Thursday, August 4, 2011 50¢ Plus tax V ol. 89 No. 31 by Patty BrantCaloosa Belle Hendry County Commissioners made short work of regular business at the August 1 meeting as they continue to focus on the business of balancing the budget. Budget workshops were expected to continue through Wednesday. Chief Deputy Kevin Nelson appeared Monday evening in the sheriff’s stead to discuss the HCSO budget for next year. Commissioner Tris Chapman complained that he has not seen suf cient cutbacks from Constitutional of cers. Without that, he said, he sees no option but to increase taxes. “I don’t want to increase taxes,” he stated, but said he could possibly vote to go to the rollback rate the amount of taxes that would bring the same amount of income as the previous year. Commissioner Karson Turner replied, “Even the rollback rate gives me heartburn.” For his part, Chief Deputy Nelson said Sheriff Whidden inherited the jail expansion from the previous administration with no funds to run it. The expansion requires eight corrections of cers to staff it, which were approved by the commissioners. He said last budget year the HCSO absorbed the full cost of the expansion, along with Budget tricky work Farmerworkers have legal recourseby Patty BrantCaloosa Belle Farmworkers hundreds of miles away from home, as well as many who make their homes here, do tough work in a culture they are often unfamiliar with. They’re bound to come into situations which require legal assistance. For these people, Florida Rural Legal Services is the organization they can turn to for guidance. There are only four attorneys, four paralegals and one intake person to cover the entire state and they are based in Immokalee at 106 S. Second Street. The of ce is open Monday 8:30 a.m.-5 p.m. and Wednesday 9 a.m.-4 p.m. There are six of ces in the state: Immokalee is the main of ce with others at Fort Pierce, West Palm Beach, Lakeland, Belle Glade and Fort Myers. Colin Abbottt is the Migrant Unit Managing Attorney. To qualify for FRLS services, he said, you must be a farmworker in this country legally. In addition, you must be eligible for the particular program you are applying for. A Hendry County resident for over 20 years, Paralegal/Migrant Unit Jesse Mendoza has been with FRLS for the past 12. He is proud of the concern the agency has for its clients. In fact, he said, FRLS has a very strong code “Clients rst!” As with the other staff members, Jesse covers a lot of ground in his job, all over the state and beyond. Still, he said he want to make sure people know FRLS is here and is able to help with many legal issues. Jesse can be reached on his cell phone at 239839-4066. It is FRLS’ mandate to handle wage claims, discrimination issues and problems involving public bene ts like Food Stamps. Services are available in English, Spanish and Creole. Covering the entire state, each attorney has a heavy case load, which Mr. Abbott said is increasing as the need rises. FRLS gets some 60 new cases per month. Forever homes were secured for 3 dogs, 4 cats and 2 rabbits with special reduced adoption fees to approved applicants. The Caloosa Humane Society, a no-kill facility, provides low-cost spay and neuter services, as well as providing care to homeless pets. The 10th anniversary celebration welcomed all area residents and their animals for a day of fun. The idea is to go out and meet the client and provide immediate help if necessary. They can also offer referrals for all types of aid. Attorneys and paralegals head out to work camps throughout the state but often focus on this area because many migrant families are living here, not just working here. In addition to actual legal problems, outreach covers training in issues like pesticide use hopefully using education to prevent potential human and legal issues. FRLS is heavily involved in helping v ictims of human traf cking. In cases of human traf cking, they can even help undocumented workers, but only if they're farmworkers. Unique to Florida, FRLS has ingress/ egress rights to farmworker facilities, even on private property, he added. FRLS staff have the right to go in and take workers out of the eld if they suspect human traf cking. If they are not admitted, attorneys can get an injunction, if necessary. Workers also have the right to ask FRLS to come onto a farm, grove or camp, he said. However, Mr. Abbott said they mainly have good relations with crew leaders and don't often have access problems. FRLS has a list of all guest workers in the state, most of whom do not know their rights. He said they need to be aware that farmw orkers can call his of ce for justice, even after they're back home in their own country, to make a complaint on some types of issues. FRLS