Journal of the House of Representatives for a Special Apportionment Session of the Seventh Legislature
under the Constitution of 1968, convened by Proclamation of the Governor and held at the Capitol in the City
of Tallahassee in the State of Florida, on Friday, March 26, 1982.



The House was called to order at 10:00 a.m. by the Honor-
able Ralph H. Haben, Jr., Speaker, pursuant to the following
Proclamation, which was read:

TO THE HONORABLE MEMBERS OF THE FLORIDA
SENATE AND THE HOUSE OF REPRESENTATIVES:
WHEREAS, the Legislature of the State of Florida convened
in Regular Session for the year 1982 on January 18, 1982, and
WHEREAS, the Legislature on March 18, 1982 extended the
Regular Session and has adjourned sine die March 25, 1982, and
WHEREAS, the Legislature, during the Regular Session of
1982 and the extension thereof, failed to apportion the State as
required by Article III, Section 16 of the Florida Constitution,
and
WHEREAS, it is my duty as Governor under Article III,
Section 16 of the Florida Constitution to reconvene the Legis-
lature in Special Apportionment Session,
NOW, THEREFORE, I, BOB GRAHAM, as Governor of the
State of Florida, in obedience to my constitutional duty and
by virtue of the power and authority vested in me by Article
III, Section 16 of the Florida Constitution, do hereby proclaim
as follows:
Section 1.
That the Legislature of the State of Florida be and is hereby
convened in Special Apportionment Session pursuant to Article
III, Section 16 of the Florida Constitution, commencing at
10:00 a.m., Friday, March 26, 1982 and extending through noon,
March 29, 1982.
Section 2.
That, pursuant to Article III, Section 16 of the Florida
Constitution, no other business than apportionment shall be
considered at this Special Apportionment Session and it shall
be the mandatory duty of the Legislature to adopt a joint reso-
lution of apportionment.



IN TESTIMONY WHEREOF, I have
hereunto set my hand and caused the
Great Seal of the State of Florida to
be affixed to this Proclamation con-
vening the Legislature in special ap-
portionment session, at the Capitol,
this 25th day of March 1982.

By Representative Moffitt-
HJR 1-C-A joint resolution of apportionment; providing
for the apportionment of the Legislature into a House of
Representatives of 120 members and a Senate of 40 members;
adopting the federal decennial census for use in such appor-
tionment; declaring the state policies and goals followed by
the Legislature in such apportionment; prescribing repre-
sentative and senatorial districts; providing a 4-year term
for all senators except those elected in 1982 from odd-numbered
districts who shall be elected for 2 years; providing for omitted
areas; providing severability of invalid portions; providing
effective dates.
-was read the first time. On motion by Rep. Moffitt, the
rules were waived and the joint resolution was read the second
time.

Amendment 7-On page 2, lines 26 through 31 and on page
3, lines 1 through 6, strike all said lines and insert: The
Florida Senate interprets Article III of the Florida Constitution
to indicate that senators elected in 1980 would not be required
to seek reelection in 1982 and the Florida House of Repre-
sentatives interprets Article III of the Florida Constitution to
indicate that all 40 senators are required to seek reelection in
1982 because of reapportionment, thereby causing an irreconcil-
able impasse on the issue of election and terms of senators.
Therefore, the Florida House of Representatives and the Florida
Senate urge the Supreme Court of Florida to take jurisdiction
of these matters and render its opinion.

Representative Dunbar offered the following amendment:
Amendment 9-On page 2, lines 26-31, strike all of said
lines and insert: WHEREAS, the House of Representatives has
declared the policy that elections should be held in 1982 for all
Senate districts as reapportioned by this Resolution; and
WHEREAS, the Senate has declared the policy that senators
elected in 1980 from odd-numbered districts should continue in
office until 1984; and
WHEREAS, the Senate and the House of Representatives
have reached an irreconcilable impasse on the foregoing issue;
THEREFORE, the Legislature urges the Supreme Court to
assume jurisdiction pursuant to Article III, Section 16(b),
Florida Constitution, and resolve this issue.

In the event that the Supreme Court decides that elections
should be held in 1982 for all Senate districts as reapportioned
by this Joint Resolution, then elections shall be held for all
Senate districts at the general election in November, 1982, with
senators elected from even-numbered districts being elected to
four-year terms ending in 1986 and senators elected from odd-
numbered districts being elected to two-year terms ending in
1984 and all senators being thereafter elected to staggered four-
year terms.
In the event that the Supreme Court decides that senators
elected in 1980 from odd-numbered districts should continue in
office until 1984, then elections shall be held for all even-num-
bered Senate districts at the general election to be held in
November, 1982, and elections shall be held for all odd-numbered
Senate districts at the general election to be held in November,
1984, all senators being elected to four-year terms.

Representatives Boles and Girardeau reported that the voting
machine had not recorded their "Yea" votes and hence their
votes were added, without objection, to the roll call because
of the apparent machine malfunction.

mediately certified to the Senate after engrossment.

Explanation of Vote

Due to longstanding previous commitments, my absence from
Tallahassee for a few hours today was unavoidable; however,



had I been present to vote on HJR 1-C, I would have voted
yea, just as I had on this matter during the regular session.
