First degree

murder

verdict in:

Davis trial
BY DEBORAH BUCKHALTER
FLORiDAN STAFF WRITER
A Jackson County jury on Thursday
found Harry James Davis guilty of first
degree murder in the beating and stabbing
death of Peggy Allen Williams.
The penalty phase of the trial is set to
begin at 1 p.m., today. Prosecutor Mark
Sims is seeking the death penalty, but the
12-person panel could sentence Davis to
life in prison with no possibility of parole,
instead.
Davis is accused of killing Peggy Allen

mind' at work

"This Wbas a frenzy. An absolutefrenzy."

Walter Smith,
attorney for Davis

Harry James Davis
*Williams in her Marianna home, in August
of 2007. She suffered blunt trauma to her
head and body as well as multiple stab,
wounds, and authorities initially said that
the blunt trauma appeared to be the cause
of death. However, the last witness sworn

in at trial Thursday cleared that up.
Chief Medical Examiner, Dr. Michael'
Hunter of the 14th Judicial Circuit, said
the stab wound to Williams' carotid artery
was likely the ultimate cause of death.
Hunter testified briefly about several
graphic photographs that showed stab
wounds on Williams' body, including one
that opened some of the tissue of her ear.
Earlier in- the three-day trial, jurors saw
.evidence that suggested Williams also had
been beaten with several objects, including
a microwave oven, a frying pan and a con-
tainer similar to a paint can, which still
had contents inside. All three of those
objects were dented, Sims pointed out to
the jury as he built a portrait of Davis as a
.violent killer.

Toward the goal of obtaining' a first
degree murder conviction, rather than a
lesser charge, Sims drew testimony from
Hunter that suggested Williams likely suf-
fered before she died, rather than losing
consciousness early on in the attack.
There was little reaction in the court-
room when the verdict was announced, but
several members of Williams' family
hugged and cried as they walked down the
hall to the elevators and left the second
floor of the courthouse.
About the verdict,'Williams' son, Daniel
Minton, said, "It eases the pain' a
little...nothing can bring her back, but it
does help."

Quorum prevails in court against.

former hospital CEOI John Wes
B* DEBORAH BUCKHALTER
FLORIDAN STAfF WRITER

- Former Jackson Hospital CEO John. West
lost on every point Thursday in his civil case
against former employer Quorum Health'
Resources and two of its key employees,
Michael Kozar and Chuck Ellis.
His lawyer, Bruce Minifick, said he would
appeal the case, and West also said that was
likely.
West won a $49,000 settlement in an earli-
er, related action against Jackson Hospital, a
doctor, one of the hospital board members
and a nurse. But this time around, the jury
never got a 'chance to act on some of the
,claims. Judge Brantly S. Clark issued direct-
ed verdicts in favor of the defendants, in most
of the claims.
The case revolved around the circum-
stances under which West was fired from his
job with Quorum. The company manages
Jackson Hospital and tapped him as CEO in
2000.. He was fired in 2004 amid allegations
of impropriety. While never proven in'a court
of law, the allegations were nevertheless
brought to the attention of the hospital's
board of trustees when Quorum terminated
West.
Under the terms of his contract with
Quorum, West served "at the pleasure" of the
company and could be dismissed without
cause. However, he brought the suit, in part,
on the grounds that when Kozar went to the
Jackson Hospital Board of Trustees with
specifics related to the firing, it foiled his
career.
In this civil trial, which began Monday,
West sought defamation damages against
Quorum at large and individually against
Ellis and Kozar.
He also brought additional individual
claims against Ellis and Kozar, in both cases
alleging that the men interfered with his

cluded Thursday with victory for the defendants that west filed suit against in the case. -

employment.
Clark issued directed verdicts in all but one
allegatiori before the jury was to deliberate
the case, ruling that there wasn't enough evi-
dence to bring any of the defamation claims

or the claim against Ellis to the jury.
With only the interference claim against
Kozar remaining, the six-person jury deliber-

St. Luke's Episcopal,

First Methodist prayer

workshops begin Oct. 11
SPECIAL TO THE FLORIDAN

St. Luke's Episcopal and First United iMethodist church-
es host a Centering Prayer Workshop from 8:30 a.m. to
1:30 p.m., beginning Saturday, Oct. 11. After the initial
meeting in the Wesley Center at First Methodist, six fol-
low-up sessions will be held on Sunday afternoons from
Oct. 19 to Nov. 23, from 2 to 4 p.m., in the parish hall at
St. Luke's. ,
Sponsored and conducted by Contemplative Outreach,
LTD., each. workshop aims to teach how to develop con-
templative prayer in order to create a deeper relationship
with God as well as the discipline necessary to foster that
relationship. Participants will be helped t'o open their
awareness to God and achieve a method, of prayer that
moves beyond a conversation with God to communion
with Him.
During the Oct. 11 session, the group will cover four
topics: Contemplative Heritage, the method of Centering
Prayer, the use of the Sacred Word in Centering Prayer and
the fruits of Centering Prayer and extending the benefits
into daily life. A light lunch will be served at this meeting.
During the six follow-up meetings, the participants will
be supported as they establish a .daily commitment to a
practice of Center Prayer. Along with videos and infor-
mation sharing, each of the sessions will include discus-
sion and prayer. '
Diane Jacobs, local coordinator for the Centering Prayer
Workshop, explains that attending the first session is very
important. However, she adds, "While we hope everyone
will be able to attend all of the meetings, all are welcome
to attend as many or as few of the sessions as they are'
able."
For more information or to pre-register, interested per-
sons should contact the First United Methodist Church at
482-4502 or St. Luke's Episcopal Church at 482-2431.

ated for about an hour before returning its verdict in favor
- of Quorum.
Quorum attorney Gary Shipman said afterward that he
--- felt the panel's decision was the right one.
West, on the other hand said he was disappointed that
Clark set aside the defamation claims and by the jury's
-. verdict on the remaining allegation against Kozar.
a- At the same time, he said, he was glad to have brought
a- the case forward and hoped that it would ,still have an
- impact.
S "I've lost as a matter of technical law, but the support of
the people in this community has been very comforting
over the four years this has been going on," West said."
- "The damage to me has already been done, but I made part
of the point I was trying to make that actions which are
morally incorrect need to be challenged, and I hope that
this will be of sonie benefit to other people."

