The Florida State Fund Committee, which is comprised of representatives from each Friends of the NRA Committee in Florida, has funded over 420 grants, for more than $1,651,750 in the past 19 years. Over 81 percent or $1,337,917, of the funds raised has been used in support of Youth Programs, Firearms Training and Education & Safety. This equipment includes much needed targets, bows, and accessories for their Archery Club, as well as the equipment needed to 4-H shooting sports program receives help from NRA grantSee NRA — Page 20 Water managers accused of ‘selective enforcement’ of rulesBy Eric KoppSpecial to the Glades County Democrat Information has come to light that actions o f a local cattle company on property being leased from the South Florida Water Management District (SFWMD) are apparently accepted by water managers, even though they may violate the terms of that lease. These actions by the Old River Cattle Company of Okeechobee include baling hay and, at one time, using water from the L-59 canal without a permit from SFWMD. Numerous phone calls were placed to the SFWMD seeking comment and answers to questions but none have been returned. The Old River Cattle Company is currentl y leasing 4,701 acres of non-contiguous parcels in Glades County. And while it may appear to be an innocuous violation, it is stated on the rst page of that lease that: "Lessee may utilize the premises solely for the purpose of cattle grazing in accordance with the terms, conditions, covenants and provisions of this lease and those incidental uses which are directly related thereto and approved in writing by lessor in lessor's absolute discretion." No language could be found in that lease that permits hay baling. On Dec. 13, 2011, SFWMD extended Old River's lease until March 14, 2022. Water managers also signed 10-year lease extensions in December for James and Beatrice Prescott, Elsie Lanier, Otis P. Clemons and Alis a Sherman. They have large variety of calls that can be heard over long distances. They are commonly recognized by their loud gull-like “jay, jay, jay” alarm call which increases in speed if the bird becomes agitated. Blue Jays also make clear whistling notes and gurgling sounds. They frequently mimic hawks including Red-shouldered Hawks. One of their other calls sounds like an old squeaky handoperated water pump. Their rarely recognized “whisper song” is a soft quiet vocalization made up of clicks, chucks, whirrs, whines, and elements of other calls. This singing may last two minutes or more. Blue Jays are a large, crested songbird with a broad, rounded tail. They are smaller than crows and larger than robins. Their crest may be fully raised when they are excited or aggressive. The crest bristles up like a brush when they are frightened and is attened to the head when they are resting or among other Blue Jays. The oldest banded Blue Jay lived to be 17 years and 6 months old. These birds are lavender-blue to mid-blue w ith white or light gray under parts and white face. They have a black border behind the crest and U-shaped black collar around their neck. Males and females are similar in size and plumage. Their bills, legs, and eyes are black. Blue Jays prefer eating acorns, seeds, and nuts. At feeders, they often select sun ower seeds rst before eating other seeds. They also eat insects, bird eggs, nestlings, and small animal prey such as toads or rodents. Blue Jays are found in a wide variety of habitats and will build a bulky nest 10 to 40 feet above the ground in a tree. This nest is made from twigs, pine needles, Spanish moss, paper, and debris. The female will lay four to ve greenish, blue, or buffy eggs spotted with brown which she incubates for 17 to 21 days. Both parents feed the young until they edge at approximately three weeks of age. Blue jays will be one of over 135 bird species that photographers and birders look forward to seeing during their trips to area birding hotspots in Hendry and Glades County during the March 27 31 Big “O” Birding Festival. This festival will also offer workshops and programs at the Port LaBelle Inn as well as live Birds of Prey demonstrations, a silent auction, photo contest, and displays by local photographers. Attorney claims proposed changes in rules fall short of meeting Florida StatuteBY ERIC KOPPSouth Florida Water Management District (SFWMD) governing board members were presented a resolution Thursday, March 15, that claimed to bring their land leasing program into line with state statutes but, according to an attorney, it falls short of that mark. SFWMD Assistant Executive Director Robert M. Brown presented the resolution at the district’s March 15 meeting in West Palm Beach. He said the proposed resolution will make the district’s lease program “more transparent to the public.” But, does it? According to attorney Chester Brewer, the answer is no. As he addressed the board Thursday afternoon, Mr. Brewer alluded to a statement in the resolution that calls for the district to accept competitive bids for their property when an existing lease expires. The resolution then goes on to say: “... unless the governing board approves a waiver of competition.” In short, that means if the board wants a lease holder to remain a tenant, the board can waive the competitive process and the lease could be extended. “The statute demands competitive bidding with notice. The statute does not provide any exemption for the mandate that requires competitive bidding,” said Mr. Brewer. “That language must be taken out if you’re trying to comply with the statute.” Mr. Brewer was at the meeting to represent Glades County ranchers and property owners