Philip's Building Offer


To Be Reviewed Tonight


Bartow city commissioners are
scheduled to decide tonight
whether or not to allow the
Community Redevelopment
Agency to offer financial incen-
tives to the owners of the old
Philip's Department Store build-
ing to shore it up and renovate it.
The CRA board has voted to
loan the owners. Neal O'Toole
-and Richard McKinley. $160,000,
interest free. for three years to
shore up the building to prevent
it from collapsing into Main
Street. The CRA also has offered
to pay one year's interest on a
construction loan of up to $1.5
million to renovate the building.
But City Atty. George Dunlap
ruled that the CRA's redevelop-
ment plan, which must be
approved by the city commission,
did not authorize that type of
\expenditure.
The amendments to be consid-
ered by the commission tonight
would authorize the CRA to:
"Provide financial incentives
and;or assistance to owners to
stabilize, renovate and improve
unique and historic buildings."
"Develop ita financial assis-
tance program to preserve and
protect unique and historic
downtown buildings."
"Provide financial assistance
to the owners of the property at
330 East Main St. to stabilize the


building to allow completion of
the Main Street streetscaping
project."
The city condemned the two-
story building last year and
again this year, finding that it
was unsafe for occupancy and in
danger of collapse. The owners
have filed suit against the city'
and the Main Street redesign
contractor. David Nelson
Construction, alleging that it was
work on Main Street and on the
sidewalk in front of the building
that caused extensive cracking in
the east wall of the building
The city's hoard of appeals
upheld the city's order of condem-
nation against the building, but
allowed the owners additional
time to make repairs, and said
that the city is not to order the
building torn down.
Completion of the Main Street
redesign project has been held up
out of concern that milling of the
pavement and further work on
the sidewalk in front of the build-
ing might cause further damage.
The city commission v:ill hold
a work session this afternoon at
5:301. and will reconvene for its
regular business meeting at 6:30.
Other items on the agenda:
Ratification of a two-year
contract with the city general
employees union, retroactive to
Oct. 1 of last \ear.


First reading of an ordi-
nance zoning 38.8 acres of land
west of Bartow Municipal Airport
and north of Gordon Heights as I-
2 'heavy industrial'. The pro-
posed zoning prompted strenu-
ous protests from nearby home-
owners. If passed on first reading
tonight, the ordinance will come
up for a public hearing and final
passage on Aug. 21.
First reading of an ordi-
nance rezoning a parcel of prop-
erty on East Pearl Street at
Broadway to be rezoned from R-
1-A to R-1 to allow two homes to
be built on a piece of land large
enough for only one home under
R-1-A zoning.
First reading of three relat-
ed ordinances annexing 2.5 acres
of land on U.S. Highway 17
North, owned by Central Fhlorida
Truss, designating it as industri-
al property, and zoning it R-2
'heal-v industrial .
First reading of an ordi-
nance authorizing purchase of a
parcel of land from James T. Hill.

Closing of Four Bartow Parks

Topic of Public Meetings


Two public meetings are planned to discus the
possible closing of four Bartow parks.
S The first meeting will take place at Carver
Recreation Center on Tuesday, Aug. 15, at 6 p.m.,

Bartow Parks and Recreation Department is
considering discontinuing the use ofthese parks as


they are used very little by the neighborhoods in
which they are located, and "the lack of use does
not justify, the maintenance the city has to do on the
parks," Director Barbara Newell said.

Polk Countr, School Board has
released its tentative budget for
the 2006-2007 school year, which
includes a decrease in 'property
taxes.
The total property tax will be
7.770 mills, or $7.77 per $1,000 of
property value. Last year's mill-
age was 8.078.
A two-mill property tax for
capital outlay projects w'll be
added to the proposed 5.770 mills
for operating expenses.
This capital outlay tax will
generate approximately
$55,1)27,049.
The money will be used to ren-
ovate the main building at
Dundee Elementary. add 10
classrooms to Kathleen Middle,
purchase land for new elemen-
tary schools in Poinciana and
Winter Haven, and renovate and
repair existing facilities.
The tax also covers the pur-
chase of 51 school 'buses and
related electronic equipment,
furniture and equipment for new
and existing facilities, payments
for educational facilities and
sites due under a lease purchase
agreement, and payments for
leasing portable classrooms.
The final draft of the budget
will be approved on Sept. 12.
This school year's budget cov-
ers about $1.325 billion in total
expenditures, transfers, and bal-


