While the Florida Highway Patrol (FHP) has not released the identity of the driver (pending next of kin notication), friend and co-worker Charles Wood conrmed that the victim was Eddie Acevedo, 43. We have been friends for the past 10 years. He has three little girls down south. He and his (ex) wife and their children moved up here a few years ago to make a new start. When they broke up, he stayed here. Im from Mayo and thats where I knew him. I moved over here (Perry) a few years ago, and he came over too. Hes been in Perry about two years, Wood said. I had been with him just a little while before the crash happened. He had just gotten the car he was driving, and he worked so hard to get that car. I know they are trying to reach his family; even Eddie had a hard time getting his mother sometimes. Her health isnt very good, Wood said. Acevedo was traveling south on U.S. 19, likely headed to his home in Salem, when the crash happened around 4:33 p.m. just north of Bill Howell Road. He was traveling south in the inside, southbound lane and traveled into the grassy median. The vehicle started to lose traction and began to rotate clockwise. The vehicle traveled back This four-door sedan was nearly split in two when it crashed into a tree Wednesday afternoon. The driver, Eddie Acevedo, was pronounced dead at the scene. Please see page 2County commissioners and staff will reportedly tackle a $1.2 million decit when they begin working on Taylor Countys proposed scal year 2018-19 budget in a series of budget workshops beginning on July 16. The public budget workshops will be held at 9 a.m. at the Taylor County Administrative Complex (old post ofce) beginning on Monday, July 16, and continuing on Thursday, July 19. Two additional workshops will be held the following week on Tuesday, July 24, and Thursday, July 26. Commissioners and Clerk of Court Annie Mae Murphy referenced the large gap between anticipated revenues and requested expenditures at the countys most recent meeting. Our problem is going to be nding $1.2 million at budget time, Commissioner Malcolm Page said after Murphy conrmed budget requests may exceed projected revenues by more than $1 million dollars. Page also expressed concern over dwindling contingency funds, as commissioners dipped into cash reserves (for capital projects) several times during the meeting to cover unanticipated expenditures. We have taken a lot of money out of reserves this year, Murphy warned. Yes, we have, Page agreed. At the countys most recent July 2 meeting, commissioners approved Commissioners begin budget talks facing $1.2 million decit Please see page 2 Happy birthday, America! Fourth of July celebration Wednesday ended the thousands who gathered in, and around, was a great success, said Coordinator Dawn White & Blue contestants helped set the tone of area events, please see page A-3. This week not only marked Americas 242nd birthday, it also saw many changes to Florida law, with more than 100 bills approved this past spring by the legislature and governor going into effect July 1. These changes include everything from school safety and beach access to opioid prescriptions and child marriage. The specic bills that went into effect this past week include: Opioid Prescription Limits HB 21 limits an opioid prescription for the treatment of acute pain to no more than a threeNew law: As of July 1, pain meds limited to 3-day supply Please see page 2 Murphy honored as Clerk of the Year When Marcia Johnson began reviewing the eld of nominees for her organizations top award, she said she wanted someone she felt was a good role model, someone who was consistently up front and honest...a true public servant with the highest moral character. The person she selected is all that and more, Johnson said last week, before announcing that Taylor Countys own Clerk of Court, Annie Mae Murphy, was this years Clerk of the Year for the state of Florida. She is someone myself and many other clerks look to for guidance. She is heavily involved in the ofce and performs many duties that are normally handled by our deputy clerks. She worked in the ofce prior to being elected clerk, and has 55 years of service in the ofce, with 26 years as the clerk, said Johnson, outgoing president of the Florida Court Clerks & Comptroller (FCCC) association. She always speaks up when appropriate to express an opinion on matters being considered that affect us all, both at FCCC events and county meetings. People listen to her and respect her. Once, during an executive session of clerks, there was a big discussion about a new law, and clerks were not in agreement on a service (that was) discretionary for us. There was a lot of talk about Please see page 3

