Page 3 Navigation locks reopen ...Page 11 By Katrina ElskenOkeechobee News Three-year-old AnnMarie Town remembers “falling and falling and falling.” The little girl is in the hospital in Tampa, recovering from injuries she suffered Sunday afternoon when a tornado destroyed the Venus home she shared with her mother and two sisters. In her hospital room Wednesday, AnnMarie told her grandparents that she was watching “Scooby-Doo” just before the storm hit. She said her mother grabbed her up and they went to the door to leave, but the wind was too strong so they went back inside. The next thing she can remember, she was “up high” in the air and her mother was holding her tight. And then, they were “falling and falling and falling.” The little girl told her grandparents that her Mom held her tight. She said her Mom saved her. Highlands County Sheriff Susan Benton credited Heather Town, 32, with saving her daughter’s life, at the cost of her own. “She never let go of her little one,” said the sheriff. The tornado—one of four that hit Highlands County on Sunday—picked up mother and child and threw them into a wooded area approximately 200 feet away. Shortly after the storm moved through, neighbors followed the sound of a child crying to nd the 3-year-old still cradled in her mother’s arms. EMTs were called to the scene and the little girl was transported to the hospital. But the rst responders could not save the mother, who was pronounced dead at the scene. The Highlands County Sheriff’s Of ce report states the debris eld from this tornado extended over several miles from the Montan a Trail home. According to the National Weather Service, four tornadoes were con rmed in Highlands County Sunday between noon and 5 p.m. Statewide, 14 tornadoes were reported. According to friends of the family, Heather Donations sought to help girls orphaned by tornado More OHS Scholarship photos inside By Eric KoppOkeechobee News “We’re done,” said Karen Gehle, as she stood outside of Courtroom A in the Okeechobee County Judicial Complex with a smile on her face and tears in her eyes. “Now, it’s time to get back to some sort of life.” For the second time in two years an Okeechobee County jury found James Paul Mullin, 39, guilty of killing Anthony ‘Tony’ Richard Gehle—the son of Richard and Karen Gehle. Mullin was rst convicted of manslaughter and two counts of culpable negligence on May 12, 2010. Then, on Feb. 1, 2012, the 4th District Court of Appeals (DCA) granted Mullin’s appeal and a new trial. So on Thursday, June 28, 2012, another jury made up of six Okeechobee County residents again found Mullin guilty of the same charges. Mullin was found guilty of jumping onto the hood of Tony’s red Toyota Corolla and trying to punch him through the open window of the driver’s door. However, to use one of the favorite phrases of county attorney John Cassels, “the devil is in the details.” Commissioners realize there are still a lot of unanswered questions and details to be worked out. The motion was contingent upon approval from all applicable government agencies and a developer’s agreement that is acceptable to both parties. So at this point, commissioners have not obligated themselves to anything. The vote was 3 to 1 with Commissioner Ray Domer casting the negative vote. Commissioner Joey Hoover was not present. “There is not enough interest,” Commissioner Domer said. “I think it is too risky.” He said that no one contacted him who was in favor of the project Randall Henderson, who has over 30 years experience developing RV resorts, explained his proposal to commissioners. It involves leasing the park for 99 years. Mr. Henderson would sell RV lots to RVers who would own them for the duration of the lease. The owners would pay ad valorem taxes on the property and the county would get 2 percent of the sales. Due to excessive rain water from Tropical Storm Debby, Okeechobee County Health Department of cials urge residents and visitors to protect themselves against mosquitoborne diseases. Be diligent in protecting yourselves from mosquito bites by following the "5 Ds," w hich include: Dusk and Dawn Avoid being outdoors w hen mosquitoes are seeking blood. For many species, this is during the dusk and dawn hours. Dress Wear clothing that covers most of your skin. DEET When the potential exists for exposure to mosquitoes, repellents containing DEET (N,Ndiethyl-meta-toluamide, or N,N-diethyl-3-methylbenzamide) are recommended. Picaridin and oil of lemon eucalyptus are other repellent options. If additional protection is necessary, a permethrin repellent can be applied directly to your clothing. A gain, always follow the manufacturer's directions. Drainage Check around your home to rid the area of standing water, which is