I. / PHILIP F. ASHLER DUTIES OF THE STATE TREASURER The Florida Constitution establishes the Treasurer as one of the six-member elected State Cabinet and stipulates that "The treasurer shall keep all state funds and securities" and "shall disburse state funds" (By Comptroller's warrant countersigned by the Governor). In addition to these conventional Treasury functions, a further responsibility has evolved over the recent past-namely the maximi- zation of investment of the State's pool of operating funds in order to increase revenues for the taxpayer's benefit. Supported by a recommendation from the Treasurer and his Banking and Finance Advisory Committee, the 1971 Legislature formally endorsed this concept, enacting a statute which makes it incumbent upon the Treasurer, "consistent with the cash requirements of the state, to keep such money fully invested or deposited in interest-bearing time deposits ... in order that the state may realize maximum earnings and benefits to the economy." In addition to his Treasury duties, the State Treasurer is the Insurance Commissioner of the State of Florida, administrator of the Automobile Financial Responsibility Law, State Fire Marshal and a member of the following governmental bodies: CONSTITUTIONAL BOARDS Board of Administration S Board of Education Board of Pardons STATUTORY BOARDS, DEPARTMENTS AND COMMISSIONS Administration Commission Department of Natural Resources Elections Canvassing Commission Department of Revenue Department of General Services Board of Trustees of the Department of Highway Safety Internal Improvement Trust Fund and Motor Vehicles Interstate Cooperation Commission Department of Law Enforcement Governor's Highway Safety Commis- sion 3 TREASURER'S COMMENTS When appointed State Treasurer, my initial concern was to become thoroughly familiar with the Treasury's investment program and procedures. Particular attention was addressed to placement of time deposits in Florida banks and at least one significant change has come about as a result-namely, a more extensive use of telephone bids, and competitive interest rate quotations from banks when new time deposits are offered by the Treasury. Section 18.10, Florida Statutes, which governs the Treasury's activities in this respect, stipulates that the State's money shall be invested in such manner as will "maximize earnings and benefits to the economy." Several techniques are used to achieve these dual purposes. One is the use of a formula under which the office of the State Board of Administration (Governor, Comptroller, Treasurer) conducts a twice-weekly polling of not less than five (recently increased to eight at my request) sizeable Florida banks to determine the interest rates offered by them on fully collateralized time deposits. Rates are obtained on four maturities: 90 days, 180 days, 1 year and 2 years. Simultaneously, quotations are secured on U.S. Treasury bills with similar maturities. Then the average time deposit rate and average Treasury bill rate is computed for each maturity and whichever is higher, in each case, becomes the minimum acceptable rate for State Treasury time deposits of that duration. The rates so developed tend to be approximately as high as the traffic will bear. All banks receive equal treatment in the monthly renewal offers of existing deposits which normally involve several hundred banks per month. All money not accepted by banks or that which is needed as a ready reserve for bill-paying purposes is of course invested in U.S. Treasury securities. As of June 30, 1975, the Treasury had time deposits in 651 of the 737 banks in Florida. In an effort to bolster the state economy, the Treasury tries to systematically distribute its time deposits among the counties in proportion to each county's contributions to total sales tax collections. The latter is recognized as an excellent indicator of economic activity in a given county and also provides a guideline for returning a portion of tax revenues to the economy of the area where they originated. Of benefit to new banks is the Treasury's so called "opening-day time deposit" which is routinely granted to any new bank which makes a request and will meet the Treasury's terms as to interest rate, maturity date and collateral. A third way in which the Treasury makes an extra effort to help regional economy is through the placement of time deposits in "disaster areas" where lendable funds are urgently needed. As Fiscal 1974-75 progressed, there was very little money available for new time deposits. Nonetheless, in the entire year, a total of $52 4 million in new deposits was placed, most of it in the first two months. As the recession deepened, few banks appeared interested in State funds at the rates asked by the Treasury. By December, the decline in major sources of revenue made it necessary, for the first time in three years, to withdraw a portion of time deposits as they matured. Incidentally, no withdrawals were made from small banks, on the theory that the larger the bank, the less the effect. By the end of the fiscal year, a total of $103.7 million had been