Port St. Lucie City Attorney Reginald Osenton en-US resigned last February under very similar circumstances. Mr. Messer en-US had headed up the Fort Pierce Legal Department since April 2016, en-US while Port St. Lucie hired Mr. Osenton in August of that same year. en-US The charges against Mr. Messer first came to light during a special en-US City Commission meeting Aug. 1 when he requested the city authorize en-US payment for an outside attorney according to the stipulations of his en-US contract. City Manager Nick Mimms told commissioners he had placed en-US all of Mr. Messers female staffers on paid administrative leave while the en-US city was investigating at least three written complaints again him. en-USFORT PIERCE -Insurance Services Office, Inc. recently lowered St. en-US Lucie Countys insurance rating on new construction, paving the way to en-US lower insurance premiums for any new construction plans coming en-US through the Building Department. en-US Planning & Development Services Director Leslie Olson introduced en-US three members of the team responsible for helping earn the new 3.2 raten-US -en-US ing during the Aug. 21 County Commission meeting. The memorial service will en-US be held at 10 a.m. on Tuesday, Sept. 11 at the en-US Liberty Garden located at 600 N. Indian en-US River Drive. en-US The ceremony honoring Lyles is held en-US annually at the site where a life-sized bronze en-US statue of the Fort Pierce native overlooks the en-US Indian River. Born and raised in Fort Pierce, en-USSeeen-US en-US NOTES en-US, page 5en-USDuring its subsequent meeting Aug. 6, the en-US Commission agreed to hire Winter Park en-US attorney Rebecca Vose to investigate the en-US allegations against Mr. Messer, who then en-US reported her findings to the Board during en-US the latest meeting. The city recruited St. en-US Lucie County Attorney Dan McIntyre to en-US moderate the discussion, who explained en-US the ramifications of Mr. Messers resignaen-US -en-US tion without cause letter submitted via en-US email.en-US If he resigns without cause, he would be en-US entitled to severance pay, and so basically en-US by accepting that, you would be accepting en-US that he did not commit misconduct en-US because thats one of the conditions for payen-US-en-US ing severance is that there was no misconen-US -en-US duct, Mr. McIntyre said. So he is condien-US -en-US tioning his resignation -its not an en-US unconditional resignation -so theres en-US some other implications for you. You now en-US have a report that outlines various allegaen-US -en-US tions, and there were findings by the invesen-US -en-US tigator, which youve read, so you need to en-US consider that in the context of the offer to en-US resign without cause.en-US Ms. Vose then warned the Commission en-US that accepting the city attorneys resignaen-US-en-US tion at face value could cause legal complien-US-en-US cations down the road if he were eventually en-US proven guilty of misconduct while in office.en-US I will tell you that there is a Florida staten-US -en-US ute that prohibits paying severance pay if in en-US fact it is shown that there have been violaen-US -en-US tions, she said. If you accept the findings en-US of this report, his actions constituted misen-US -en-US conduct. So legally you dont have the en-US option of giving him severance if you make en-US a finding that there was misconduct. And if en-US you find that there was misconduct or dont en-US making a finding, you risk having an audit, en-US which could indicate that youve spent puben-US -en-US lic money inappropriately.en-US Ms. Vose went on to describe the citys en-US other options, which included termination en-US with cause, termination without cause, foren-US -en-US mally accepting his resignation -which en-US she advised against -and a resignation en-US without conditions, which the city didnt en-US have at the time. She did not include the en-US option of retaining Mr. Messer on the city en-US payroll due to her findings, which she did en-US not go over publicly.en-US I did not feel that it is an option for the en-US city attorney to stay in the employ of Fort en-US Pierce for liability purposes because of his en-US admissions during his interviews, which en-US were recorded and transcribed with his en-US permission, she said while carefully choosen-US -en-US ing her words. He admitted to have a proen-US -en-US pensity to not be able to act appropriately en-US around some women.en-US Commissioner Reginald Sessions then en-US questioned Ms. Vose if the Commission en-US had the legal right to fire Mr. Messer. en-US Do you think that his admission was of en-US the magnitude and significance for us to en-US justify for cause? he asked.en-US In my legal opinion, yes -absolutely, en-US she responded. en-US Mr. McIntyre advised commissioners en-US early on in the meeting not to mention the en-US names, positions or titles of the female en-US employees making the allegations against en-US Mr. Messer, but Ms. Vose herself said she en-US found the city attorneys request of a female en-US employee to pull up photographs of potenen-US -en-US tial job applicants to determine if they en-US were hot or not hot to be personally offenen-US -en-US sive. en-US It appears that what he is saying is that en-US he felt he could say whatever it is he wanted en-US to say until someone objected, and thats en-US not what the law is, she explained. He en-US understands what the law is, but when I en-US asked him if he continued to make comen-US -en-US ments about women like milkmaid or you en-US need to lose weight or that sort of thing en-US after that, and he said yes.en-US Commissioner Thomas Perona en-US expressed frustration that such alleged en-US behavior could have gone unnoticed for so en-US long that he and his fellow commissioners en-US even renewed the city attorneys contract en-US