Those were the many faces of Oriana Forsythe painted by witnesses and attorneys during the two-day guilty verdict or placing her fate in the hands of Judge Greg Parker by accepting a deal that could lessen her sentence. Jurys guilty verdict vacated Surprise Deal By CAITLYN BURCHETT After a six-person jury reached a unanimous verdict Wednesday -nding Oriana Forsythe guilty of rst-degree premeditated murder in the death of Steinhatchee resident Aaron Tappe the prosecution shocked many in attendance at Thursdays 10 a.m. sentencing by announcing a plea agreement had been reached. Forsythe was allowed to enter an open plea deal to vacate the guilty verdict of the jury. In doing so, the 19-year-old plead no contest and neither admitted nor deny guilt. The plea deal waived Forsythes right to an appeal for any and all matters except in the case she felt her representation was inadequate. Forsythe also retained the right to appeal the sentencing. It was necessary to go through the trial to reach a verdict to get to where we are today. By entering an open plea of no contest, it untied the judges hands and allowed him to determine an appropriate sentencing, Weed said when asked why a plea had been agreed to after the jury reached a guilty verdict. Based on the charges, the lowest permissible sentencing was determined to be 21 years. However, according to the 2017 Florida Statute of Mitigating Circumstances, judges can hand down lower sentences due to factors such as the defendants age, mental capacity to understand the law and repentance of the criminal actions committed. Circuit Court Judge Gregory S. Parker placed Forsythe under oath to begin sentencing, then went through the stipulations of the plea deal, asking her questions to ensure she understood the contract she had signed. The tearful testimony of 19-year-old Oriana Forsythe painted a picture of a teenage girl who found herself tangled in a jealousydriven murder committed by an abusive boyfriend who forced her to travel across the country, severely beat her and threatened to sell her into human trafcking. But was it true? The trial of Oriana Forsythe for the murder of Steinhatchee resident Aaron Tappe continued on Wednesday, March 21, as the prosecution lined up 15 witnesses to support their case. The defense countered with only the defendant and her account of the events surrounding Tappes murder. Skyler Scott of Niles, Michigan, was one of various friends Forsythe and her former boyfriend, Douglas Mihal, visited after eeing the scene of the crime in Steinhatchee. According to Scott, Forsythe messaged her on Facebook at the end of January 2016 saying she was in town and wanted to hang out. How did Oriana act? Assistant State Attorney John Weed asked. She seemed normal. She got a tattoo. We went to the mall, the movies, out to eat. We just hung out, Scott replied. Did Oriana or Mihal say why they left Florida? Weed asked. They brushed it off and acted like they did not want to talk about Florida. Oriana just said something went wrong and they had to leave, Scott replied. The body of Aaron Tappe was found on March 10, 2016, in a shallow grave. Amy George, of the Florida Department of Law Enforcement crime scene unit, testied about the discovery. Tappe was wrapped in sheets and stuffed in a blue plastic tote before being buried in a wooded area. Trash was then placed on top of the gravesite, and lit on re. A Colt .45 shell casing was recovered in the master bedroom, and a bullet was recovered from the chest/ abdomen area of Aaron Tappe, George said. According to Taylor County Sheriffs Ofce Chief Investigator Ron Rice, Tappe was found a half a mile from his residence in Steinhatchee after Rice interviewed Destiny Pendley in Utah. It was Destiny that lead us to begin searching that area. After Tappe was reported missing, Rice traveled to Utah to investigate the discovery of Tappes stolen Jeep in the parking lot of a Utah state park. The Jeep was lit on re. Accelerant was poured on the seats, the re was lit and the doors were shut. The re burned out when it ran out of oxygen There was a Visa card recovered from the Jeep with Tappes name on it, Rice said. There was no license plate on the vehicle at the time of the discovery. Destiny Pendley, the girlfriend of Mihals cousin served as a critical witness, providing key testimony for the prosecution and the defense. Pendley provided incriminating testimony, detailing the conversation she shared with Forsythe. Oriana said she was not as innocent as I thought. These were just a few of the varied topics the Perry City Council covered at its regular meeting last week, resolving some issues and merely getting updates on others. The agenda led off with council