Page 3 By Eric KoppOkeechobee News In an odd turn of events, Okeechobee County Sheriff Paul May found himself in circuit court and testifying how a web site has upset his family and could cause the public to doubt him. The sheriff Wednesday, May 16, went before Circuit Court Judge Elizabeth Metzger in an effort to get an injunction that would force Barry Rhodes to take down the web site sheriffmay.com, and to quit handing out business cards that may lead people to think the sheriff has terminal cancer. Those cards, testi ed the sheriff, state: stop the cancer, pray for may, sheriffmay.com.' The web site also refers to Sheriff May as a moral leper' and accuses him of corruption, taking payoffs, being a racist and ignoring violations of law by his deputies. Mr. Rhodes' web site also alleges that his mother, Audrey, "died prematurely at the hands of Sheriff Paul May." As he was being questioned by his attorney Marc Sugerman, Sheriff May said he didn't know about the business cards until someone said something to his wife at her place o f work. "They were inquiring about my health," he said. He went on to say emphatically that he does not have cancer and is not terminally ill. May seeks order to close web site By Eric KoppOkeechobee News A former school bus driver accused of drinking prior to running her afternoon routes will spend the next 30 days in the Okeechobee County Jail. Following her time in jail, Judith A. Austin will then be on probation for another 60 days. County Judge Jerald Bryant also ruled at Austin's change of plea hearing Wednesday, May 16, that she cannot drink any alcoholic beverage or go to any bars. She also will be evaluated for substance abuse and will be subject to random urinalysis testing. Austin, who was arrested Dec. 22, 2011, on a misdemeanor charge of culpable negligence, entered a plea of no contest to the court. During Wednesday's testimony Dale Barrett, director of operations for the Okeechobee County School Board, said he was contacted in the afternoon of Dec. 22 and asked to check on Austin. Park Street, hosted the monthly Main Street mixer. By Pete GawdaOkeechobee News The Okeechobee City Council held a short meeting dealing with routine items on Tuesday evening, May 15. As one of the conditions for applying for a Community Development Block Grant for a left turn lane in front of Applebee’s the city approved a participating party agreement. This agreement makes the owners of Applebee’s a participating party to the grant. As such Applebee’s would be responsible for any cost overruns on the project and they must hire a certain percentage of low and moderate income employees. Dennis Lee, an employee of Martin County Traf c Engineering, was appointed an alternate member of the code enforcement board with a term from May 16, 2012, to A pril 30, 2014. The city’s nance director, India Riedel, was designated as the city’s representative to the annual conference of Public Risk Management, the city’s insurer. The council also voted to cancel the rst meeting of the month for the months of June, July and August. Turning to another matter, the council received a water conditions update from Gary Ritter, director of South Florida Water Management District’s Okeechobee Service Center. He said that from last Nov. 11 until the present we have received less than half the average rainfall for that period. In the past he said that during times of low water, water managers have brought water into Taylor Creek to bring up water levels in the canals of Treasure Island and Taylor Creek Isles. Mr. Ritter said that would not be possible in the future due to the newly constructed Lakeside Ranch Stormwater Treatment Area, which will have to be kept hydrated. Mr. Ritter said that a pulse release was currently being made to the Caloosatchee River to prevent salt water intrusion and algal blooms. He said it has been several years since there has been a pulse release to the St. Lucie Canal. Within the next three or four weeks Mr. Ritter said his of ce would be moving into quarters across U.S. 98 from the county industrial park. He said they got a good deal on the lease and they would have a conference room, something that is lacking in their present quarters. He said there would be less space in the new quarters, but the existing space is more ef ciently laid out that the present of ce. Mr. Ritter reminded the council of the two-day-a-week watering rule. Odd numbered addresses can water lawns on Wednesday and Saturday. Even numbered addresses can water lawns on Thursday and Sunday. He also said that after the rehabilitation of the Herbert Hoover Dike, the U.S. Corps of Engineers could revise the Lake Okeechobee Regulation Schedule to allow for holding the lake at over 15 feet.Post your opinions in the Public Issues Forum at www.newszap.com. Student recognized at Rotary meeting By Pete GawdaOkeechobee News Budget season is once again upon us. At their last meeting Okeechobee County Commissioners took their rst look at the preliminary budget. It contains a 3 percent salary increase for board employees. If approved, it would be the rst raise in four years for many employees. Any increase for board employees or employees of constitutional of cers or school board employees could have an effect on the overall economy of