Mark Hunter and Patricia Pearce. “That just gives you the right to not follow the statute,” Mr. Pearce told the board. The district has come under re recently for renewing leases without putting them out for bid. Florida state statute 373.093 says the district can lease their land as long as it is consistent with the land’s intended use and “for the best price and terms obtainable, to be determined by the board.” Some 20 leases were renewed by the board in 2011. Among those were area leases held by Alisa Sherman, Elsie Lanier, James and Beatrice Prescott, Otis P. Clemons and the Old River Cattle Company. The lease held by Mrs. Sherman is on property in Highlands County and, according to records, it was advertised in area newspapers prior to it being signed on December, 13, 2011. However, no ads can be found regarding the other four leases. The proposal discussed Thursday would have no real effect on these existing leases. In response to that question, SFWMD general counsel Carolyn Ansay replied with an e-mail that said: “If the resolution is adopted, it will not unilaterally alter the legal rights or obligations contained within any existing lease agreement. Any existing lease agreement can only be altered or terminated pursuant to the terms contained within the document.” The resolution goes on to state that, in accordance with 373.093, the district will publish their intention to lease in a newspaper in the county where the land is located and other places as the board determines, which complies with the statute. Also, the proposed resolution would allow the district to give an existing tenant a right of rst refusal on the lease if the tenant: 1. has been in substantial compliance with the existing lease; and, 2. submits a responsive and responsible bid. “What is substantial compliance? That’s like being a little bit pregnant,” offered Mr. Brewer, in a phone interview Friday. The resolution goes on to state that before an existing tenant can exercise the right of rst refusal, they must agree to “... pay rent at 10 percent over the highest bid from another responsive and responsible bidder.” Governing board member Glenn J. Waldman questioned that part of the proposal. “They (existing lease holders) will have to overbid — it may be too much money,” he said. “Maybe we ought to think again about the right of rst refusal. This may cause someone to overpay.” While he didn’t necessarily agree that an existing lease holder should have to pay an added 10 percent, Mr. Pearce asked the board to leave the right of rst refusal in the resolution. “If I sell my property to the district and I get a 10-year lease but I don’t get the bid, then I have to leave. The right of rst refusal has to be in there,” he said. When his allotted three minutes were about to expire, Mr. Pearce looked over the top of his glasses and asked: “Is the district going to correct those leases that were done completely wrong?” No one answered. The contest pits 99 of the top bass anglers in the world, including shing legend Kevin VanDam and 2012 Bassmaster Classic champion Chris Lane, against each other as they compete for the $100,000 prize and a coveted spot in the 2013 Bassmaster Classic set for Feb. 22-24 in Tulsa, Okla. Glades at a Glance The U.S. Army Corps of Engineers has postponed the closure date of the Moore Haven Lock after taking into consideration additional concerns expressed by local business owners. The lock will now be closed, effective J une 11, to install the Manatee Protection System (MPS) on the gates. The adjustment comes after local business owners expressed additional concerns about the lock being closed during the height of boating season on the Okeechobee Waterway and the resulting economic impacts. The work on the lock is expected to continue for approximately eight weeks. “Finding the optimal time to close down the lock requires a balancing act between risks and impacts,” said Jacksonville District Commander Col. Alfred Pantano Jr. “While there is no way to nd a time that will be preferred by all, we do believe that we have found the time that will allow the lock to remain open during boating season, while also allowing work to be completed prior to the height of hurricane season.” Installation of the MPS is part of the Manatee Pass Gates project. The primary goal of the project is to safeguard Florida’s endangered manatees at water control structures and navigation locks by modifying these structures with a MPS. Using a set of acoustic transmitters and receivers, the MPS detects the West Indian manatee and prevents the gates from closing and harming the protected animal. Above-ground xtures have already been installed at Moore Haven Lock. The remaining work includes dewatering the lock, installing the MPS to the lock gates, testing the system, and re-watering the lock. Even though it was a couple of days early, the local senior group the Keenagers, had a great time in fellowship, visiting, eating Irish food and learning about the beautiful country of Ireland. Irish blessings were at each place, and following a luncheon of corned beef and cabbage (plus other pot-luck) shamrocks taped under chairs indicated winners of door prizes--some inspirational and some Irish inspired--all fun. They all learned a little more about Ireland and St. Patrick following a 25-question quiz. Bet you didn’t know that St. Patrick w asn’t Irish at all--his dad was Italian and his mom was Scottish; and he was born in Scotland. His real name was Maewyn Succat not Patrick. That came later. Of course practically everyone knew Ireland’s nickname (Emerald Isle), where leprechauns bury their gold, (end of the