By Eric KoppOkeechobee News John Austin Collier easily summed up how his family wants their battle with water managers to end: “The truth. All we’ve ever, ever wanted was for the water management district to step up to the plate and honor the binding agreement Austin Pearce negotiated for his family.” But, the problem is: Just where does the truth lie? Does it lie somewhere in the alleged “investigation” conducted by Department of Environmental Protection (DEP) Inspector General Candie M. Fuller? Can it be found somewhere in the West Palm Beach of ces of the South Florida Water Management District (SFWMD)? When pressed, no one at the district could produce the one critical piece of evidence alluded to in Ms. Fuller’s investigation. So, just where does the “truth” lie? The truth could be found in black and white and in the hands of Mr. Collier and fellow members of Twin Sisters’ Family Lands.BackgroundOn May 30, Twin Sisters’ Family Lands sent a letter to DEP Secretary Herschel Vinyard. In that letter, the family asked Mr. Vinyard to open an investigation into how water managers had handled water issues surrounding the L-59 canal in Glades County. The letter also outlined the history of the Austin and Rosa Lee Pearce family and the 13,000 acres of land they owned in Glades County, as well as the battles the family has since fought with the district over the L-59 canal. Mr. Vinyard turned the letter over to Ms. Fuller, who then began her investigation. Her probe included asking for documents from the district and speaking to four SFWMD staf f members: Robert Brown, assistant executive director; general counsel Elizabeth Ross; Ra y Palmer, section leader in the Real Estate section; and Jorge Patino, section administrator in the Right of Way section. Ms. Fuller also spoke with Deena Reppen, a former chief of staff at the district. On Oct. 4 she was named the legislative director for the Florida Association of Counties. The Nutcracker is a two act ballet with a score by Pyotr Ilyich Tchaikovsky and a libretto adapted from E.T.A. Hoffman’s story The Nutcracker and The Mouse King. The ballet originally premiered in 1892 at the Mariinsky Theatre in St. Petersburg, Russia. Our production features choreography by Melissa Waters, and is perfect holiday entertainment for the whole family. They are also a time to pay special attention to your health and the health of your family. Follow these tips to have a safer and healthier holiday season: Watch the kids: Keep your children with you at all times while you are shopping. Accompany and supervise your children in public restrooms. Have a plan in case you become separated. If your kids are old enough to understand, have a pre-designated spot to meet if you get separated. Teach children to look for people who can help, such as a uniformed security of cer, or a salesperson. Kid safety: Keep a watchful eye on your kids when they’re eating and playing. Keep potentially dangerous toys, food, drinks, household items, choking hazards (like coins and hard candy), and other objects out of kids’ reach. Learn what to do for children who are choking. Make sure toys are used properly. Wash your hands often: Keeping your hands clean is one of the most important steps you can take to avoid getting sick and spreading germs to others. Wash your hands with soap and clean running water for at least 20 seconds. If soap and clean water are not available, use an alcohol-based hand sanitizer. Stay warm: Cold temperatures can cause serious health problems, especially in infants and older adults. Stay dry, and dress warmly in several layers of loosetting, tightly woven clothing. Manage stress: The holidays shouldn’t cause problems with your health. Be aware of your actions, try not to over-commit or overspend. Try to balance your work, home, and play. Get support from your family and friends. Try to keep a relaxed and positive outlook. Travel safely: Whether you’re traveling across town or around the world, keep safety in mind. Do not drink and drive, and don’t let someone else drink and drive. Wear a seat belt every time you drive or ride with someone in a motor vehicle. Always buckle your child in the car using a child safety seat, booster seat, or seat belt according to their height, weight, and age. Be smoke-free: Avoid smoking and breathing other people’s smoke. If you smoke, quit today! Call 1-800-QUIT-NOW or talk to your health care provider for help. Get check-ups and vaccinations: Exams and screenings can help nd problems before they start. They can also help nd problems early, when the chances for treatment and cure are better. Vaccinations help prevent diseases and save lives. Schedule a visit with your health care provider for a yearly exam. Ask what