w here mosquitoes can lay their eggs. Tips on Repellent Use Always read label directions carefully for the approved usage before applying a repellent to skin. Some repellents are not suitable for children. Products with concentrations of up to 30 percent DEET are generally recommended. Other potential mosquito repellents, as reported by the Centers for Disease Control and Prevention (CDC) in April 2005, contain picaridin or oil of lemon eucalyptus. These products are generally available at local pharmacies. Look for active ingredients to be listed on the product label. Apply insect repellent to exposed skin, or onto clothing, but not under clothing. In protecting children, read label instructions to be sure the repellent is age-appropriate. According to the CDC, mosquito repellents containing oil of lemon eucalyptus should not be used on children under the age of three years. DEET is not recommended on children younger than two months old. Infants should be kept indoors or mosquito netting should be used over carriers when mosquitoes are present. Avoid applying repellents to the hands of children. Adults should apply repellent rst to their own hands and then transfer it to the child's skin and clothing. Symptoms of West Nile virus may include headache, fever, fatigue, dizziness, weakness and confusion. Physicians should contact their county health department if they suspect an individual may have a mosquitoborne illness. Department of Health laboratories provide testing for physicians treating patients with clinical signs of mosquitoborne disease. Dowling Watford receives Carl T. Durrance AwardBy Tabitha TrentSpecial to the Okeechobee News In October 1944, Carl T. Durrance became one of the founding members of the Okeechobee Rotary Club. Much of his ideas and commitment to our community are still re ected in our current club projects. As a former Okeechobee County Superintendent of Schools, Carl T. championed projects that were both youth-oriented and exempli ed the Rotary motto, "Service above Self." That vision is still the focus of our club today. Even in his later years with physical limitations, Carl T. was always there with encouragement, enthusiasm, and nancial support. Carl T. also obtained the rare achievement of over 50 years of perfect attendance at Rotary club meetings. But then again, that was just another part of Carl T's Service above Self attributes. In honor of Carl T. and those in our community like him, our club annually recognizes an outstanding individual whose work in our community re ects their "Service above Self." The Carl T. Durrance Service above Self award is one of the highest regarded honors our club can bestow on an individual, this year's recipient was Dowling Watford. Mr. Watford, a lifetime resident of Okeechobee, was recognized for his countless hours of service to the community of Okeechobee. Owner and operator of family legacy Okeechobee Motor Company, Watford serves on many civic boards, is a veteran Kiwanian and has served as a city councilman for 28 years. What makes Watford the perfect candidate for the Carl T. Durrance award is that he truly serves from the heart for the betterment of the community and its citizens. Congratulations, Dowling! The Florida Fish and Wildlife Conservation Commission (FWC) on Wednesday named Donald Sellers of Okeechobee its 2011 "Volunteer Hunter Safety Instructor of the Year," at its June meeting in Palm Beach Gardens. Each year, the FWC gives this award to the volunteer who signi cantly advances the cause of safe hunting through extraordinary service in training and education. Mr. Sellers has been helping with hunter safety courses since 2001. In 2011, Mr. Sellers was the chief instructor for 23 courses in Okeechobee, Glades and Hendry counties. He also assisted with additional courses in Martin, St. Lucie and Hendry counties. Last year he certi ed nearly 600 students, and during the past two years he recruited 13 new instructors. "Don is extremely enthusiastic and knowledgeable about hunting and hunter safety, and he enjoys sharing this knowledge with others," said Diane Eggeman, director of the FWC's Division of Hunting and Game Management. "He is one of the strongest advocates you could have for passing along the hunting tradition to the next generation." Throughout his life, Mr. Sellers has been recognized by a variety of organizations. Some of his awards include the Lifetime Service to Agriculture Award from Okeechobee County Farm/City Committee, the Palm Beach County Cooperative Extension Service Award for years of support to the Extension Program and an award from the Florida Lettuce Mosaic Committee for his outstanding leadership. Mother saves child I didn’t know Heather Town, but I wish I had. She will be remembered forever as a mother who was willing to give her own life to save her child. There is no greater love than that. She gave her all for her child. I know she will be watching over her girls from heaven. For those who still have their mothers in their lives, take the time to hug y our mom or call her on the phone and just t ell her that you love her and appreciate her.  