An application hnaving been duly made pursuanrt to anld in full
complianrce with th~e provisions of TIitle I of the Natioiclrl Indus~triial
RecovFery ALct, approved June 16, 193::3, for approval of an amlend-
nientr~ to a Code of Fiair Compe'tition for thle Steel Tublarlll' and Fiire-
box. Boiler Industry, and opportunity to be heard havcing~ been
aff~ordled all interested p~er~son, and no objections having been filed,
and the annexed report on said amendment, containing findings with
respect thereto, havinga been made and directed to the President:
NOW, THEREFORE, on behalf of the President of th~e U~nited
States, the National Industrial 1Recovery Board, pursuant to author-
ity vested in it by Exezcutive Orders~ of the Pr~esidenlt, including
Exec~utive Ordfer N~o. 6i859, and otherwise, does hereby incorporate,
by reference, said aInnexed report and does find that said amend-
ment and the Code as constituted after being amended comply in a~ll
respects with the pertinent provisions and will promote the policy
and purposes of said Title, o~f said Act, and does hereby order thiat
said amendment be and it is hereby appIroved,.l and that the previous
approval of said Code is hereby nmecnded to inc~ludle an. appriloval of
said Code in its entirety as aendedltt;, such approval andl such amnendl-
ment to take effect ten (10) days from the date hereo~f, unless good
cause to the contrary is sh~own- to the National Indul~str~ial Recovery
Board becfor~e that time and the NationnI Indusstrial Recovecry Board
issues a subsequent order to tha7t effect.

Smr: This is a report on aun amendment to the Code of~ Fair Com-
petition for the Steel T'ubular and Firebox Boiler Industryv. Notice
of opportunity to bJe heard was senlt to allI ilter~ested persons ,In
Septemb~ler 15, 1934, and no objections wrrle filed with the Admlinis-
trationl. The amende nt.,~cnt whE-ich. is attachled, was presented by the
Cod-e Aulthlorityg.
The Code of Fair Comnpetition for the Steel Tubular and Firebox
Boiler IndustryT prov~ides in ~Article IX, Section 2 that
Suchl of the provisions of this Clode as are not required to be
included therein by thne Nartionasl Industr~ial R~ecovery Act may,, withl
the appr~ovnl of the Preside~nt, be mnodified or eliminated as changes
in cir~cumlstance or experience may indicate. It is contemplated
thiat from time to time supplemlentalry provisions to this Code or
additional Codes will be submnittedl for the atpproval of the President
to prevent unfair competition inl price and other unfair and destrue-
tive competitive pr~actices."~
eThisn amf~Ltend enprovides that Parzagraph 1 of Article II, and
Secion2 f Atile Ibe amended and that Sections 7 and 8 of
Article VI: be deleted and that certain provisions be substituted in
lieu th~ereof to facilitate thne collection of assessments from each
member of the Industry.
FINDINGS

The Assistant DIeputy Admninistrator in hiis final report to mne on
said amemeninent to said Code having found as herein set forth and
on the. basis of all the proceedlings in this matter:
It is found that:
(a) The amlendment to said Code and the Code as nmnended are
well designed to promote the policies and purposes of Title I of the
National Industrial Recovery Act, including thle removal of obstruc-
tions to the fr~ee flow of inter~stnae and foreign commerce whichl tend
to dimlinish the amount thereof, and will provide for the general
welfare by promnotin~g the organization of industry for thle purpose
of cooperatl\ve action among trade groups, by inducing and miain-
taining united action of labor and mannagemlent under adequate
governmental sanction and supervision, by elim~inating unfair com-
pectitiv-e practices, by avoiding undue restriction of production
exceptt as may be temporarily requiredd, by increasing the con-
sumption of industrial and agrcultural products through increas-
ing purchasing power by reducing and relieving unemployment,
by improving standartkl of labor, and by otherwise rehabilitating
inrdustry







(b) T'he Code as amended comp~lies in all respects with the! perti-
nent provisions of said Title of said Act, including without limital-
tion Su~bsecition (a) of Section 3, Suabsection (a) of Section 7, and
Suabsection (b) of Section 10 thereof.
(c) The amendment and the Code as ninendlred are not designed
to and will not permit monopolies or monopolistic practices.
(d) The amendm:lr ent and the Code as nIne11nde d are not designed
to and will not eliminate or oppress small enlterpr'''ises~ and will n1ot
opera''te to dicceriminatt e against them.
(e) Those engagedl in other steps of the ecolonomic process have
not been deprived of the right to be heard prior to approval of said
amendment.
For these reasons, therefore The National Industrial Rcecovery
Board h~as approved this ament ment.

t'prope for the forego~ingr purpo~sse and to meet such obligations out
o-f funds which may b~e raised as hereinafter provided and which
shall be h~eldl in trust for the pur~posecs of the Code:
(b) To submit to the ~National I~ndustrial Recovery Board, subject
to such notice and opportunity to be healrdi as it mnay deem necessary:
(1) A~n itemnizedt budget of its estimalted expenses for th~e fore-
gainc purposes, and
(2P An equitable basis upon which the funds necessary to sup-
port suchl budget shall be contributed by members of the
Industryy;
(c) After such budget and basis of contribution havre been a.p-
pro~ved by the National lIndustrial Recovery Board-, to determline and
obtain equiitable contribution n as above set forth by all members of
the industry; and to that end, if :nece~ss~ry, to institute legal pro-
ceedings thecrefor in its own name.
(2) Ea~ch memllber' of thne Industryr shall pay h~is or its equlitable
co~ntr~ibution to the expenses of the mainteinance of thle Codle Au-
thocrity, determined d as hereinabove providepd, and subject to rules and
Icregultio~ns pertatining thereto issued by the National Indlustrial
Recoeryy BIoa rd. Only members of the TIndusitry compel~' ng with
th~e Code anid co~ntrib~utingr to th~e exp~eneses of its admninistration as
hlereinabove providled, unless duly exemlpted from makting uhcn
tr~ibutions, shall be entitled to participate in the selection of members
of th~e Code Aulthorit.y or to receive the benefits of any of its volun-
tary activities or to mak~e us~e of any emblemn or insignia of the
National 1Recov-ery Administration.
(3) The Code ALuthority shanll neither incur nor pay any obliga-
tion ubllstantfiallyr in excess of thre amount, th~erof as estimated in its
alpproved bulgret, and shl~nl in. no event, exceedl the total amount con-








tained~ in the approve~-td budget, except upon approval of the Ja~tional
Indusltr~ial Recorwyc Boa5rd-; and no su~bsequent budge~tl shall contain
any deficiency iteml for exp~enditures in ,.atcs of prior budget esti-
ma~tes except those which the Nationael 3Industri~al Recovery Board
shall have so approved.