CLINIC FOR GREENVILLEA large group of Greenville residents pushed hard for a medical clinic to serve the large rural area around their city. And, with a little luck and persistence, the clinic could have become a reality as early as October, one of the groups organizers said. Butler Read, vice-president of the Bank of Madison County in Greenville, said the move got started in Greenville and the surrounding areas because, I think we need it more here than anywhere due to the isolation of Greenville from existing medical facilities. EMS UP FOR BID?The future of the Taylor County Ambulance Service again reared its head for the Taylor County Board of County Commissioners July 5, 1983. This time it was Emergency Medical Service personnel who raised the question. But, in the end, commissioners agreed to go ahead and advertise for bids to operate the countys ambulance service. Several of the ambulance employees appeared before the board to convey their fear of being laid off their jobs if the ambulance service was taken over by a private contractor. They encouraged commissioners to keep the service in the county so that the people of Taylor County would get service from Taylor Countians, the ve men said. NEW HOME WON CHURCH SOFTBALLIt was quite a struggle July 5, 1983, but the New Home Baptist Church League softball team managed to take two out of three games from First Baptist to win the Perry Church League softball crown. The two champions of their divisions split the rst two games July 5, with First Baptist taking the opener, 5-3 while New Home came back in the second game to win, 8-3. In the third and deciding game, however, First Baptist must have run out of gas, as the New Home team cruised to a 13-0 victory. CITY GOT PARK GRANTIt took less than one month for the Department of Natural Resources to award a $45,000 grant to the City of Perry for a proposed 18.5-acre recreation park in the western section of the town. The city received notice the week of June 27, 1983, that the grant, which was created under the Emergency Jobs Bill passed by Congress, was approved. The Florida Department of Natural Resources administered the grant. The amount of the award was actually half of the cost of the proposed park. The grant was awarded on a matching funds basis, with the city kicking in the other $45,000. City Manager Bill Noonan said that the grant approval would be presented to the Perry City Council for acceptance or denial, but that he saw no reason why the council would not accept the grant. Plans for the recreation park included: a multi-purpose ball eld, a basketball court, shufeboard courts, a playground for children and a picnic area. The area surrounding the proposed park would be paved and include parking. GREENVILLE WATER CLEAREDIt seems that at least some of the 1,000 residents of Greenville were boiling mad about their water problem. A state epidemiologist report issued pinpointed the cause of Greenvilles much publicized water problem: bird droppings. Yes, it seems our feathered friends rudely used Greenvilles aerator and ltration tanks as a toilet. The result was an outbreak of intestinal illness in Greenville that had the medical and state health ofcials stumped. But it wasnt only the birds that should be blamed, the state reporter said. Human error and bureaucratic mistakes also entered into the mess. Greenville residents hoped that the citys hiring of a certied water plant operator would eliminate the problem. Dorothy Drawdy of Jasper began checking the system twice a week. Weve probably got the safest water in Florida right now, Mayor Randy Stephens said. LOCALS WON HONORS AT DAIRY COOK OFFElsie Ricketson and Lyndal Ellison received Honorable Mention awards at the annual state Dairy Days recipe contest held in Daytona Beach on June 14, 1983. They were among 15 nalists chosen from over 1,000 participants in a 36-county contest sponsored by the Florida Cooperative Extension Service of the University of Floridas Institute of Food and Agricultural Sciences (IFAS). The 15 cooks from around the state prepared their favorite dairy food dishes in one of three different categories: main dishes, vegetables or salads and desserts. Products were judged on nutritional value, practicality and economical use, avor, texture, creativity and attractiveness. YARD OF THE MONTHJessie Lee Jackson received the Yard of the Month award for the SmithBellair neighborhood. The Neighborhood Improvement Award Program was a project of the Clean Community Committee (CCC). A yard was selected each month by the CCC and the Perry Garden Club. PERMIT HIKEThe Taylor County Board of County Commissioners voted to increase some of the countys building permits to make the county department more self-sufcient. The Building Inspector department had been running at a $1,000-$2,000 decit for several years. Projects Coordinator Ed Allen told commissioners that a $5 increase for both trailer hook-up permits and electrical permits would more than take care of the decit. The basic building permit fee of three-cents per square foot could then remain the same, Allen said. Commissioners voted unanimously to increase trailer hook-up permits from $10 to $15 and electrical permits from $5 to $10. A-4 Perry News-Herald July 6-7, 2018 July 6-7, 2018 Looking Back A glance at the past THE PERRY NEWS-HERALD July 7, 1983 Remember when... By ANTHONY L. WHITE anthonylamarwhite@yahoo.comA match made in culinary heaven You couldve called me Bubba Gump. I didnt grow up eating shrimp, but not because I didnt like them. I just didnt. But, in my early twenties, I suddenly developed a Bubba-Gumplike relationship with shrimp. I started liking steamed shrimp. I fell in love with fried shrimp. And I lived for grilled shrimp. Shrimp and I were a match made in culinary heaven. But, it didnt take long for the relationship to end just as suddenly as it began. Shrimp was never on the menu at my grandmothers house. Fish, oysters and crabs were regularly part of Friday night dinners, along with grits, homemade buttermilk biscuits with syrup, baked beans and sometimes coleslaw -but never