And, according to the Florida Attorney General’s Of ce and the 1st and 4th District Courts of Appeals (DCA), the answer may be “yes.” But at the SFWMD governing board’s Oct. 13 meeting, they were told by the district’s chief real estate specialist and general counsel that SFWMD policy allows for lease renewals to be offered without going out for bid. “A lease may be renewed without competitive process,” SFWMD general counsel Carolyn Ansay told the board members on a video of the meeting. But, board member Glenn J. Waldman questioned Chief Real Estate Specialist Ruth Clements about the policy. When Mr. Waldman, an attorney, continued to doubt the policy Ms. Clements repeated that, in accordance with SFWMD policy, the lease does not have to go out for bid. However, Florida State Statute 373.093 states: “Before leasing any land, or interest in land including but not limited to oil and mineral rights, the district shall cause a notice of intention to lease to be published in a newspaper published in the county in which said land is situated and such other places as the board may determine once each week for three successive weeks (three insertions being suf cient), the rst publication of which shall not be less than 30 nor more than 90 days prior to the date the board executes the lease, which said notice shall set forth the time and place of leasing and a description of the lands to be leased.” A check of newspapers in both Okeechobee and Glades counties showed that SFWMD never ran a legal notice indicating that the property was coming up for lease. Ms. Clements told the board it needed to vote on several lease renewals—including the 4,701-acre lease of the Glades County property to the Old River Cattle Company of Okeechobee. FHP: Heavy fog compromised driving conditions, led to wreckBY JOSE JESUS ZARAGOZA Glades County DemocratSerious, but not critical injuries resulted following an early morning wreck in Glades County on Wednesday. Emergency crews arrived to nd a man trapped inside one of the two vehicles involved in the wreck. He had become entrapped, but crews were able to remove him in time to provide aid and stabilize his injuries. The accident happened at approximately 1 a.m. on a stretch of highway on U.S. 27 and C.R. 733. According to the subsequent Florida Highway Patrol report, two vehicles, a 2011 Volvo and a 1989 Kenworth trailer, were driving north on U.S. 27, on the right travel lane, one in front of the other. The visibility had been heavily compromised due to thick fog blanketing the roadway. The driver of the trailer, Juan Gutierrez, 50, of Miami Beach, was traveling below the posted speed limit after the fog conditions worsened. The driver of the Volvo, Matthew M. Murphy, 33, of Tampa, failed to take note of the vehicle ahead of him and crashed into the rear of the trailer. Both vehicles came to a nal stop facing north on the roadway, but the Volvo car suffered the worst of the damages, pegged at $20,000. Permits will be available on a rst-come, rst-served basis to individuals 16 years of age or older. BY RANDY SMITH SFWMDIn response to improved regional water resource conditions, the South Florida Water Management District (SFWMD) Governing Board today rescinded all emergency water shortage orders for South Florida, many of which had been in place since March this year. The Governing Board also declared a water shortage warning today to encourage vigilance and voluntary cutbacks. Frequent swings in South Florida’s water conditions — and the drier-thannormal La Nia forecast — indicate a return to w ater shortage is possible. “It’s a relief to see an improvement to water supplies throughout the region, especially considering the drier-than-normal forecast for the next few months,” said SFWMD Governing Board Chairman Joe Collins. “We continue to encourage people to conserve water and be mindful that there is still a chance that dry conditions will return in the spring.” The District’s 16-county region remains under permanent conservation measures with the YearRound Irrigation Rule that limits landscaping to two or three days per week based on location. Permitted water users such as nurseries, agriculture and utilities are required to continue following the terms of their permits. Improved Conditions The dry season that stretched from October 2010 until June 2011 was one of the driest on record and required mandatory, emergency cutbacks to protect water resources from serious harm and safeguard the water supply. The District received 38.2 inches of rain during the June-to-November wet season, which is 4.52 inches above normal and compensated for the signi cant rainfall de cit during the preceding dry season. The record-setting 9.8 inches of rain in October was two-and-a-half times the average for the month and resulted in localized ooding. Lake Okeechobee, the Kissimmee Chain of