vaccinations and tests you should get based on your age, lifestyle, travel plans, medical history, and family health history. Prevent injuries: Injuries can occur anywhere and some often occur around the holidays. Use step stools instead of furniture when hanging decorations. Leave the reworks to the professionals. Wear a bicycle helmet to help prevent head injuries. Fire Safety: Most residential res occur during the winter months. Keep candles away from children, pets, walkways, trees, and curtains. Never leave replaces, stoves, or candles unattended. Don’t use generators, grills, or other gasolineor charcoal-burning devices inside your home or garage. Install a smoke detector and carbon monoxide detector in your home. Test them once a month, and replace batteries twice a year. Handle and prepare food safely: As you prepare holiday meals, keep you and your family safe from food-related illness. Wash hands and surfaces often. Avoid cross-contamination by keeping raw meat, poultry, seafood, and eggs (including their juices) away from ready-to-eat foods and eating surfaces. Cook foods to the proper temperature. Refrigerate promptly. Do not leave perishable foods out of the refrigerator for more than two hours. Protect pets from rabies: Pets are considered family members. Keep them healthy and safe as well. Your pet should have regular checkups and be sure to keep rabies vaccinations upto-date. Do something positive for yourself and those around you and you will be happier and healthier! Passing on your observations to the Florida Breeding Bird Atlas (between Nov. 1 and July 1) will save the BBA II volunteers a lot of sleep, time and gasoline. The street address or location, date, and the breeding owl species observed is all that is needed. No one will be visiting your home and usually only one report of a species at a location will be necessary though 2016. For Hendry and Glades County nesting observations can be sent to Margaret England sta5birding@embarqmail.com. Information for other Florida counties may be sent to Rick West at RickLWest@aol.com. Barn Owls are the world’s most far ranging owls with up to 46 different races being described w orldwide. The North America form is the largest, weighing more than twice as much as the smallest race which is found in the Galapagos Islands. A Barn Owl is larger than a Screech Owl, but smaller than a Great Horned Owl. These medium-sized owls have long, rounded wings and a short tail. Their legs are long and the head is smoothly rounded, without ear tufts. They are pale with dark eyes and have a white heartshaped face with a mix of buff and gray on the head, back and underwings. At night they appear to be all white. Barn Owls are known locally as the “Ghost Owl” or “Monkey Faced Owl”. Females are more reddish and more heavily spotted on the chest than males. These birds don’t hoot the way most owls do; instead, they make a long, harsh scream or a soft purring call. They will make loud hisses when disturbed. The oldest know North American Barn Owl live to be at least 15 years and ve months old. Barn Owls are found in open grasslands, marshes, agricultural elds, forests, suburbs and cities. Their diet consists mostly of small mammals, particularly rats, mice, voles, bats, rabbits, and birds. They also eat insects and amphibians. The female makes a simple cup-shaped nest that she lines with her own regurgitated pellets, wood, and trigs which she shreds with her feet. These owls use their nest site which is built in a tree cavity, old building, abandoned machinery or rock crevice for roosting throughout the year. The female usually lays ve to seven eggs, but as many as 11 have been found in a clutch. The eggs are incubated for 30 to 34 days with the young edging at 55 to 62 days old. Share your visions and thoughts with your family and friends and ask for their input as well. 2. Set Goals and Prioritize: Its okay to say “no” sometimes. Saying yes when you should say no can sometimes leave you feeling overwhelmed. Family, friends and colleagues should understand if you can’t attend every party or participate in every activity. 3. Organize and Simplify: Try to nd ways to organize you activities and create a “to-do” list so you can check things off as you get them accomplished to help you feel more organized and productive during the holiday season. 4. Take Care of “You”: You must nd time to take care of yourself physically, mentally and spiritually. Go for a walk, get enough sleep, read inspiring literature, spend time with close friends to talk and laugh, listen to music, go outdoors, spend some quiet time alone, meditate, and try to be tobacco free. 5. Think Safety: Whether you are traveling long distances, hanging lights, or simply walking in a busy parking lot, it’s important to pay extra attention to the safety of you and your family around the holidays. 