ances.
The general fund operatingg
budget is estimated to be,
$706,650,097. These funds are.
used to-pay for the day-to-day,
operations of the district.
Teacher salaries account for
an estimated $446,778,961 of the
general fund budget:
Operating funds are received
from the federal and state gov-
ernments, an'd local sources.
Most state funds are provided hb
the Department of Education.
State-level programs account
for the majority of the general
fund budget at in. estimated
$463,166,086.,
The special revenue funds
budget is estimated to be
$95,082,053. It includes federal
and state grant revenue, and
food service revenue.
Federal' and state grants are
estimated at $55,032,315 and
food service revenue is estimated
at $37,927,459. The special rev-
enue funds budget retained
$2,122,279 from last year.
The debt service funds budget
is estimated to be $34,732,558.
Debt service funds are used to
pay the long-term debt of the dis-
trict.
Approximately $33,911,835
will be spent on repaying debt
this year; leaving an estimated
$820,723 in the debt service


funds budget.
The capital projects funds
budget is estimated at
$389,.823.921. 'This amount rep-.
resents $228.224.297 in, antici-
pated revenue, and a beginning
fund balance of $161'.559.624.
The state's allocation for
school maintenance increased to
$8,377,705 from $6,739,434 the
Sprevirou.. year. The di-trict's allo-
cation for new construction
increased to $16(,547,443 from
$6,043,261 the previous year.

Candidate Files Suit To Remove

Opponent From Judicial Race


A Bartow lawyer running for
election to a circuit judgeship has
filed suit seeking to have his
opponent removed from the bal-
lot..
Nathaniel White filed the suit
against State Rep. John Stargel,
alleging that Stargel is using
funds raised for his race for re-
election to the Florida House of
Representative in his race for cir-
cuit judge.
A candidate who switches the
office for which he is seeking
election is required to offer to
refund the money to his contribu-


tors, and must wait 30 days
before spending the money in the
new race, the suit says.
White also charged that
Stargel raised money for the leg-
islative race in ways that he
could not have solicited money to
run for circuit judge.
He alleged that Stargel
improperly paid his $5,579.88 fil-
ing fee for judge with a check
written on his legislative cam-
paign account.
The suit, filed in Tallahassee,
asks that Secretary of State Sue
M. Cobb be ordered to remove


Stargel's name from the ballot.
The suit also asks that the
court forbid Stargel from spend-
ing funds given to his legislative
campaign for his judgeship cam-
paign until he has given contrib-
utors 30 days notice of their right
to seek a refund. Since the elec-
tion will be held on Sept. 5, that
would effectively prohibit Stargel
from spending any of the $74,485
that White said Stargel raised for
the legislative race.

Red Cross emergency re-
sponse specialist Eric Carroll
urged Bartow Lions Club mem-
bers during their Aug. 1 meeting
to prepare now for upcoming
hurricanes, which, he said, could
become a major event for this
section of Florida.
"It is not what the Red Cross
says, but what we do that de-
fines us," Carroll said, noting
that the Red Cross has been ac-
tive for more than 125 years.
The Red Cross partners with
major service clubs and the.
armed forces in responding to


natural disasters.
Carroll told club members
they should formulate an emer-
gency response plan in the event
of a hurricane so that assistance
to others might be available
through food supplies, displace-
ment information, financial as-
sistance, and shelter.
"Plan for the worst and hope
for the best," le said.
In cases of-emergency, free as-
sistance is available through the
Red Cross for those who qualify.

your life and property later,"

Carroll said. "Know where you
would go, how to get there, and
what to take with you."
Carroll stressed the impor-
tance of having insurance cover-
age up-to-date, preparing to pre-
vent hurricane damage, and pur-
chasing a battery-powered radio
to listen to storm warnings.
If possible, he said, it is best
to stay in your home in case of a
hurricane and if not, to seek
public shelter as a last resort;
then stay there until an official
"all clear" has been broadcast.