Lakes, the Water Conservation Areas and groundwater levels improved dramatically in recent weeks. “The District is storing as much water as possible given the forecast for below-average rainfall in the months ahead, while also balancing ood control responsibilities. Given Florida’s long history of weather extremes and recent and dramatic swings from dry to wet conditions, we remain on alert for a drier-than-normal dry season,” said Tommy Strowd, SFWMD Director of Operations, Maintenance and Construction. “Conserving water and following the Year-Round Landscape Irrigation Rule remain key to stretching supplies.” October’s storms did signi cantly bene t Lake Okeechobee, a key backup water supply for millions of South Floridians. The lake stood at 13.79 feet NGVD today, and continues to rise above last year’s level. The current level is more than 2.5 feet higher than on Sept. 30. Born in Lake Placid, he spent his lifetime around Lake Okeechobee as a commercial cat sh sherman. Alfred was a member of Maple Grove Baptist Church in Lakeport. He is survived by his wife of 44 years, LaLainie Collier; step-sons, Larry (Doris) Williams o f Lakeport, Donald Williams of Moore Haven; step-daughters, Kathy Snook of Lakeport, Mar y Alice (Ray) Ford of Birchwood, Tenn.; seven grandchildren; seven great-grandchildren; brothers, Allan (Nina) Collier of Lake Placid, Charles (Barbara) Collier of Lakeport; and a sister, Thelma Able of Baker, Fla. He served his country proudly in the United States Army from 1968 until 1983 then he returned to Moore Haven before residing in Clewiston until his death. On Friday, Nov. 4, 2011, at 3:15 p.m. Jesus Christ spoke to him that his time in this painful earthen vessel is over, come to me and rest in my presence forever with a glori ed body. Michael Luke Mazzina, 65CLEWISTON — Born Sept. 27, 1946, in Clewiston, to parents Guido and Gloria Mazzina, Michael Luke Mazzina was a life long resident of Hendry County. Not long after his arrival his family welcomed his sister Quita Mazzina, who still survives him. As a child Mike was always active in sports. In High School he excelled as a student and shined as an Elite Athlete in several sports. After High school Mike attended the University Of Florida and Graduated top of his class with a B.S. in Marketing. Immediately after college he was drafted to the United States Army where he spent much of his Duty in Vietnam as 2nd LT. After surviving hell on earth he returned home to marry his soul mate, Terry Jean Moore and created their heaven on earth. In his late twenties Mike took a career at U.S.S.C where he was Director of Purchasing for more than thirty years. In 1981, after years of trying to have children, Mike and Terry welcomed there rst child into the world, Laquita Michelle Mazzina. One year later they welcomed there son, Michael Luke Mazzina ll. Both children were deeply wanted and unconditionally loved. Mike spent his years as a father and husband shing, hunting, camping, playing and teaching sports, and gol ng. A mans man, best friend, provider, and supporter Mike was well known for his generosity in the community. Mike would give you the shirt off his back, the shoes off his feet, and the last Busch Light in his cooler and never expect anything in return. He stood up for what was right, stood behind those he loved, and wore a set of shoulders that could carry any load. Just when he thought his days of raising kids were through, along came his most prized possession, his Grandbaby Mia. Mia brought a brand new kind of smile to his face. A few years later Mia’s little brother, Brayden was born and quickly followed by his cousin Michael Luke Mazzina lll, known as Lil Mikey and just recently, Grandbaby Aleigha. Mike has many people that call him father and he did just that for every single one of them. Last names didn’t matter to him nor did rst impressions, second chances were what he was know for giving and in some cases third, fourth, and fth chances. The man never judged or convicted only loved and cared. He leaves behind a sense of responsibility and expectation in every single person who he cared for and loved to maintain, man up, get along, and most of all as he would always say, “Just Be Cool”. He was more than a man, He was a hero and always will be a Hero. SAM S. THOMAS, PH. D.