shrimp. I was working for the Florida Board of Bar Examiners in 1987, administering the Bar Exam to nearly 500 hopeful attorneys in Tampa, when a co-worker talked me into going to a seafood restaurant near the coast. I was placing my order -fried oysters, fried crab claws and fried grouper -when my co-worker suggested I try the grilled shrimp. When our dinners arrived, my Five minutes later, before I touched the fried oysters, crab claws and grouper, I told the waiter I wanted two more orders of grilled shrimp one to eat at the restaurant and the other to carry with me back to the hotel. When I made it back to Perry, I told my mother about my new, unbridled love for grilled shrimp. Thats when she warned me to take it slow. She told me she and my brother Ken had both loved shrimp once and both had paid a high price for doing so. I didnt listen. That same day, I called my friend, Shonny, who lived a few houses down the street, and told her I was on my way to her house for our daily lateafternoon chats under the oak tree in her front yard. I had told her about the grilled shrimp I had in Tampa, so she knew what time it was when I showed up with a bag of 40 fresh jumbo shrimp. We dug a hole in the ground about and a few pieces of charcoal. While the charcoal was heating up, we seasoned the shrimp. Then we placed a foil-lined rack from a grill over the hole and began grilling our shrimp. Neighbors and people passing stopped to gawk at our grilled shrimp, and we were nice enough to give away The next evening, Shonny and I again and cooked another 40-orso shrimp. That day, we reluctantly gave away twice as many samples. The next day, we got smart and moved our hole-in-the-ground grill to the side of Shonnys house, which reduced the samples back down to As the summer turned to fall and then winter, our daily grilling slowed to twice-a-week, once-a-week and, When spring arrived, I tried to rekindle my love for grilled shrimp. the shrimp, my lips, face and hands were swollen, and my body was covered in hives. Thats when I knew the Bubba Gump relationship was over. It was delicious while it lasted. 113-year-old building to be demolished? The two-story brick building located at the corner of Washington Street and Main has been home to many businesses throughout its 113-year history...but for most Perry residents, it is best remembered as the Western Auto building. Sadly, time has taken its toll on the structure, which was built in 1905, and the current owner (Patrick Lourey of Melbourne Village) has obtained a has been released. A-6 Perry News-Herald July 6-7, 2018 Religion By SARAH HALL Prophecies being fullled Some 2,000 years ago, the Bible foretold that critical times and hardships from every possible avenue would come in the last days. We dont know when the last days will come, but we do know that we are experiencing some very unusual and very difcult times. These days we are being plagued with every kind of suffering imaginable. 2 Timothy 3:1-5 states, In the last days...men will be lovers of themselves, lovers of money, boastful, haughty, blasphemers, disobedient to parents, unthankful, disloyal, having no natural affection, not open to any agreement, slanderous, without selfcontrol, erce, without love of goodness, betrayers, headstrong, puffed up with pride, lovers of pleasure rather than lovers of God, having an appearance of Godliness, but denying its power. All of these are happening today. Surely, if you listen to the news, read the newspaper, observe the happenings around you and interact with people, you will know that this is indeed true. And things are getting worse, day-by-day. Just imagine what is yet to come. Believers, we must stay focused on the uncompromising, unchanging word of God. I will never leave you or forsake you. God is depending on us to lift Him up. Prayer focus Please keep these friends in your prayers: Viola Woodfaulk, Crosby Whetsel, Alma Jean Harris, Betty Graham, Alonzo Sparrow, Jean Ester Lee, Mary D. Jackson, Dorphy Grimes, Vera M. Green and the Rev. D.L. McBride. Wise words Truth...a rare commodity. Pass it on. City Wide Mission meets Sunday City Wide Mission Ministrys (CWMM) next session will be held this Sunday, July 8, at 2:30 p.m. at St. Peter P.B. Church. The Rev. Cedric Spradley is pastor. We extend an open invitation to all who wish to join us in a spirit-lled fellowship, Sister Irene Barnes, CWMM president, said. Calvary Baptist Church has announced it will resume its Deeper Discipleship informal reading group beginning Sunday, July 15, at 2 p.m. We will now be reading C.S. Lewiss profoundly insightful and delightfully entertaining book The Screwtape Letters. We will plan to discuss chapters 1-10. We want to invite everyone at Calvary and our sister churches in the Taylor Baptist Association and across the community to join us as we dive deeper into Christian discipleship, Pastor Ben Kimmell said. This new, informal reading group is not only for older youth and young adults, but for all people in our community who are interested in going deeper into discipleship. We will read important works by Christian thinkers whose teachings and examples have had a broad impact for Gods kingdom. We have already begun with John Pipers book Desiring God. And, we will now be following that with several works by C.S. Lewis, beginning with The Screwtape Letters. From there we will read Lewis classic Mere