members accepting liability for this Saturdays parade planned to welcome home three-time Super Bowl champion LeGarrette Blount. The family has requested that we do road closures. Normally, it has been like a procession, and we are not required to have someone at each corner. However, since they have asked for it to be more like a parade and have the roads closed, the city will be incurring some overtime since we will have to have people posted at each corner. It should be approximately $400-500, City Manager Bob Brown said. Councilwoman Shirlie Hampton made a motion to approve accepting liability for the parade; Councilwoman Venita Woodfaulk offered a second. The motion passed unanimously. Next, Brown updated council members on discussions staff has had with Anderson-Columbia regarding the installation of a new gas pipeline to service the companys asphalt plant located off Highway 27 East. They are looking to start back up their asphalt plant. Right now, we dont have a large enough pipeline to supply what they are saying they would need to run two big pieces of equipment. We would be looking at installing a three-and-onehalf mile pipeline to the site that would cost an estimated $700,000. We told them we would need to recoup that amount in three years with proposed payments of $19,000 a month. This would be a pipeline that would be used strictly by them. It would cost another $35,000 to $40,000 to add a step-down station to use for household customers, Brown said. We have also discussed a second option that would cost about $35,000, and Please see page 4 Person of interest in murder investigationPerry Police Department (PPD) detectives have announced that Jarnell L. Roosta Coverson, 22, is a person of interest in the murder investigation of 27-year-old Kashawn Davis. Davis body was found in the 500 block of South Wilder Street the night of Jan. 24. While ofcials have declined to release any details regarding the manner of his death, a family member said Davis was shot several times and hit by a car. Davis was pronounced dead at the scene and investigators have continued to ask the public for assistance. Anyone with information is asked to please contact our investigations division (584-5121), Perry Police Department (PPD) Capt. Gene Franklin said. While Coverson is the only individual identied in relation to the homicide, he is not the only person of interest with the investigation. There are several others, Franklin said. Coverson is currently wanted on an outstanding arrest warrant for armed carjacking, possession of a rearm by a convicted felon and violation of probation (VOP). In the past several weeks, ofcers have stepped up efforts to execute search warrants at residents known for heavy drug activity in their bid to locate Coverson. He (Coverson) frequents these areas. Eastern Airlines subsidized these in-school ights in order to give children the thrilling experience of ying in an airplane. BEER STOLEN FROM PERRY RESTAURANTAn undetermined amount of beer was stolen from the Perry Restaurant during the night of Saturday, March 19, and a cigarette vending machine was damaged, according to a report from Ptl. Ray Morgan of the Perry Police Department. Morgan said that he was called to the restaurant on South Byron Butler Parkway at about 5:30 a.m. Sunday, by the restaurant owner George Mantzanas. He said that the back door to the business had been pried open and that a cooler containing beer had been robbed. Morgan said that ngerprints were lifted from the scene and the investigation was ongoing. Eric William Weekly Mr. and Mrs. Tommy Weekly of Perry were proud to announce the birth of a son, Eric William, on Monday, March 21, at Doctors Memorial Hospital. CHRISTIANS FORMED FELLOWSHIP GROUPLiving Word Fellowship was the name of a new organization in Taylor County formed for the purpose of teaching Bible principles of action and ministry to those in the Body of Christ and to anyone in need of help, according to Bob Ball, spokesman for the group. Ive been a regular churchgoer and in a variety of Christian denominations all of my life, said Ball. But this is different from anything Ive seen in Christian groups until quite recently. Ball said that people who came to the meetings troubled and worn-out left renewed and refreshed and ready for a great weekend. Ball stressed that Living Word Fellowship was not intended to compete with, but as a necessary complement to, local churches. STORE ALMOST ROBBEDAn as-yet-unidentied knife-yielding man attempted to rob the owner of Gayles Games and Gifts Monday, March 21, but ed when his victim began to scream, according to a report from the Perry Police Department. Storeowner Gayle Lundy was uninjured