Dozier Celebrates
100th Birthday
Olga Dozier celebrated her
100th birthday at a party given
by her family on Saturday, July
29, 2006, at the Hawthorne. Inn
in Lakeland.
Attending the party were her
entire family, fellow residents of
the Hawthorne Inn, and many
friends.
Mrs. Dozier was born Aug. 6,
1906; in Lake Butler. She has
lived in Florida her whole, life
and taught public school in Cen-
tral Florida, mostly in Bartow,
for 43 years before her retire-
ment in 1972.

versary celebration on Aug. 5,
2006, with a waterfront cere-.
mony on Lake Norman in Sher-
rills Ford, N.C., to renew their
wedding vows.
The service and reception
were given by the couple's four
children and their spouses, Pam-
ela and Michael Fitzgerald, Tho-
mas and Margaret Johnson, Jill
and Cindy Johnson, and Bradley
and DeAnna Johnson.
Also honoring the couple were


their nine grandchildren, Shay,
Trica, Kristen, Matthew, Tani-
sha, Niklas, Amanda, Spencer,
and Quinn.
Mr. and Mrs. Johnson first
met in the first grade in the
town of Monroe, Mich., and were
married there on Aug. 4, 1956, in
the chapel of the Presbyterian
Church.
Mr., Johnson retired as a dis-
tribution manager in the mobile
home 'industry, and Mrs. John-
son is a homemaker.

Protect Wild Dolphins spe-
cialty license plate program has
just awarded $302,000 in grants
to four dolphin research, infor-
mation and awareness programs
in the state.
Funds will support important
work to locate and identify dol-
phins using acoustic detection
devices; develop a code of con-
duct for dolphin tour operators; a
public service announcement
that will convey that it is both il-
legal and dangerous to feed ma-
nmhe mammals; and an investiga-
tion of the impacts to dolphins
and 'their environment from re-
cent hurricanes and episodes of
"ed tide.
This year's awards bring the
total grant funding distributed
since the plate's inception in
1999 to nearly $2.8 million.
In addition, more than $4.5
million has supported Harbor
Branch's dolphin research pro-
grams, including an ongoing
health assessment of Indian
River Lagoon dolphins and the
rescue and care of stranded dol-
phins.
Each year a $30,000 fund also
is established to reimburse other
authorized organizations for ex-
penses incurred while providing
care and assistance to sick
andinjured marine mammals.
Mote Marine Laboratory in
Sarasota will receive two grants.
Working with the PWD program,
the National Marine Fisheries
Service (NMFS) and the Florida
Fish and Wildlife Conservation
Commission (FWC), Mote Ma-
rine Laboratory will use the
$100,000 grant to develop public

Dolphins accustomed to beg-
ging for food become less able to
fend for themselves and these
feeding interactions can lead to
physical harm to the persons
feeding the dolphins as these are
large, powerful animals.
The other award to Mote Ma-
rine Laboratory provides
$59,879 to investigate how hurri-
canes and red tides in the Port
Charlotte area have impacted
this habitat for dolphins.
Florida State University has
been awarded $70,541 to to
study the feasibility of tracking
and identifying individual dol-
phins using acoustic detection
technologies.
This project will involve set-
ting up a monitoring system at a
Big Bend study site for the pur-
pose of advancing the means of
determining where populations
of dolphins go and why.
Combining this with monitor-
ing of prey populations and
movements, as well as water
quality parameters can begin to
provide important clues to the
motives and objectives of dolphin
population movements.
The DolphinSMART project
has been awarded $72,410 to de-

dolphins, it is also illegal and po-
tential dangerous to approach
wild dolphins, even if it is done
by an experienced tour operator.
Operators who learn and


practice the code of conduct will
be able to advertise their partici-
pation and compliance and will
be recognized by the program.
The objective is to teach and en-
courage methods of dolphin ob-
serving that do not involve be-
friending or harrassing the ani-
mals.
Harbor Branch Oceano-
graphic Institution, a Florida
non-profit research organization
(www.hboi.edu) administers all
proceeds from the sale of the
Protect Wild Dolphins specialty
license plate.
These research grants from
the program are awarded based
on a competitive peer-review
proposal process. The program
makes final grant awards based
on recommendations from an in-
dependent and unbiased panel of
dolphin researchers and resource
managers.
The Protect Wild Dolphins
specialty license plate is avail-
able at all Tax Collectors' offices.
The $20 annual surcharge
supports dolphin research and
conservation in Florida. During
the month of August, Harbor
Branch is partnering with 28
Florida counties to promote sales
of PWD specialty license plates.

