en-US 2 en-USCommunity calendar STATE OF FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION NOTICE OF INTENT TO ISSUE PERMIT The Department of Environmental Protection gives notice of its intent to issue an Environmental Resource Permit modication (File No. MMR_206327009) to Stewart Materials, LLC, c/o Nick Stewart, CEO, 2875 Jupiter Park Drive, Suite 1100, Jupiter, Florida 33458, to create new surface water management systems at the Capron Trails Mine, an operating limestone and sand mine. The property is owned by the Indrio Land Group, LLC, and portions have been leased for mining by Dickerson Aggregates, Inc. and Stewart Materials, LLC. The new project area will adjoin property included within Permit No. MMR_206327-008, which was issued to Dickerson Aggregates, Inc. on May 11, 2016. Permit No. MMR_206327-008 will remain in eect, and is currently being mined under a lease by Stewart Materials, LLC. The new permit will allow mining to start in two new tracts, 4C and 4D, which are adjacent to Tract 4, the northernmost tract in the Dickerson permit. After the completion of mining in Tracts 4C and 4D, mining will expand westward into new Tracts 5 and 6. The mine plan involves a total project area of 750.04 acres, 403.72 acres of which will consist of the expanded mining into Tracts 4C and 4D (85.21 acres), Tract 5 (174.51 acres), and Tract 6 (144.00 acres). Tracts 4C and 4D will be mined for both sand and limestone, while Tracts 5 and 6 will be mined only for sand using a oating suction dredge. Tracts 4C and 4D will be dewatered to enable dry mechanical excavation to access the limestone. Recharge canals will be used to hydrate adjacent undisturbed wetlands during dewatering. The maximum mining depth will be limited to -28 feet National Geodetic Vertical Datum (NGVD), although deeper key ditches will be excavated within Tracts 4C and 4D to facilitate dewatering. The mine is located within the boundary of the Capron Trail Community Development District (CTCDD), which operates under an ERP issued by the South Florida Water Management District (SFWMD) (Permit No. 56-00745-S-02) to address the overall water management for the property. The mine also operates under a SFWMD Water Use Permit, No. 56-00765-W, which will be modied to address the mine expansion. Prior to mining of the sand and limerock deposits, overburden (non-mineable surface material) will be removed and stock piled along outer edge of the mining limits. Where suitable this material will be used in association with the construction of temporary access roads. All mechanically extracted limerock within Tracts 4C and 4D and wet dredged sand within Tracts 4C and 4D, 5, and 6 will be hauled or piped, respectively, back to the plant site and processing facility. The water and tailings transported with the sand will be returned to the excavation areas. Tailings will also be used during the reclamation process to create slopes along the post-mining lake littoral zones. A total of 24.28 acres of wetlands and 5.81 acres of other surface waters will be impacted by mining. To oset adverse impacts to wetlands, the permittee will provide a total of 227.83 acres of preservation through the recording of a conservation easement prior to the initiation of land clearing within wetlands. The preservation area consists of 75.11 acres of wetlands (56.03 acres mixed forest and 19.08 acres herbaceous or prairie) and 1.02 acres of other surface waters, along with 80.88 acres of herbaceous uplands (mostly dry prairie) and 70.82 acres of forested uplands (mostly pine atwoods). Hydrology within the preservation area will be enhanced by blocking unnecessary drainage ditches. To provide assurance that there will be no secondary impacts from mining on the hydroperiods of wetlands located near each mine phase, the permittee will conduct semi-weekly (every two weeks) hydrological monitoring, utilizing an array of sta gauges and piezometers. Each of these selected wetland locations will also receive annual qualitative vegetation monitoring to evaluate the response of the vegetative community. The mining and reclamation will result in three lakes surrounded by gently sloping littoral zone wetlands vegetated with native herbaceous plants. The lake depths will average about 53 feet below the ground surface. All the proposed mining will be subject to the mandatory reclamation requirements of Chapter 62C36, F.A.C. The control elevation of the nal post-mining Tract 4C lake is being proposed at 22 feet NGVD, which is lower than the seasonal high-water elevation (SHWE) of 23 feet NGVD of adjacent wetlands. As such, impermeable clay barriers as previously approved in the previous ERP, will be installed if needed between the post-mining waterbody and adjacent wetlands to prevent secondary impacts to the hydroperiods of these wetlands. The surface water created by mining in Tracts 4D and Tract 5 will be merged into a single lake, which, along with the Tract 6 lake will have a control elevation of 23 feet NGVD which is the same as the SHWE. The system is designed to contain up to a 100year three-day storm event and discharge structures will be in place to prevent overtopping if that storm event is to be exceeded. The project, as modied, will consist of a total permitted system of 715 acres. The estimated life of the mine is twenty years. The construction phase, including reclamation, of this permit expires in twenty years. The post reclamation land types will include lakes, wetlands, pine atwoods, herbaceous prairies, and pasture. The project is located just north of Indrio Road, approximately one-quarter mile west of Interstate95, Sections 6 and 7, Township 34 South, Range 39 East; and Section 12, Township 34 South and Range 38 East in St. Lucie County. The aected wetlands are isolated wetlands and ditches in the watershed of the CTCDD Canal C-5, Class IV waters. The Department will issue the environmental resource permit unless a timely petition for an administrative proceeding (hearing) is led under sections 120.569 and 120.57, F.S., before the deadline for ling a petition. On the ling of a timely and sucient petition, this action will not be nal and eective until further order of the