Heather Town is a hero. She should never be forgotten. We can honor her by helping the family with donations to the trust fund set up for her children, or with prayers if you can’t afford a donation. We can honor her by trying to live up to that standard of always putting your children’s welfare rst.Murals About the murals painted on the window areas, I think it’s one of the coolest t hings I have seen in a long time. A really nice touch for the old building and downt own.  It was such a creative idea and I think it turned out great! I like all of the murals in Okeechobee. I hope they do more. The murals could become a tourist attraction, espec ially since they have a historical theme.  Looks great. Glad they xed the old b uilding up instead of tearing it down.  I very much appreciate the murals that have gone up around town! Every time we go to Lake Placid it’s a must to go by to see and “listen” to the cattle drive that is painted on the entire south side of their Winn Dix ie. I’m very happy to see the murals come t o Okeechobee ... would love to see some more of them around town.  A really wonderful addition. It’s an eyec atcher alright.  Does anyone know the history of that old building? It was a bank at one time. They sure have done a nice job on the touch up, the murals are great. (Editor’s note: Judge Hendry gave the history of the building during the dedication ceremony. The Okeechobee News article about the dedication is available online on Florida.Newszap. com. Click on “Okeechobee” and you should be able to nd the headline for the mural dedication story.)  Now that the outside looks so nice, I wish they x up the inside and use that building. How about using it as an art gallery featuring local artists?  I also enjoy the murals in Lake Placid. And if you ever go through the little town of Frostrpoof in Polk County, there are some wonderful murals there as well.Thoughts to ponder A word of encouragement during a failure is worth more than an hour of praise after success.Marco Rubio—born here, but does it count? Birthers have other things to get over besides themselves, mainly the fact that so many people can’t get over their adoration of the president, who is destroying the country. SFWMD land acquisitionEnvironmental restoration took a muchwelcomed step forward this month with federal and state consensus on a suite of projects to achieve Everglades water quality improvements. Timely implementation of the new projects—to be built by the South Florida Water Management District over the coming years—would not be possible without needed tracts of land already in public ownership. Regrettably, effective strategies used a decade ago to acquire land for restoration purposes have recently come under criticism. It’s easy to forget the context in which Florida’s explosive growth in the early and mid-2000s provided the impetus—and the resources—to place hundreds of thousands of acres of land into public ownership. Anyone who lived in Florida at that time will remember its fast-paced real estate market. As development increased and property values escalated, it made sense for the District to set aside lands ahead of the design and construction of projects associated with long-term restoration programs. One of these programs was the state-federal Comprehensive Everglades Restoration Plan, just getting under way. The District’s responsibility as its local sponsor was unambiguous: acquire land for the restoration projects. The land acquisition program accomplished its goals. From 2000 to 2008, the District put close to 165,000 acres into public ownership for Kissimmee River Restoration, the Comprehensive Everglades Restoration Plan and other water resource purposes. And, the $1.6 billion invested in land during those years has brought tangible results. In the restored Kissimmee, for example, we have vastly expanded the river’s oodplain, holding more water north of Lake Okeechobee and thereby reducing harmful discharges to coastal estuaries. Throughout this oodplain, wetlands have expanded and sh and wildlife have returned, including nine species of long-absent waterfowl. Moreover, the public has gained a recreational gem in the heart of the northern Everglades. A challenge then—and now—is that the District’s need for certain parcels is determined by speci c geographic locations where water resource protection