Overholt, 58, was back in an Okeechobee courtroom Wednesday, July 17, after the 4th District Court of Appeals ruled he should be given a new trial. He was found guilty in 2011 on a felony charge of lewd and lascivious molestation. That conviction carries a minimum-mandatory sentence of 25 years. Even though Overholt was granted a new trial he, instead, chose to enter a plea of guilty. “I do give credit to the fact you entered a plea and didn’t want to put the child through another trial,” said Circuit Court Judge Sherwood Bauer looking down at the shackled man standing before him. “With 25 years, odds are you probably won’t get out of prison anyway. But, I do believe in the penalty of natural life.” Judge Bauer added that a natural life sentence means no possibility of parole. Overholt eschews trial; enters plea N.W. Okeechobee Asphalt and Ready Mixed Concrete and neighbors in Deans Court appear to have resolved some differences, but not all o f them, in a planned rezoning of 1.49 acres on N.W. Ninth Street. The company plans to use the area to store asphalt and concrete materials. City administrator Brian Whitehall met with both sides after the June 18 city council meeting. nearby home and spoke with resident Bruce Snell who spoke against the plant at last month’s meeting. Mr. Gent said most of the issues have been resolved. “I want to be a good neighbor regardless of where we go after tonight,” he said. The council voted 4-) to approve the ordinances required for this project. Bruce Snell, who owns property in the neighborhood, said as long as the property is used for storage he does not oppose the project. He is afraid that zoning the land industrial will allow a use that might impact his quality of life. A petition of residents was presented to the council which voiced those concerns. He said the city doesn’t have to change the zoning to industrial to allow storage. He asked for a condition that limits the use to only storage. “The issue is industrial coming down to our neighborhood. Right now, it’s storage, but what about ve years from now when the plant extends into the neighborhood. It’ll be too late then and you can’t stop it then,” he added. Ossie Flemming, president of the Community Action Committee for Douglas Park and Deans Court, said their goal is to make Dean’s Court a better community. She noted they don’t feel they have a voice with local government and how land is zoned. “We w ould like to be part of the future development plan. We welcome new businesses. W e need stores and recreation for the youth. W e feel that industrial businesses in front of residential houses have upset people.” Ms. Flemming also expressed concern of a suggested bypass road that could cut through their community. She urged the council to consider the neighborhood. “I don’t want them (residents) in the same slump where they don’t want to go outside and help their community.” Ms. Flemming said they have cleaned up the community. Two days per month they pick up debris. Councilman Dowling Watford said he thought the best use for this property was industrial. He said it would be very dif cult to develop this land as residential since it is next to the railroad tracks. “Normally, that would be heavy commercial or industrial. I disagree with our planner who stated residents had the right to expect residential there. The times change, issues change and circumstances change. We must look at the best use for the property,” he said. Mr. Watford said he had all the sympathy in the world for the property owners. He applauded the work of the residents in Deans Court and said they have done a nice job improving the neighborhood. He suggested the company will meet their commitments, will be a good neighbor, and the community will not be negatively impacted by the change. “This is not an easy decision because it will affect a lot of people. I have to make a decision that is best for the City of Okeechobee,” he added. Councilman Devin Maxwell said he wants to improve all neighborhoods in the city. He said he felt his job is to weigh the manufacturing opportunities that create jobs against the interest of the neighborhood. “My opinion is preventing this development will not resolve the concerns. The improvements that need to be made are separate from this use,” he said. “We have to do more than simply make wise planning decisions. I look forward to this action committee and their ideas.” Mr. Maxwell said he wants to preserve the neighborhood too and will work with this action committee with their ideas and suggestions. Chris Padgett said the company expansion will bring jobs and lower the unemployment rate in Okeechobee. In other business, State Senator Denise Grimsley presented a ceremonial check of $250,000 to the city for stormwater and drainage improvements. The state budget also includes several million dollars for Okeechobee state road projects like the four-lane widening of S.R. 70 and the enlargement of the main intersection