in the incident, and no money or merchandise was stolen. According to a report by Reserve Ofcer Gena Morgan, at about 1:15 p.m., a man entered the jewelry store, located in the Taylor Square Shopping Center, and asked to look at wedding rings in the $500 range. Lundy told police that the subject looked at and inspected all the rings and asked when more would be in. Lundy said that he turned toward the door, turned back to her and moved very close and told her this is a stick up. When the suspect reached into his pocket, Lundy screamed and ran toward the back of the store, knocking over a display stand and falling. She said that the man ran out the door with a knife in hand. The scene was processed by Police Chief Ron Smith and Deputy Steve Spradley with the Taylor County Sheriffs Department. The report noted that samples of ngerprints, hair and ber were taken into evidence. STEINHATCHEE IMPROVED EMSResidents of Steinhatchee were very proud of progress being made to better prepare their community for emergency health care. Cardiopulmonary Resuscitation (C.P.R.) courses started Feb. 10, and 39 people completed the course. Defensive Driving courses were then given by Sgt. Fred Sowell of the Florida Highway Patrol, with 27 persons completing this course. A total of 34 people completed a First Aid course, and Emergency Medical Technician (EMT) courses started in March 1982. The success of this course was very important to Steinhatchee and surrounding areas. March 1 was a very exciting and interesting evening. One of the helicopters from Shands Hospital visited the group, touching down at the Steinhatchee School. The paramedics group aboard the helicopter explained its functions those in attendance.CONCRETE COMPANY BURGLARIZEDNorth Florida Concrete, located at Rt. 2 Box 12-A, was burglarized sometime during the night Thursday, March 23, by unknown subjects who stole about $8 in change and caused $200 in damage to a drink machine. According to a report from Sgt. Skip Wood of the Perry Police Department, the subjects entered the building by breaking out a window on the west side, and went through the secretarys desk, taking a cash box and about $4 in change. The burglar then pried open the soda machine, taking more change and causing the damage. The theft was reported by company employee Roberta P. Hartseld who discovered the theft in the early morning when she reported to work. WHITE anthonylamarwhite@yahoo.comWhos the boss? I knew what I was getting into when I hired her. The year was 2004, and Id just been hired as program director for the Boys and Girls Club branch on Washington Street. One of my responsibilities was hiring and supervising the program staff, and friend Cynthia. I didnt hire Cynthia because she was my friend. I hired her because I knew she could get the job done. A few years earlier, in 2000, I hired her as a student supervisor for a local youth summer job program. She did an excellent job. The students liked her because she was fun to be around and she stood up for them when necessary. The students parents loved the sense of responsibility and good behavior she demanded from the students. So did the employers who hired the students. It seems the only person who sometimes had problems with Cynthia was the person who hired her -me. My issue with Cynthia wasnt her job performance. It was her unauthorized veto power over things I said and did. Cynthia wasted no time exercising this power when she started working at the club. Hi, Im Miss Cynthia, she told the Im a new program staff member, and these are the new rules. The club members glanced over at me to see if this was really true. My nervous smile wasnt the answer they were looking for. First, if I have to holler at you and tell you to stop doing something once, youll get a time-out, Cynthia continued. If I have to tell you twice, its automatic suspension from the club. One of the students looked over at me and asked, Mr. Anthony, can she do that? Before I could answer, Cynthia quickly replied, You should ask me. Not Mr. Anthony. Another student turned to me and asked, Is she your new boss? Again, before I could answer, Cynthia responded, No, hes still the boss, but these are the new rules. After Cynthia had oriented the students to the new rules, I called her amend the new rules a little bit. Instead of automatic suspension from the club, students who violate the new rules will spend the entire suspension, I suggested. If thats what you want to do, Cynthia responded. But, I dont think thats going to work. Before the day was over, the three students who had not fallen in love with Cynthia spent the day in in-club suspension. The next day, there were The next day, there were seven. A