and restoration are needed. As a result, some acquisitions took place through the state’s formal condemnation process, which increases costs. Wherever possible, the District worked to achieve negotiated acquisitions, even i f the nal price exceeded appraised value. In the long run, that approach saved taxpaye r dollars rather than squandered them, as some critics have charged. The years of intensive land buying ar e behind us. We are now focused on putting publicly owned acreage to its very best use, whether building on-site projects, swapping for lands in more critical locations o r leveraging it to gain the resources needed to carry out restoration work. At the same time, we are looking internally to assess what worked well for ou r land programs in the past and what needs revision for today. Already, the District has taken multiple steps to improve many o f its land management processes. These include: updates to our leasing policies; organizational changes to better align real estate, land management and land stewardship activities; inventorying District lands to identif y properties not directly needed for restoration or mission-speci c purposes; review o f the District’s land surplusing protocols; and close coordination with the Department o f Environmental Protection for land surplusing as well as any needed acquisitions. In all cases, the District’s policy making, land acquisitions and surplusing activities are carried out under Governing Board direction in accordance with state statutes and as part of an open and public process. To further enhance transparency, we have posted land-related documents and contracts to the District’s website, providing for ready access by the public. These steps re ect our continued focus District-wide on reviewing and improving the agency’s business, administration and operational practices. Our ongoing goal is to ensure the agency is operating prudently, effectively and ef ciently in the best interes t of South Florida’s water resources and its taxpayers. Melissa L. Heather’s life revolved around her family and three beautiful daughters that she was raising as a single parent. In addition she loved celebrating every holiday and birthday that brought the family together. Heather would do anything for her daughters, which is no surprise that Heather’s last breaths were taken clutching her youngest daughter to protect her from the tornado that took her life. Heather Town is a Hero and will always be remembered as a hero by her family, friends and people everywhere. She was considered more than a tenant by her landlord and more than an employee by her employer, she was a friend. Heather blessed everyone she came in contact with. Heather will always be in our hearts and loved forever. w ould rent out the lots. The lot owners w ould receive 50 percent of the rental and the county would receive 10 percent. “The rental revenue from a campground is seasonal and it won’t retire the debit,” he explained. Mr. Henderson said he chose Okee-Tantie because it is so unique, “I really don’t think you can duplicate it anywhere in the United States. You have water, sunshine, good weather, bass shing.” He plans to draw weekend guests from both coasts of Florida and winter visitors from out of state. “This will provide the single most unique RV resort built in the state of Florida in the last 20 years.” “This is not selling real estate. This is selling life style,” Mr. Henderson said. “We are comfortable in our estimates at this point. W e have identi ed what will work and what w ill be marketable to the consumer.” Most lots front on small lakes, “Those lakes have a dual purpose,” he explained, “aesthetic and controlling runoff.” The project is in four phases. Each phase has its own amenities, such as club houses, tennis courts and pools. Part of the rst phase involves enlarging and improving public use facilities and moving them to the front of the park for easier access. “We love it,” he said of Lightsey’s Restaurant. He wants it to stay. The bait and tackle shop would become a convenience store. Plans call for the marina to be widened and a set of slips be put down the middle. “What we tried to do is address every issue we are aware of,” Mr. Henderson said. As to the question of airboats he said, “We are going to accept them.” At this point the only revenue to the county would be from ad valorem taxes and the percentages from sales and rentals. Mr. Henderson predicted ad valorem taxes would generate $2 to 2.5 million in revenue. He said this would be net because the type of growth he is promoting does not put a burden on the infrastructure. He would maintain the roads. There would be no additional students in the schools and the park would have its own