the county. Okeechobee County follows the trend in Florida counties whereby government is usually the largest employer. According to a recent survey by the Florida Taxwatch Research Institute, every county in Florida has at least one government entity in its top ve employers. In all 67 Florida counties the school board is in the top 10 employers. In Okeechobee County three of the top 10 employers are government entities. With approximately 914 employees, the Okeechobee County School Board is the number one employer in the county. The Okeechobee County Sheriff’s Of ce is number ve with about 212 employees. Coming in sixth is county government with 162 employees. The clerk of the court, the tax collector, the property appraiser and the supervisor of elections combined have about 63 employees. The school board is a separate taxing district and school board salaries are negotiated between the teachers’ union and the school board. The board of county commissioners is the sole authority for setting county employee’s salaries. They are also indirectly involved in the salaries of the sheriff’s of ce and the other constitutional of cers. While they cannot dictate the salaries of constitutional of cers’ employees, they do approve the budgets of the constitutional of cers, which are part of the overall budget of the county. However, there is a mechanism whereby constitutional of cers can appeal their budgets to the state. New budget will affect local economy

T roubles... We all have our own share of troubles and worries. I will deal with mine and you deal with yours. There is no need to share all y our problems with everyone around you. If these troubles have been created at your own doing, it is only you who can rectify the s ituation. You call yourself a Christian, then y ou should know that lying, hiding, cheating and deception is not the way to live or to t each our young people how to live either. T his is how you are teaching your children. Have you thought about that? Rethink your actions and live truthfully. Let your cons cience be your guide in life. T exting while walking In the news I saw a city has banned text ing while walking. It seems that some folks are so busy texting that they are a hazard to t hemselves and others. They bump into other people, walk into walls, walk into traf c w ithout looking up. One video on the internet shows a girl in China walking past warning signs and right into a sink hole! I don’t t hink texting while walking is a big problem in Okeechobee yet, but I do think the State of Florida or the federal government should b an texting while driving. It is so dangerous for these folks to be driving a car and not even looking where they are going because t hey cannot wait a few minutes to send or read a text.  I am of the opinion that there are more than enough laws and ordinances in existence throughout the world already to attend to any society’s needs. In the past people walked down the street reading a newspaper, (even the Okeechobee News!), and we didn’t need an ordinance. If they b umped into someone, at worse they were c alled some profanity by the victim, and life w ent on. As to the girl walking into the sink hole, well look at it as nature adding some w ell-needed chlorine to the gene pool, aka s urvival of the ttest. The ones texting while driving, treat them like a DUI. Have you ever s een a law enforcement of cer tapping away on his laptop while driving? I have.  The people who text while walking don’t endanger others on the sidewalk for the most part. Same for those who read while walking or are distracted in other ways. But texting while driving should fall under the “distracted driving” rule and they should be pulled over and ticketed. And if the cops are doing it too, that is even more dangerous. Drivers need to have their full attention on their driving.  We have plenty of laws on the books already that can cover texting while driving; failure to have your vehicle under control, willful reckless driving, etc ... When our lawmakers try to complicate things by getting so technical, you sometimes make things worse and create loop-holes .. simple is sometimes better as more can be squeezed into the interpretation, thus leaving the nal outcome up to the State Attorney and judge to decipher and enforce. Law Enforcement should simply start exercising their authority with what we already have .. word will get around!  Texting while walking is here in Okeechobee. I was in town yesterday and a woman who was walking toward me was texting, not looking up. I stopped and stood there waiting to see what would happen .. right, and I mean RIGHT before she got to me she looked up startled that I was there -what one could call “a near miss” or “a near hit” .. remember George Carlin’s skit about near collisions of airplanes? Texting and driving should be STOPPED!Scrap metal thefts In today’s paper is a story about a guy who apparently dug up and stole someone else’s irrigation pipes and sold it to a scrap dealer. This is so out of control. The guy got $8 for the pipe from the scrap dealer, and of course he had to show ID so they had a record of the transaction. But he caused more than $500 in damages by digging up and taking the pipe. Now they have the stricter rules and the scrap dealers are