Christianity, then The Great Divorce and possibly others. We will explore important topics with other Christian authors and scholars, such as N.T. Wright, William Lane Craig and more, he said. Upcoming topics will include Christian theology, philosophy, church history and general apologetic topics. Through it all, I pray that God will create stronger disciples and authentic Christian champions by establishing structures of heart and mind that will t us for beholding true beauty and urgently pursuing lasting and durable joy, Kimmell said. By CAITLYN BURCHETT Contributing writer After spending nearly 33 years in prison -including six on death row -Jessie James Livingston Jr. was re-sentenced for the murder of Irene Buckhalter Hill on Wednesday. While the state argued to have Livingstons current sentence of three life terms re-imposed, the defense fought for a sentence of time served. The decision was placed in the hands of Circuit Court Judge Greg Parker, after he listened to testimony from the victims grandson, the defendants brother, a clinical and forensic psychologist and the defendant himself. I just shot the white b**** in the head and in the chest, Assistant State Attorney James McCain stated, as he began the re-sentencing hearing by using Livingstons alleged own words against him by reading witness testimony from Livingstons friend Terry Baker. I shot at the black lady, but she ran in the kitchen or somewhere, McCain related. That is how he (Livingston) referred to the murder of Irene Hill and attempted murder of Millie Mae Evans half an hour after the robbery. McCains opening statement detailed how on the evening of Feb. 18, 1985, 47-year-old Hill was working at her brothers convenience on Byron Butler Parkway when a teenaged Livingston came into the store, pointed a .38 caliber pistol at her and demanded all the money in the cash register. Livingston shot Hill in the head, then reached over the counter to shoot her again in the chest after Hill fell to the oor. He red a shot at a second store attendant, who locked herself in the back room, before stealing the cash register and eeing to his friends (Bakers) house. 5 Friday 50%Saturday89 75 Sunday88 75 60% 91 75Index Looking Back . ......... She was a loving, caring Even inmate Livingston, if he had asked. When the qualifying period ended on June 22, all local led candidates were ofcially cleared to run in their respective races, and incumbent Taylor County School Board members Brenda Carlton and Bonnie Sue Agner both earned new terms without opposition. Carlton, Taylor Countys longest-serving elected ofcial, will serve her eighth four-year term on the School Board, after rst being elected in 1990. Agner was rst elected in 2016 to serve the nal two years of the term vacated by Danny Glover Jr. after he resigned to run -successfully -for school superintendent. Also winning her race without opposition was Lisa M. Dykes, who will assume the Taylor County Soil & Water Conservation Board Seat #2, currently held by Joe LaValle, who did not seek re-election. Candidates for the Perry City Council concluded their qualifying period on Monday, June 18, and the city council approved the list of four candidates at its Tuesday meeting (see related story). For county candidates, Carlton, Agner both re-elected to school board without opposition On the heels of disappointing state assessment scores, local school ofcials received an unexpected surprise on Wednesday when they learned the Taylor County School District had earned its rst B grade in nine years -by one percentage point. At the individual school level, Taylor County Middle School (TCMS) led the pack with a B of its own -the rst grade higher than a C earned by a local school since 2014. Taylor County High School (TCHS) and Taylor County Elementary School (TCES) both earned a C -the same score as last year -while Steinhatchee School was graded an F, the districts rst failing grade since Steinhatchee was given an F in 2013. Over the past three years, all four schools had earned C grades. Were very excited about our B, Superintendent of Schools Danny Glover Jr. said. We know we have some challenges ahead of us. Weve go to trust our plan and trust our administrators and our teachers. Glover and the Taylor County School Board met with school principals Thursday morning to go over their plans for Please see page 2 First time in nine years: District earns rare B grade When the Perry City Council tackles weeding through 14 applications in search of a new city manager tonight (Friday), they will be forging ahead with no plan in place as far as its next step and the public will not be allowed to offer any input. This will be a working meeting. There will not be an opportunity to take public comments. (Hiring a new city manager) is our responsibility by charter, and Friday night we are not going to open the oor for public comment, Councilman Mike Deming said during talks at the councils regular meeting Tuesday. We had an outcry of people at the podium who said it was our job to do that. I dont want anybody to tell me what to do who is not registered to vote or who cant vote, Deming said. Part of the situation we face Friday is really not having a plan at all of what we are going to do. There is no plan in place, Mayor David Sullivan said. I would hope everyone does a little homework before they get here and come with their top candidates, he said. I