Department. Because the administrative hearing process is designed to formulate nal agency action, the hearing process may result in a modication of the agency action or even denial of the application. Therefore, on the ling of a timely and sucient petition, this action will not be nal and eective until further order of the Department. Petition for Administrative Hearing A person whose substantial interests are aected by the Departments action may petition for an administrative proceeding (hearing) under sections 120.569 and 120.57, F.S. Pursuant to rule 28-106.201, F.A.C, a petition for an administrative hearing must contain the following information: (a) The name and address of each agency aected and each agencys le or identication number, if known; (b) The name, address, any email address, any facsimile number, and telephone number of the petitioner; the name, address, and telephone number of the petitioners representative, if any, which shall be the address for service purposes during the course of the proceeding; and an explanation of how the petitioners substantial interests are or will be aected by the agency determination; (c) A statement of when and how the petitioner received notice of the agency decision; (d) A statement of all disputed issues of material fact. If there are none, the petition must so indicate; (e) A concise statement of the ultimate facts alleged, including the specic facts that the petitioner contends warrant reversal or modication of the agencys proposed action; (f) A statement of the specic rules or statutes that the petitioner contends require reversal or modication of the agencys proposed action, including an explanation of how the alleged facts relate to the specic rules or statutes; and (g) A statement of the relief sought by the petitioner, stating precisely the action that the petitioner wishes the agency to take with respect to the agencys proposed action. The petition must be led (received by the Clerk) in the Oce of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000 or at Agency_ Clerk@dep.state..us. Also, a copy of the petition shall be mailed to the applicant at the address indicated above at the time of ling. Time Period for Filing a Petition In accordance with rule 62-110.106(3), F.A.C, petitions for an administrative hearing by the applicant must be led within 21 days of receipt of this written notice. Petitions led by any persons other than the applicant, and other than those entitled to written notice under section 120.60(3), F.S., must be led within 21 days of publication of the notice or within 21 days of receipt of the written notice, whichever occurs rst. Under section 120.60(3), F.S., however, any person who has asked the Department for notice of agency action may le a petition within 21 days of receipt of such notice, regardless of the date of publication. The failure to le a petition within the appropriate time period shall constitute a waiver of that persons right to request an administrative determination (hearing) under sections 120.569 and 120.57, F.S., or to intervene in this proceeding and participate as a party to it. Any subsequent intervention (in a proceeding initiated by another party) will be only at the discretion of the presiding ocer upon the ling of a motion in compliance with rule 28-106.205, F.A.C. Extension of Time Under rule 62-110.106(4), F.A.C., a person whose substantial interests are aected by the Departments action may also request an extension of time to le a petition for an administrative hearing. City manager Nick Mimms en-US reminded the Commission July 9 that some en-US of its members had asked to bring the topic en-US back to the table two weeks prior for further en-US discussions.en-US To assist with this discussion, we have en-US included in your package today the RFP and en-US the RFP special conditions, the existing lease en-US with the existing tenant, the memorandums en-US from the city attorney, the title report and the en-US appraisal, he said.en-US Commissioner Thomas Perona expressed en-US frustration that the current tenants had not en-US mentioned wanting to offer an extension of en-US their lease to a prospective future tenant in en-US his talks with them and doubted the city en-US could legally do anything beyond the current en-US leases provision to sell out the remaining en-US years.en-US It seems like we get caught up in all of en-US these legalities and proper formats of en-US RFPs, and it seems like weve caused a little en-US bit of a stir, he said. I guess theres still an en-US intention for the principles to market their en-US lease as long as the city can extend it in some en-US way. Everything that Ive seen so far just en-US doesnt provide me with any type of reasonen-US -en-US ing that this is something that we can actualen-US-en-US ly do legally. As far as Im concerned if en-US somebody else wants to take over the remainen-US -en-US ing time of the existing lease, that would be en-US about the only decision that we can do legalen-US-en-US ly.en-US Commissioner Jeremiah Johnson, conen-US -en-US curred, saying the RFP process had become en-US a little convoluted to him.en-US This was brought to us as a proposal, and en-US the original question was can we extend the en-US lease, and digging into the legalities and the en-US lease and all those factors, we cant do that en-US without an RFP, so thats where we are today, en-US he said. The attorneys office provided us en-US some information that was a proposed possien-US -en-US ble RFP agreement that involved multiple en-US parties, the city and the Kings involved as a en-US third party. If the Kings want to remove their en-US contractual requirements, then thats up to en-US them, and maybe we can negotiate and find a en-US way to do that, but I dont think the city is in en-US the position to do that.en-US For his part, Commissioner Perona admiten-US -en-US ted to having second thoughts after his origien-US-en-US nal approval of the RFP language May 21.en-US We had a proposed RFP draft language in en-US front of us, and it was sometime after that I en-US ended up very uncomfortable with that lanen-US -en-US guage because I felt that this was not solid en-US clad, it