6. Try to Stay Financially Fit: We are all responsible for our own happiness and health during the holidays. Whether or not you have a good holiday is a function of your decisions and not the conditions around you. Try to make realistic nancial commitments and time commitments that you can keep this holiday season. 7. Try to Eat Well: There are a few things that you can do to keep things under control: Limit your portions, don’t go to a party hungry; steer clear of items high in fats; watch out for high calorie foods and beverages. Drink lots of water. Sample and taste new things, but try not to overdo it. 8. Stay Active: Find opportunities to stay active to help you feel better, more energized, focused and t for the demands of the season. 9. Get Connected: Encourage those you love to help you create meaningful traditions and routines that can be part of future holidays. Get in touch with extended family and old friends. 10. Explore New Experiences but Set Limits: Trying something new – especially a refreshing exercise, like Tai Chi. It is a great way to keep t, relieve stress, and meet new friends this holiday season. Read a new book, write in a journal, visit a library, study something new, and try to watch less TV. 11. Give: Commit random acts of kindness. Small gestures (that don’t cost anything except for your time) can make a huge difference in someone’s life. Other things you can do: volunteer, visit the elderly, read to a child, or donate clothes, toys, and food to a needy family. 12. Have Fun: Play, dance, sing, laugh, and enjoy. Experience the joy, excitement and wonder of the holiday season. The District-wide rainfall average of 0.29 inches in November was just 0.01 below the previous record low of 0.30 inches in both 1940 and 1944, based on District records since 1932. All 16 counties in the District were more than 1.5 inches below average for November, which is typically one of the driest months in South Florida. “With the bene t of above-average wet season rainfall, regional groundwater and surface water levels fortunately were in a position to ‘weather’ a record dry month,” said Susan Sylvester, SFWMD Chief of the Water Control Operations Bureau. “It is too early to assess the impact this record dry period will have on conditions and water levels.” Eastern Palm Beach County had the largest rainfall de cit in the District, with 0.69 inches of rain, representing a de cit of 3.46 inches, or 17 percent of average. The Upper Kissimmee Basin and Martin, St. Lucie and eastern Miami-Dade counties all recorded rainfall de cits of more than 2 inches for the month. The East Caloosahatchee Basin also recorded more than a 2-inch rainfall de cit while the Southwest Coast recorded a 1.88-inch de cit. Lake Okeechobee stood at 15.10 feet NGVD today, which is 0.30 feet above the historic average for this time of year.2012-2013 Dry Season ForecastSouth Florida is forecast to experience one of the few dry seasons having near-average rainfall in the past 14 years. Only two dry seasons, 19981999 and 2003-2004, have actually been about the historical average in that timeframe, with two above average and 10 below average dry seasons. The National Oceanic and Atmospheric Administration’s Climate Prediction Center forecast calls for equal chances of slightly above or slightly below average rainfall for the rst three months of the upcoming dry season. Among the of cial forecast highlights for the 2012-2013 South Florida dry season: Near normal precipitation is mostly likely during the rst part of the dry season, from November to February. A drier-than-normal trend may characterize March and April. Average dry season precipitation: 12 to 15 inches in the interior and west to 15 to 21 inches in the east. Long-term average winter temperature: 64 to 66 F in the interior and west to 67 to 69 F in the east. She was an award-winning artisian who was exceptionally v ersed in several mediums. She was known as a generous and kind-hearted person that freely gave of herself to help others. The Department is awarding seven domestic wastewater facilities as well as 13 drinking water facilities, recognizing the hard work and dedication of these facilities as examples that represent the best water treatment and conservation solutions the state has to offer. The award program judges three size categories within each plant type: facilities that serve less than 3,300 customers; facilities that serve from 3,300 to 50,000 customers; and facilities that serve greater than 50,000 customers. The competition is statewide, all participants apply at their own discretion and there is no guarantee of