of U.S. 441 and S.R. 70. Sen. Grimsley has worked in Tallahassee for nine years. She said the communication with the city during session was very important to her success this year. Ken Grimes, with the CAS Legislative Services group, told the council that the legislature did not make any changes to the property tax code this year and fully funded the library system. They also allocated $600,000 to the Okeechobee Utility Authority. Grimes detailed several discussions about proposals that affect city business taxes and sovereign immunity protection, but no law changes were made this year in Tallahassee. In other action, the council honored Palmer ‘Cleveland’ Lamb with a 40-year longevity award. He has the served the city as general laborer, equipment operator, crew leader, maintenance foreman and interim public works director. Mr. Lamb thanked the council and called it a privilege to work for the city. He thanked his co-workers and his former supervisors like L.C. Fortner, Frank Bennett and Chuck Elder for their support and guidance over the year. “I think a lot of the city councilman because they have been a lot of help to me. They did some ne things for me,” he added. He also praised his understudy Marvin Roberts and his co-workers for their hard work and dedication to their jobs. “I enjoy coming to work. You get up every morning and it’s a routine. You go to work and it feels good, especially when you have a nice crew to work with who always are there to help you out,” he added. They also accepted the Florida Most Improved Safety Performance Award from Public Risk Management. They also scheduled a budget workshop for Tuesday, Aug. 20 at 5 p.m. The tentative millage was set at 8.875 mills, which is a 1 mill increase from 2012-2013. Property values in the city have declined by over $11.5 million in the past year. One mill equals $1 for every $1,000 of assessed value. The proposal would collect an estimated $1.98 million in property taxes about nine percent more than the current year. The city has routinely approved a tentative millage, created their budget and then lowered the millage rate to accommodate the expenses planned. Public hearings on the proposed budget are scheduled for Sept. 3 and Sept. 17 at 6 p.m. The council approved an ordinance that prohibits residential construction and education facilities located within 2,500 feet of a runway at the Okeechobee County Airport. This policy is required by the state. Currently, there are no homes within this distance. T axes When they do incentive tax breaks to lure a business to an area, there are always restrictions such as they have to employ a c ertain number of employees and the tax b reaks are for a limited time. And while the b usiness may be getting a partial break for a few years, they are still paying more in taxes t han the property would be generating if it s tayed vacant.  If the county could start taxing churches, it would really help the tax base. Why s houldn’t churches pay their fair share for law enforcement protection? Businesses have to pay property tax and some of these c hurches rake in a lot more money than the b usinesses clear after expenses.  I see our county tax rate is almost three t imes what St. Lucie and Indian River county is. The re department costs us $7 million a year. The sheriff’s department budget is c lose to $15 million, including the jail. The c ounty charges property tax, re tax, EMS t ax, garbage tax, half cent sales tax, local opt ion county tax, gas tax, local option gas tax, b uilding permit fees, impact fees, and amb ulance fee. When is the Board of County Commissioners going to stand up for the t axpayers? Z immerman trial Have there been any murder cases in Okeechobee where race was alleged to be a factor? I admit the only murders I can recall in the past 20 years were mostly white people accused of killing white people; black people accused of killing black people; and, Hispanic people accused of killing Hispanic people. I do recall one case of a Hispanic man accused of the murder of a black woman, and he got the death penalty.  We’ve come a long way since the Jim Crow days and obviously have a long, long way to go. It seems no matter how hard all of us try or how far we’ve progressed, something (whether valid or not) crops up, setting us all back to the ‘60s, as though there are those of all races who revel in the discord, never wanting anything different.  I blame the media for all of the anger and violence surrounding the Zimmerman trial and verdict. The FBI conducted an in depth investigation and could nd no evidence that Zimmerman is a racist or that his actions were racially-motivated. The jurors followed the law and the evidence and found reasonable doubt so they had to let him go. But some people want to make it all about race because it increases their ratings.  This whole thing with Zimmerman and Trayvon has been about the Stand Your Ground law here in Florida. From the very beginning The Stand Your Ground law was attacked when it had nothing whatsoever to do with this case.  