code violations. The Hicks, who have owned The Tropic for years and have run a dance company in the theater, strongly refuted Brannan's claims and have said that he violated the terms of his lease. The terms of that lease stated that Brannan was responsible for any and all renovations that may need to be made. According to Brannan, those renovations would have cost him $20,000 to make. That was something that he was in no way prepared to do. "I had to walk away," said Brannan. "They had $25,000 in work that was not disclosed. They were in code violation." Thus far, only four other theaters have been linked to Brannan through a company called Chalet Theaters LLC, which is located in Lakeland, Fla. These four theaters, the Orpheum What is Mr. Brannan Hiding?SUPPOSED THEATER SAVIOUR HAS HIGHLY QUESTIONABLE PAST V. That theater would later be closed due to reasons unknown and Brannan disappearing from the area. Crash still under investigationBY JUAN LOPEZ jlopez@newszap.comA crash on CR. 833 proved fatal for a Clewiston woman this past Saturday. The accident happened just three miles north of CR 835 at 12:40 p.m. Georgina Grasshopper Bert, 36, was traveling east on 833 in her 2004 Nissan Altima. According to the report provided by the Florida Highway Patrol, Bert swerved to the left suddenly in the attempt to avoid hitting a hog that was in the middle of her lane. She was unsuccessful and hit the hog, killing it, while swerving into the westbound lane. Her Altima collided with the rear left portion of a Mack truck that was being driven by Paul Leclair, 45, of Lehigh Acres. Bert's Nissan spun counterclockwise after the collision and came to rest on the south shoulder of 833. In the process, Bert was ejected from her vehicle due to her not wearing a seat belt. Emergency personnel pronounced her deceased on the scene. The driver of the Mack truck was reported as having no injuries. Lt. Greg Bueno, of Florida Highway Patrol, stated that the investigation is ongoing and a post-mortem report will be led with any other details. A toxicology screen will be run on the victim. "Those results will be published upon the homicide investigator completing his investigation," stated Bueno. "A fatal investigation report typically takes 30 to 60 days depending upon the circumstances involved." Clewiston Woman Dies in 833 Crash NON-PROFIT SPONSORED EVENT UNDAUNTED AFTER THEFTBY JUAN LOPEZ jlopez@newszap.comIt is time once again for the Winter Wonderland sponsored by the Active Citizens For Children. Many remember the brazen burglary of their storage facility nearly two weeks ago. That burglary left them without event equipment for their upcoming Winter Wonderland Event that has been a community success these past few years. Among the items that were taken were their Chirstmas props and Santa's Throne. The worst part about that crime was the fact the several toys were taken that were meant to be given out to needy families this holiday season. However, according to Mercedes Vary, active member of the local nonpro t group, that won't stop ACFC from showing up and showing out for this year's event. "So far, the only thing that has been recovered was Santa's Throne. That is, at least, a bit of good news," she said. "We are still on track for this Saturday." Vary continued to say that several members of the community have come forward to help the group. The request for community volunteership was made by ACFC president Brenda Holcomb, as the they were in need of coolers, tables and other donations. ACFC was provided with tables, chairs, tents, and donations to make this year's event as "Grinch-less" as possible. COMMUNITY NEWS AND INFORMATION in Hannibal, Mo.; the Rex in Clay Center, Kan.; the Lawford in Havana, Ill.; and the Pioneer in Falfurrias, Texas have had dealings with Chalet Theaters. In all four cases, Brannan has gone in, added a fresh coat of paint, done some small renovations, has had a newspaper/web site report on it, then has made claims that there are problems with the theater, backing out of the deal before, or soon after assuming operations. Usually, the theater is open for a short time, a week or two, then its closed right back down.History repeated? All this leads into the present situation in Clewiston. The lease that Brannan signed with the Manns states that the lease period is for ve years with the option to buy. All of Brannans other theatrical pursuits were lease/purchase options. It is a deal that Dennis Mann, owner of the Clewiston Theater, is now regretting. The man is a con artist, said Mann. We, more or less, went on along on a handshake. He has shampooed two carpets and hes not paying anyone. Hes not even paying my booker the man who brings the lms! Mann continued on, saying that he has already told Brannan that