am pleased with the applications we received, Councilwoman Shirlie City manager search: No plan, no public input Please see page 14 Please see page 14All local waters open to scalloping School system to fund full-time psychologist Taylor County School Board members unanimously voted to establish a full-time psychologist position to serve the Taylor County School District for the upcoming year, a move which coincides with Floridas statewide push for better mental healthcare for students. At their June 19 meeting, board members discussed why establishing the position is a no-brainer. Previously, through a $100,000 contract, FSU provided psychology students twice a week to perform evaluations on students in the district, Superintendent Danny Glover Jr. explained. With the establishment of the new position, well have our own full-time psychologist that will be on staff ve days a week, Glover said. Not only will students across the district have access to the psychologist ve days a week, but it will be a cost savings, according to Financial Director Ashley Valentine. The position will be paid for out of the districts general fund. The contract with FSU is sometimes over $100,000, and that is general fund dollars. The person in this position is not going to make $100,000. Please see page 7 Please see page 14 1985 murder sentence revisited:Livingston: cold-blooded killer or a changed man?

PERRY NEWS-HERALD WAS PERFECT FOR MULLET WRAPPINGThe Perry NewsHerald received another distinguished honor the week of June 27, 1983. Along with state press association awards handed down, the News-Herald was also honored when it was learned the newspaper passed certication and was approved for use as a Mullet Wrapper in the nest tradition of the Keaton Beach Mullet Festival. A select committee weighed and tested 28 newspapers from North Florida and found that all 28 newspapers -including the News-Herald -passed muster and were approved as certied wrappers of mullet, the staple sh of the South, according to Festival Chairman Bob Wood. Wood added that the only publication tested which was not honored by the title of Mullet Wrapper was the Congressional Record, the daily printed recording of the goings-on of Congress. Too dry, was the problem, Wood said. It dried out the sh. The News-Herald, on the other hand, kept moisture in and odor out, Wood said. Wood and Keaton Beach Honorary Mayor Edwin Jackson signed the NewsHeralds proclamation. News-Herald Publisher Michael Schuver attributed the newspapers high quality of newsprint as the dictating factor leading to the prestigious award. He noted that the newspaper used the high quality newsprint in hopes that someday we would be honored in this way by our friends in Keaton Beach. I have never known exactly what to think when people referred to our newspapers as the local Mullet Wrapper, Schuver said. Now that I know what a compliment that is, Ill thank those who so courteously refer to our publication in that manner.COMMISSION TIGHTENED BELTTaylor County Board of Commissioners Chairman Edwin Hendry sounded the warning in his opening statement June 27, 1983, at a county budget hearing. Were going to come up short if were not careful. Well be short on our tax revenue. Weve got some added expenditures this year with renovation of the courthouse and the lawsuits. Personally, I dont see how we can fund these budgets as requested. We cant raise all the money you request. 25 YEARS OF SERVICEIn recognition of more than 25 years of service with the U.S. Postal Service, James A. Crumpler was presented with an award by Postmaster Claude Kelly. Crumpler had been a regular route carrier in the city since 1961, and spent more than three years with the Federal Bureau of Investigation in the postal division. In a letter commending Crumpler for his service, Kelly said that he appreciated the loyalty and dedication Crumpler had shown throughout the years. BIRTHSGeorge William Pridgeon Mr. and Mrs. G.W. Space for Joy There is always space for more joy in this world. Fill that space with joy of your own making. You need no special condition or reason to be joyful. Give joy, spread joy, live joy just because you can. Let yourself be amazed by the fact that a whole universe exists for you to experience and enjoy. Stream your own joy into whatever unique corner of the universe you happen to nd yourself. What can you do to remind yourself and others how great it is to be alive today? What words, thoughts and activities can you initiate to express joy from your own perspective? Carry joy into the most unlikely situations, for thats where joy can make the biggest difference. Share joy with even the most unreceptive people, for they are who yearn for it most. Look out and imagine all of existence as a massive container for joy. The Lords Test I woke up this morning and knew that today, ( The sun would not be shining and the clouds would be gray. As I stepped outside, rain fell upon my head. My car wouldnt start, so I walked to school instead. I forgot all of my assignments. I failed all of my tests. I dropped my head in disgust and asked the Lord for one request. ( Lord, why is it that things wont go my way? He gently replied, Dear child, it is because you didnt thank me yesterday. ( I woke you up and enabled you to see the sun again! ( I gave you shelter, protected your family and even let you make a new friend. ( I blessed you far