AMENDMENT TO CODE OF FAIR COMPETITION
FOR THE

BITUMINOUS COAL INDUSTRY

As Approved on June 4, 1934


ORDER

MNODrFICATION OF CODE OF FAIR COMPETITION FOR. THE BITUM-INOUr
COAL INDUSTRY
It having been established to my satisfaction that it is necessary to
modify the basic minimum rates of pay for day labor in certain
mines in District G of the Bituminous Coal Industry establi.hied by
my Order of April 22, 1934, modifying and affirming Amendment
No. 1 of the Code of Fair Competition for the Bituminous Coal
Industry as set forth in "New Schedule A" annexed thereto, and to
prescribe certain rules affecting sales from Districts G and H; and it
appearing to me that justice requires that the modification herein
effected be made and that Anendment No. 2 of April 22, 1934, as so
modified shall be in all respects affirmed and as so modified will tend
to effectuate the policies of Title I of the National Recovery Act;
Pursuant to the authority reserved to me under said Order and
otherwise vested in me under said Title of said Act by Executive
Orders of the President, and otherwise, it is hereby ordered that that
portion of said New Schedule A" which is applicable to said Dis-
trict G be and it hereby is modified so that it shall read as follows:

FURTHER ORDERED that, in view of the differentials ac-
corded District G, and in view of the situation existing in District H,
pending further order there shall be no sales by operators of said
Districts into the normal consuming markets of another District

which is subject to higher rates of pay, at any prices for coal of com-
parable grade and quality, less than the price for such coal in said
market charged by iltwh other District, and there shall be no destruc-
tive invasion of such other consuming markets and, in the absence
of -;iti.-factory agrwiieniits governing this matter, the determination
of the Administrator on complaint of any such destructive invasion
shall be concluive;
FURTHER ORDERED that a study shall be made by the Coal
Research Unit of the Research and Planning Division and a report
s.iubmitted to the Administrator with recommendations for such fur-
ther changes as may appear desirable. This order to become effec-
tive on June 11, 1934 unless just case to the contrary shall be shown
prior to said date and I by my further order otherwise determine.