getting IDs and keeping records. What does it take to get the word out to the idiots who steal things to sell for scrap that they will be caught and they will go to jail? Even though they do get caught, that does not repay the poor homeowner whose property was damaged during the theft. Why vote?Why should I register to vote? Why are politics the major headline every night? What does this really do for me? For those of you wondering the above, especially those of you under 25, these are valid questions and questions that thankfully you have partial control of. I would like to say that, I’m still a young man with views slightly different than those of “older” voters. I do care about the future of this county, not only for me but my child. I would like to sway everyone to vote as I do, however it’s your right to have your opinion, yet another reason that makes America so great. First why should you vote? Well having a “say” is what countries around the world wish they had; and a right that many Americans have fought and died for. Being able to be free and select who you feel is the most quali ed is important, more than you may realize. Voting is what makes every man and woman equal in government selection. You could have billions of dollars or be on the brink of being homeless, either way you still have one vote. Make it count. As for why politics are interfering with your programming, that’s the question that you don’t have control over. I would say shut off the television and play on the computer but it’s the same story. It may actually be overwhelming to some, especially for rst time voters. As mundane as you feel it is, once you read next paragraph, you change your tune and listen for at least a few minutes. $$$$ dollars, cash, money, dough, green….Enough said? If the idea of giving more of it to the local, state or federal government, or wondering why some people get “free rides” while you’re your working hard to with just enough to make your car payment, bothers you, well maybe, I have nally gotten your attention. I hope this aspect, if nothing else, gets you involved. If it doesn’t, then maybe I have wasted your time in this article. Having at least an idea on which candidate is lying less or which one is going to adhere to their campaign and limit government spending could be critical for you. You may believe all the clichs on politicians pertaining to lying and corruption. I have no answer for that, but overall, knowing thei r stance or moral character may assist you in making your decision. Topics from taxes, health care, gay marriages, abortion, immigration reform, social security, even zoning or development beliefs; are just a few topics that could get you going. When mos t people think of voting, they think of voting for president, however driving around town you know the signs are up. Local politics are tricky; with friends, neighbors, and even family involved. Learning what candidat e mimics your own concerns and beliefs o r which is the least repulsive and could swa y your vote. If you are registered to vote, encourag e others to vote. For us “young” folks who may not know the game; get involved and try to attend at least one meet and gree t locally and see if you get answers to you r questions. Its simple, register and vote, it’s not jus t your right it’s your duty as an American. Millions in other countries around the globe ar e ghting for their right to do what you freel y do now. Don’t let someone else make up your mind for you. Registering and voting not only gives you the right to choose, it also gives you the right to complain. FORT PIERCE—Indian River State College received unanimous approval from the Florida State Board of Education on May 10 to launch new Bachelor’s Degree programs in Information Technology/Security Management and Public Administration, expanding IRSC’s Baccalaureate program choices to 21. Classes will begin Aug. 23 and applications for the new programs will be accepted beginning May 14. “These new Bachelors Degree programs w ill open the door to a wide range of jobs in information technology and public administration,” said Dr. Edwin R. Massey, IRSC President. “The new IT degree program will provide students with advanced skills in building, operating and managing computer networks. Every business and organization today is concerned with maintaining the security of its data systems and intellectual property, and with every one of us concerned about identity theft, graduates w ith IT and cyber security training will be in demand. He was very involved w ith the Flying B Ranch as well as the cattle and ranching industry. Later he became a dragline operator for the County of Okeechobee in which he w orked and retired after 30 years. His love for Bluegrass Music is well known in Okeechobee. He played, mentored and gave lessons in Bluegrass music. He enjoyed Okeechobee History and loved to train horses. He was a devoted and faithful member of the Missionary Baptist Church for over 45 years. Mr. Arnold was a loving and devoted father. He is preceded in death by his loving wife of 58 years, Ruth Lorena Thomas Arnold; brothers, Elroy, Noel, Rufus “Uncle Bully”, Robert, and Freeman; sisters, Irena and Viola. She was born February 12, 1945, in Indianapolis, Ind. Her childhood was divided