CYLINDRICAL LIevIa Trana PAPER CONTAINER INDUSTRY
An application having been duly- made piur~sulnnt to and in full
compliance with, the provisions of Title I, of the National Indus-
tria~l Recovery Act, approved June 16, 1933, for approva\l of a modi-
fication to a Code of Fair Completitionl for the Cyrlindrical Liquid
Tight Pa per Container Industry, and due notice and opportunity to
be heard2 having been given thereon and the annexedl report on said
modification, containing findings with respect thereto, having been
made and directed to the President:
N~iOW, THEREFORE, on behalf of the Presidlent of the United
States, I, Hugh S. Johnson, Administrator for Industrial Recovery,
pursuant to authority vested in m~e by Execuitive Orders of the Presi-
dent, including Executive Order No. 6543-A, dated Decemnber 30,
1933, and otherwise; do hereby incorporate, byT reference, said an-
nexed report and do find that said modification and the Code as
constitutedf after being modified com~plyS in all respects with the
pertinent provisions and will promote the policy and purposes of
said Title of said Act, and do herebty order that said modification
be and it is hereby approved, and that the previous approval of
said Code is hereby modlifiedl to include an approval of said Code
in its entiretyr as modified.

Delete Section Y' of Art~icle II and in lieu thereof insert:
5. (a) It, beings found necessaryT in order to support the adminis-
tration of this Code anld to maintains, the standards of fair competi-
tion established hereundler and to effectuate the policy of the Acet,
thle Code Authority is author~ized:
1. To inc~ur such~ r~ealsonble obligaltio~ns as are necrts-nary and
proper~P I for the forePgoing purposes, and to meet suchn obligations
out of funds which mlay be raised as hereirnafter provided and
which. shall be held in trust for the purposes of the Code.
2. To subm~nit to the AdmlinistLraotor for his app~rroval, subject
to such notice andl oIpportunity to be heard as he may deem
neclessary~ (a) an itemnized b~udget of its estimated exspen-ces for
the foregoinlg purpos~es and (b) an eqluitablel basis upon which
thec funds necessaryl~ to~ support such budget shall be contributed
byr Itmlember of thle Induistr~y.
;3. After such~ budget anld bnsis of contributions nl have been
a!pp'''rove by' the Admin istra~tor, to dletermnine. and obtain equi-
table co~ntributio~ns as above set forth by all mnemberts of the
Industry, andl to- thant enld, if necessary, to institute legal pr1oceed-
ings theretfor in its own~ name.
(b) Each membller of the Industry shall pay his or its equritable
contribution to the expenses of th-e mainltenance of the Code Aiuthor-
ity, det~ermined~ as h~ereinab~ove provided, and subjject to rules and
regulat ions p~erta ining t hereto issued by thre Admninicst rator. Only
members~ of theP Indusl~t~ry IcomplyingF wcith the. Code andr conntributingr
to the expenses of its admrinistra~tionl as hereinabove provided, unless
diul exem~nptd fro~m makting such contributions, shall be entitled to
participate in the selection of members of the Code Authorit~y or to
rece~ivec the benefits of any? of its voluntary activities or to make use
of alny emblem~ or insignia of the National Recovery Admini.-tration.
(c) The C'ode Author~ity shall neither incur nor payy anyT obliga-
tion substantially in excess of the amlount thereof as estimated in
its approvedc budget, and shall in no event exceed the total amount
contained inl the app~rovedl budget, except upon. approval of the
Adm~inistrut.or; and no subsequent buidg-et shall contain any defi-
clency it~em for expenditures in excess of prior budget estimates
except those which the A~dministrator shall hatve so approved.