can still help with nonpayment issues. If they have their own records pay stubs, etc., it can make the process much faster and easier, he said. FRLS can co-counsel with other agencies to represent clients and can also be of direct service between states. Mr. Abbott is licensed in all three Florida federal districts as well, and handles his share of cases with the entire staff. For him, that amounts to about 180 cases at any given time. FRLS attorney Amanda Caldwell is involved in human traf cking education. Migrant workers often also fall prey to the unlawful practice of law, such as someone representing themselves as a lawyer and providing false immigration papers, tax returns etc. Mr. Abbott is a member of the Florida Bar committee governing this area of law. Each attorney has cards listing their cell phone numbers and hands them out to possible clients. This provides direct contact with an attorney or paralegal to farmworkers, should they need it. Supervising Attorney Soli MercadoSpencer is currently implementing her new Get Paid program, which tries to ensure that all farmworkers receive all the pay they're entitled to. FRLS attorneys are there to make a difference with small cases, too, she said. In time, she hopes to expand the Get Paid program throughout the state. Soli was an intern in Indiana University in its migrant worker program and found she had an af nity with farmworkers who receive low pay and no respect. She said there are really bad conditions in Indiana due to the shorter season in the Mid West. Housing is done by employers there. She said farmworkers often don't call for help because they're afraid of losing their job. However, they have as much as two years to make a wage claim, she said. The federal minimum wage is $7.25 at this time, although there are different pay schedules that can be used. They may be paid hourly or get a piece rate, whichever is greater. Either way they cannot be paid in total less than minimum wage. Soli points out that farmworkers must also be paid for time waiting to start working. For instance, if they're stuck on a bus till a eld dries enough to be picked, they must be paid for the time they wait. FRLS cannot represent undocumented workers except in cases of human traf cking or domestic violence; nor can they handle class action suits. As of last December, FRLS can collect fees from clients, which go to support the program. This practice should help cushion expected budget cuts. A social worker is available to meet with family caregivers at the United Way House in LaBelle on the rst Wednesday of each month. Free assistance offered includes an opportunity for caregivers to learn more about Alzheimer’s disease and aging issues. The center’s social worker works with family caregivers to develop effective coping strategies and learn how to access community resources. CPD Of cer Mallery was arresting of cer. a 20 percent increase in insurance over two years. He said Sheriff Whidden cut the command staff from eight to four, putting more of cers on the street. He added that the state average is .17 of cers per 1,000 population. Hendry County has .08 of cers per 1,000 population. Capt. Nelson said the only way to cut $1 million from the HCSO budget would be to cut 20 deputy positions. He also noted that next year the SO will have to assume four of cers that have been funded by the COPS grant. He added that statistics show property crimes are up, while violent crime is down. The HCSO has also seen increases in utility bills and a 33 percent rise in fuel costs this past year. In addition, the state will require all public safety agencies to change radio systems. Public Safety Director Randy Bengston said the best move would be to an 800 megahertz system like most of the state. However, there is an option to go with narrow band, which will allow the continued use of VHF radios.Sports park assessment The board backed up the City of LaBelle’s plan to set up a uniform assessment rate for the West Hendry Rec Board. The additional funds will allow the completion of the new Sports Park and an 18-hole golf course.Local vendor preferenceThe commission continued the Local Vendor Preference Ordinance, giving additional points to local contractors bidding for county jobs, for another two years. The ordinance will be revisited August 1, 2013. Commissioner Tris Chapman said he was concerned that a lack of competition could set in after the economy rebounds. Commissioner Karson Turner agreed, adding that the goal is to increase the percentage of local subs working on construction projects. BOCCContinued From Page 1