for four more years recently.en-US Im embarrassed by this personally, and en-US I feel that we have failed in our policies, he en-US said. I mean my office is next to theirs, the en-US city managers is next to the Legal Departen-US -en-US ment, and we thought everything was en-US hunky-dory. This didnt just happen in four en-US or five days; it seemed like according to en-US what I read here -even to Mr. Messers en-US own admission -this thing has happened en-US over a long period of time.en-US Mayor Linda Hudson concurred with en-US that sentiment, emphasizing that Mr. Messen-US-en-US er was one of only two employees directly en-US hired by the Commission. en-US I echo the frustration, and I think one of en-US the aspects of this is that we were dealing en-US with a charter officer -our city attorney -en-US and I think that has made this whole thing, en-USvery, very difficult, she said. It would be en-US as if Mr. Mimms were in this situation, and en-US I think that has made it particularly diffien-US-en-US cult.en-US For his part, Commissioner Jeremiah en-US Johnson searched for a different option and en-US even gleaned through the city attorneys en-US contract to find a loophole of sorts.en-US In his contract, paragraph 14 talks about en-US voluntary resignation and he has to provide en-US 90 days written notice, Commissioner en-US Johnson said. Obviously commissioners en-US we didnt get that [notice] in this case, but it en-US does say unless the parties agree otheren-US -en-US wise, so obviously wed have to formally en-US come up with a plan. en-US Ms. Vose then shot down that idea.en-US You are not in receipt of an unrestricted en-US resignation, so the only way you could en-US accept his restricted offer of resignation is en-US for you to decide that he didnt do anything en-US wrong, she said. If you make a determinaen-US -en-US tion that you do not agree with the report en-US -which is an option you have -and since en-US you didnt find fault with anything he did, en-US he would be paid his severance. That I do en-US believe would set a precedent in the city.en-US Both Commissioners Johnson and Sesen-US-en-US sions then prodded Mr. McIntyre to conen-US -en-US tact Mr. Messer during a recess to see if he en-US would be willing to resubmit his resignaen-US-en-US tion without conditions, but the attorney en-US initially balked, saying Mr. Messer had en-US rejected that very idea the night before. en-US It seems to be that this is beyond repair: en-US Based on reading the report, the whole en-US relationship is not repairable, Mr. McInen-US -en-US tyre said. So from my perspective based on en-US the report, I think my recommendation be en-US that you terminate with cause and that you en-US proceed along those lines.en-US The majority of the Commission rejecten-US -en-US ed that suggestion, however, and took a en-US 15-minute break while the county attorney en-US contacted Mr. Messer. The latter subseen-US -en-US quently tendered an unconditional resignaen-US-en-US tion, which the Commission voted unanien-US -en-US mously to accept. Commissioners en-US subsequently voted unanimously to select en-US retired Judge Ben Bryan to serve as interim en-US city attorney until a replacement could be en-US found. They could not agree, however, on en-US how best to undertake the search for a new en-US city attorney. Both Commissioner Rufus en-US Alexander and Commissioner Sessions en-US wanted the city to look internally for a en-US potential candidate, referring indirectly to en-US Assistant City Attorney Lola Mosley who en-US had been the first alternate choice in 2016 en-US and subsequently tapped by Mr. Messer. en-US Both Commissioners Johnson and Perona, en-US however, wanted to use the same outside en-US consultant, Colin Baenziger, to widen the en-US net for possible candidates, which would en-US cost the city his $20,000 fee.en-US Commissioner Sessions opposed that en-US idea adamantly, reminding the Commisen-US-en-US sion that it was Mr. Baenziger who recomen-US -en-US mended the city hire Mr. Messer. The conen-US -en-US sultant also made the recommendation for en-US Port St. Lucie to hire Mr. Osenton. en-US These consultants, in my estimation, en-US havent been the very best with hiring, and en-US thats just me speaking, he said. We spent en-US all this money with consultants, and we en-US come in here and we hire, and look at what en-US were dealing with. We have an HR director en-US thats capable of performing a lot of duties en-US of the consultant, and we could do a lot of en-US these things ourselves internally.en-US Mayor Hudson also wanted to hire the en-US consultan. At that time, the en-US Florida Motor Vehicle and Traffic Law proen-US -en-US hibited loud music emanating from a motor en-US vehicle, if the music or noise could be heard en-US within a distance of about 20 feet from the en-US vehicle. We enforced that law when necesen-US -en-US sary, writing a uniform traffic citation.en-US Unfortunately, as a result of a lawsuit en-US claiming the law was unconstitutional in en-US that operators of motor vehicles had a conen-US -en-US stitutional right to play music as loud as en-US they wanted to, the court hearing the case en-US agreed. That is why loud music from a vehien-US -en-US cle is not enforced. (Local noise ordinances en-US may apply if at night.)en-US Although I am still a law enforcement en-US officer in my 48th year, all I can do now en-US when some individual, who will likely go en-US deaf in 20 years, pulls next to my patrol car en-US with music blaring, is to look at the operator en-US with a serious face. That usually results in en-US the music being turned down.en-USEnforce littering en-US laws on the beachen-USUnbelievably we still need to remind peoen-US -en-US ple not to litter.en-US We need to take some tax money and post en-US signs at all beach entrance accesses, on