The mainstream media really caused quite a mess with the unprofessional way they handled the Zimmerman case. For example, they kept saying the police told Zimmerman to stay in his vehicle. If you read or listen to the entire 9-1-1 transcript, you will nd the dispatcher never said that. When Zimmerman told her he was trying to look for the person he saw, she said “We don’t need you to do that.” She never advised him to stay in his vehicle. The whole thing is a sad tragedy but it was blown up by the media into a circus.Baby injured There are so many people who want babies and can’t have them. It is such a crime when a mother does not immediately get care for an infant that is hurt. The poor baby had broken bones and was left to just suffer through it. Whether she is responsible for the injuries or not, she certainly was responsible for getting that child medical care.  I am praying the baby has a quick recovery and loving caretaker. Also praying the perpetrator is healed and does not get around other children for a long time. Overholt will also be classi ed as a sexual predator. It was pointed out by the state Wednesday that Overholt had been convicted of second-degree sodomy in 1972 in Wyoming County, N.Y. He was then convicted of lewd and lascivious molestation on a child under the age of 12 in Okeechobee County on Nov. 16, 1985. Overholt was sentenced to 42 months in a Florida prison on that charge, which was followed by three years probation. His third conviction was on Nov. 30, 2011, which was the case for which he was granted a new trial. In handing down his sentencing decision W ednesday, Judge Bauer said Overholt's prior record " gured in greatly." The 4th DCA awarded Overholt the new trial because prosecutors placed a screen between Overholt and the 7-year-old victim w hen the child testi ed at the November 2011 trial. A camera was also set up so that Overholt could watch the child testify on a television placed in front of the defense table. This was not the rst time Assistant State A ttorney Ashley Albright elected to use the screen as a means of protecting the young v ictims when they testi ed. However, this w as also the third such case of Mr. Albright's in which a convicted offender was awarded a new trial by the appeals court because he had used a screen. In the rst case, convicted sex offender Timothy McLaughlin was returned to Okeechobee but, as with Overholt, he entered a plea of guilty and was sentenced to 15 years in prison. A third case has yet to be set for trial. Mr. Albright went on to say there is a fourth case currently before the 4th DCA with the same issue, but that court has to yet to hand down a ruling. "The (4th DCA) ruled the screen was prejudicial to the jury because they could assume he was guilty because of the screen in the courtroom," explained Mr. Albright. "When we did that (put up the screen) we thought we were doing it in a way that was more fair for the defendant. But, the appellate court said the child should have been put in a separate room and put on video." When asked why Overholt chose to plead guilty instead of going to trial, the prosecutor indicated the reason for that was pretty simple. "The defense basically knew he would be found guilty because he was recorded on a phone call and admitted to being guilty," he said. And, in his statement to the judge, defense attorney John Cook said basically the same thing. "I told him a new trial doesn't always mean a new result," said Mr. Cook. Mr. Albright said the appellate court rulings will now change the way he handles a young victim when they take the witness stand. "Personally, in my opinion, they'll have to testify live or risk being overturned. MurphyOkeechobee News  Okeechobee County Parks and Recreation hosted another successful season of adult softball action this spring at the OK Softball Complex. The 2013 Spring softball champions included the Chobee Outlaws in the Men’s League and Teez 2 Pleez in the Men’s Div ision 2 league. Total Roadside Service claimed the Co-Ed League. The women’s league championship was claimed by Seminole Signs. The Parks and Recreation Department w ould like to thank all of their sponsors and teams. The sponsors included Faith Farm Ministries, Teez 2 Pleez, Lynch Paving, Seminole Heat, Hi-Tek Automotive, W oody’s, Chobee Outlaws, Farm Bureau, Total Roadside Service, Nunez Lawn Care, Y oung Guns, Seminole Signs, ECO Mowing and J&E Fencing. The Okeechobee County Sports Complex, OK Softball elds and Okeechobee High School will host games through Saturday in the Native American Youth Organization girls fast pitch and boys baseball tournament. The event is a cooperative event presented by Okeechobee County Parks & Recreation, the Okeechobee County Tourist Development Council and the Seminole Tribe Recreation Department. Approximately 50 Native American teams are due to take part. There will be no admission charge. Teams will compete in three age divisions, 7-8, 9-10, and 11-12.  