any winners due to lack of applications. Facilities go through a rigorous judging process, with every aspect of their operation scrutinized. The facility must maintain an impeccable history of recordkeeping and submission to the Department. Facility activities, such as malfunctions, maintenance or upgrades must all be documented and demonstrable to Department environmental specialists during unannounced inspection visits throughout the year. Facility upkeep is paramount, as well as making sure facility personnel have all of the proper, up-to-date certi cations and training on the latest water monitoring rules and techniques. Special to the Glades County Democrat Special to the Glades County DemocratStand Up to BullyingStudents and staff at West Glades School observed Anti-Bullying week during the week of Nov. 12–16. The themes for the week were “Stand Up to Bullying” and “Be the Change You Want to See in the World.” Students in K-4 and students in 5-8 attended separate anti-bullying assemblies on Nov. 12. They learned about different kinds of bullying, long and short-term consequences of bullying, and how to report bullying to adults. All WGS students signed an anti-bullying pledge. WGS also sponsored a “Be the Change” contest. Students could do a good thing and winners were awarded donuts, as was David Zavala, who correctly identi ed Mahatma Ghandi (the Indian philosopher and leader) as the original author of the phrase, “Be the Change You Want to See in the World. WGS also held an anti-bullying poster contest. Winners were announced on Friday, Nov. 16, when everyone wore blue in support of anti-bullying. The Poster Winners were Julissa Casiano (1st), Carson Williams (2nd), Hailey Hernandez (3rd), Alyssa Herrell (4th), Jade Banky (5th), Aries Ruark (6th), and Kaylee Sabella (7th). Students and their families enjoyed visiting booths, playing games, and eating chili and other goodies. The West Glades Band provided musical entertainment. It was a fun night for all! Pastor Arlen and Loretta Cook served for over 10 years as pastor of Northside Baptist Church in Okeechobee. In June, he gave his retirement notice, intending to buy a summer home in Virginia near their families. But before they left the area, on Sunday, Aug. 19, he was contacted to preach that day. He explained he was retired from pastoring, but would serve as interim pastor. God has so wondrously blessed his ministry here. On Sunday, Nov. 25, Pastor Cook accepted the call to pastor a wonderful group of people at Buckhead Ridge Baptist Church. Pastor puts off retirement to serve BHR Baptist Church Special to the Glades County DemocratPastor Arlen Cook and his wife Loretta are excited about the ministry at the Buckhead Ridge Baptist Church. No one was injured as about $1,000 in property damage was done late Monday after a toaster caught on re on Linda Road in Buckhead Ridge, re of cials said. Two units and four remen from Okeechobee County Fire Rescue assisted Buckhead Ridge Volunteers in the re call. Smoke was the big problem caused by the re, Lt. Everette Wooten said. Firemen worked to ventilate the home to clear the smoke. The re was contained to the kitchen of the home. The re crews were dispatched just after 11 p.m. and were on the scene for about an hour. Glades County Fire Chief Bob Jones said re crews in Lakeport battled two mobile home res last week but that no injuries were reported. The Lakeport res are being investigated as arson. A reward has been offered for information about these res. No injuries in Buckhead Ridge re

Family Lands, Ms. Fuller made reference to the district issuing Austin and Rosa Lee a right of way permit for the L-59 canal in 1961—the same year Austin and Rosa Lee entered into an eminent domain agreement w ith the district for 7,500 acres of their land south of the L-59. The L-59 stretches from the Indian Prairie Canal to the Kissimmee River. In 1972, wrote Ms. Fuller, the law changed and Austin and Rosa Lee were required to get a consumptive use permit for the L-59. In 1978, continued the inspector general, the SFWMD issued Austin and Rosa Lee that permit “... which applied to their property until the death of the last surviving individual, Rosa Lee Pearce.” It’s at this point that things get murky. Public records requests were made with both the water management district and Ms. Fuller that asked for that consumptive use permit. After several months, this newspaper has yet to receive that permit. Why? The newspaper’s investigation indicates that answer is simple—that document doesn’t exist. It never did. On Nov. 16 the water district replied to another request for that permit by stating in an e-mail that: “After an in-depth review, the District has no record of a 1978 permit with A