he wants no more to do with him, especially after Mann discovered that Brannan had used his name to order lms that he has now. Mann cancelled the other six lms that Brannan ordered under his name. Another fact concerning Brannan is the incident involving the projector. Brannan had hired a person to run the projector. The man quit because he wasnt being paid and was expected to help pay for equipment and be reimbursed later, said Mr. Mann. Brannan was unable to start the movie projector, according to Mann. The man said he owns 18 theaters and he doesnt know how to start a movie projector, said Mann. When I got to the theater, it looked like an eight-year-old had put the projector together. The larger concern is that Brannan is misrepresenting himself when he negotiates deals with theater owners. When Brannan was pressed by this newspaper for more details regarding the theaters he has owned or does own, Brannan became belligerent and aggressive. He would not name speci c theaters after representing himself to be the owner of as many as 19 theaters, sometimes as many as 44. It doesnt matter if I have one theater or 50 theaters. It doesnt matter, Ive represented myself correctly, he said. There is nothing in writing saying I have 50 theaters, 100 theaters period. Ive ran more theaters than you have been to. People close to the situation wonder if Brannan has a scheme he undertakes targeting historic theaters across the country for some quick windfall, or if he is simply a very bad business person. According to Mann, he suspects Brannans goal is to show movies and collect money on all the tickets, without paying the 35 to 50 percent of the gross tickets (contract commissions) back to the movie studios. Because there is a crudely typed up document laying out the foundation of the lease agreement, Mann is not pushing to evict Brannan from the theater immediately. Im gonna let him die in his own deal, Mann said. Mann was so upset that Brannan would misrepresent his involvement in the theater, claiming to be its new owner, that he threatened to physically hurt Brannan if Brannan showed up at his restaurant, which is located next to the theater. Im going to knock him on his ass. Hell have to live with the fact that a 74-year-old man beat the crap out of him. Thats a promise, not a threat, said Mann.Employees unpaidJennifer Lovell was hired as the theater manager. She thought it was odd that Brannan did not have her ll out any new employee paperwork when hired. I started on Nov. 30 and Brannan said that he was going to pay me a salary of $65,000 a year, said Lovell. Later, he said that he would be paying me an hourly wage of $8.50. Lovell said she became very wary after she, along with her husband who helped with renovations, were not paid. Lovell stated that she put in a lot of work toward the theater, even starting up a Facebook page to drum up excitement and support for the new venture. Brannan constantly changed his story about who he was in order fast talk his way out anything and was constantly calling her at all hours of the day, she claims. He would call me about little things as late as 11 p.m. to midnight, she said. He later told her that any work done after her regular hours were considered volunteer work. Another disturbing fact was that Brannan gave keys to the theater to everyone. Lovell still doesnt know just how many keys he gave out. All she does know is that after she quit, BranTHEATERContinued 1 SEE THEATER 15 PAGE 3 BY MARGARET ENGLAND Hendry-Glades AudobonBirders and photographers are invited to participate in the Fifth Annual STA5-Clewiston Christmas Bird Count (FLSO) on Saturday, Dec. 31. One bird missing from last years STA5 CBC report was the Wood Duck. In previous y ears, two to ve were reported by observers. The Wood Duck was once a threatened species in the early 1900s, but has since become one of the most widespread breeding waterfowl in Florida (FL Breeding Bird Atlas). The Wood Duck is a medium-sized perching duck. It is one of a few duck species that have strong claws that can grip or perch on branches. When swimming they bob their heads back and forth in a jerking motion. The adult male has iridescent chestnut and green plumage and red eyes with a white are down the back. The adult female is less colorful and has a w hite eye-ring and whitish throat. Both adults have crested heads. The males call is a thin, rising and falling whistle. Females make a loud oo-eek, oo-eek sound when alarmed or when taking ight. Wood Duck feed by dabbling in water making short shallow dives or by walking on land. Their diet consists mainly of plant material, such as berries, acorns and other nuts, seeds of grasses and sedges, wild grape, and duckweed but they w ill also eat insects and a few crustaceans. Wood Ducks