security system. Both county administrator Robbie Chartier and Commissioner Frank Irby questioned Mr. Henderson’s tax gures. According to Commissioner Irby’s calculations the annual ad valorem taxes would be about $256,000. He suggested that the county receive more revenue from the lots. Mr. Henderson did agree to allow ad valorem taxes to begin accruing when the lot is completed rather than at the time of sale as he had originally proposed. Mr. Henderson was anxious to get approval. He predicted that phase I would be completed by the second week in January. He said he would begin marketing the project in August. He said failure of immediate approval would delay the project 18 months and could have an affect on the nancing. Jeffrey Brockwood, president of the Lake Okeechobee Airboat Association said, “Our biggest concern is airboating rights.” He said the proposed airboat launch area is not acceptable. However he said his organization would be willing to work with the developer. “Lightsey’s is in favor of the development of the park,” said Travis Chambers, who represented the owner of Lightsey’s Restaurant. “I think this is an awesome project,” said businessman Carl Shumate. Builder Jerry Jollicoeur said the proposition made a lot of sense to him. “You have built in income for 99 years.” Commissioner Bryant Culpepper, who has championed this project, said it is imperative to do something for the airboaters. Mr. Henderson was willing to put language in the lease to give airboaters ingress and egress. He said that if for some reason the project failed, the county would still have the improved facilities. “There are a lot of things about this that may be successful,” Commissioner Domer said. ‘“But, it may not.” Gary Ritter, director of South Florid a Water Management District’s (SFWMD) Okeechobee Service Center, suggested that Mr. Henderson have a workshop meeting with SFWMD, the U.S. Army Corps of Engineers, and any other applicable government agencies who would have to give approval to the project. Commissioner Margaret Garrard Helton was pleased with the improved public facilities in the proposal. In another matter related to Okee-Tantie, commissioners terminated a Department o f Transportation grant for trailhead enhancements to the Lake Okeechobee Scenic Trail at Okee-Tantie because of time constraints. Deputy county administrator Jim Threewitts said he was fairly con dent the money could be transferred to another grant that could be used by the county. She spent most of her life in Okeechobee County. The single mother and her three daughters had lived in Venus for about a year. In Okeechobee, family members and friends are trying to do what they can to help the little girls. In addition to the devastating loss of their mother, the little girls lost their home and all of their clothes, toys and other possessions. (The two older girls were not at home when the storm hit. They were at a relative’s home in Okeechobee County on Sunday.) A trust fund has been set up to help the family. The “Town Children Account” is at TD Bank. And even though three years have gone by, having to sit through another trial and see photos of the mangled Toyota was nothing short of torture for Richard and Karen. “Having to relive this makes me miss my son even more,” said Karen, her eyes welling up with tears. “Not a day goes by that I don’t cry for my son.” Tony Gehle was 24. In the car with Tony was his then-5-yearold daughter, Catelyn, and Amber Anthony—the sister of his estranged wife, Angela. A s a result of the crash Catelyn, who was in the back seat, has undergone a number of facial surgeries. Ms. Anthony, a passenger in the front seat, suffered a back injury. The culpable negligence charges against Mullin stemmed from those injuries to Catelyn and Ms. Anthony. On March, 29, 2009, Tony took his daughter and Ms. Anthony to the Oak Park home that Angela, shared with Mullin. Mullin, lled with jealousy, was arguing w ith Angela over Tony’s visit. He then carried that argument over to Tony, who was bringing his daughter to see her mother. Mullin became furious when Tony w ouldn’t ght him, so he hit the larger and y ounger man. With blood running from a cut over his left eye, Tony gathered up his daughter and Ms. Anthony, then 19, and prepared to leave. As they were pulling away from the home Mullin sprinted from the front yard and jumped onto the hood of Tony’s car. “Tony did everything we’re supposed to do,” Assistant State Attorney Don Richardson told the jury in his closing statement this w eek. “The defendant cursed him, and he stood silent. When the defendant punched him, he literally turned the other cheek. When the defendant challenged him to a ght, he walked away. He walked away.” Mr. Richardson