week later, 14 students were suspension, until Cynthia marched in and yelled, There is no more in-club suspension! Why? I asked. Because this isnt punishment, Cynthia answered. They want to be here. They get to play on your snack line. They have you helping them with their homework. Youve made in-club suspension the place to be. So, everybody get out! One of the students asked, Mr. Anthony, are you still the boss? I was about to answer, when Cynthia cut her eyes at me and said, I dare you. As the students walked out of my shes the new boss. She told me she shot Tappe while he was sleeping and that she pulled the gun on Mihal to make him help her get rid of the body. Oriana said he was so scared he peed himself It was like she was bragging about it, Pendley said. In her rebuttal, Defense Attorney Shirley Bates argued Forsythe was the victim of Mihals controlling and abusive behavior. Upon dismissing the jury, Bates played an audio recording of Pendleys interview with Ron Rice as part of the investigation into Tappes death. Pendleys voice echoed through the recording, Mihal beats the [expletive] out of Oriana. He wont let her go anywhere. After listening to close to 10 minutes of Pendleys interview with Rice, the judge called the jury back into the room for questioning to continue. Bates repeated Pendleys recorded statement to Pendley and the jury. Do you remember saying that in your interview, Destiny? Bates asked. I dont know. I dont really remember, Pendley replied as she shrugged her shoulders and looked down. William Mickler, Special Agent with the FLDE and lead investigator into Aaron Tappes death, interviewed Forsythe for two hours after her arrest in Bakerseld, California. She waived her rights and agreed to talk. Oriana admitted she assisted Mihal by digging the hole with small gardening tools and to moving Tappe, Mickler testied. Forsythe had also revealed to Mickler in her interview that the license plate of Tappes Jeep had been removed and placed in the other vehicle they stole in Utah. She said she planned to throw the plate away, Michaeler said. Dr. Anthony Clark, the medical examiner of KWB Pathology, conducted the autopsy of Tappe, concluding Aaron Tappes cause of death was a gunshot wound to the top left side of the head that traveled through the neck and into the right side of the chest. Manner of death was ruled as a homicide, Clark stated. Forsythe gave tearful testimony on her own authority Wednesday, rst being questioned by Bates. According to her testimony, Forsythe ran away from her parents in Ohio because her family was moving and she did not want to move and have to make new friends, again. Mihal came to get me (from her mothers house in Ohio in June 2015). I snuck out my window. I was supposed to go to my boyfriends house, but Mihal would not let me, Forsythe said. Forsythe stated she wanted to go to Michigan to see her grandparents on her mothers side, but Mihal would not allow it. This led to an argument that turned violent. He pushed me on the bed and choked me over and over. When he hit me, I was scared and did not understand why. I kicked him in the face, but it made him even more mad He just wouldnt stop, Forsythe said, her face red from crying. The Department of Children and Families (DCF) took the then-16year-old Forsythe into custody after police picked her up when looking for Mihal in relation to a string of burglaries in the area. DCF placed Forsythe in the care of her grandparents in Georgia. Forsythe testied she ran away from her grandparents home in Georgia (in November 2015) because their Pentecostal faith was a culture shock to her. My grandma said to my cousin about my lip piercing God does not like that, Forsythe recalled. They only wore long skirts. I was not allowed to wear leggings or tank tops I had too much pressure on me at my grandmas. It was like everything I did was wrong, Forsythe said. Forsythe testied she got into contact with Mihal again through Facebook and said he apologized for hurting her. According to Forsythe, Mihal and friends picked her up from her grandparents house in Georgia, and they drove to Steinhatchee. Forsythe recalled she recognized Tappes vehicle as belonging to a friend of her moms, and that she and Mihal spent a few days talking with Tappe before he invited the couple to move into his home. Tappe and Forsythe grew close over the short time they lived together, she said. I could tell Aaron anything and he was okay with it. He was someone that would not let anything happen to me. He took care of me. He was like an uncle, Forsythe said. However, Mihal did not like the friendship that had developed between Forsythe and Tappe. He (Mihal) got mad at me for talking to