cannot make their own nest cavities. They use natural cavities in trees or man-made nest boxes which are normally situated near or over water, but they have been known to nest up to 1.2 miles from the nearest water. If nest boxes are too close together females will lay eggs in the nests of other females. Females usually lay 7 to 15 white-tan eggs that incubate in about 30 days. The day after hatching, ducklings will climb out of the nest opening and jump to the ground from up to 290 feet without injury. The mother calls them as they make their way to water where they nd food on their own. Join Hendry-Glades Audubon volunteers for birding and photography trips. I still have a lot to do including the shopping and putting up the tree, but the bass shing has been too good to stay home. The water level on the lake has remained pretty steady at around 13.75 feet above sea level and the rain we received over the weekend should even bring it up a little. We have had a few fronts move through the area the last couple weeks but it really hasnt affected the shing much. The bass are being caught from the north end of the lake all the way to the south and everywhere in between. This year should be a recordsetting year again as was last year, with average tournament weighing bags to win are more than 30 pounds in ve sh. I have been shing from the North Shore area down to Kramer Island and have had a hard time patterning sh. But if you just keep shing you will nd them. The bass seem to be moving around a lot right now and it can make it a little tough to nd a concentration of sh. I have just been putting the trolling motor down and covering a lot of water and nding the sh. Some areas that have been really good are the East Wall, Grassy, Long Point, around Observation Island, Turners Cove, and Cochrans Pass but out on the outside grass line. The bass are really scattered out as you get back in the grass and not really concentrated like they should be and, as we head into January, there should be a big push of bass moving in to spawn. I have been catching bass on wild shiners, arti cial lures, and have even been catching bass y shing. For arti cial lures I have been using the Charlies Worms Zipper Dipper and the new Big Dipper most of the time. On the cold front days, I have been throwing a Salt Stick O also made by Charlies Worms and shing it real slow. With all the grass that we are shing in I recommend at least fty pound braided line and heavy action rods to get the bass out of the heavy cover and to the boat. I have also been trying the new craze in the shing industry called an Alabama rig, it looks like an umbrella rig that the offshore guys use but a smaller version for bass shing. I have been using the Zipper Dippers on it and have caught some bass but not any really big sh yet. It works great on the outside of the grass or where the grass is really scattered and thin. I will have more to report on this rig as the season progresses here on Okeechobee. We have had reports of the crappie shing being pretty good with the area around Bird Island, the rim canal south of Clewiston, and the Kissimmee River great places to start. Jigs and minnows are both working. Good luck, tight lines, and hope to see everyone on the water soon. Capt. Mark King is a full time guide out of Roland Martins Marina and Resort in Clewiston. Florida landowners Lykes Bros., Inc. and A Duda & Sons, Inc. will implement a masterplanned international logistics center on 4,700 acres in central southern Florida and have named the international commercial real estate rm of Cushman & Wake eld to begin marketing the facility. Planned for 30 million square feet of manufacturing and distribution facilities, the center w ill serve as an integrated logistics hub for trade w ithin the Americas and with Asia and Western Europe. David J. Duda, president and CEO of A. Duda & Sons, said "we believe in this project and see it being of tremendous value to the region and the state." "While there are other logistics projects moving forward in Florida, we chose to work on this one because it has so much going for it," said J ames Underhill, CEO-Americas for Cushman & W ake eld. "From the standpoint of supply chain cost, transportation, and network strategy, it is positioned to be a major facilitator of not only goods coming into the U.S. through Florida's ports, but also as a key component in serving the rising demand for U.S. and Florida exports to Latin A merica and Asia." On the outskirts of Moore Haven, the 4,700acre tract offers a number of signi cant locational advantages for logistics companies. The center is situated to supply more than eight million consumers within the Southwest, Heartland And Southeast regions of Florida -from Sarasota and Fort Pierce to the north, and