The
Government's Proposals for
Further Constitutional Change


The constitutional changes incorporated in the Sierra Leone
House of Representatives Order-in-Council, 1956, were limited to the
structure and membership of the Legislature. However, it had been
agreed that an early duty of the new House of Representatives would
be to consider proposals for changes in the composition and functions
of the Executive Council and other related matters.

2. Government now considers, after exploratory talks with
Her Majesty's Government in the United Kingdom, that the
following proposals for changes in the Executive should be made:
I-The Executive Council:
(1) The Executive Council shall consist of the Governor,
the Premier and not less than seven other Ministers, all
of whom shall be chosen from among the elected members
of the House of Representatives, and the Governor shall
preside over the Council.
(2) The Governor shall in his discretion appoint as Premier
the person who appears to him to command a majority
in the House of Representatives.

(3) On the recommendation of the Premier the Governor
shall appoint and allocate responsibilities to the other
Ministers.
(4) Whenever the Premier is ill or is absent from the country
the Governor may, on the advice of the Premier, appoint
one of the Ministers to act as Premier.










(5) Ministers shall be required to resign office at the discretion
of the Premier. They shall also vacate office when the
Premier does so, subject to the usual provisions enabling
Government to be carried on until the appointment of
the new Premier.

II-The Governor:
(1) Subject to the safeguarding of his ultimate responsibility
for the peace and good government of the territory, the
Governor shall consult the Executive Council and act on
its advice. The Governor's general reserved Executive
and Legislative Powers shall in consequence be redefined
in the Royal Instructions.
(2) External Affairs, Defence, Internal Security, Police and
the Public Service shall be subjects specially reserved to
the Governor.

III-The Deputy Governor:
(1) There shall be'a Deputy Governor who shall be appointed
by the Governor acting on Royal Instructions.
(2) The Deputy Governor shall not be a member of the
Executive Council; he shall, however, preside over the
Executive Council in the absence of the Governor.

IV-The Future of Certain Posts:
(1) The Attorney-General
(a) The Attorney-General shall cease to be a member of the
Executive Council, but shall continue to be an officer
of the Public Service and the Legal Adviser to the
Government. As Government does not propose to
recommend the creation of a Ministry of Justice, the
Attorney-General shall be provided with the papers and
decisions of the Executive Council and may be called
upon to attend Executive Council whenever his legal
advice is required.









(b) He shall be responsible for the initiation, conduct and
discontinuance of criminal proceedings.
(c) The Attorney-General shall also, at the request of
Government, be able to attend meetings of the House
of Representatives with the right to speak, but not to
vote. One of the Ministers will answer questions in
the House relating to the Legal and Judicial Depart-
ments.
(2) The Financial Secretary
The Financial Secretary shall cease to be a member of the
Executive Council, but shall continue to be an officer
of the Public Service and the principal Financial Adviser
to the Government. The Government proposes to
recommend the creation of a Ministry of Finance or other
suitable Ministry.

(3) The Chief Secretary
This post shall cease to exist on the' coming into force
of the new Order-in-Council. Such functions presently
performed by the Chief Secretary which are not related to
the subjects reserved to the Governor, shall be allocated
to the appropriate Ministries.
(4) The Chief Commissioner
The Chief Commissioner shall cease to be a member of
the Executive Council. Alternative administrative
arrangements will be made and the post of Chief Com-
missioner will cease to exist.

V-The Public Service:
(1) The Governor shall continue to have full responsibility
for the control of the Public Service and shall make
appointments and promotions and take disciplinary
measures as at present with the advice of the Public
Service Commission.










(2) Government wishes to assure all members of the Public
Service that the constitutional changes proposed in this
White Paper do not in any way lessen the responsibility
of the Governor and the Secretary of State for the Colonies
for the well-being of the Public Service,' nor are they
intended adversely to affect the Service.

VI-Constitutional Instruments:
If these Proposals are adopted, Her Majesty's Govern-
ment will be requested to make the necessary consequen-
tial changes in the Sierra Leone Royal Instructions,
1956, and the Sierra Leone (House of Representatives)
Order-in-Council, 1956.