The Okeechobee High School Brahman football squad has been very busy this summer as they compete in 7-on-7 passing leagues around the area. The team has played games in Lake Placid and Martin County in the past few weeks. They were rained out on Tuesday in Lake Placid. Okeechobee has played John Carroll, Fort Pierce Westwood, Frostproof, Sebring, Lake Placid and Fort Meade in league games this summer. Coach Chris Branham said they have not emphasized winning the games, only improvement in the passing games. Thursday, the Brahmans played Jupiter, Jensen Beach and Martin County in Stuart. On July 24 they play at Clewiston against the Tigers and several Big Lake area teams. Coach Branham said he expects to keep 30 players on the varsity roster this year. He said they have focused on the basics of the passing game and have seen some improvement in recent games. “I think the team has improved as the summer has gone on so that has encouraged me,” he admitted. He also has scheduled a kickoff classic exhibition game in Lake Placid on Friday, Aug. 23. Game time is 7 p.m.  Former Brahman offensive tackle Anthony Kibler has accepted an offer to college football play for Bethune Cookman College. Kibler played one year at a Mississippi Junior College after a stint at the University of South Florida. Erick McQueen continues to recover from an injury suffered last year at Webber International University. Current Brahmans Cody Walker and Cor y Vickers were offered football scholarships by Edward Waters College in Jacksonville. Vickers also elded an offer from Webber International.  The Okeechobee Junior Dixie Boys trip to the Florida State Tournament begins on Saturday morning in Sebring. Okeechobee will meet Spring Hill at 12 noon in the double elimination tournament. Other teams this year include Key West, West Seminole, East Lakeland and West Volusia. The tournament runs through July 24th at Buzz Field in Sebring. Circuit Court Judge Sherwood Bauer accepted the no contest plea W ednesday, July 17, of Justin Ross W ells and sentenced him to a year in the county jail. The judge also adjudicated Wells, 22, guilty on all charges. Wells was charged with the felonies of resisting a law enforcement of cer w ith violence and battery on a law enforcement of cer. He was also charged with the misdemeanors of petit theft and trespass after warning. It was brought up in court that this is Wells' second conviction of petit theft. As part of the plea agreement Wells will not be credited with the time he has already spent in jail. Wells was arrested June 10 by Sergeant Justin Bernst of the Okeechobee City Police Department (OCPD). According to the of cer's arrest report Wells was seen taking some items from Walmart and then leaving the store without paying for them. When the of cer found Wells he was in the restroom of Hibbett Sports. When the man came out of the bathroom, Sgt. Bernst asked Wells what he was doing and then told him he was under arrest. As the of cer prepared to handcuff Wells, the man struck the of cer in the chest with his shoulder and ran for a door that led to the front of the store. Sgt. Bernst was able to direct Wells into a wall as he fell through that door. Waiting on the other side of the door was OCPD Lieutenant Donald Hagan who red his taser into Wells' lower right torso. At that point, the man quit resisting the of cers. Sgt. Bernst's arrest report stated he found two X-box 360 headsets and a package of cold medicine on Wells. Those items, added the report, were valued at $63.35 and returned to Walmart. The sergeant also pointed out in his report that Wells had already been trespassed from Walmart, the Murphy USA gas station and the plaza where the sporting goods store is located. W ells enters plea; sentenced to county jail Special to the Okeechobee News High water levels have prompted the Florida Fish and Wildlife Conservation Commission (FWC) to issue an executive order temporarily restricting public access to Everglades and Francis S. Taylor, Holey Land, and Rotenberger Wildlife Management Areas (WMAs). This action is necessary because high water levels force area wildlife to take refuge on tree islands and levees, resulting in high levels of stress for these animals. Effective at midnight on July 19, the order prohibits vehicle, airboat, all-terrain vehicle and other public access to the Everglades and Francis S. Taylor, Holey Land, and Rotenberger WMAs. These three areas are in Palm Beach, Broward and MiamiDade counties. Access to Conservation Area 2A from the L-35B levee north to the east-west airboat trail is still permitted. The order also prohibits the taking of game. This order, however, does not apply to people permitted to participate in the statewide alligator and migratory bird hunts, to frogging, or to people operating boats while shing within the established canal systems. A minimum distance of 100 yards from any tree