greater than I ever had before. But you were too busy to thank me once more. You didnt feel sick because I maintained your health. ( You had money in your pocket because I maintained your wealth. You had shoes on your feet and clothes to wear, too. You had plenty of food to eat, and what did you do? ( You ignored me and went about your tasks. ( But when you wanted something you never hesitated to ask. ( I was there when you needed me, and that wasnt too long ago. ( But, when things started going your way, it was me you did not know. ( As if that werent enough, I provided your favorite luxuries. ( This was something I didnt have to do -they werent even necessities. And when it was time to get on your knees and show your gratitude, You decided that after such a fullling day, you werent in the mood. So I decided to give you just a little test. To show you how it would feel to stop being blessed. I began to realize what the Lord was saying. And when I got home, I fell to my knees and started praying. He said, My child, you have learned, and you know I do forgive. But, remember to remember this day as long as you shall live. I love lling your life with joy, and your pain Ill alleviate it. But, just a simple thank you would show how much you appreciate it. --Author unknown Wash Day MONDAY WASH DAY Lord, help me wash away my selshness and vanity, so I may serve you with perfect humility through the week ahead. St. Johns Christian Fellowship Nursery & Childrens Ministry Cody McNeese, pastor Located at the intersection of Puckett Rd. and Golf Course Rd. 584-7251 Sunday School 10 a.m. Morning Worship 11 a.m. Sunday Evening 6 p.m. Residents are invited to join an interdenominational and collaborative community prayer meeting this Saturday, June 30, at Perry First Assembly of God starting at 6 p.m. This is an all churches prayer service -Taylor County churches praying as one, Calvary Baptist Church Pastor Ben Kimmell said. Our aim is to gather Gods people for a time of petitionary prayer on behalf of our local churches and community in order to push back the darkness that has, in many ways, descended over our community and accelerated its cultural collapse. Meth addiction has absolutely deconstructed the very humanity of people all around us. Fatherlessness, the leading indicator of social and psychological morbidity, is rampant. Gods gift and purposes for human sexuality are routinely ignored or even scorned, resulting in the dissolution of the very fabric of society, he said. But in Ephesians 6, the apostle Paul is clear that our struggle is not against esh and blood, but against the rulers, against the powers, against the world forces of this present darkness, against the spiritual forces of wickedness in high places. And for this reason, Gods people are commanded to put on the whole armor of God, so that we may be able to resist in the evil day, and stand rm, having girded our loins with truth, put on the breastplate of righteousness and our feet shod with the preparation of the gospel of peace. Beyond this, we are to take up the shield of faith with which we will be able to extinguish the aming arrows of the evil one. We are to take the helmet of salvation and the sword of the Spirit, which is the word of God. With all prayer and petition, Paul commands us, pray at all times in the Spirit and with this in view, be on the alert with all perseverance and petition for all the saints. Due to the enormity and urgency of the need, as well as the arsenal that God has placed at the disposal of His battalions, we invite all prayer warriors to join us for this important time of pleading for divine power to recover and re-capture Taylor County, Kimmell said. Scheduled speakers for the prayer meeting include: Pastor David Stephens, Pastor David Beagle, Brother Austin Bishop, Dr. William Anderson, Brother Gary Brett and Superintendent of Schools Danny Glover Jr. Brother Marshall Combs will provide special music. Topics will range from prayers of intercession for the young people of the community to a petition for deliverance from the scourge of global pornography as well as a prayer for evangelistic courage and the needs of schools, praying for God to mobilize His people to get involved rather than simply complain that prayer has been taken out of schools. Livingston hid the register in a nearby dumpster and stashed the gun -which he had stolen during a home burglary earlier in the day -under an air conditioning unit of a club. During a pre-sentencing investigation, Hills family stated her death was a senseless waste, sharing that she and her brother had discussed giving an assailant whatever was asked for in the case of a robbery. Hill lived for six weeks after the shooting, but never regained consciousness. Her family had to deal not only with the murder of Hill, but six weeks of sitting by her bedside and six weeks of forlorn hope that she would survive and, through some miracle, regain consciousness, McCain said. We ask that you reimpose the current sentence, which is life without the possibility of parole, McCain concluded. (Livingstons current sentence also includes two consecutive life without parole terms for the attempted murder of Evans and for robbery while armed.) Defense attorney Matt Roland waived his opening statement, allowing the proceeding to move to the states rst witness. McCain called the victims grandson, Wil Clark, to the stand. Have