+ Saint Martins ChurchA lady called me one day and said, “You gotta help me!” She had decided to quit smoking and made a promise to God that she would do it. “Now I’m going nuts,” she said. “I ght with my husband, I can’t stand my kids, I am at wits end,” and on and on. I asked her, “Why did you make such a promise?” She thought it would help her quit and was trying to give herself a boost because she knew it was going to be very dif cult. Tobacco is the number one addiction in the U. S. according to one of the authors I’ve read. Treatment centers for other addictions often will have “smoking areas” or one can see the staff taking a break outside, and ash trays are provided for those in the programs. My question to people when they are about to embark on something very serious is “Do you know what you are getting into, what you are committing to do/not do, are ready to face areas that you may well not know about?” One lesson I read recently was from Joshua (Chapter 24: 1-3, 14-25) when the people of Israel were entering the promised land. They are grateful, and Joshua puts before them a challenge. “Choose this day whom you will serve … as for me and my household, we will serve the Lord.” The people responded, “far be it from us that we should forsake the Lord and serve other gods,” and they recount that they were brought out of slavery and God did great things among them. They assured Joshua, “Therefore we also will serve the Lord, for He is our God.” Joshua, though, reminded them that God is a jealous God, and that he will not forgive their transgressions or sins, that He will do harm if He is forsaken, and He will consume them after having done good. That’s a bit harsh, but it speaks of a reality the people may not have wanted to face when making a commitment. RELIGION COLUMNSSEE RELIGION  7

They reaf rmed. "No, we will serve the Lord." Joshua told the people, "You are witnesses against yourselves," and the people af rmed once again, "We are witnesses." Joshua is insisting that the people whom he will lead understand the seriousness of what they are promising; and they have to reaf rm it more than once. In spite of all of the shortcomings over the centuries, and the ups-and-downs, God's people still recognize the seriousness of commitment and still work to follow Him. That's a message that is true today. Know how serious the promises we make are going to be, know what it is that we are promising, know what the implications of giving our word are going to be and don't make rash promises in the heat of an emotional moment. The New Testament admonishes, "Do not break your oath (Matthew 5:33)." It's about thinking before speaking, and when it comes to promises, be serious be very serious! Don’t be a Thanksgiving TurkeyBY PASTOR JOHN HICKS First United Methodist ChurchI've been called a turkey before. No one wants to be a turkey. Being called a turkey takes on an even deeper meaning when you realize the fact that commercially grown turkey is not one of nature's most intelligent creatures. As a matter of fact, the domesticated turkey has been described as being "as brainless as a baseball." Even drinking can put a strain on turkey intelligence. If a turkey is outdoors, looking up at the sky when it starts to rain, it can drown. They're often not smart enough to close their mouths in the rain. No one wants to be a turkey. But at least the turkey has an excuse for being "bird-brained." There is less excuse for us human beings. Take the nine lepers Luke writes about in Luke 17. Jesus had healed them from a disgusting, painful, and unsightly skin disease. It was a tremendous gift. Even more so in that Jesus had made it possible for them to re-enter society and reunite with their families. Ten lepers were healed. But only one leper, and a Samaritan at that, came back and said, "Thanks." Talk about turkeys! Ten received God's blessing, but only one stopped to say thanks. What about us? Thanksgiving Day is here. In which group will we be found? Amongst the nine who took their blessing and walked off or with the one who came back to thank God? If we want to avoid being "turkeys" this Thanksgiving, the behavior of that tenth leper might prove instructive. We are not meant to keep our blessings to ourselves. "Thanks," is only half of the word. "Giving" is the other half. We can make generous giving a part of our thanks-giving. Remember, every time we feed the hungry, give drink to the thirsty, clothe the naked, visit the sick or the prisoner, it's the same thing as doing it for Jesus (Matthew 25:31). The tenth leper may not have had much, but in his gratitude he shared what he had to give. This Thanksgiving, don't be a turkey. In English, the word "think" and the word "thank" both come from the same root. Nine out of ten forgot to think and forgot to thank God for their blessings. But the tenth leper saw his blessings, gave thanks for his blessings, and shared his blessings. So can we.Psalm 23 A SummaryBY JACKIE MILLER, EVANGELIST First Christian ChurchI have just completed a seven sermon series on Psalm 23. What a great Psalm! This Psalm can be summarized as follows: If I know the Shepherd, I don't have to fear anything! I don't need to fear loneliness, for He is with me. I don't need to fear mistakes, for He guides me on the right path. I don't need to fear failure, for He restores my soul. I don't need to fear the future because goodness and mercy will follow