Aaron and always called Aaron my boyfriend, Forsythe said. The defense argued Mihals motive for killing Tappe was jealousy, using Forsythes testimony to support the theory. Mihal raped me a week before the murder, Forsythe said. Snifes could be heard in the court as Forsythes testimony described her version of the moments, weeks and months following Tappes murder. I heard the gunshot and ran up the stairs and into the kitchen. Mihal did not have an expression on his face. The gun was in his hand. He said he did this for us, Forsythe said. Mihal got a tote from the storage room, took it into Tappes room and closed the door. When he came out, Mihal was dragging the tote, and he still had the gun in his waistband, she said. Mihal then told Forsythe she had to help him hide Tappes body. If I did not listen to what he said, he would kill me too, Forsythe said. Forsythe described Mihal instructing her to hold the ashlight while he dug the threeto four-foot deep hole. After burying Tappe, cleaning up the Steinhatchee residence and gathering valuable items to pawn, Mihal and Forsythe traveled to Michigan in Tappes maroon Jeep. In Michigan, Forsythe and Mihal stayed with the Turnocks, friends of Forsythe, for several weeks before leaving to do laundry and never going back. Forsythe claimed Mihal said they needed to leave because Jernigan was going to run the serial number on the guns before committing to purchasing them. Mihal was worried they would be caught with the stolen guns. Forsythe emphasized Mihals control of the situation and how afraid she was. Everywhere he went, I had to go too I had to act normal because I did not want my friends to be in the same situation as me...I got my birthday tattooed on my arm, so if something happened to me, my mom would know it was me, Forsythe testied. Mihal and Forsythe traveled to Utah to meet Mihals cousin Michael Rogers. It was in Utah that Forsythe was left alone in the vehicle with a cellphone while Mihal and Rogers were looking for a vehicle to steal in a parking garage. I was looking into the mirrors, trying to make sure they were not around when I called my mom. I told her everything that had happened. My stepdad told me to get to the Greyhound buses and get away from them, Forsythe said. Mihal overheard Forsythes phone call through a cracked window. He started screaming and cussing at her and threw the phone, breaking it. His cousin stood there watching him beat me I shouldnt have called my mom, Forsythe said as she began to cry. Mihal, Rogers, Pendley and Forsythe then stole a new vehicle and lit Aaron Tappes Jeep on re in the parking lot of a Utah state park. Forsythe, Mihal and Rogers traveled to Colorado, where Mihal decided to leave Rogers because he was telling people about stealing the vehicle. Forsythe and Mihal then traveled to California, stopping in states along the way. Mihal was trying to get to a place called Tijuana. Its in Mexico. He wanted to be out of the country, Forsythe said. Forsythe and Mihal were arrested in Bakerseld, California on March 17, 2016, while living in a meth house for three weeks. According to Forsythe, Mihal confronted a man he noticed was watching the house. Forsythe watched out the window as police swarmed the house, and Mihal tried to run. But I did not run. I just walked outside. I was happy to be done, Forsythe testied. Assistant State Attorney John Weed conducted a revealing cross examination, asking Forsythe questions pertaining to statements from her arresting interview on March 17, 2016. You said Aaron Tappe was like an uncle. Even though he wanted to dress you up in slutty lingerie outts? he said. Forsythe appeared to pause at the question, before replying, He wanted to open a costume cleaning business. Thats why we looked at stuff on the Internet. Do you ever say he freaked you out and that you wanted to leave? Weed inquired. When Forsythe denied making the statement, Weed then referred her to a transcript of her initial interview with FDLE Agent Mickler. I remember the interview, but I dont remember anything I said. I was freaking out, she said. Bates followed up Weeds cross-examination by asking Forsythe, When you were arrested, did it feel like you had been rescued? I did, until months down the road. I thought this would all be done, she replied. Assistant State Attorney James McCain delivered the prosecutions closing statements by rst outlining the legal denitions for the jury, then applying those denitions to the case that was presented. Forsythe killed Aaron Tappe in cold blood. She asked Mihal to kill Tappe, and when he refused, she shot Tappe in bed while he slept, McCain said. Mihal is pleading no contest to second-degree murder and will serve 