you grown up hearing about your grandmother? McCain began. Yes sir, Clark said. What have you heard about her? ( She was a loving caring person and would have given anyone anything they asked for, Clark responded without hesitation. McCain asked Clark if he wanted Livingston to ever be released from prison, with Clark immediately responding, No, I do not, as the defense cut him off with an Objection, your Honor. Roland argued the allowance of the victims familys opinion was a violation of the defendants Eighth Amendment rights, which prohibits cruel and unusual punishment. McCain argued: In the state of Florida, the victim has a constitutional right to be heard. Clark concluded his testimony by reading a letter he wrote to the court. In his victims letter, Clark stated Hill was not just a store clerk, but also a grandmother, mother, sister and friend to many. She was a loving and caring person who would have given anyone anything, including Inmate Livingston -if he would have just asked, Clark read. Clark gave a tearful testimony about how Livingstons selsh actions created a devastating ripple effect when he took away a vital part of Clarks family. Clark -who was born 19 months after the murder of his grandmother -stated he never had the chance to experience Hills love and kindness, or the chance to tell her he loved her as a result of Livingston killing her in cold blood 33 years ago. I ask today that you continue his life sentence in prison for the murder of my grandmother. My grandmother received the death sentence the day he decided to take her life for no reason at all, Clark concluded. The defense then began calling its line of witnesses, beginning with Livingstons older brother James Davis of Immokalee. Davis testied to the poor living conditions he and his 11 siblings endured as migrant working children, describing a life of instability, poverty and hunger. We used to sleep with four of us in the bed at the same time...I remember us having nothing to eat, and a restaurant called Amigos would give us beans, Davis said crying, almost inaudibly. There were things that we just had to do. It was rough. It was poor, but you live with what you got, Davis concluded. The defense then called Dr. Randy Otto, a clinical and forensic psychologist with 29 years experience evaluating adults and juveniles in the criminal justice system, to the stand. Dr. Otto said he administered three psychological tests on Livingston and reviewed his school and criminal history, trial documents, prison documents and medical history to understand Livingstons brain development and criminal behavior throughout his life. According to Ottos expert opinion, during the time Livingston committed the murder, his brain was not fully developed, as he was still an adolescent experiencing changes in his brain structure and chemistry. There is disportionately more dopamine in an adolescent brain that is reward-focused...As people come into adolescence, they become much more reward-focused, much more sensation-seeking and much more risk-taking, Otto said. The appreciation of risks, recognition of risks and thinking through the negative outcomes of risks has yet to develop at this stage of adolescence. Ottos test results and interview revealed that prior to incarceration, Livingston lived an uneducated and impoverished childhood, with a lack of positive role models and an abusive stepfather. Despite these struggles, Otto stated Livingston went to greater lengths than anyone he has evaluated to take responsibility for his actions. One of the most striking things about Livingston was -unlike many others I have evaluated -he was adamant about not placing blame on his upbringing. He went to great lengths to talk about the many sacrices his mother made to raise him and his siblings, despite a number of challenges. Livingston said, I am not going to blame society. I take responsibility for my actions, Otto explained. Based on Dr. Ottos analysis of correctional facility records, Livingston was treated for depression and thoughts of self-harm for the rst 10 years of his sentence -six of which he served on death row before his death sentence was vacated. During his 33 years of incarceration, Livingston earned 24 disciplinary reports for possession of contraband (such as food and tobacco), theft, aggravated assault and disorderly conduct, with a disproportionate amount of those disciplinary reports taking place during the rst 10 years of his sentence. Since nding God, as described by Dr. Otto, Livingston has been on a path toward rehabilitation, earning 20 certicates for rehabilitation studies, including managing emotions, victim empathy, managing money and irrigation systems. The defendant himself testied on his own behalf as the nal witness before closing arguments. Livingston testied to the abuse he suffered as a child, how he was saved by God, his rehabilitation efforts and expressed remorse for the murder of Hill. Livingston gestured to the scars lining his arms as he said, To this day, I still have extension cord marks on me, as he recalled the severe beatings he began to receive at 11 years of age -the lacerations caused by whippings from his stepfather that resulted in Livingston sleeping in the woods just to avoid going home. Livingston further described his drug and alcohol habits, dropping out of school and delinquent lifestyle that ultimately earned him a spot on