Foreign Trade Development


Date Marking of Food (United Kingdom). For some time suppliers of pre-packed foods
to the U.K. market have been voluntarily date marking their produce, to help the
retailer with stock rotation and to inform the consumer about the freshness of the
product. However, from January 1, 1983 the Food Labelling Regulations 1980 come into
force and from that date the uncoded date marking of most pre-packed foods will be
compulsory. Food will have to be marked with an indication of minimum durability;
that is the date up to and including which a food product can reasonably be expected
to retain its specific properties (e.g. freshness) if properly stored. In other
words, it is the date up to which the food will remain at its best.

Generally this will be indicated by the use of the term 'best before' followed by the
date (day, month and year in that order) and any relevant storage instructions.
However for foods with a minimum durability of up to 3 months, only the day and month
need be given, and for foods with a minimum durability of more than 3 months the
month and year, preceded by the words 'best before end' is enough.

The minimum durability of perishable foods intended to be consumed within six weeks
of packing may be indicated by 'sell-by' followed by the date and an indication of
the period from the date of purchase for which the food can reasonalby be expected to
retain its specific properties if properly stored. Necessary storage instruction
must also be given. To give an example, the formula most likely to be used on foods
from a chill cabinet will be 'sell by 23 December but eaten within two days of
purchase. Keep refrigerated'.

There will be some exemptions from date marking; these include fresh fruits and
vegetables, most alcoholic drinks (apart from pre-packed beef), deep frozen foods,
ice-cream and foods with a long shelf life.

It will not be illegal for food to be sold with an expired date mark provide the food
in question is fit for human consumption and the customer is made aware that the
product is out of time and may not therefore be of its usual quality.

These and other food labelling requirements are contained in the Food Labelling
Regulations 1980 which are enforced by the Trading Standards Departments of the local
authorities (i.e. The County Councils, and the London Boroughs).

The Food Labelling Regulations 1980 (S.I. 1980 No. 1849) were laid before Parliament
on December 11, 1981.

Labelling Regulations of Arabian Gulf Nations. Government Authorities within the
Arabian Gulf are all suspicious of labels which have been altered, reflecting recent
adverse experiences with such goods. In their minds, any overprinted label is
considered to be altered. In Saudi Arabia and the UAE, officials invariably (and
almost automatically) reject products which bears altered labels, as they have no
repeat no idea when or where the alteration occurred. They are especially.concerned
about labels bearing revised production and expiration dates following receipt of
goods which bore production dates which had not yet been reached. In Kuwait and
Bahrain, officials will consider approval of products bearing over-printed labels
only after the goods have been tested in local facilities for wholesomeness. If
found acceptable, consideration will be given to permitting relabelling. However,
this is usually done only once for a specific supplier. If additional shipments
arrive with altered labels from the same supplier, they will barely be considered for
relabelling.

Suppliers who continue to provide altered products risk loss of market as they create
bad will between the importers and the local officials who must be approached for
exemptions. And in several of the gulf markets, continuation of altered product
arrivals will result in black listing of the supplier by the government officials.
FYI if the altered product is part of a mixed container load of goods, Saudi and
UAE officials will often seize the entire lot, not just those with altered labels.