30 years in prison with 10 years of probation. So, with nothing to lose, why would Mihal not tell the truth? Prosecutors argued that Forsythes testimony of being raped, beaten and threatened with slavery was not consistent with the testimony of multiple witnesses or Forsythes own interviews with law enforcement after being arrested. Oriana was not under duress. She chose to go to Michigan. She sold the guns. She had some control in their relationship They were a team. They are both culpable. How can she not be held accountable for her part in the crimes? The evidence is there to convict her, and I ask you to do that. Find her guilty as charged, McCain said as he concluded the prosecutions closing statements. Compton Jr. passed away peacefully on March 16, 2018. John was a beloved husband, father, grandfather and friend. He was born in Perry on Dec. 25, 1948, to John H. Compton Sr. and Beatrice Lundy Farmer. He was a sergeant in the U.S. Army and a Vietnam veteran. John worked in the logging industry for more than 40 years. He loved the logging woods, shing, FSU football, and he was an amazing cook. He was preceded in death by: his parents, John H. Compton Sr., Arthur Shorty and Beatrice Farmer; and his brothers, Larry and Gregory Farmer. en-USIm sure youve heard it before, since I tend to harp about it, but there seems to be a curse en-USin Hollywood when it comes to adapting en-US video games for the big screen. Sure, there en-US have been some enjoyable ones over the en-US en-US as well as 2001s Tomb Raider, and even en-US en-US in the minority, with many more failed en-US attempts littering the cinematic en-US landscape, such as the ill-en-US conceived disaster that was en-US Assassins Creed. In 2013, the latest (at that time) Tomb Raider video en-USgame rebooted that franchise, en-US so its not a surprise that en-US we now have a new Tomb en-US Raider movie, rebooting en-US en-US starring Angelina Jolie as Lara en-US Croft in 2001 and 2003. Like en-US the video game, this is a bit en-US grittier and more realistic (but en-US not too much), while giving us en-US a younger, less experienced Lara -played en-US by Alicia Vikander (Ex Machina) -who en-US hasnt yet begun raiding tombs. breaks the curse or delivers a mind-blowing en-USexperience that will be remembered for years en-US to come, but it does offer solid popcorn en-US entertainment for its two-hour run time, en-US which is not only what I expected from en-US a Tomb Raider movie, but also what I en-US Ive never played any of the various Tomb Raider games, but if youve played the 2013 en-USen-US and story beats from that game in this movie. The Lara we meet at the beginning of the en-USen-US a living as a bike courier. Her father, Richard en-US Croft (Dominic West, The Wire), has en-US been missing for seven years and is about en-US en-US however, Lara believes he might still be en-US alive, and when she unlocks a hidden vault en-US containing evidence of her fathers secret en-US life as a world-traveling adventurer, she sets en-US en-US happened to him. (Daniel Wu, Geostorm), whose own en-USfather went missing the same time as Laras. en-US Together they travel to a dangerous stretch of en-US en-US armed men led by Mathias Vogel (Walton en-US en-USThis all leads back to a legend Laras father en-US was investigating which might hold the key en-US to an ancient evil locked away thousands of en-US years ago.en-US Dont worry. Before the movie is over, en-US there will be a tomb, and it will be raided.en-US I really enjoyed Vikanders portrayal of en-US Lara. As I mentioned before, this is a much en-US different version from the en-US one we saw in the Angelina en-US en-US some skills, otherwise there en-US would be no way she could en-US survive what happens later in en-US the movie, but a little bit of en-US kickboxing experience and a en-US childhood learning archery is en-US a big difference from being en-US a gun-toting killing machine en-US from the opening scene.en-US en-US alone on a hostile island being en-US pursued by men with bad en-US intentions, she is not prepared en-US for this, as none of us would be unless wed en-US had some kind of military training. This goes en-US en-US en-US of this up.en-US Once we get to the island, the action en-US really begins to ramp up, and many of the en-US sequences are ripped directly from the game, en-US including a harrowing episode involving a en-US rusting plane perched above a waterfall.en-US en-US en-US a series of fun action sequences. Recalling Medical Examiner Dr. Anthony Clarks expert opinion on the stand, Bates reminded the jury of the implications and the inconsistencies of Mihals testimony. Dr. Clark testied there would not have