death row by the age of 18. In stark contrast to Livingstons criminal adolescent decisions, he claims he is a changed man, as he serves as a minister and mentor to others in the prison. I came a long way. God decided to use me. If you have a problem, I listen. If you need a shoulder to cry on, I am there, Livingston said proudly. At one point, Livingston addressed Hills grandson directly, stating: Mr. Clark, I was never a bad person. I did try to reach out to your family. I always showed my condolences. I am not that vicious person they told you I am-- I dont want to hear anything from you, Clark interrupted. Livingston did not appear to let the negative reaction from Clark faze him, as he later stated, I am remorseful daily, but you can only apologize so many times. I just wanted to talk, to let Mr. Clark know I am sorry, and I did try to reach out. When asked what he would do if released from prison, Livingston responded he would: Serve the Lord, work for my brother and stay productive. Live for the day I am given. In the states closing, McCain reiterated Hills death was senseless, describing the crimes committed by Livingston as planned and intentional. McCain then challenged the defenses argument that Livingston was rehabilitated and could be successfully released and reintegrated into society. Livingston continued to commit disciplinary reports after he says he changed his life in 2006. The nature of these reports is very troubling. He had eight different counts of disciplinary reports for contraband, ghting, assault, disobeying orders. Your Honor, those do not paint the picture of someone who is rehabilitated, McCain said. We are asking that you reimpose the current sentence in the case, which amounts to life in prison without the possibility of parole. The defenses closing statements raised questions regarding Livingstons Eighth Amendment rights -which prohibits cruel and unusual punishment. We are no longer a system of rehabilitation. The tough task judges have is to enter into a proportionality analysis. How much punishment ts the crime? Roland said before citing a previous case that read: Children are constitutionally different from adults for purposes of sentencing. Because juveniles have diminished culpability and greater prospect for reform, they are less deserving of the most severe punishments. Roland continued to argue Livingston was an impulsive, reward-focused, and panicked juvenile at the time of the Hills murder, but that Livingston is a different man today. Roland discussed the likelihood of Livingstons rehabilitation, as he has expressed remorse, has a plan to minister, a job lined up with his brother and a place of residence available in Immokalee. We are asking for a time served sentencing, your Honor, Roland said, addressing Parker. Parker was tasked with the difcult decision of respecting Livingstons constitutional rights as a defendant and two Florida State Supreme Court rulings over the case. Parked ultimately reimposed Livingstons current sentence, but changed the nature of the time served. Rather than serving his time consecutively (one life sentence after another), Livingston is now sentenced to concurrent life sentences (all to be served at the same time). For the murder of Hill, the defendant should be sentenced to a life sentence without the possibility of parole for 25 years. For the attempted murder [of Evans] with a rearm, the court sentences Livingston to a concurrent life sentence. For count three, robbery with a rearm, the court sentences Livingston to a concurrent life sentence, Parker said, while reading his ofcial ruling. Parker then explained the various contributing factors that led to his decision. There are a lot of positive things that I see here, but the nature and circumstances of the offense weigh heavily on the court. The nature and circumstances of the offense were heinous... He continued to carry out this crime not by running and panicking, but by methodically removing the cash register and hiding it. Parker also addressed Livingstons potential rehabilitation if he were to le for a sentencing review or request a parole hearing at a later date, and even offered Livingston words of encouragement to continue his personal rehabilitation efforts within the prison system. I dont see where Livingston was on a path of violence. It may have just been the understanding at the time that evil played a part in this and just an utter lack of consideration for human life...You are trying to better yourself. I see that. Just keep doing what you are doing, working toward rehabilitation, Parker said. Davis, Livingstons brother, struggled to hold back his emotions after the ruling was announced, as he watched his baby brother get ngerprinted and led away, only being allowed the opportunity for a sad smile and a eeting wave. It is Floridas law. If he did this in any other state, or if he did this to a person of color, he would have been released 10 years ago, Davis said. After the emotional day in court, Clark said, I accept his apology, but I do not forgive him for what he did. I have peace knowing he wasnt released from prison today. I do feel that justice was served again today. Livingston will continue to serve his three life sentences, but is expected to le for a sentencing review within 30 days -an opportunity for a second chance granted to juvenile offenders rehabilitated while incarcerated.