rainbow), Ireland was the rst country in Europe to grow potatoes, (Irish potatoes of course), and the Irish dance that became popular in America in the early 19th century (Irish jig). Forty percent of the USA presidents were of Irish ancestry. Almost every Keenagers’ hand went up when asked how many present had Irish ancestors. Kirby Sullivan (Irish name and possible ancestors) has been to Ireland twice, and knew most of the answers in the quiz--including who created the Book of Kells, a 1,000 year old illustration of the Bible, which he has seen. The group still doesn’t know though, if the U.S. Heavyweight boxing champion, John L. Sullivan, was a relative. No Irish program would be complete without “When Irish Eyes are Smiling” and “Toora, Loora, Loora,” and Tom Shanahan played his guitar and beautifully sang them both. Shanahan is a nice Irish name, and he said he’s not Irish, but he surely can sing as well as any Irishman! Following the program, Oleta Richardson offered prayer for all the requests. Bobbi Brown announced that the April meeting will be a sh fry at her house, complete with cheese grits. By Eric KoppINI Florida MOORE HAVEN -A Moore Haven woman has been arrested after being accused of stealing more than $6,000 in cash from her employer. Marla Lee Johnson, 38, was arrested Thursday, March 15, on felony charges of grand theft and fraud-swindle. She was booked into the Glades County Jail under a total bond of $7,000. Jail records indicate she has since been released on bond. An arrest report by Detective Sergeant Steve Harris, of the Glades County Sheriff’s Of ce (GCSO), stated that Johnson was allegedly taking between $50 and $350 in cash daily from her employer. She was a cashier at a local business, he added. Sgt. Harris went on to state that Johnson would reportedly create fraudulent transactions then take the cash from the register. The thefts started in January, the detective added. According to the investigator’s report, Johnson didn’t realize that much mone y had been taken. Cashier accused of theft By Eric KoppINI Florida MOORE HAVEN -A Moore Haven man is being held in the Glades County Jail following his arrest for the alleged theft of a washing machine and clothes dryer from a man’s home. Randall Lee Moseley, 55, Meadow Brooke, was arrested Thursday, March 15, on felony charges of burglary of an unoccupied dwelling, grand theft, dealing in stolen property and exploitation of the elderly. He was also charged with the misdemeanor of resisting a law enforcement of cer without violence. He is being held on $26,000 bond. An arrest report by Deputy Anthony Blachowski, of the Glades County Sheriff’s Of ce (GCSO), indicated that a witness apparently saw some people remove the appliances from a home. As he followed leads in the case, Deput y Blachowski talked to a man who said he bought the washing machine and dryer from Moseley for a total of $10. The man reportedly told the deputy he helped Mosele y remove the items from the home because he believed they were junk. The deputy’s report stated that the man offered to cover the appliances and store them in his fenced yard until they could be picked up. Deputy Blachowski’s report does not indicate if the washing machine and dryer had been returned to home of their owner. Man accused of stealing appliances

373.093 states that the District must advertise their intention to lease the land. That ad is required to be published in a newspaper in the county in which the land is found, and that the ad should run once each week for three w eeks. These leases also require the lease holders to obtain all necessary federal, state, local, regional and other governmental approvals and permits. However, SFWMD records show that no water use permits were obtained for the Glades County property until nine months after torrential rains from Tropical Storm Fay caused the L-59 canal to ood landowners in the area, as well as Buckhead Ridge. The L-59 canal runs from the Indian Prairie Canal to the Kissimmee River. Records show that a now-defunct company known as Pomcor purchased stocks in companies owned by J.F. Pearce (Indian Prairie Groves, Sixty Nine Ranch and J.F. Ranch, Inc.) then formed Pomcor-458 Acres, LLC, and leased the 4,701 acres to Ricou Hartman. SFWMD then acquired the acreage, now referred to as the Pearce-Pomcor Tract, from Pomcor. Ricou Hartman, who owns Hartman Realty in Palm City, made a lease with Pomcor and the District then assumed that lease in May of 2006. The District renewed the lease with Mr. Hartman on March 21, 2007, and again on Feb. 12, 2008. That lease was again renewed with Mr. Hartman and another partyOld River Cattle Companyon June 12, 2008. Mr. Hartman is listed as a manager of that company. State records show that Louis E. Woody' Larson Jr. is the principal agent of the Old River Cattle Company. Mr. Hartman and Jeffrey O. Clemons, of Okeechobee, are listed as managers. SFWMD records show that Mr. Hartman did not receive a water use permit for the property until May 14, 2009, which was after the culverts had been removed following the ooding event brought on by Fay. And despite these two documented lease violations, the District's real estate division issued the extensions to Old River and Mr. Hartman. Armed with the new extensions, these lease holders can now apply for federal funds under the Environmental Quality Incentives Program (EQIP). For Old River, if they are approved, their EQIP funds would total $168,000. Records show Old River is paying a total of $55,380.92 a year for the three parcels. That breaks down to about $11.79 per acre. Jeffrey Woods, the assistant state conservationist for