also successfully prosecuted Mullin at the rst trial. As the jury was deliberating at the 2010 trial, they asked to hear Angela’s testimony about Mullin jumping on the hood of the car. However, when the trial court replayed the relevant portions of her testimony during Mr. Richardson’s direct examination it did not replay the cross examination done by defense attorney Stanley Glenn, of the District 19 public defender’s of ce. According to the DCA’s ruling the failure to replay Mr. Glenn’s cross examination was misleading in that Angela’s testimony was within the scope of the jury’s request, yet the jury was not told that the playback included only the testimony from Mr. Richardson’s examination. Mr. Glenn also represented Mullin at this week’s trial. After that initial conviction Mullin, who was also ruled to be a habitual offender and a prison releasee re-offender, was sentenced to a total of 30 years in prison. Following Thursday’s verdict, Mr. Richardson said he will again ask that Mullin be declared a habitual offender and a prison releasee re-offender. Mullin, he added, has 10 prior felony convictions. With those classi cations, Mullin faces a maximum sentence of 30 years. Without them, he faces a maximum of 15 years. Mr. Richardson said Mullin will receive credit for the time he’s already spent behind bars. Mullin will be sentenced Monday, Aug. 20, at 1:30 p.m. Even though Richard and Karen can manage some measure of satisfaction with Thursday’s verdict, they still have to go home and carry on without their son. As Karen talks about her son, tears start to run down her cheek. But, then, she breaks into a wide grin at the thought of the beautiful gift that Tony left them—Catelyn. “We still have our precious granddaughter. She’s the light of our life,” said Karen. Four navigation locks will be placed back in on-demand serviceRainfall from Tropical Storm Debby increased the level of Lake Okeechobee to 12 feet NGVD, the threshold to reopen four navigation locks. The locks will resume ondemand service on Monday, July 2. The reopened locks will be:  S-135 at J&S Fish Camp, Martin County;  G-36 at Henry Creek, Okeechobee County;  S-127 at Buckhead Ridge, Glades County; and,  S-131 at Lakeport, Glades County. The locks can remain in service as long as the lake remains above 12 feet NGVD. Following is the status of other area navigation locks: The S-193 Lock, located on Taylor Cree k on the north shore of Lake Okeechobee, is closed due to ongoing renovation work to refurbish the lock and ensure decades o f reliable service. It is scheduled to reopen in the fall. On the south shore of Lake Okeechobee, the S-310 navigation lock at Clewiston is currently secured in the open position. The navigation lock becomes operational and is staffed by a lock tender when lake levels reach 15.5 feet NGVD and higher. Navigation locks operated by the U.S. Army Corps of Engineers, which includes locks on the Caloosahatchee River and St. Lucie Canal, are also impacted by lowerthan-normal water levels. Sheriff Paul May said such check points are a proven tool and are effective in reducing the number of people killed or injured in alcohol-involved crashes. He went on to say research shows that such crashes are reduced by an average of 20 percent when w ell-publicized checkpoints are conducted enough. As drivers pass through the checkpoint law enforcement of cers will look for signs of possible impairment. Drivers will also be checked to make sure they have the proper licensing. Impaired drivers can expect to be arrested and jailed. They can also expect license suspension and an increase in their insurance, along with nes and other fees. DUI classes and other expenses can exceed $10,000, Sheriff May pointed out. Motorists are reminded that if they are going to drink they should designate a driver; call a cab; call a family member; or, stay home. Florida law considers a driver with a blood alcohol content (BAC) of .08 or higher to be impaired. Drivers under the age of 21 with a BAC of .02 or higher are also in violation of state law. They played their tournament this past w eekend which was a round robin on Saturday June 23, rst against Lake Placid. The w inning score was 14-3. Later that day they played against Avon Park. The winning score w as 10-0. They were supposed to nish Sunday but got rained out Sunday and Monday, They were able to nish Tuesday night against Lake Placid with a winning score of 7-1. Winning all 3 games! Lonnie Pryor was there to hand out trophies. The District Champs are now headed to Carrabelle in the Florida panhandle to play in the State Championship on July 12-15. You will see our girls around town fundraising to help with costs for food and hotels while at the State Championship.