s observed last week, some politicians are fond of
counseling: "Never get into an argument with a
man who buys his paper by the truckload and his
ink by the barrel." We buy our ink by the barrel (and plen-
ty of people argue with us anyway). It's sold by the pound,
in 55-gallon barrels. (Larger newspapers have ink delivered
by tank trucks.) A barrel of black printer's ink weighs 470
pounds, and in that quantity, sells for around a dollar a
pound. We average a barrel a month. Our black ink is soy-
based, which reduces the consumption of petroleum and
makes the ink more environmentally friendly. We purchase
colored ink in smaller quantities, typically 80 pounds for
the three basic hues used in full-color printing. Called
process colors, they are magenta (red), cyan (blue) and yel-
low. The price varies by color because of the different chem-
icals used to create each color, and typically costs about
three times as much as black ink. Specially mixed colors
cost about twice as much as the three process colors. S.L.

With today's issue, we begin our editor-
ial endorsements for the 2006 elections.
Like everything else that appears in this
space, our editorial endorsements are
opinions, nothing more. As journalists, it is
both our privilege and our responsibility
to meet most of the candidates for public
office, and to appraise their qualifications.
We are not "telling people how to vote;"
we are expressing our viewpoint. We wel-
come viewpoints from our readers,
whether in agreement with or in opposi-
tion to our own. (When we say "our read-
ers," we mean just that; we discard mass
mailings from non-subscribers.)
In past years, we have made it a point to
say positive things about some politicians
whose candidacies we do not support. At
least one candidate has taken such remarks
out of context and quoted them to make it
appear in his advertising that we endorsed
him, when exactly the opposite was true.
We will try to avoid setting ourselves up
'for that type of misrepresentation this year.
In many cases, our appraisal is made in
one-on-one interviews; in the case of
today's endorsements for governor, it is
based on having attended two face-to-face
debates, and having had the opportunity
to visit briefly with all four of the major
candidates.

There are two major candidates running
for governor from each major party. At
first glance, there is little separating the
duo running in each party. (There are 15
"dark horse" candidates, many running as
write-in or no-party candidates, including
one who filed for office simply as "Bob."
The elective process guarantees their fight
to run for office, but their chances of win-
ning the election are too remote to calcu-
late.)
As the campaign has developed, we
have seen significant differences in their
campaign tactics, and one member from
each party strikes us as clearly the better
choice.

Republican: Charlie Crist

The Republican candidates are Charlie
Crist and Tom Gallagher, both members of
Florida's elected cabinet. Both link them-
selves to the state's popular governor, Jeb
Bush, promising to carry on with what he


does best while improving in other areas.
Gallagher has been hammering the vot-
ers with what a devoted family man he is,
in an apparent attempt to overcome the
revelation of a less than amicable previous
divorce, and to point out that Crist is a
bachelor without children. Neither has
anything of consequence to do with gov-
erning Florida.
He promises to protect us from "liberal
Massachusetts judges" and to tear down
billboards for "adult businesses."
Crist is focusing on such issues as edu-
cation, taxes, and out-6f-control insurance
costs, all of which are more important than
billboards and Massachusetts judges.
He has shown himself to be an adept
consensus builder in his campaign, and we
believe he would bring that same talent to
the governor's office.
Charlie Crist is*our recommendation for
the Republican nomination.

Democrat: Jim Davis

Both Jim Davis and Rod Smith, the two
major Democratic candidates, find the
Republican administration of Jeb Bush to
fall short of the mark, and promise a new
direction for state government. There is lit-
tle difference in their positions. There is
much difference in their styles.
Smith campaigns like the former prose-
cutor that he is: strong on rhetoric inter-
spersed with wisecracks.
Davis takes a.more dignified approach.
He seems more interested in getting his
point across than in playing to the crowd.
As governor, we believe that would make
him the more effective leader.