ustin and Rosa Lee Pearce as applicants. There is, however, a 1978 permit to Pearce Ranch Inc., which is attached.” Austin and Rosa Lee had no connection to Pearce Ranch Inc. which belonged to J.O. Pearce. That response goes on to say that other permits can be found on the district’s e-permitting database. So, if there is no consumptive use permit how could Ms. Fuller refer to it in her response to Mr. Collier and Mr. Story? On Nov. 20 Patrick Gillespie, DEP press secretary, replied to that question by saying: “Upon further review of the documentation, the Department determined that the 1977 permit in the name of D.L. Pearce is the permit that applies to Austin and Rosa Lee Pearce family property. There was confusion about the property ownership of Pearce Ranch, Inc., and D.L. Pearce Ranch/L Cross Ranch, which led to an inaccurate citation in the Department’s response in the Oct. 2 letter to Twin Sisters’ Family Lands. It should be noted that this newspaper has never talked with Ms. Fuller. Instead, we w ere required to go through Mr. Gillespie w ho then apparently took our questions to Ms. Fuller and sent us her responses.Permit, permit ... who’s got the permit?After receiving that response from Ms. Fuller, this newspaper made another public records request from the SFWMD and received a letter that Ms. Fuller apparently didn’t see. That March 9, 1987, letter from D.L. Pearce to the district’s Linda Horne states: “At this time, please waive Permit Number 22-0052-W. Said permit belongs to some other Pearce.” This was the permit that Ms. Fuller and the district apparently believed was issued to Austin and Rosa Lee. So, if Austin and Rosa Lee didn’t have this permit and D.L. Pearce didn’t have the permit, who did? As it turns out the permit in question was issued to Pearce Ranch, Inc., which does not apply to Austin and Rosa Lee or to D.L. Pearce.Where is the truth?With all this in mind, just where is the truth sought by Twin Sisters? Austin and Rosa Lee entered into the eminent domain proceedings with water managers in 1961 that applied to their 7,500 acres of land south of the L-59. By going through eminent domain, Austin and Rosa Lee were assured of ood protection for the families along the 8-mile canal, as well as the right to use water from the canal for irrigation purposes. Eminent domain is essentially the taking of someone’s land by a governmental agency after paying just compensation to the landowners. So, what was “just compensation” to Austin and Rosa Lee? According to the eminent domain document, they were paid $22,150. After a six-month investigation by this newspaper, it has been learned that they also received some other very important compensation: the water in the L-59. The eminent domain document plainly states: “The petitioner (SFWMD) stipulates and agrees to grant the parties defendant (Austin and Rosa Lee) a “Permit” for installation of headers on the two culverts constituting the culvert crossing. The purpose of these headers is to give better water control to the defendant and other owners served by the Levee 59 and its borrow canal.” The document also states that this applies to Austin and Rosa Lee’s “... heirs, successors or assigns... .” In short, their descendants. In essence, the descendants of Austin and Rosa Lee Pearce control the water in the L-59 canal.More errorsIn subsequent public records requests by this newspaper, Ms. Fuller stated that this eminent domain agreement no longer applies and that state statute supersedes that agreement. However, an eminent domain attorney disagrees, without speci cally speaking to this issue, with that statement. Orlando-based attorney Bruce Harris answered, when asked if state statute trumps eminent domain, “The answer is probably no.” “The power of eminent domain is inherent in government. Everything we own is subject to sovereign—the government’s right to take it,” he said in a phone interview Monday, Dec. 3. “There are limitations on eminent domain and that is it has to be for public purpose, and you have to pay for it.” He also explained that eminent domain “continues in perpetuity.” The only time eminent domain can be changed or amended is through a court of law. And, to date, the eminent domain document between Austin and Rosa Lee and the water management district has never been taken before a judge to be amended. Even Austin and Rosa Lee’s death does not change eminent domain. Mr. Harris said unless the document states otherwise, or it’s taken before a judge, eminent domain remains in full effect. This then means the agreement between Austin and Rosa Lee and the district has not changed, and whatever was agreed to in that document applies still today. With all this in mind, why did Ms. Fuller say state