Naples and Miami to the south -a number that is expected to grow to 9.5 million by 2020. Planned to capture and enhance the growing trade between North America and South America, Western Europe and Asia, the center will include a combination of distribution centers, warehouses, manufacturing facilities, mixing centers, refrigeration facilities, transload and cross docks, and related logistics uses. With its central location, the site is rail and road served to several ports, including the Port of Miami, Miami International Airport, Port Everglades, Port Manatee, Southwest Florida International Airport and the Port of Palm Beach. Rail service is provided by CSX and FEC via SCFE. "Rail service to these major ports is a very important advantage," said Jamie Kishel, director of operations-National Industrial Services for Cushman & Wake eld. "The site is also ideally located for trucking transportation, with easy access to major U.S. and Florida highways. "The location has great access to competitive labor and distribution markets. Yet companies will be able to move goods in and out ef ciently, bypassing Florida's congested coastal residential and tourist areas," said Kishel. "This center is going to play a critical role as an industrial hub and economic driver in Florida's global supply chain infrastructure." The center will provide users with intermodal opportunities and diverse sustainable transportation and business solutions. The location will additionally bene t from the widening of the Panama Canal, which will open Florida to large Asian container ships. "All of these factors create an outstanding opportunity for this strategic site to become a key component of Florida's global supply chain infrastructure," said Howell Ferguson, Chairman and CEO of Lykes Bros. All day long Pastor Jerry and Jim had been delivering Christmas boxes to families, many of which would get nothing else for Christmas that year. The pickup had been loaded when the two men started out, but now only one box remained. The address on the card meant a drive of several miles beyond the city limit, and the weather was getting worse. What do you think? Jim asked. He was the driver and it was his truck. Pastor Jerry knew what Jim was thinking. Why drive way out in the country when we could give this last box to someone close by and be home in thirty minutes? It was a tempting thought. Jim, however, answered his own question, Well, lets give it a try. If we cant nd the place, we can always come back and give the box to someone else. The rain was pouring down by the time they reached the address on the card. The old white framed house stood on a hillside overlooking the valley. The men slipped and slid as they carried the box up the hill. The red clay offered no foothold. They climbed the high steps to the porch, and set the box down. They straightened up just in time to glimpse the face of a small boy at the window. Hed been watching them coming up, and now announced their arrival with excitement, Theyre here, Grandma, theyre here! The door opened and an older woman in a plain dress and white apron greeted them. I told you, they would come, a childs voice said from behind her. The little boy rushed to the box and began pulling at the goodies inside. The woman told them that she and her grandson were all that was left of her family. The father and mother had divorced and gone their separate ways. The little boy had been left behind for Grandma to raise. She said, I am so glad you are here. He was up early this morning looking for you. He sat by that window all day. I wasnt sure you would come and I tried to prepare him in case of a disappointment. But he just said, Dont worry, Grandma, I know they will come. That young boy didnt know it, but in a sense, he was speaking for all of us. A thankful people, more than one billion of us around the world, pause for a few moments this season and pray with faith.A Rescue OperationBY JACKIE MILLER, EVANGELIST First Christian ChurchThe happiest person is not someone who received a wonderful present on Christmas, but someone who, after days in an open boat, after hours in a crippled airplane, or after minutes in a burning building is rescued! We thrill when we read of the rescue of miners or of mountain climbers or of a child who has fallen deep into a well. What irony when a soldier risks his life to save a buddy, only to have this buddy refuse help, claiming that he can solve his own problem and then he dies! The greatest rescue operation of all time began on the rst Christmas Day. Yet most of us refuse to be rescued. We are con dent that we can solve our own problems. We deny that we are in danger. But mans danger is fantastically great: All the ordinary dangers of sickness, accident, war, poverty and