BREEDS AND PUREBRED ANIMALS

Under authority of paragraph 1606 of the act of Congress approved June 17,
19301 entitled' "The act to provide revenue, to regulate commerce with foreign
countries, to encourage the industries of the United States, to protect American
abor, and for other purposes ", the following regulations are issued governing
ihve recognition of-breeds' and purebred animals; imported into the United. States
for breeding purposes. For purposes of identification these regulations are desig-
$ited as B. A. I. Order 350 and supersede al previous regulations on. the same
subject. They shall become and be effective on and after July 1, 1935.

INFORMATION CONCERNING FREE ENTRY OF PUREBRED
ANIMALS IMPORTED FOR BREEDING PURPOSES UNDER
TARIFF LAW
The United States tariff law provides that American citizens
may import purebred animals free of dut for breeding pur-
poses. (See par. 1606 (a) (b) of the Tariff Act of 1930 quoted
on p. 8.)
Problems relating to duties on imported animals come under
the supervision of the United States collector of customs at the
port of entry. An importer should communicate with this
official regarding duty on his entry. The Department of Agri-
culture gives consideration only to the purity of breeding of
animals imported under the. provisions of paragraph 1606 (a)
(above referred to), issuing the certificate of pure breeding
which the collector of customs requires as one of the condi-
tions for free entry.
For the purpose of determining purity of breeding of animals
eligible for free entry under the provisions of paragraph 1606
(a), the Department of Agriculture extends official recognition
to certain foreign registries for purebred livestock, dogs, and
cats. These registries are given on pages 4-8 of this order.
Animals eligible for the privileges stated in paragraph 1606 (a)
should be recorded in these books.
Purebred animals declared for importation for breeding
purposes under the provisions of paragraph 1606 (a) should be
accompanied to the United States customs ort of first arrival,
with pedigree certificates and official transfers from the proper
breed record association.
Importations of purebred animals are iot certified to the
collector of customs for free entry under the tariff law until
such animals have actually come under United States customs
supervision and an application, affidavit of identity, and regis-
tration papers have been submitted to the Bureau of Animal
Industry, United States Department of Agriculture, Washington,
D.C.
Importers may obtain Application for Certificates (A. H.
Form 105) and Affidavit of Identity (A. H. Form 283) upon
request to the Bureau of Animal Industry. United States De-

All official communications relating to the provisions of this
order should be addressed to the Chief of the Bureau of Animal

REGULATIONS GOVERNING THE RECOGNITION OF
BREEDS AND PUREBRED ANIMALS

Regulation 1.-Certification of Purebred Animals

SEcnoN 1. Bureau of Animal Itidustry to issue certificates.-Paragraph 1.
The Bureau of Animal Industry of the Department of Agriculture shall issue
certificates of pure breeding under the provisions of this order.
Par. 2. Application for certificates.2-An application for certificates shall be
made to the Bureau of Animal Industry on forms furnished or approved by
the Department, showing the number of animals imported, the breed and sex,
the port of arrival into the United States, customs entry number, the name of
the vessel or carrier by which shipped, and the date of arrival. This applica-
tion may be signed by either the owner, the importer, or the agent, stating the
name and address (in the United States) of the owner of the animal or animals.
Par. 3. Certificates of pedigree.-Certificates of pedigree for such animals,
issued by the custodian of one of the books of record given in regulation 2,
section 3, of this order, shall be furnished to the Bureau of Animal Industry.
Par. 4. Affidavit of identity.--An affidavit, duly acknowledged before an
officer having authority to administer oaths and having an official seal, from
the owner, agent, or importer, that the animals so imported are the identical
animals described in the certificates of pedigree, shall be furnished to the
Bureau of Animal Industry.
Par. 5. Oownership.-Complete transfer of ownership of imported animals
from the breeder to the importer shall be shown, such transfers to be either
officially recorded by the registry associations issuing certificates, or on official
certificates of transfer of such associations.
SEC. 2. Examination of animals.-An examination by an authorized Federal
inspector shall be made of all animals imported under the provisions of para-
graph 1606 of the Tariff Act of 1930, for the purpose of determining their
identity. The certificates of pure breeding of the Bureau of Animal Industry
will not be issued until the descriptions of the animals submitted b.y an
authorized Federal inspector at the coast or border port of arrival are received
in Washington. Descriptions of animals which are claimed to be entitled
to free entry will be taken only at the time of arrival; and then only if such
animals are accompanied by proper pedigree certificates and transfers.
SEC. 3. Eligibility of animals.-When the provisions of this order have been
otherwise complied with, animals will be certified as purebred which have
been fully registered in good faith in one of the books of record for one of
the recognized breeds given in regulation 2, section 3, of this order, except those
which have been registered on inspection. All papers for animals which do
not meet the requirements of this order will be retained or returned at the
discretion of the Department.

Regulation 2.-Recognition of Additional Breeds
SECTION 1. Application for recognition.-Before a breed, in addition to those
shown in section 3 of this regulation, shall be added to this order, the custodian
of its book of record shall submit to the Department a complete set of the pub-
lished volumes of such books of record to date of making application, together
with all rules and forms in force on said date affecting the registration of
animals in said book of record.

2 Applications will be given consideration in the order in which they are received.
When the application and accompanying papers are satisfactory, certificates to that
effect will be issued and forwarded to the collector of customs at the port of arrival
and the pedigree certificates returned to the importer or his agent. A. H. Form 105,
Application for Certificates, will be furnished on request. When the application and

nized breeds shall forward volumes of their books of record as soon as pub-
lished, addressed to the Chief of the Bureau of Animal Industry, in care of the
United States dispatch agent, 2 Rector Street, New York, N. Y., U. S. A.

National Live Stock Records are recognized for the following breeds: Provided,
That no animal or animals registered in the Canadian National Live Stock
Records shall be certified by the Secretary of Agriculture as purebred unless
such animal or animals trace, in all crosses, to animals which are proved to

Sup. VII, Title 19, Sec. 1201), is as follows:
Par. 1606. (a) Any animal imported by a citizen of the United States seeially 'for
breeding purposes, shall be admitted free, whether intended to be used by the importer
himself or for sale for such purposes, except black or silver foxes: Provided, That no
such animal shall be admitted free unless pure-bred of a recogniSed, beedstand 4d: .
registered in a book of record recognized by the Secretary of Agriculture tor that
breed: Provided further, That the certificate of such record and pedigree of such animal
shall be produced and submitted to the Department of Agriculture, duly authenticated 1
by the proper custodian of such book of record, together with an affidavit of the
owner, agent, or importer that the animal imported is the identical animal described in
said certificate of record and pedigree. The Secretary of Agriculture may prescribe
such regulations as may be required for determinilng the purity of breeding and the
identity of such animal: And provided further, That the collectors of customs shall
require a certificate from the Department of Agriculture stating that such animal is
purebred of a recognized breed and duly registered in a book of record recognized by the
Secretary of Agriculture for that breed.
(b) The Secretary of the Treasury may prescribe such -additional regulations as
may be required for the strict enforcement of this provision.