between Indianapolis and Deer eld Beach, Fla. She attended Pompano Beach High School but graduated from Southport High School in 1963. She married and had two children. She was active in her family’s business in Indianapolis. As her children studied at Indiana University, she returned to school and earned her teaching degree at Ball State University. She also studied abroad in Oxford, England and received her Master’s Degree in 2001. She was the media specialist at Hamilton Heights Middle School for 18 years. In 2008 a major stroke ended her career and she moved to Okeechobee with her husband who became her care-giver. She waged a three year battle against deteriorating health until she suffered a second major stroke on Tuesday, May 8, 2012 and was airlifted to Lawnwood Regional Medical Center. Her family gathered to be with her until the end. Karen was an adventurous individual who lived life at full speed. She was a season ticket holder of both the Colts and Pacers. She was there to support her team in the Super Bowl and followed I.U. to the Final Four. She held tickets to the Indy 500 and the Brickyard. She was known for her Indy 500 and Fall parties that she hosted for her family and many friends. She loved to travel and swim in her pool. She taught many children to swim and she insisted upon hosting the ZINK family reunion for many years. Karen was preceded in death by her parents, Ervin Reed Zink and Lossie Hart Zink; brother, Ervin Zink Jr.; sister, Velma Clements; aunts, Flossie, Rossie (Odas Tanner), Ruth Hart, Kathleen and Luevia (Roger) Zink; uncles, Amos (W.W.2), Kenneth (Marion), and Foster Bruton Hart. He told Assistant State Attorney Ashley A lbright that he met up with Austin at Seminole Elementary School. Mr. Barrett said A ustin had just nished her rst route and w as waiting for students to board her bus so she could make her second run. "When I stepped on the bus, I could smell the alcohol," testi ed Mr. Barrett. Mr. Albright played a brief video taken by a camera on the bus for the court. On that v ideo, Mr. Barrett could be heard asking Austin to breathe in his face. He then asked his bus driver if she had been drinking, and she replied that she had a beer with lunch. He could then be heard telling Austin, "I can't let you drive this afternoon." He then asked for the ignition keys. Mr. Barrett told the court that Austin was later given a breath test. Her rst bloodalcohol reading at 3:46 p.m. was .059. Her second reading, some 15 minutes later, was .046. While both of those levels are well under the state's legal limit of .08, the legal limit for those holding a commercial driver's license (CDL) is .04. When asked by Judge Bryant, Mr. Albright recommended that Austin be sentenced to the maximum of 60 days in the Okeechobee County Jail. "This is a woman who put the lives of 49 children at risk," he told the judge. But Austin's public defender, Brandi Tillman, reminded the judge that the breathalyzer machine used to test Austin is not regulated by the Florida Department of Law Enforcement. And, she added, this case was not investigated by the Okeechobee County Sheriff's Of ce. Ms. Tindall also told the judge that her client had lost her job and endured "... serious public scrutiny." In a January 2012 interview, Superintendent of Schools Ken Kenworthy said Austin handed in her resignation on Jan. 3 and it was accepted. He also explained that Austin drove a dual route and that her rst route only took about 20 minutes. She would then return to the school to pick up more students and run her second route. "No one was hurt or injured," said Mr. Kenworthy. "There's no indication the kids were under any danger, per se. Cameras on the bus did not show any swerving or running of stop lights. The bus was being operated properly." Austin had been employed by the school board since Nov. 22, 1994. By Charles M. MurphyOkeechobee News Okeechobee High School honored eight graduating baseball players and handed out ve awards at the annual Brahman baseball banquet Monday night. Coach Jeff Blackstone said the Brahmans (13-12) record was better than it appeared because 10 of their opponents quali ed for the regional this year. A team Okeechobee beat, Melbourne, reached the State Final 4 Tournament which is being played this w eekend in Port St. Lucie at Digital Domain Park. He honored Brad Coleman as the team's Most Improved Player, Timmy Farrell as Pitcher of the Year, Dalton Murray as Offensive Player of the Year, and two veterans, Tyler Finney and Justin Morgan with the Brahman Awards. Blackstone said the group of seniors w ere great to coach and be around and w ere strong students and people. He admitted he wanted to challenge the team this y ear because they won't ever get to the state tournament or win a state title without playing tough teams. In the off season he wants to see more kids getting in better condition. They lift w eights after school this month and will focus on cardiovascular and running next w inter. A number of the kids will also play summer ball. "We have a lot of potential in our younger grades and I expect to have a good group next year. I'm sorry to see the guys go that w e lose but I think the future is bright and it is an exciting time for Okeechobee baseball," he suggested. Coleman said the