In answer to What’s good for the goose . I am the of ce administrator for POA Unit 4. First off I would like to thank all the homeowners who go above and beyond by mowing past their property lines, THANK YOU! I know this is not your responsiblity but you do it any way. I am very aware of the high greenbelts. I have collated with Barron Water (who mows the ditch banks in Unit 4) and the County Of ce (who mows the side of the road in Unit 4) and Grow Works (who mows our greenbelts in Unit 4) so they all mow at the same time and the place looks nice. We, as well as the other two of ces only budget to mow these areas 7 to 8 times a year. I know with the rainy season this is hard to cope with. I am very sorry for any inconvenience this may have caused to the homeowners. Please do not hesitate to call the of ce and check on the schedule date for the mowing times. (863) 675-4168. And for the person who who wrote in, the only way I knew your grass was to tall is because I rode by 12 days after our greenbelts were mowed on (6/26/11) and your property stuck out like a sore thumb. Parents need to make sure their children have received the proper immunizations as required by law. The Hendry and Glades County Health Departments can provide school vaccinations (free of charge) for children from infants through the age of 18. Please be advised that there are changes to the required vaccines for school entry. The new change in the vaccination schedule requires a fourth dose of the polio vaccine within a shorter time period. This means a child should have an additional polio vaccination six months after their rst dose or after they turn four years old. Studies from the Centers for Disease Control and Prevention (CDC) shows the vaccine works better when given on this schedule. Students must have proof of immunization on a Department of Health form (DOH 680 form). This form has been referred to as a “blue card” because it used to be printed on blue paper, however, the DOH 680 form can be in any color. Students entering kindergarten are required to have the following vaccinations:  (5) DTaP (Diphtheria, Tetanus, Pertussis): If the 4th DTaP vaccine is administered on or after the fourth birthday, a 5th DTaP is not required.  (5) Polio: If the 4th dose is administered on or after the fourth birthday, a 5th dose is not required.  (2) MMR (Measles, Mumps, Rubella)  (3) Hepatitis B  (2) Varicella (Chickenpox) Students entering 7th grade must receive a Tdap (tetanus, diphtheria, and pertussis) booster. Immunizations will be provided at the following locations: Hendry County Health Department:  Clewiston 1100 South Olympia St. 8 a.m.-4:30 p.m., Monday through Friday.  LaBelle – 1140 Pratt Blvd 8 a.m.4:30 p.m., Monday through Friday. Awaiting The King was the theme for the conference that featured a bridal fashion show in which ten beautiful wedding dresses were modeled by local young women. There was wonderful music, a dance performance and special speakers. Twenty-seven churches were represented by ladies from all over Hendry County as they enjoyed refreshments and wedding cakes that were generously donated by local restaurants and bakers. Dozens of door prizes and gift certi cates were given out to ladies of all ages. The civic center was decorated like a wedding reception with purple being the accent color and white roses on the center of each table. The stage, which was decorated with beautiful white lattice, was draped with royal purple satin while beautiful palm trees and numerous other plants were placed all around the hall to provide an ambiance of a garden party. Rev. Sherry Hanes delivered the main message about sexual purity and abstinence. Numerous young women signed a purity contract and received a sterling silver purity ring and white rose representing the promise of abstinence before marriage. Rev. Hanes has a heart for this community and feels she has been called back to ministry here after leaving LaBelle for ve years to minister in Georgia with her daughter and son-in-law, who is the Music Minister of a large church in Jessup, Ga. One of her goals is to bring people from all different walks of life together regardless of age, race or church denomination. A huge thank you goes out to the entire community from Rev. Hanes and her executive board for your help and support to make it possible to have a successful conference here at home in LaBelle. A lpha Theodore Farabee Sr.LABELLE — Alpha Theodore Farabee Sr. (Ted) died on July 26, 2011, at Gulf Coast Medical Center in Fort Myers. Viewing was held at the Akin-Davis Funeral Home on Saturday, J uly 30, 2011, from 6 to 9 p.m. A Home Going Celebration w as held at the Labelle Church of God on Sunday, July 31, 2011, at 3 p.m. Interment was in Fort Denaud Cemetery. Ted was born Jan. 23, 1923, in Arcadia, Florida. He spent his childhood in