been any splatter from that particular wound, but Mihal said Oriana had splatter on her faceMihal is a liar, Bates said. Destiny Pendley did not want to admit to Mihals abuse of Oriana that she was a witness to because she was the states witness, Bates said. The defense asked the jury to consider why Mihal would lie to incriminate Forsythe. To get back at her. That is what their relationship was. He always made her pay, and this is his last chance to get back at her, Bates said, Tappe was not raping Oriana. Mihal was. Then Mihal shot Tappe and made Oriana help him. Bates described Forsythe as being a child, whose friend had just been killed by someone that beat her regularly. Oriana believed there was a signicant threat to her if she did not help Mihal. She did not aide him willingly. In conclusion, Bates inquired of the jury, What was Oriana supposed to do? Go into the bedroom and take a bullet, too? Jury deliberation began at 3:30 p.m. on Wednesday, as Forsythe was lead out of the courtroom, and the judge retired to his chambers. While the jury deliberated, the courtroom relaxed. Opposing counsel were chatting, bailiffs shared jokes and even the mother of the defendant, Charlene Cook, could be seen smiling from across the room. A knock came at the door of the jury room, causing everyone to fall silent. The bailiffs gathered the judge, the defendant and all essential personnel to hear the jury had a single question. Can the defendant be found guilty of accessory to her own crime? Parker read to the court from the jurors handwritten note. After collaborating a response, Parker retired to his chambers yet again as Forsythe was allowed to stay in the courtroom. The jurys question dramatically altered the mood of the courtroom, as Defense Attorney Bates shook her head, putting her hand to her face to shield her emotions. Forsythe sat hunched over, elbows on the table and hands to her face. Charlene Cook and victims advocate counselor Brandi Turner sat in silence. The room was engulfed in silence. No one spoke. Only the ticking of the clock cut the tension in the air as the court awaited the jurys verdict. After deliberating for less time than it took for the judge to read sentencing instructions, the six-person jury reached its decision. Just over an hour and 20 minutes after beginning deliberations, the jury unanimously found Forsythe guilty of premeditated rstdegree murder, tampering with evidence, grand theft (auto) and grand theft (rearm) a verdict that carried with it a maximum sentence of life in prison without the possibility of parole. Do you understand what it means to plead no contest? Judge Parker asked. No. I did not really read the whole thing before signing it, Forsythe responded. You did not read the whole document before you signed the agreement? Parker repeated. No, Forsythe replied. Obviously surprised, Parker issued a recess, during which time Forsythe was instructed to read the document in its entirety. After several minutes, Parker returned from his chambers and announced the court would recess until 2 p.m. I have a duty to ensure that you knowingly, intelligently and voluntarily entered this deal. I cannot make that determination until you have had ample time to go over the open plea deal and what it means with your attorney, Parker said. When court resumed at 2 p.m. Defense Attorney Shirley Bates stated her client would be continuing with the plea deal. I have decided an open plea deal is in my best interest, Forsythe conrmed. You understand you are waiving the right to remain silent, and the right to not incriminate yourself, correct? Parker said. Yes sir, Forsythe replied. Did you have enough time to consider this decision? Parker asked. Yes sir, I have had enough time, Forsythe answered. Assistant State Attorney James McCain later stated the prosecution offered an open plea deal to the defense on jury selection day, however the defendant was not interested in accepting the offer at that time. McCain told the Perry News-Herald that the prosecution approached the defense after the jurys verdict was delivered to offer the open plea deal again. The court accepts the defendants plea, Parker ruled. Forsythe pleaded no contest to second-degree murder, tampering with evidence, grand theft (auto) and grand theft (rearm). A pre-trial investigation in the case for sentencing will be held on April 20. Forsythes sentencing is scheduled for April 30 at 1:30 p.m. Codefendant Douglas Mihals sentencing has not yet been scheduled. After the trial, McCain stated, I am satised with the results of the trial. I believe this was an appropriate resolution. When approached for a statement, Defense Attorney Shirley Bates declined to comment.