Most Improved Award meant a lot to him. He got a chance to be the every day rst basemen and hit around .340 while elding the position well. He plans to attend IRSC and have a career in the medical eld. "I de nitely worked hard this year. The coaches really helped me out. They don't get enough credit," he said. Murray couldn't throw this year due to off season shoulder surgery but remained the team's top hitter. He tied for the team lead in RBI with 26. He said the team really was strong offensively and he still worked hard to be a part of the team. "Coach Blackstone kept me game-ready and I wanted to contribute and put up runs. I tried not to do too much and be a team player," he added. He will play summer ball for Fort Pierce American Legion Post 358. Childers said he was glad to get the chance to play this year. He saw time at second base, third base and in the out eld. No matter where he played, Billy never complained and had a positive attitude. He intends to seek a career as a pharmacist. "I showed the coach that I could make improvements and the award meant a lot to me. I didn't expect it but I'm real glad that I got it," he added. Finney will move on to play at Flagler College next year. He said the Brahmans had a good season overall. He worked as hard as he could every day and was proud of the results. "I thought it was a good year overall. We played a lot of tough teams. Shortstop took a little getting used to but I did the best I could and worked my hardest every day," he added. Farrell intends to go to college and try out for the baseball team. He'd like to study architecture or engineering and might enlist in the US Air force after college. Farrell said he worked hard in the offseason and got faster and stronger which helped him on the mound, "I added some velocity and tried to re ne my pitches. I wasn't overpowering but I was more effective and I used my pitches wisely," he explained First year letterman honored were Layton Thomas, Christian Crews, Adam Davis, David Coleman, Tyler Milrot and Cody Phillips. Second year lettermen were Kutter Crawford, Jesse Stebbins, Billy Childers, Brad Coleman and Bryan Stokes. Third year lettermen included Tyler Barber, Alex Estremera and Dalton Murray. Four year letter winners were Tyler Finney, Justin Morgan and Timmy Farrell. As to the web site, the sheriff described the statements of Mr. Rhodes as “crap” and that he is trying to in uence the election. “I do believe the election is what this is all about. Absolutely,” said the sheriff. When asked by Mr. Sugerman, Sheriff May said if people believe what’s on the w eb site “they’re not going to come see you about anything. They’re certainly not going to vote for you.” Mr. Rhodes, who represented himself, claimed there is nothing personal intended w ith the either the business cards or the web site. He said the statement about cancer refers to cancer in the community, and does not state that Sheriff May has cancer. In his opening to the court, Mr. Rhodes asked the court to appoint an attorney to represent him because he has been diagnosed with four different mental illnesses. Judge Metzger declined the request and told him that an attorney could not be appointed to represent him. “As a matter of law, you’re not entitled to w hat you’re requesting,” she told Mr. Rhodes. During cross examination, the exchanges between the sheriff and Mr. Rhodes became contentious and the judge had to stop the proceedings and remind Mr. Rhodes that the hearing was only being held to determine if the cards and web site were making it difcult for the sheriff to do his job. “What interferes with you doing your job?” asked Mr. Rhodes. “The whole thing, Mr. Rhodes,” replied the sheriff. “I’ve spent 35 years in Okeechobee trying to build my reputation and now someone has taken about ve minutes to destroy it.” In his closing statement to the court, Mr. Rhodes continued to emphasize that it is clearly stated on the web site that what he espouses is solely his opinion. “But, why did you use his name (Sheriff May) on the web site?” asked Judge Metzger. “Because I wanted to bring out the wrong at the sheriff’s of ce,” replied Mr. Rhodes. “Everything I have on my web site I have documents to back up. Mr. Sugerman then asked Mr. Rhodes if he did, indeed, have documentation to back up his claims. But every time the Orlando attorney posed that question, Mr. Rhodes would hedge and answer that his documentation “backs up his opinion.” Finally, after continued pressure by Mr. Sugerman and Judge Metzger telling him to answer yes or no, Mr. Rhodes said he has documented evidence to support his allegations. “All I’ve done is allow the public to see,” said Mr. Rhodes. “There’s no act of harm here.” But, Mr. Sugerman disagreed by saying the web site has “harmed the sheriff’s ability to do his job.” Mr. Sugerman also told the judge if Mr. Rhodes would voluntarily take down the web site he would withdraw the lawsuit. When Judge Metzger asked Mr. Rhodes if he would voluntarily take down the web site, he simply replied “no.” Sheriff May is not seeking any monetary relief in the action. All he is asking is that the web site be removed and that Mr. Rhodes stop handing out the business cards. Judge Metzger did not state when she would make her ruling on the injunction.