was not something that would pass all en-US test of legality in proper format, he said. I en-US dont know if anybody else had the same feelen-US -en-US ing afterwards, but I would propose that we en-US revisit that decision on the RFP language.en-US Commissioner Johnson also admitting to en-US having second thoughts on the RFP lanen-US -en-US guage.en-US I agree, he said, the RFP needs to come en-US back, we need to have some more discussion en-US and a discussion obviously with a decision en-US afterwards. We should be en-US buying public properties because there are en-US not a lot of public properties in the city of en-US Fort Pierce. en-US 4 en-USDont blame your computer, blame your Internet speeden-USMen-USany people are surprised (shocked en-US even) when they replace their en-US ancient computer with a brand en-US spanking new machine with 10 times the en-US horsepower than their old one but their en-US new computer still crawls at a snails pace en-US when connected to the internet. en-US I often get calls from frustrated people en-US who tell me stories like I just got a new en-US machine but my home page takes forever to en-US load or every time I try to watch a video en-US online, it freezes, goes for a bit then stops en-US again over and over! I cant stand it! The en-US frustration is usually mixed with confusion en-US because they figure that, since its a new en-US machine with gobs of ram and all sorts of en-US processor power, it should be much faster en-US than their old machine. en-US Now as a rule this is usually true their en-US new machine is actually much faster than en-US their old machine and if you set the two of en-US them up side by side youll see the new one en-US start up much faster, open programs much en-US faster and visibly outperform the old en-US machine with every test you throw at it. en-US That is until you start doing things that en-US depend upon a fast internet connection. en-US You know, things like watching a en-US YouTube video or waiting for a page like the en-US Yahoo portal to load. Then, if the internet en-US connection is not what it should be, things en-US grind to a halt and start working at the en-US same pace as the old machine.en-US When people start off by telling me that en-US watching videos over the internet is en-US frustrating because it pauses and skips, I en-US usually tell them about the old work around en-US of starting the video and then immediately en-US hitting the pause button for a while. (I still en-US use this technique just to make sure, en-US especially if its a long video Ill start the en-US video then pause it and go get a cup of en-US coffee or something. Then when I come en-US back Ill hit play and it usually plays without en-US a hitch). What were doing by starting it and en-US pausing for a while is giving the data stream en-US a good head start before releasing the play en-US head in the hopes that the point of the en-US video that we are watching doesnt catch up en-US with the data stream thats downloading. If en-US the internet connection is slow and we hit en-US play and dont hit the pause button, the en-US video will sometimes play faster than the en-US computer can download the data that en-US makes up the video and the whole thing en-US stops while it downloads a bit more. This en-US process is called buffering and has more en-US to do with the speed of the internet en-US connection than it does with the speed of en-US the computer. Pause the video and give the en-US data stream plenty of time to buffer and en-US when you hit the play button again the play en-US head wont have a chance of catching the en-US data stream and it should play smoothly. en-US With YouTube videos you can even see it en-US in action start a video and hit pause, then en-US watch and youll see a thin red line start to en-US grow from the left to the right even though en-US the video isnt playing. That line is an en-US indication of how much of the data stream en-US is downloaded and the trick is to make sure en-US its far enough ahead. Catch up to the line en-US and the video will pause and try to buffer en-US on its own but usually the automatic en-US buffering doesnt give the data stream en-US enough of a head start and the process en-US repeats itself over and over.en-US OK so we know that even a brand new en-US computer will come to a screeching halt if en-US its trying to do something over a slow en-US internet connection but how does one go en-US about testing that? One way to check is to en-US fire up your web browser and go to en-US www.en-US speedtest.neten-US and click the Go button. en-US (Caution the button you want to click is en-US labeled Go Ignore any ads that may load en-US first with misleading buttons!) en-US This will run a series of tests and give you en-US a good idea of just what your download and en-US upload speeds are measured in Mega Bits en-US Per Second (MBPS). Many of our residents are unceren-US -en-US tain how to drive through the roundabout en-US commonly called, CONFUSION CORen-US -en-US NERS (with good reason) already. This is en-US the only access to Martin Memorial and en-US when moments could mean life or death, we en-US do NOT need a train in this area. With the en-US approval of thousands of homes on the west en-US side of the area, perhaps thought should be en-US given to moving the tracks so those moving en-US there would have a direct route to Orlando en-US or Miami. The fisherman again will suffer if en-US this train becomes reality as well as downen-US -en-US town small businesses. If they have enough en-US money to build the train, they have enough en-US to build tracks west of 95 where there will be en-US much less impact. en-US This isn't rocket science. Instead of the en-US thinly rolled slices of Italian cold cuts en-US found in most antipasto salads, the Pagaen-US-en-US no version features chunks of the savory en-US meats and cheeses making for a much en-US hardier appetizer that could really serve as en-US a meal.en-US My visit to Villa Pagano also instilled in en-US me a new passion for Pasta Fagioli, a typien-US -en-US cal Italian soup made of cannellini beans, en-US red kidney beans and ditalini pasta.