S ,Defense attorney Walter Smith
rested without presenting any testi-
mony, but indicated he would bring in
two expert witnesses for the penalty
phase.
- In his closing argument to the jury,
- Smith walked a fine line. On one
- hand, he tried to convince the panel
that his client was not guilty, that a
companion may have gone with
Davis to Williams' home and killed
her. On the other hand, Smith tried to
convince the jury that, if they
believed Davis was responsible, sec-
ond degree murder was a more appro-

private finding than first degree.
He used the violence of the crime
scene to make his point.
Rather than a premeditated act, he
argued, the scene suggested some-
thing out of control.
"Was this (done by) a calm, reflec-
tive person or (someone) of a
depraved mind?," Smith asked.
"Everything that could be grabbed
and used as a weapon was grabbed
and used as a weapon. This was a
frenzy. An absolute frenzy...a crazed
mind (at work)."
Smith went on to say that there had

been no clear evidence of a logical
motive for the killing, like robbery or
sexual assault, but thai it was done
out of "pure meanness." And under
the law, he said, a killing committed
in that mindset is second degree mur-
der. .
The same jury will be back for the
penalty phase of the trial.
Several people familiar with the
local court system said Thursday that
they could not recall a death sentence
being handed down in Jackson
County since the mid-to-late 1980s.

Cottondale eager to play first home game

in a month tonight against John Paul II 11

BY DUSTIN KENT
FLORIDAN SPORTS EDITOR
After a three-game road trip Cottondale
would like to forget, the Hornets return
home tonight to face winless John Paul II
in the hopes of ending a four-game losing
streak.
Cottohdale (1-4, 0-1 in District 1-1B) is
coming off of a disappointing 34-6 loss to
South Walton Oct. 3, which was preceded
by losses of 46-0 to FAMU and 26-14 to
Wewa.
With his team reeling, Hornets coach
Mike Melvin said he is happy that his team
is back home with a chance to regroup.
"I just know I'm glad to be back at the
house," the coach said. "It's big. We can
get the student body back involved, get
some home fans back in. It's expensive for
them to travel right now. We can get our
fans back at the games to see the kids. I'm
just glad to be back home."
Tonight's game marks the start of a
three-game homestand for the Hornets,
with all three contests being district games
that will determine whether or not
Cottondale will play postseason football.
Melvin said his team is well-aware of
the magnitude of the coming games,
though his primary concern is simply get-
ting his team to play better football than it
has played in recent weeks.
."The district games are huge,".the coach

"They're tired of traveling.
They're just ready to get back
in front of the home
crowd...instead effacing a
hostile environment every
week. "
-Mike Melvin,
Cottondale coach
said, "but we just want to execute and let
the wins and losses take care of them-
selves. We want to take care of the basic
stuff, like not turning the" ball over and
staying in our stuff on defense. We just
want a good showing."
Turnovers have plagued the Hornets in
each of their last .three losses and it's a
trend that Melvin said his team must
break. '
"We just have to take better control of
the football," he said. "We can't have. a
good drive, then turn it back over to them
and give their offense a short field to play
with against our defense. We just have to
do a better job of playing fundamental
football."
Fundamentals has been the theme of
practice this week, according to Melvin.

game earlier this season. Floridan File Photo

"We've been working on a lot on block-
ing and tackling drills," the coach said,
"just basic fundamentals. We've had a
pretty.good week of practice."
Melvin said he thought his team has had
a bit more spring in its step this week with

no more road games scheduled for the next
month.
"Yeah, I think so," the coach said.
"They're tired, of traveling. They're just

The loss was the third the Indians
have suffered by just two points.
Grand Ridge controlled the time
of possession but came up short on
the scoreboard, accumulating 446
yards while holding the Tigers to
257 yards.
Delontre Keys had a banner

Brown picked up 61 yards on eight

Seventh-grade quarterback
Wayne Driggers rushed .for 55

The deficit came on 2-point con-
version attempts when the Indians
failed to convert on all five
attempts and Blountstown capital-
ized on all of its attempts.
Following the game, Grand
Ridge coach Art Porep was positye
about the season and his team's

, "We could just have easily been
5-1, with six points separating us
from wins in three games, two
points each game and a last minute

touchdown in the fourth game," he
said. "We are losing 15 players this
year, but our quarterback returns
and we have some solid players
coming back next year."

As for the Hornets' oppo-

played three games this
year,_ all lopsided losses, are
a difficult team to read at
this point in the season.
"The tapes I got on them,
Graceville was real good to
them and played a whole lot

of their backups, so I'm not
sure exactly how good'John
Paul is," the CHS coach

said. "It's hard to say. I just
know that they like to throw
the ball."

John Paul has lost its
three games this year by, a
combined score of 169-14,
falling to Eagle's Nest

Christian Academy, Maclay
and Graceville.
Tonight's game. and the
Oct. 24 matchup with
Aucilla Christian presents
the Hornets with two very
winnable games before the
Nov. 7 showdown with
rival Graceville, which
could potentially decide the
second playoff spot from
District 1-1B.
"Graceville is already a
big game, but if we pull off.
some wins in the next two
games, that one plays an

even bigger part," Melvin
said.