death, striving for the wrong goals of life: misplaced self-con dence, unawareness of the spiritual world, and the biggest of all, lack of realization that he is destined to live forever, either in unspeakable sorrow or unspeakable joy. In fact, mans danger was so great that the in nite God had to become a man in order to rescue man. No one else could do it. God became man in the person of the baby Jesus. That is why Christmas is so important. You see man had sinned. Our sin was a rebellion against God; a selling of ourselves to the devil; a total pollution of our wills and souls. The only rescue from this out of degradation is by someone taking the punishment due us and also having the power to clean up our innermost being. And this is exactly what Jesus Christ did. Since He is the sinless Son of God, He could bear the in nite anger of God against all sin. And He sends His Spirit into the lives of all who believe His Gospel, repent of sins, confess Him before men, and are baptized (immersed) for remission of sins. Then we must be a part of His church, learning and practicing all that He commanded.Distractions and BeaconBY REV. SAM S. THOMAS, PH. D.+ Saint Martins ChurchI worked on a boat in and out of the Bahamas many years ago. One of the sights crossing the gulfstream at night were the lights on a tower in Bimini. This was often the rst landfall as wed enter the island chain and out of the familiar waters of the Florida coast. The night was dark, the boat would often roll if the wind picked up a chop and there were times that the nights were starless. Then, on the horizon would appear the lights; with that vision came a sense of not being alone, being on the right course, and a safe arrival in port was a short while away. There were other times I have had this experience: a long air ight when the plane would descend through the clouds and there would be a city full of lights beneath us and the beacon at the airport would be a welcoming ray to say Youve arrived, youre almost home! As God would have it, there was that other beacon, a star in the East on a winter night. It guided shepherds and wise men; and stood as a beacon for humanity leading people to the makeshift shelter for a mother and babe. Scientists have shown that the star in the East was most likely a convergence of stars; coming together to form that special great light to guide those who saw it and felt called by its radiance. The Biblical message, We have seen His star in the East is echoed time and again. The message of Christmas is one that brings light into a darkened world. That star served as a guide, a homing point, a way of orienting the path of the wanderer; and still does. In the midst of all of the getting ready for Christmas, society may have taken away our homing beacon. People scurrying around, lastminute shopping, trying to get packages in the mail, planning to invite guests, wondering how to decorate the house, all of the parties and invitations to answer. No wonder that I hear every once and awhile someone say, I wish they would cancel Christmas! or, Ill be glad when the holidays are over! Thats a very sad commentary. The message of the star in the East has been dimmed. The pre-Christmas season is a time of getting ready and preparing for the coming of the Lord into our world once more. Thats what it is about. The rest? Those are the distractions. Drop through the clouds that they make, look to the horizon and search the light that guides us home again. Johns gospel tells us, The true light that gives light to every man was coming into the world (Ch.1, v9). May it shine in our hearts once more and guide us home. I resigned and was not red as he (Brannan) claims I was, she said. All that Lovell has left of this situation is regret for ever becoming involved. I have lived here all my life and now Im being blamed for all of this, she said. I have people upset at me because they are listening to this man who is a crook. The Facebook page had become popular by the time Jennifer decided to apologize publicly for her involvement with the theater on that page. She has a daughter in elementary school that would have gone on a eld trip to the theater this week to see Puss in Boots, but she will make sure that her daughter will not attend. He knows what my daughter looks like and Im concerned for her safety and everyone elses children, she said. W ill Brannan Stay? For Brannan, this is just one more place w here he is trying to do some good yet has encountered people who are trying to stop a good thing from happening. I dont know what is going to happen now, Brannan said. I was supposed to do a good thing. But, its not my loss, its yours (communitys). According to Brannan, he has already spent $4,000 to get the theater opened. He is hoping to recoup