nancial assistance programs with the United States Department of Agriculture's of ce in Gainesville, said he could not release the names of lease holders who have applied for EQIP funding. However, if they are approved for EQIP funds their names can be released. When the District acquired the PearcePomcor Tract they also acquired 243 acres of citrus grovesa majority, of which, had already been destroyed due to citrus canker. A photo of that area taken by the Florida Department of Agriculture and Consumer Services on Feb. 24, 2012, shows the groves are no longer there. But, that same photo also shows a number of round bales in a pasture being leased by Old River Cattle Company. According to a Glades County rancher who has land in the middle of the three non-contiguous parcels owned by the District that is being leased by Old River, he has seen someone cut hay, bale it and haul it off the property. He said the last time hay was cut there was in February of this year. "Most of the hay I've seen go out is on a semi or gooseneck. The semis and goosenecks are going down range and off property and toward Okeechobee County, but I haven't followed them," said rancher John Austin Collier. "They've been hauling hay and cutting hay here on different elds at least once a year from 2006 until 2012weather permitting. But, I've seen very little used on this place." When asked if Old River representatives should have known that hay was being cut on their property, Mr. Collier said, "if I saw it, they should have seen it." Mr. Collier also has a cattle grazing lease with the District, similar to Old River's. But, he continued, he is not allowed to bale hay under that lease or use water from the L-59 canal. Ironically, said Mr. Collier, the property leased by Old River was actually offered to Twin Sisters Water Use Area. Twin Sisters is made up of Jeanette Peeples, Byron and Janet Storey, Mr. Collier and his wife Kim, and their families. "In a proposed dispersed storage settlement, Ruth Clements (SFWMD real estate specialist) offered us the lease on the property as part of a settlement over a ooding issue but we declined. We weren't looking for a grazing lease," said Mr. Collier. "And, we were not looking to interfere with the lessees in any way, shape or form." He went on to say the Twin Sisters property, as well as nearby property belonging to D.L. Pearce and Mark Hunter Pearce, has been ooded periodically in the past 20 years due to three culverts on the L-59 canal that were in disrepair. But the worst ooding episode came in August of 2008 when Tropical Storm Fay dumped copious amounts of water across the area. Some areas saw as much as 25 inches of rain. Mr. Collier said there is one parcel, of the three non-contiguous parcels, that had water owing from the L-59 through those three culverts onto 2,500 to 2,700 acres from 2006 until 2008 with no consumptive use permit and no oversight. He went on to say Twin Sisters will be asking Herschel Vineyard, secretary of the Florida Department of Environmental Protection (FDEP), to review all permits issued on the L-59 canal, all ooding events and all actions taken by the District pertaining to permits and ooding from 1992 until the present day. "Hopefully, this review will avoid any litigation with the water management District and we'll be able to lay this issue to rest once and for all," added Mr. Collier. After that " ooding event," Mr. Hartman applied for and was given a water use permit on behalf of the Old River Cattle Company. Mr. Collier pointed out that since that 2008 ooding event the District took the culverts out of the right of way of the L-59 and that the current tenants have had to rely on water holes, artesian wells or 2-inch wells for waterthe same way Twin Sisters property owners and the Pearce families have had to for the last 20 years. Still, despite all of this, the District maintains that Old River "... is meeting the District's property management needs and is in good standing at this time," stated Gabriel Margasak, a member of SFWMD's media department, in an e-mail. He also stated that SFWMD staff routinel y inspects the property and has found that the land is in good condition. But, scoffed Mr. Collier, it's odd that water managers inspect this land and have periodic y overs in helicopters yet they have failed to see the large round bales of hay dotting the landscape as well as the 2,500 to 2,700 acres of property that was being irrigated without a consumptive use permit. "They only see what they want to see, enforce what they want to enforce and the y hold others accountable without ever holding themselves accountable," he added. Glades County 4-H is extremely grateful to the NRA for this grant! 4-H is a non-formal, practical educational program for youth. It is the youth development program of Florida Cooperative Extension, a part of the University of Florida IFAS. 4-H is located in every county in the state of Florida and is open to youth ages 8-18 (as of September 1, 2011) without regard to race, color, national origin, religion, gender, disability, or handicap. On Saturday, March 10, 4-H Archery Club members from across the state of Florida competed at the 4-H State Competition in Newberry, Fla., at the Easton Newberry Sports Complex. Glades County 4-H Archery Club had 17 of the 181 contestants participating in the contest. Each archer had to shoot 40 arrows in three different categories: FITA, eld, and 3-D. At the end of the day Glades County 4-H member Bronson Bass quali ed for the State Team that will travel to Grand Island, Neb. in June. In addition, Lane Prevatt & Tanner Mathis were named as the team alternates.
