MODIFICATION OF CODE OF FAtIR COMPElFTITION FOR
THE STIAY MANUFACTURINGG IN1;DUSTHRY
The followT-i ngI shall be sub~t ii u tedt for Article VI, Section 5:
1~. I[t being found necessary to support the Administration of this
Codec, in order to effiectuate the policy of the Act and to maintain the
stand~ards of fair competition established hlereundll~er, the Code
Authority is authorized:
(a) To incur such reas:lonable obligations as a~re necessary and
proper for the foregoing purposes and to meet such obligations out
of funds which shall be held in trust for the 1xul'poses of the Code
and raised as hereinafter provided.
(b) Tpo submiit to3 the Administrator for his approval, subject to
suxch notice and opportunity to be heard as he may deem necessary:
(1) An itemnizedl budgett of its estimlatedl expenses for the foregoing
(2) An equitable basis upon which the funds necessary to support
such budgerit. shalll be contributed by all members of the Industry
entitled to the Illnefits nerningll~r from the maintenance of such
standards, and the administration. thereof ;
(c) Aftter L1uch1 budget and basis of assessment~; have been approved
by the Achallji,;tni tratr, to dtermtll in~e and collect eqitablef1I~ assessments
a~s set fourth, and to that end, if necessary, to institute legal proceed-
ingfs ther~efor in its owyn name.
(d) Each member of the Industery shall be liable for his or its
equitable usess-;lcInent to the expense of the maintenance of the Code
A~uthoritey as hereinabove provided.
(e) Only members of the Industry complying with the Code and
contributing to the expenses of its administration as provided in
Section 3 hereof (unless duly~ exempted from making such contribu-
tion) shall be entitled to participate in the selection. of members of
the Code Authority or to make uxse of any emblem or insignia of the
National Recov~ery Administration.
(f) The Code Authority shall neither incur no~r pay any obliga-
tion substantially in excess of the amount thereof as estimated in.
its approved budget; and shall in no event exceed the total amount
contained in thle approved budget except upon approval of thie Ad-
ministrator; and no subsequent budget shall contain any deficiency
item for expenditures in excess of priv or budgoet simts ec
those which the Administrator shallhaeoaprvd