me all the days of my life. I don't need to fear death, because I will dwell in the house of the Lord forever! God is beneath me in green pastures. He is beside me in still waters. He is with me in the valley. He is around me in the presence of my enemies. He's upon me anointing my head with oil. He is before me leading me in the right paths. He is behind me, surely goodness and mercy will follow me. He's even beyond me in Heaven. I will dwell in the house of the Lord forever. What more could I want. That covers it all! Jesus is all you need, the Good Shepherd provides protection, provision, providence, companionship (His presence), and paradise. That wraps it all up. If you haven't become a Christian, I want to urge you to become one so this Psalm can be your Psalm too. You must believe the Gospel, that Jesus died for your sin, was buried and arose again. You must repent of sins. Jesus said "Repent, or Perish!" You must confess faith in Christ. Before the Eunuch was baptized into Christ he confessed, "I believe that Jesus Christ is the Son of The Living God." (Acts 8:37). Then your must be baptized (immersed in water) for the remission of sins to receive the Holy Spirit (Acts 2:38). When you do this the Lord adds you to His One Church. Then you should meet with those who call themselves "Christians only" and continue steadfastly in the Apostle's Teaching, Fellowship, Breaking of Bread and Prayer (Acts 2:42). And of course once you do this you will want to share you faith with everyone you come in contact. Jesus said: "Freely you have receive, freely give." The largest member of the Skimmer species is the Black Skimmer which is found in America. “Skimmers are the only birds in the world with a lower mandible (bill) longer than the upper,” (Great Florida Birding Trail). The Black Skimmer is considered a species of “Special Concern” in Florida due to habitat loss and disturbance during nesting. They are found year-round along Florida’s coasts and are often reported in inland Florida from December to June. The Black Skimmer is a medium-sized large tern with white underparts and black back and cap. Adults have a long red and black knife-thin bill with an elongated lower bill which makes their recognition easy in the eld. Black Skimmers have very short red legs and long pointed wings. At hatching, the young Black Skimmer’s mandibles are equal in length, but at about four weeks, the lower mandible is longer. Immature Skimmers will have mottled black-and white feathers on their back and head. The Black Skimmers call is a barking “kak-kak-kak”. This gregarious bird is seen in large ocks in inland Florida during the winter, ying over the water dragging its lower mandible along the surface while skimming for small sh, insects and crustaceans. It uses touch to catch sh which gives it the ability to forage in low light or darkness. They normally nest in colonies on bar sandbars in coastal Florida from May through August, but have been reported nesting inland and on rooftops. Their nest is a scrape in the sand made by kicking sand with their feet. Males do more scraping with the average scrape being 10 inches in diameter and one-inch deep. The clutch size is normally four to seven pale cream, white, greenish or pinkish eggs spotted with dark brown or black which are incubated for 21 25 days. The tan colored down chicks are almost helpless when born. They must be feed by their parents for three to four weeks after hatching. Members of Glades County Woman’s Club wondered as Ticia carried in a folding table. When Laura Bedard, a new member of the club, heard that the club had voted to purchase a table for the Historical Society in appreciation for their allowing them to meet in their restored house, she purchased one for them. As Laura was away on business, she asked Ticia to present it to the Woman’s Club, who will in turn give it to the Historical Society. Mystery solved, and this presentation will be made later to Julie Wigton, who is a member of both clubs but was unable to be at the Woman’s Club meeting. Money that GCWC had planned to purchase the table, is now being donated to the Historical Society to be used for secure locks on the Westergaard House. A big thanks to Laura for making this happen. Pat Ringstaff and Dianne Tillery volunteered to deliver Thanksgiving baskets to deserving families. It may have a calf or be traveling with other manatees,” said Kipp Frohlich, who leads the FWC’s imperiled species management section. How to spot this aquatic giant? Boaters and personal watercraft operators should scan the water near or in front of their vessels and look for the signs that manatees are close by, including swirls resembling a large footprint, a repetitive line of half-moon swirls, a mud trail, or a snout or uke (tail) breaking the water’s surface. Other steps that boaters and personal watercraft