island or levee must be maintained to minimize disturbance to upland wildlife. These special regulations remain in effect until rescinded by a subsequent executive order. MurphyOkeechobee News Okeechobee is hosting 45 Native American baseball and softball teams this week for a national tournament at the Okeechobee County Sports Complex and other area ball elds. Games began Thursday in the 7-8-yearold division. There were six boys baseball teams and four girls softball teams in the double-elimination tournament. Tribes represented included the Cherokee, Choctaw, Seminoles, Poarch Creek and Iroquois. The Seminole Tribe had nine teams at the tournament, the Choctaw had eight teams, and the Poarch Creek had 10 teams, the Cherokee six teams and the Iroquois one team according to Director of the Seminole Tribe of Florida Recreation Department Richard Blankenship. He explained that the annual tournament is hosted in the Southeast United States. This y ear was Florida's turn to host the tournament and they chose Okeechobee over Hollywood. "We knew that Okeechobee would appreciate us. It is centrally located, and I knew I could work together with the County Parks and Recreation Department," Mr. Blankenship said. Okeechobee County Parks and Recreation Director Albie Scroggins said he meet with Mr. Blankenship, put the details together and was proud to host the prestigious event in Okeechobee. NAYO represents Native American Tribes in the Southeast and also the Seneca Tribe in upstate New York. Mr. Blankenship said all of the tribes have strong recreation departments. They also host annual basketball tournaments. The event was expected to attract at least 1,000 visitors to Okeechobee this weekend. Mr. Blankenship said each team usually generates about $10,000 in economic impact to a local economy during these tournaments. "We love the economic impact," Mr. Scroggins admitted. "It will be phenomenal for Okeechobee." In the opening round the Seminole softball team, comprised of players from Brighton and other Florida reservations, lost to the MBCI Elite team comprised of Choctaw Indians from Neshoba County, Mississippi, 17-1. Melina Billie scored the lone run of the contest for the Seminoles. The Seminoles baseball team battled back and forth with the Native Giants comprised of Choctaw Indians from Mississippi, 9-6. Ramone Baker had a key triple for the Seminoles. A ve-run fth inning rally proved to be the difference for the Choctaw "Native Giants." Thursday afternoon the Seminole baseball and softball teams in this age group were eliminated from the tournament. The baseball team lost a heart breaker 8-7 and the softball team was shutout 7-0. Teams in other age groups will play Friday and Saturday with games at the Okeechobee County Sports Complex, Okeechobee High School and the Okeechobee Adult Softball Fields. Spectator admission to all games is free and community members are invited to come out and enjoy the ball games. By Eric KoppOkeechobee NewsAn Okeechobee man entered into a plea deal with the state in a felony drug possession case and was sentenced to one year and a day in the Department of Corrections (DOC). Daniel Jordan Estey, 18, entered a plea of no contest Wednesday, July 17, in front of Circuit Court Judge Sherw ood Bauer. He was charged with the felonies of possession of marijuana over 20 grams, possession of marijuana with intent to sell and possession of cocaine w ith intent to sell. He was also charged with possession of drug paraphernalia, a misdemeanor. Judge Bauer adjudicated Estey guilty on all charges and sentenced him to serve one year in the Okeechobee County Jail on the paraphernalia charge. He also ruled that all sentences would run concurrently. Estey was arrested March 2 on an Okeechobee County warrant. The judge also ruled that Estey’s driver’s license would be suspended for two years and that he must provide a DNA sample. His bond was set at $52,500.  Felton Gary Johnson, 39, S.E. Ninth Ave., Okeechobee, was arrested July 17 by Of cer Jeremy Larue on felony charges of grand theft auto and domestic battery by strangulation. His bond was set at $750.  Tesheena Lister, 15, N.E. 39th Blvd., Okeechobee, was arrested July 17 by Deputy Steven Pollock on a felony charge of aggravated battery by a detainee on a detainee (two counts). She was booked into the Okeechobee County Jail then taken to the St. Lucie Regional Detention Center in Fort Pierce.  Denise Georgeanne Thomas, 50, S.E. 35th Ave., Okeechobee, was arrested July 17 by Deputy John Hazy on an Okeechobee County warrant charging her with grand theft. Her bond was set at $6,000.  Jeffery Lynn Keehn, 63, S.E. 23rd Ave., Okeechobee, was arrested July 17 by Deputy John Hazy on a DOC warrant charging him with the felony of violation of probation aggravated assault with a deadly weapon. His bond was set at $5,000.  Reed Ashton Hair, 24, S.R. 710, Okeechobee, was arrested July 18 by Deputy Bart Potter on a felony charge of false imprisonment.