withdrawn and $47.9 million had been turned back to the Treasury by banks declining to renew maturing deposits. The final result was a net decline for the fiscal year of approximately $100 million in total time deposits-from $627 million to $527 million. Similarly, the average daily balance invested in U.S. Treasury securities declined from $281 million in June 1974 to $111 million in June 1975, reflecting the use of surplus to compensate for declining revenues and rising expenditures. It is a pleasure to report that the Treasury's annual contribution to State revenues-in the form of interest earnings, all of which are deposited in the General Revenue Fund-was a bright spot in an otherwise somewhat gloomy State revenue picture. Having reached a new all-time high of $71.6 million for the year ending June 30, 1975, these earnings, combined with some $10 million earned by the Working Capital Fund, constituted the fifth largest source of income for the General Revenue Fund, following the Sales Tax, Corporation Income Tax, Beverage Tax, and Motor Vehicle Licenses, in the order named. An important accomplishment during the year was the action by the State Board of Administration on June 3, 1975, when, on the recommendation of the Governor's Commission on Management and Efficiency, the Board closed five of the Treasury's eleven demand accounts. Added income through investing a major portion of the money formerly held in these non-interest-bearing accounts is estimated to be in excess of $400,000 per year at the current level of interest rates. In compliance with a 1974 statutory change, the Treasury is engaged in a joint effort with the Department of Administration to bring under closer surveillance the many State agencies' demand accounts not under the Treasurer's jurisdiction, known as Clearing Accounts and Revolving Funds. The opening of such accounts must be initially authorized by the Department of Administration. The new statute requires agencies to report quarterly to the Treasurer the balances in these accounts and amounts that will eventually be remitted to the Treasury. It has become increasingly clear to me that no responsibility of Florida's State Treasurer is greater than his role as treasurer ex 5 officio of the State Board of Administration. The fact that the office of the Board not only administers all bonded indebtedness (now $2.69 billion) directly involving the State government but also invests the various trust funds (including pension fund investments in the Treasurer's custody which alone total $1.83 billion) makes evident the importance of the three Board members' responsibilities in this area. Another function that is growing in importance as the general level of interest rates moves higher is the statutory requirement that bonds or other debt instruments "issued by counties, municipalities, towns, villages, districts, commissions, authorities, or any other public body, agency, or political subdivision of the state" may not bear interest in excess of 7.5% per annum unless the Board of Administration authorizes a higher rate on the basis that "it appears to be in the public interest." I have asked my staff to work with aides of the other two Board members in formulating a definitive policy together with guidelines that will enable the Board to evaluate these requests prudently and to act on them with dispatch. Further, a policy statement is ready for adoption by the Board, delineating the authority and mode of operation of the Investment Advisory Committee which provides guidance to the technicians investing State Retirement System moneys. Monthly earnings from this source fluctuate widely (see right-hand column above), being influenced not only by the frequent changes in the level of interest rates but also by the volume of such securities liquidated by the State Treasury in a particular month. The optimum conditions prevailing in much of Fiscal 1973-74- i.e., high interest rates and large sums available for investment-did not continue very far into the 1974-75 year. Rates on 90-day Treasury Bills moved briefly above 9% in August 1975 but declined steadily thereafter to a low of 4.85% in June 1975. Also the average daily balance invested in U.S. Treasury securities dropped rapidly as the State began to consume the surplus accumulated during the previous three fiscal years. This float is composed of checks (warrants) which have been drawn by the State Comptroller against the Treasury in payment of various and sundry State obligations but have not yet cleared through one of the Treasury's eleven checking accounts (being reduced to six accounts as the year ends). Such checks may have already been received by the payees and may or may not have been cashed or deposited in banks. However, until these remittances pass through banking channels to one of the banks where the Treasury maintains a checking account, they continue to represent investable funds from the Treasurer's standpoint. Accordingly, some 95% of this float is placed in interest-bearing short term investments, with 5% maintained as a cash reserve to meet checks as they clear.