operators can take to help manatees migrate safely: Keep vessels in marked channels; Wear polarized sunglasses to improve your vision; Obey posted boat speed zones; Use poles, paddles or trolling motors when close to manatees; Have someone help scan the water when under way. Besides following manatee-safety recommendations, people can help manatees survive by reporting sick, distressed, injured, orphaned or entangled manatees to the FWC’s Wildlife Alert hotline at 888-404-FWCC (3922). She said Oct. 31 was the deadline for application to receive federal funds under the Environmental Quality Incentives Program (EQIP). For the Old River Cattle Company, those funds would total $168,000. EQIP provides nancial help to eligible producers based on a portion of the average cost associated with practice implementation. Owners of land in agricultural production, who are engaged in livestock production on eligible land and that have a natural resource concern on the land, may participate in the program.Property backgroundThe property being leased by SFWMD to Old River spans a little more than 4,701 acres of noncontiguous parcels in eastern Glades County. The acreage, once part of the Pearce family's 13,000acre cattle ranch, is split into three parcels. One parcel consists of 1,655 acres, the second has 2,459 acres and the third has 587 acres. Before voting on the lease issue, the governing board heard from Patricia Pearcewife of Glades County rancher Mark Hunter Pearce. Mrs. Pearce, the vice chair for the Glades County School Board, told board members that the property they were leasing had been in the Pearce family since the 1800s and questioned the SFWMD land lease policy. "Who are the bidders?" she asked the board. "Why haven't landowners been given options on the land?" According to family members, Pomcor Inc. bought stocks in companies owned by J.F. Pearce (Indian Prairie Groves, Sixty Nine Ranch and J.F. Ranch, Inc.) but did not buy his cattle. Pomcor then formed the Pomcor-458 Acres LLC and leased the 4,701 acres to Ricou Hartman, who owns Hartman Realty in Palm City. Then, SFWMD acquired that acreage from Pomcor. Mr. Hartman made a lease with Pomcor, and the district then assumed that lease in May of 2006. It should be noted that Pomcor is now defunct. On March 21,2007, the district renewed the lease with Mr. Hartman. It renewed the same lease with Mr. Hartman again on Feb. 12, 2008. The lease was again renewed with Mr. Hartman and another partyOld River Cattle Company on June 12, 2008. According to Florida Department of State, Division of Corporations, records Louis E. Larson Jr., of Okeechobee, was and is the principal agent of Old River Cattle Co. Mr. Hartman, along with Jeffrey O. Clemons of Okeechobee, are listed as managers. That local cattle company has held the lease on this property for approximately ve years now. According to Ms. Clements, the Old River Cattle Co. is making yearly lease payments of: $23,909 on the 1,655-acre parcel; $25,485.63 on the 2,466-acre parcel; and, $5,986.29 on the third parcel. In a phone interview Tuesday, Nov. 1, Mr. Hartman said the property is being operated as "a normal ranch" and that there is rotational grazing. When asked how many cattle were on the property, he said he didn't know. It should be mentioned that Mr. Larson was out of town on vacation and unavailable for comment. Mr. Hartman went on to explain that the amount of the lease is gured on an "animal unit basis and not by acres" and how many units (a cow and a calf) the property can support.State statuteIn a phone interview Monday, Oct. 31, SFWMD Executive Director Melissa Meeker said the district has followed its rules in handing out its leases. "It's a careful thing we're walking here," she said. "Our legal counsel was involved in the entire policy. We feel like we followed the rules we had at hand." However, the Attorney General's Of ce has a different opinion on the district's land leasing policy. "State law has to be abided by and it does prevail over any rule or policy. In general, laws need to be followed," said Jennifer Meale, communications director for the AG's of ce. "As far as our applications, we can't speak to the speci cs but, generally, state law trumps policy or rule." And 1st and 4th DCA rulings coincide with the attorney general's. In a 1980 ruling, the 1st DCA ruled that: "It is axiomatic that an administrative rule must be consistent with the statute under which it is promulgated. It may not amend or repeal the statute." The 4th DCA then ruled in 1995 that: "A rule cannot change the statute simply because it would be in the public interest to do so." Then, in yet a third ruling, the 1st DCA offered in 2004 that: "An agency rule cannot contravene statutory provisions. Statutes take precedence over administrative rules." However, both Ms. Clements and Ms. Ansay told governing board