pursuant to authority vested in mne by Executive Orders of the Presii-
dlent, including Ex~ecutive Order No. 6543-A, dated Decemiber 30,

SIR: ~An application has been duly made p~ursunnt to and in full
compliance with the provisions of the Naztiona~l Industrial Recove~ry
Act for a mlodlification of Article IV of the Supplementary Code of
Fair Competition for the Screw Machine Productsflj Manufacturingf
Indlustry by the Supplementary Code Aiuthority for that Industry.
The~~ Sulpplem~en~tary Code of F~iair Comlpetition for the Screw
Machine Products MIanu fwl~ -to irin Industry wras app~roved on April
28, 1934. Article IVT, Section 9, provides that:
All members of the Industry are subject to the jurisdiction of the
Supplemnentary Code Autahoricyr; shall be entitledl to participate in
and share the benefits of the Suppolementary Code Authority as pro-
vided in Section 1 of this Article; and also shall pay to the Mtanaging
Director as thle agent! of th~e Supplementary Code Authority their
r~easonable share of the expenses of the admilunistrat-ion of this Sup-
plemntarlllyr Code, such reanson~able share to be determllined~c by the Sup-
plementalry GCode Ahuthor~ity, subject to review by the Admllinist rato.r
on the basis of volume of business and/or such other factors as maty
be cdienw J~l equitable by the Supplem~entary Code Authority "
The above Section olf Article IV in effect; provides for voluntary
contributions on the part of the members of the Industry. This
method of providing funds for the proper admini~stratioi n of the
Suppl:ementary Code hans been found to be unsatisfactory. The pres-
ent mnodification is therefore proposed to create a legal obliga tion,
on. the part of the! Industry Mnlllllrl, to pay their pro ra2ta~ share of
the expenses of the Supplementar1y Code Aulthority.


The1 Assistant Deputy in his final report to me on said m~odifica-
tion of .snii1 Code having found as herein set forth and on the basisi
of all the p.1ciroceedings.- in this matter:
I find that:
(a) T'he modification of said Code and the Code as mod~cified are

National Industrial Recovery Act including the rcnmc-val of obstruc-

to diminish the amount thereof, and will provide for the general

A DIVISION OF THE FABRICATED METAL PRODUCTS MANUFACTURING AND
METAL~ FINISHING AND METtL COATING INDUSTRY

Modify Article IV- by deleting Section 9 and substituting in place
thereof the followvingr:
anSECTrtION o.(a It being found necessary in order to support the
admiistatin o ths Spplemnentary Code and to maintain the
standards of fair competition established hereunder and to effectuate
the policy of th~e Act, thne Supplemnentarly Code Authority is
authorized :
(1) To incur such reasonable obligations as are necessary and
proper for the foregaoing purposes, and to meet such obligations out
of funds which may be raised as hereinafter provided and wcshich
shall be held in trust for thne purposes of the Supplementary Code;
(2) To submit.to the Administrator for his approval, subject to
such notice and opportunity to be heard as he ma~y deem necessary.
(1) an itemizred budget of its estimated expenses for the foregoing
purposes, and (2) an equitable basis upon which the funds necessary
to support such budget shall be contributed by members of the
industry ;
(3) After such budget and basis of contribution, have been ap-
proved by the Administrator, to determine and obtain equitable con-
tribution as above set forth byr all members of the industry, and to
that end, if necessary, to institute legal proceedings therefore in its
own. name.
(b) Each member of the industry shall pay hnis or its equitable
contribution to the expenses of the maintenance of the Sup~plemen-
tary'3 Code Authorityr, determined as hnereinabove provided, and sub-
ject to rules and regulations pertaining thereto issued by the!
-Administrator. Only members of the industry complying with the
Supplementary Code and contributing to the expenses of its admnin-
istration as hereinabove provided, unless duly exemlpted from making
such contributions, shall be entitled to participate in the selection
of members of the Supplementary Code Authority or to receive
the benefits of any of its voluntary activities or to make use of any
emblem or insignia of the National Recovery A~dministration.
(c) The Supplementary Code Authority shall neither incur nor
pay any obligation substantially in excess of the amount thereof as
estimated in its approved budget, and shall in no event exrceed the