The Peril of Pointing a Gun

a gun at Storer's face as he sat in
his truck late at night in front of
his restaurant, Sumos Thai Cafe,
on East Twiggs Street.
The weapon was a BB gun,
but clearly looked like a nickel-
plated .45 caliber automatic.
Storer managed to hide
$2,000 in his truck before Wilson
marched him at gunpoint inside
the restaurant, where Wilson took
a bag of change, then left.
Storer locked the door and
called 911, then returned to his
truck and started pursuing
Wilson while remaining on a
cordless phone with the 911 oper-
ator until his phone lost the sig-
nal.
Storer ran over Wilson,
killing him.
A good argument can be made
that Storer, having called the
police, should have sat back and
let them do the job, if they were
able to get to the scene in time to
catch the fleeing gunman. That
would have been the safer course


of action, and would have ended
any accusation of vigilante jus-
tice.
SThat is the decision that a
calm, cool and collected citizen
would have made.
Having just had what
appeared to be a deadly weapon
shoved in his face, Storer presum-
ably was neither calm, cool nor
collected. He was, we may safely
guess, both outraged and scared
out of his wits.
He took an action that was nei-
ther rational nor merciful.
Does that make him a felon
deserving of a 15-year prison sen-
tence? Not in my opinion, or the
jury's.
Let there be no mistake about
it: I don't countenance vigilante
justice.
But when you decide to stick a
gun in a guy's face, you have
decided to start it.
And you do so at the peril that
the other guy not you may
decide when and how to end it.

Defend The Pledge of Allegiance

in favor to 167 against to keep
"one nation under God" in our
nation's Pledge of Allegiance.
Now this issue, HR2389, will go
to the Senate for a vote.
How ironic, when we look
back upon all the documents that
our founding fathers created and
see how God is clearly in the fore-
front of all of them. Our founders
were men and women of prayer.
Their faith played an inseparable
part of the fiber of their lives.
History reflects how much they
relied on God in the course of all
the decisions they made.
Never before in the history of
our country have we been at the
crossroads we now face. There is
no longer any room for lip service
when it comes to where we stand
in our relationship with God.
God sees all, knows all, hears all
and can influence all.
Our relationship with God can'
be very much like a husband who
rarely communicates with his
wife and soon they find them-
selves strangers in the same
house. We cannot exclude God
and expect His protection, guid-
ance and blessings upon our peo-
ple.
I was a senior in high school
when the words "under God"
were added to our pledge. Since


then, prayer has been taken out
of our schools, the Ten
Commandments removed from a
courthouse and other issues have
removed our country further
from asking for God's blessings
upon our actions.
When our nation's leaders are
ashamed to acknowledge that
God is sovereign and we need
His Divine blessings, guidance
and protection, then we are des-
tined for a fall. Prayer has been at
the heart of our nation during
every past war, national disaster
and major decision, and rightly
so.
When we look at the U.S. cur-
rency, it says "In God We Trust,"
but then I ask myself, "Are we, as
a nation, really putting our trust
in God?"
During my lifetime, I have
seen how legislators' ability to
bring about consensus on deci-
sions affecting the overall good of
our nation has eroded. How bick-
ering, hotheaded and unruly, dis-
agreements have often hampered
passage of seemingly good legis-
lation.
When political parties,
Republicans, Democrats or
Independents, seek to win their
own issues, often at the expense
of what is really best for the
nation's interest they have
missed the mark in serving the


people.
With the world terrorism, eco-
nomic and social problems of our
day, we need to come together as
a nation. United, we can stand
against the opposition facing our
nation.
Regardless of your individual
position upon our involvement in
Iraq and Afghanistan, when I
read that our troops are dealing
with high temperatures of 122
and lows of 111 in such hot,
sandy desert lands, I'm obliged
to pray for their safety, strength
and endurance.
I served in the U.S. Air Force
for 23 years and my son also
served in the U.S. Air Force for 23
years and I care about this coun-
try more than I can ever begin to
put into words.
Never in my lifetime can I
remember a time when our sena-
tors need to come together, with
one voice, to approve including
the words "One Nation Under
God" as a permanent part of our
Pledge of Allegiance.
We need to honor the blood,
sweat and tears shed by the
founders of our democracy and
acknowledge Almighty God who
has made all our achievements
possible.