Rainey Slough near Venus, Fla. He is one of the few left who attended the one room school house that is still standing at Rainey Slough on Farabee Rd. He later attended Labelle High School where he played football. Later he served in the U.S. Coast Guard during WWII in the Philippines and the Sea of Japan until the end of the w ar. At seventeen he went to electrical school in Chicago and then remained in electrical work until he retired from FPL as chief electrician after 36 years, and after retirement worked at A ce Hardware on a part-time basis. For 58 years, Ted served his Lord and his church in various positions including Sunday school superintendent, Sunday school teacher, Pastor’s council, and church clerk. He was an active member of the Labelle Church of God, and made it his personal goal to tell everyone he met about the love of Christ. He was preceded in death by his parents, Samuel Lardner Farabee and Lula Harn Farabee; his brother, Noran C. Farabee; his sister, Lucille Farabee Clark; and his daughter, Judith Farabee Crawford. He is survived by his wife of 67 years, Mattie Gray Farabee; his children, A. T. Farabee Jr., James Wesley Farabee, Thomas Wayne Farabee, and Dale Anthony Farabee; and two brothers, Wilbur A. Farabee and Jack H. Farabee. He has 20 grandchildren and 31 great-grandchildren. At the tender age of 88 years Ted has achieved his great reward. He will be sorely missed by his family and friends, but we look forward to seeing him again in the ‘Sweet by and by’.Juanita Irene Collins, 75LABELLE — Juanita Irene Collins, age 75, of LaBelle, passed away July 26, 2011, in Lehigh Acres. Reynolds, 62LABELLE — Stephen J. Reynolds, 62, died peacefully in his sleep while in his home on July 21, 2011. Born on Aug. 20, 1948, in Wilkes-Barre, Pa., he was proudly adopted two days later by Martin E. Reynolds and Felicia Serio Reynolds and grew up and lived in Wellsville, N.Y. He graduated from Wellsville High School in 1967 and went on to attend Alfred Ag-Tech College. He was drafted into the US Army in August 1968 and served until July 1971 in Germany and attained the rank of Sergeant. Stephen came to Florida and worked as a plumber and was later hired by Lee County where he obtained his Class A Water Treatment Operator’s License. He then attended the Fort Myers Criminal Justice Academy and became a Certi ed Corrections Of cer and worked for Hendry Correctional Institution, the Hendry County Sheriff’s Of ce and the Moore Haven Correctional Facility. He was also an Auxiliary Deputy for Hendry County and proud to be a member of the Dana Weekly American Legion Post #130 in LaBelle. He is survived by his wife, Tricia K. Reynolds of LaBelle; sons, John Thomas Reynolds (Mary) of Lehigh and Nicholas Alan Reynolds (Julie) of LaBelle; sister, Ursula Reynolds Gray (Brian) of Wellsville, N.Y.; ex-wife, Janet K. Reynolds of Lehigh; several nephews and a niece; and his wife’s parents, Karl and Beverly Wendorf of Port Orange, Fla.; as well as several brothers and sisters-in-law. He was predeceased in death by his father, Martin Reynolds, in February of 1987; and his mother, Felicia Reynolds, in October 1996. Arrangements for cremation have been made by the Akin-Davis Funeral Home of LaBelle. The family suggests that any memorials be made in the form of a contribution in Stephen’s name to the charity of the donor’s choice. A memorial service will be held on Stephen’s birthday, Aug. 20, 2011, at the American Legion Post, LaBelle at 10:30 a.m. and a luncheon will follow. Sports Shorts The conference room at Barron Library became a science laboratory for a short time on Tuesday, as a team from Southwest Florida Research and Education Center in Immokalee, under the direction of Dr. Jones, taught the children about insects. Pan traps were set out around the library property on Monday afternoon in preparation for the Tuesday event. A few young library patrons volunteered to help Dr. Jones and her assistant Dr. Monzo, place approximately 40 multi-colored bowls lled with a liquid solution under plants and trees to collect insects. The bowls were all collected Tuesday morning and children helped determine which color bowl attracts more insects. Dr. Monzo also presented a slide show of different insects and spoke about their characteristics. The children were quite entertained by a Click Bug that was randoml y brought in on a piece of moss. Each child left with a magnifying glass to inspect an y insects they may nd. The library is grateful for the willingness of Dr. Jones and her team to participate in the summer program. There were piles of sterling silver items like old silverware sets and tea pots. Company ofcials reported spending over $90,000 the rst day of the event, alone.
