An application having been duly made pursuant to and in full
compliance with the provisions of Title I of the N~ational Industrial
Recovery ALct, approved June 16, 1933, for approval of an amend--
ment to a Supplementary Code of Fair Competition for the Can
Labeling and PCan C asing Mlachinery Industry and Tlrade, and
notice of opportunity to be heard having been g~ive~n and the an-
nexed report on said amendment, containing ~findings with respect
thlereto, having been made and directed to the President:
NOW THE)REFORE, on behalf of the Presidlent of the United
States, the National Industrial Recovery Board, pursuant to author-
ity vested -in it by Exrecutive -Orders of the President., including
Executive Order No. 6859 dated September 27, 19:34, and otherwise,
does ]hereby incorporate, by reference, said annexed report and does
find that said amendment and the Supplementary Code as consti-
tut~ed after being amnended comply in all respects wlith the pertinent
provisions and will promote thze policy and purposes of said Title
of said AcLt, and does hereby order that said amrJendment be and it is
hereby approved, and that the previous approval of said Supple-
mentary~ Code: is thereby amnendedl to include an approval of said
Supplementanry Code in. its entirety as amended, such approval and
sulch amendment to take! effect ten dlays from the date hereof, unless
goodl cause to the conltrarly is shown to the ~National Industrial Re-
~ov~ery Board before that time and the National Industrial Recovery
Boa7rd issues a sulbsequent order to that effect.

A. DI\'ISION OF THE PACKAGING M\ACHINERY INDUSTRY AND TRADE

PURPOSE
Pur~sunnt to Article X Zof tlhe Sulpplemlentary Code of F'air Com-
petition for the Can Labeling and Can Casing M/achinery Industry
an~id Trade, duly approved by the President on M'uay 5, 1934, and fur-
ther to effectuate the policies of Title I of the N~ational Industrial
Recoc.very Act, thet following amendment is established as a part of
sa~id Supplementiary Code of Fair Competition and shall be binding
upon every member of thre Can Labeling and Can Casilgr Machinery
Industry and Trade.
AMrEunDMENT
Delete A~rticle IVI, Section 3, and in lieu therleof substitute the
1ollowcing :
3. Assess~inents.--(a) It being found necessary mn order to support
the administration of this Supplementary Code and to maintains the
standards of fair competition established hereunder and to effe~ctuate
the policy of the ~Act, _the Sub-Code _AuthorityI is authorized:-
(1) To incur such reasonable obligations as are necessary and
proper for the foregoing purposes, and to meet such obligations out
of funds which may be raised as hereinafter provided and which shall
be held in trust for the purposes of the Supplementary Code;
(2) To submit to the N~ational I~ndustrial Recovery Board for its
approval, subject to such notice and opportunity to be heard as it
mray deem necessary (1) an itemized budget of its estimated ex-
penses for the foregoing purposes, and (2) an equitable basis upon
which the funds necessary to support such budget shall be con-
tributed by members of the industry and trade;
(3) After such budget and basis of contribution have been ap-
proved by the NJational Industrial ~Recovery Bo3ard, to determine
and obtain. equitable contribution as above set forth by all members
of the industry and trade, and to that end, if necessaryT, to institute
legal proceedings therefore in its own name.
(b) Each member of the industry and trade shall pay his or its
equitable contribution to the expenses of the mlainternance of the
Sub-Code ,Authority, determined as hereinabove provided, and sub-
ject to rules and regulations p~ertainingr thereto issued by the NiJa-
tional Industrial Recovery Bon edl. OnlyT members of the industry
andt tradec comprlyingr with the Supplementarry Code and contribut-
ing to the expenses of its administration as herecinabove pr~ovided,
(unless duly exempted from. marking; such contributions), shall be