members that their policy, in essence, trumps state statutes. Ms. Clements did say in an Oct. 31 phone interview that there has been a lot of public comment on the district's lease policy and that it may be revised. "We are amending the policy to go out for competitive bids on all leased property," she said. She did not say when that revised policy would go before the governing board.DiscrepanciesWhen Ms. Clements was asked about the board's Oct. 13 vote, she said the vote was not in regard to renewing the leases. Instead, she said, the board was voting on the EQIP money. She said the Old River Cattle Company's lease has not yet expired and that the board won't vote on renewing that lease until it expires. She said one of their leases will expire in March 2012 and another in May 2012. "Their lease has not been renewed at this point," she said. "I don't know if it will be put out for bid. That will be a board policy decision." However, according to SFWMD records the board voted 6-2, with one absent, to accept Resolution 2011-1020. According the board's Oct. 13 meeting agenda, that is a governing board resolution: "... approving the extensions of lease for Williamson Cattle Co, Matthews, Lanier, Boree, Driggers Ranch, Ru-Mar, Inc., and Old River Cattle Company... ." When asked about the board's vote, Mr. Hartman concurred that his company's leases were renewed or extended. The board voted to extend Old River's lease to 10 years on two of the parcels, and renewed its lease for another ve years on the third parcel. By renewing the leases, Old River Cattle Co. will now qualify to receive EQIP funds. Also, when watching the video the board could be heard voting to extend and renew Old River's lease. Voting against the measure were Mr. Waldman and James J. Moran. Both Mr. Larson and Mr. Hartman addressed the board and explained to them why they should retain the leases. And even though Mark and Patty Pearce attended the meeting, they did not get a chance to bid on the property. In an interview Mark Pearce said he and his father D.L. Pearce would like to bid on the property if they had the opportunity. He said they would like to put cattle on the property. Mark Pearce's lawyer, Chester Brewer, said the Pearces weren't even told that the lease was going to go before the governing board. "On the morning of the 13th, Mark got a phone call at 7:30 that he had better be at the meeting," said Mr. Brewer. Another Glades County rancher, John Austin Collier, is in the process of ling a lawsuit against the district because of ooding issues. "We have led a claim letter in regard to the ooding issue, and SFWMD allowing culverts to free ow without protecting the property below," said John Bryan, Mr. Collier's attorney. Those culverts are on the L-59 canal that runs across the property leased by Old River. When asked about the lease renewals, Mr. Bryan said water managers "de nitely" violated state statutes. "The purpose of these types of statutes is to make sure taxpayers get the most out of their land," he said. "The second issue is to keep people from getting sweetheart deals that no one knows about." Since then, SFWMD Executive Director Melissa Meeker issued the following response: “Land leasing is an important and legally valid land management tool for all ve of Florida’s water management districts, as described in state statutes. While land leasing issues can be complex, the article unfortunately confused the facts relating to requirements for competitive bidding and public noticing. “First, Governing Board policy allows the District to renew existing leases without competition if the lessee is in good standing, i.e., taxes are paid and all lease conditions are met, and the lessee agrees to an appraisal to establish market rent as well as an annual Consumer Price Index or agricultural commodity index adjustment for future years. “Second, the News reported that three weeks of public noticing are required for all leases. State statute is silent on whether renewal of an existing lease in good standing requires this step. The District’s long-standing practice—and those of the other water management districts— has been to publicly notice new leases only. “As the District’s new executive director, transparency and public access are important to me—and also to this Governing Board. In recent months, we have been evaluating many of the District’s past practices to nd opportunities for improvement. Land leasing is no exception. “This month, the Governing Board will speci cally consider revising the agency’s land leasing policy. They will be looking at policy components such as length of lease term, competitive bidding requirements, public noticing protocols and a number of other options. Their revisions, if any, will be in full compliance with Florida Statutes. We encourage public participation in these policy discussions.