some of those funds with the school eld trips that visited the theater early this week. These eld trips were originally set up by the Mann to help Brannan out. Those eld trips did happen, school of cials said. They said the children were treated very well. What remains to be seen is whether or not Brannan will have any other movies to show after Puss in Boots and New Years Eve. Mann has cancelled any movies the Brannan ordered under his name and, according to Mann, Brannan has no major credit of his own and no credit with major studios. I have $167 credit with Warner Brothers! refuted Brannan. He explained that his ordering lm under Manns name was Manns idea to begin with. As to the Mann wanting him gone, he was quite adamant that the Mann should return his deposit. What started out as a good thing has turned bad because Mr. Mann got his feelings hurt, he said. If he wants me gone, he can say, heres your $2,000 bucks. Ill be happy to go out. How this situation will end is anyones guess. One of Brannans quotes comes to mind as the clock winds down on what could be a failed revival of the theater. This theater has great opportunity to succeed with support from the community and the revenue that that support can generate. Mann has his own ideas. We have had the theater for 12 years, and Im going to retire next year in August, he said. If I cant sell the theater, Ill just tear it down and make a parking lot. 2 Serving the communities south of Lake Okeechobee May 27, 2010 WINTER SEMESTER 2011-2012CLEWISTONADULT& COMMUNITYSCHOOL475 E. LOW COST VACCINATION CLINICS 15 Serving the communities south of Lake Okeechobee December 15, 2011 THEATERContinued 2 A Timeline of EventsJuly 2005 Lawford Theater in Havana, IL. Outside was painted and small renovations made. Deal falls through due to too many repairs that Brannan claimed needed to be done. Sept. 2006 Pioneer Theater in Falfurrias, TX. Outside renovations made. Promised better sound system, English/Spanish showings, digital quality showings, and more. Deal fails due to argument with owners he is leasing from. The speci cs of that argument are unknown. Oct. 2006 Orpheum Theater in Hannibal, MO. Outside renovations made. However, deal failed shortly afterward due to claims made by Brannan that the owners he was buying from had too many problems and liens on the property. Owners hotly contested it and Brannan left. Nov. 2006 Rex Theater in Clay Center, KS. Outside renovations made. Made promises about better quality picture, rst run movies, improved concessions, digital sound, and more in an ad that ran in the local paper. Deal failed apparently due to the lack of a partner being found to help run the theater, leasing issues and a rodent problem. After this, there is a gap where no other information can be found until early this year, where Brannan appears in Mankato, MN to re-open the Maverick 4 theater. Brannan spelled his last name Brennan and claimed that he was the CEO of Starz Theatres LLC on a Facebook page he set up for the Maverick 4 theater. Several Mankato residents were distressed to discover that the theater was no longer operation in early October of this year. The Facebook fan page made no of cial announcement and the local newspaper, The Free Press, had a quick blurb on the theater closing. What is interesting is that several users posted that the web page that used to display theater showings was now displaying information on The Tropic Theater as early as November 2. That same web page is now being used to display show times at the Clewiston Theater. The vehicle is an innovative way of bringing the issues of memory loss and dementia to the public and it has travelled county wide. It is a simple test and takes a few minutes. The idea is to detect the earliest stage of Alzheimers. It is not only for seniors but for people of all ages. No appointments are necessary. The memory bus will be available at the following Health Department Locations: Hendry County Health Department in LaBelle on Feb. 27 from 9:30 a.m. to 2 p.m. Hendry County Health Department in Clewiston on Feb. 28 from 9:30 a.m. to 2 p.m. According to the Alzheimers Association, 1 in 14 people over the age of 65 has some form of dementia and that number can increase to 1 in 6 for those over the age of 80. Early diagnosis and care for people with dementia, as well as educating those that care for them, is one of the strategic priorities for improving a persons health and wellbeing. Tiredness, stress, depression and certain medications can all affect memory. The important thing is for people to seek help if they have any concerns about memory loss. This event will allow people to talk, in con dence, with an expert. For more information, the national number is 1-800-272-3900 for Alzheimers Association.