the en-US lifeguard stands and throughout the beach. en-US These signs should remind people to clean en-US up their trash and to not use the beach as en-US their ashtray. The signs should also post the en-US minimum fines for littering and most en-US importantly, the law should be enforced by en-US police and beach patrol.en-US The fines collected would help offset the en-US cost of enforcing the no littering law, but en-US more importantly help clean up the beaches. en-US How disgusting is it to see children playing en-US in cigarette butts at the beach or to see all en-US the cigarette butts piled up in the high-tide en-US line.en-USRight of center is Nazismen-USFor those who claim that voting for any en-US candidates "anywhere left of center" means en-US your vote would be one step closer to socialen-US -en-US ism/communism: following that logic, voten-US-en-US ing for anyone anywhere right of center en-US would bring us one step closer to Nazism.en-USEnsure a seniors well-beingen-USHeat exhaustion can sneak up, causing en-US increased body temperature, rapid pulse, en-US headache and fatigue. The Chicken Little local news and the en-US governor with their whole "get out now!" en-US and "you will die" was way over the top.en-US There were so many people evacuating en-US the highways were clogged for days and gas en-US stations ran out of gas. The people who en-US needed to evacuate, who kept cool and waiten-US-en-US ed to see where the storm was going to hit, en-US now had to hours and hours of traffic jams en-US and the possibility of going through the en-US storm out of gas on the side of the road.en-US Let's be a little smarter for the next one, en-US and by all means evacuate if you want to en-US play it safe, but please, don't let the media en-US sensationalism get us all worked up.en-USIrrigate politely, not the sidewalken-USReally people, your sidewalks are not en-US going to green up so would you stop sprinen-US -en-US kling them? One of my en-US buddies reports that when he plays a second en-US nine the wind sometimes picks up so much en-US in just a couple hours that he has to hit two en-US to three clubs more just to get to the green.en-US The second hole is your first par-4. In en-US addition to being the shortest of the par-4s, en-US this hole also has the widest fairway. If you en-US struggle to get the ball on the fairway here, en-US you need to watch out for the mangroves en-US and wetlands you will encounter over the en-US rest of your round.en-US The third hole is a beautiful par-3. en-US Measuring just 106 yards from the back, en-US there is no excuse for missing the green en-US here. If you do, you will find a challenging en-US pitch or chip or bunker shot to a severely en-US sloped green.en-US After a couple more par-3s and a short en-US par-4, you come to he most challenging en-US par-4 on the course, the 360-yard seventh. en-US You tee shot here must hug the left side of en-US the fairway or you will be blocked out and en-US forced to hit a blind approach to a small en-US green. Also, the longer your drive is, the en-US narrower the fairway becomes and the more en-US likely you are to find a bunker or waste area. en-US If you miss this green, you are better off if en-US your ball lands left or short of the green.en-US The par-3 eighth is en-US Island Dunes signature en-US hole, and it is beautiful. In en-US fact, the ride along the en-US raised wooden bridge en-US through the mangroves to en-US the tee is soothing by en-US itself. en-US Playing to 145yards en-US from the back tees, your en-US tee shot must carry the en-US mangroves and wetlands en-US and land on a green that en-US is only about 45feet deep en-US with the Indian River en-US sitting behind. Its an en-US intimidating shot, as you have to take in the en-US wind, the carry over the hazard, and yet try en-US not to hit the ball onto the beach beyond.en-US The finishing hole is a beautiful, but en-US frightfully narrow, 353-yard par-4 that runs en-US along the river. The more you hug the river en-US side of the fairway, the better your angle en-US will be for your approach. A quirky feature en-US of this hole is a short Green Monster wall en-US that runs along the mangroves down the en-US right side as you near the green. If you hit en-US your tee shot far enough, you can play the en-US carom and find your ball back in the en-US fairway with a short wedge to a well-proen-US -en-US tected green.en-US Island Dunes may not have monster en-US yardage to intimidate the best players, but it en-US does have very undulating greens and some en-US narrow areas that will penalize wayward en-US shots. Google made a decision a couple en-US months ago that has angered just about the en-US entire world wide web community. Google en-US decided that for ANY site that didnt have en-US an SSL Certificate it (Chrome) would list en-US the site in the info box (the I icon) as un en-US secure.en-US Since most sites dont use SSL because en-US they are just static brochure like pages, en-US they dont need the SSL security certificate en-US as there is no data being passed back and en-US forth that needs to be secured. Usually SSL en-US or secure sites are in place for sites where en-US you have to log in and pass information en-US back and forth like Facebook or Gmail or en-US banking. Most other sites that dont require en-US logging in just plain dont need an SSL en-US certificate.en-US When Google en-US decided to just mark any en-US site not using SSL as en-US unsecure, they en-US essentially blackballed en-US millions of websites en-US overnight. en-US Needless to say this en-US has angered a whole lot en-US of website owners.en-US The bottom line is en-US there is nothing wrong en-US Internet Explorer, en-US Edge, Firefox dont list en-US sites without certificates en-US as un secure because en-US those browsers dont en-US care.