statute supersedes eminent domain? Why did she allude to a non-existent consumptive use permit? Why didn’t the SFMWD tell her that permit was never issued? The district never had to issue it because they stipulated in that eminent domain document that Austin and Rosa Lee and their descendants controlled the water in the L-59, so why didn’t they advise the inspector general of that fact? Because Mr. Brown has been with the district since 1987, and headed up the district’s service center in Okeechobee for several years, he knows the Pearce family and the issues surrounding the L-59 canal. This newspaper asked him why didn’t he tell Ms. Fuller about the non-existent permit? Through an e-mail Mr. Brown replied by saying: “During my tenure at the District, including Okeechobee Service Center director from May 2003 to Nov. 2004, I have had the privilege of meeting many Pearce family members and am knowledgeable on present-day permit issues. However, many of the reporter’s questions reference issues that occurred more than 50 years ago, which today can make their legal interpretation challenging, even to family members. “Following a citizen letter to DEP, that agency’s inspector general requested historical Pearce-family permit information and additional clari cations, which were addressed by District staff. All relevant information was submitted to DEP’s inspector general’s of ce to facilitate their review and citizen response, which was provided in a letter dated Oct. 2, 2012. The South Florid a Water Management District remains committed to transparency and managing an effective regulatory program.” Which brings us back to Ms. Fuller’s alleged investigation of some ve months. While she did request hundreds of pages of documents, the only people she spoke to were the ve mentioned above. And, according to a public records request of her phone and e-mail records, she only spoke to them on one occasion. While Ms. Fuller did speak with some district staff, she has yet to speak with an y member of Twin Sisters’ Family Lands. Antiques of Glades CountyBy Austin Moorhouse Special to the Glades County Democrat The concept of a typewriter began with Remington who produced rearms in 1894. The typewriter was actually invented by Franz X. Wagner, a German-American immigrant who showed it to Thomas T. Underwood. Underwood supported him in producing the typewriter in 1896. For almost 100 years the typewriter was an essential piece of of ce equipment until the advent of the of ce computer in the early 1990s. On Nov. 8, 2012, Mr. Larry Lucky who is currently retiring from the Of ce of Property A ppraiser for Glades County sent this letter to Mary Booher of the Glades County Library. Larry writes: Dear Mrs. Booher: I’ve given much thought of what to do with the old Royal typewriter here in my ofce. I consider this typewriter to be very unusual and unique since it has a 36-inch carr iage and support feet to accommodate that carriage. I’ve never seen another typewriter with that extraordinarily large carriage. We veri ed it was made around the early 1940s by the Royal Typewriter Company in Camden, New Jersey. It is quite historical because of all the Glades County Tax Rolls that were typed on it before World War II and until the modern era of computer implementation in Glades County. Otherwise, it would have no value and would be destined to the junk heap. This old typewriter with County inventory #140 on it is the one that Mrs. Twitty used in the Property Appraisers Of ce for a quarter century before I was elected in 1984. The typewriter has been here all the time that Mr. Sealy was property appraiser and much of the time that Mr. Scott was property appraiser before him. There have been only three elected property appraisers since Glades County was formed in 1921, although Judge Lentz was appointed to serve until the rst election. Mrs. Jeanette Twitty told me that she had manually typed out the Glades County Tax Rolls on this typewriter until Glades County came into the modern age of computers. There are others who have shown interest in this old typewriter but, I felt that the library’s small museum was the appropriate place for it. Please keep it for all of us in Glades County and should you lose interest in it in the years to come perhaps, another museum would be interested in its unique “roll” in Glades County history. It was occupied for more than 2000 years, from before 450 B.C.E. until about 1700. The Mayan Indians of Fort Center may have been cultivating maize centuries before it appeared anywhere else in Florida. Fort Center is a complex of earthworks, mounds, linear embankments, middens, circular ditches and an arti cial pond occupying an area approximately 1 mile long and a half a mile wide.