Hillsborough County jurors
sent a clear signal to criminals in
Tampa last week:
(1)If you point a gun at the
head of a law-abiding citizen,
you do so at your peril.
(2) That peril may not end
when you quit pointing the gun
at your victim's head.

cent of manslaughter for:running
down and killing a man who had
just robbed him at gunpoint.
Admittedly, 'it was a close call
from a legal standpoint.
We have law enforcement
agencies and a court system to
discourage vigilante justice,
among other reasons. As frustrat-
ing as the criminal justice system
may be sometimes, it is a far bet-
ter alternative than stringing up a
horse thief from the nearest tree.

Huey Harris
Sellers
Huey Harris Sellers, 82, of Al-
bany, Ga., who has family in
Bartow, died Sunday Aug. 6,
2006, at his residence following
an illness.
A native of Wisner La., Mr.
Sellers moved to Albany in 1965.
He was a member of the U.S.
Navy serving during World War
II, seeing duty during the Pacific
Theatre.
Upon being honorably dis-
charged in 1946, he returned to
Central Florida to work for an
uncle, Will Sellers, in the family
department store, and later be-
came a tile contractor.
He moved to Albany in 1965,
and with the assistance of his
nephew, Glenn Denmark,
started D&S Tile, later named
Sellers Tile. He retired in 1968.
Mr. Sellers was of the Baptist
faith, but attended Covenant
Presbyterian. He was a member
of the Veterans of Foreign Wars
and the American Legion.
He enjoyed gardening; fish-
ing, animals; and all sports, es-
pecially the Atlanta Braves and
the Georgia Bulldogs.
Mr. Sellers was preceded in
death by his parents, Andrew
McNeil and Mattie Harper Sell-
ers; a twin sister, Ruey Sellers:
two brothers, Alvin Sellers and
Cecil Sellers; and a sister Vera
Sellers.
SHe is survived by his wife o:
59 years, Norma Chisholm Sell-
ers; a son, Larry Sellers and his
wife, Lgty; two -daughters, Di-
anne Sellers and Kathy E. Sell-
ers, all of Albany; a granddaugh-
ter, Llewelyn Brillantes Sellers
of Athens, Ga.; a brother, James
Bradley Sellers of Bartow; two

Raschke
Johanna E. Raschke, 91, of
BArtow, died of complications of
Alzheimer's disease Thursday,
Aug. 3, 2006, in Lakeland.
Born in Bridgeport, Conn., on
Sept. 12, 1914, Mrs. Raschke
moved to Bartow from Trumbull,
Conn., 14 years ago.
She was an assembler at
United Aircraft Sikorsky in
Stratford, Conn., for 25 years.
She was a member of Re-
deemer Lutheran Church in Bar-
tow, Veterans of Foreign Wars
Auxiliary of Stratfort, Conn.,
and American Legion Auxiliary
of Fairfield, Conn.
Mrs. Raschke was preceded in
death by her sister, Martha
SBurr.
Survivors include her hus-
band, Paul Raschke; one son,
Paul James Raschke of Emily,
Minn.; a daughter,. Linda
Schweitzer of West Linn, Ore.;

tow,.died of cancer Friday, Aug.
4, 2006, at Bartow Center.
Born in West Chester, Pa., on
March 2,. 1950, Mrs.. Reyes
moved to Bartow 20 years ago.
She was a cashier at 7-
Eleven.
Mrs. Reyes was preceded in
death by her husband, Jerardo
Reyes.
Survivors include her father,
- Wilbert Lyster of Pennsgrove,
SN.J.; two brothers, Thomas Lys-
ter and Richard Lyster, both of
Pennsgrove,. N.J.; one sister,
Bonnie Lyster of Oxford, Pa.;
f two sons, Keith Foldo of Oxford,
- Pa., and David Foldo, Jr.., of
Newark, Del.; one step-son,
- Jerado Reyes, Jr., of Bryan,
- Texas;'fiv step-daughters, Mary
- Ramirez of Pontiac, Mich., Hope
; Reyes of Mulberry, Cecilia De-
sena of Saginaw, Mich., Rosa
Gamez of Bryan, Texas, and
