the Division within any region or locality or otherwise, and the
National Industriall Recovery Board may thereupon stay, revise, or
nine1~~ said provisions as it may determine is necessary to effectuate
the policy declared by TPit~le I of the INational Indiustriall Recovery
Act.

SmR: Th~is is a report on amencxdments to the Supplementary Code
of F~air Com~petition for the Plumbling Colntraltinr Dlivrision of the
Conlstrulction, Indu ~try. wh~ichr wras approved by you1 on1 May 15, 1934.
The purplo.--e of this am~endmient is to establish~ rules and regula-
tions for th~e establishment and matinte~nance~t of bid depositories.
The bjidin'ig prlOv.isionsl of the Construnction Codes aire cocnsiid~ered
among the! me (t imp~lor'tant an1d vrital to the industry.
FINDINGS

The D~eputy Admni t ;t(rar in his final report on said2 amendments
to said Code having foundl as herein set forth and on the bn~si~ of
all the proceedlingsr in this matter:
TIhe Board finds that:
(a) The amnendmlents to the Code and th~e Code as amended are
well designedl to promote the policies and purposes of Title I of the
hnational IndustrinIn Recoruvery Act including the removal of obstruc-.
tions to the free flow of interstate and folrcig~n commerce which tend
to diminish the amount thereof, and w~ill provide for the general wPel-
fare by prom~iotin g the organ1!izatlion of industry for the purpose of
cooperativ e action of labor andr management i under adequate govern-
mental sanction and sulpervisioin, by e~liminating unfair competitive
p~ractices, by promoting the fullest possible utilization of the prenticl
productive capacity of Indlust-ries, by avoiding ulndu~e restriction of
production exceptt as may be temporarily required), by increasing
the consumption of industrial and agricultural products through in-
c~r~easing pullrchasi n g powerr, by redu ~cin g and relieving u~lcnp~emplymnt
by) impr~oving' standrdsr~l of labor, and by otherwise rehalbilita~ting
in dust ry.
(b) Thle Code as amendled complies in all respec~rts with the perti-
nient p~rovisio~ns of said Title of said Act, includling wr-ithout limlita-
t ion subs.cectionl (a) of Section 3, clubset injlll (a) of Scct ionl 7 and
subsection (b) of Section 10 thereof.
(c) Th'le Codte empowers the Div-isiiolnn Code Authority to p~resen~lt
th-e aforesaid amendments~nt on behlalf of the? Industry as a, whole.
(d) Th'le amndmenl lnt s aInd the Cod~e as amendedcc~ are not des~ignedcc
to and will not~f permit monollcpolies or mlonopolistic p~ractices..

(b) Each bid. depository shall1 function for a definite terr~itoryr
pICrescibePd by thle Divisionlal Code Authority. Rules and regula-
tions- giov'erning bid depositories may be adopted by the Divisional
Codle Authlority subject to the approval of the Natiornal TIndustriail
Recovery Boardc. Thereafter bid depositories shall function sub-
jlect to .suchl rules and regulations.
(c) The Divisional Code Author~ity shall maintain on file in its
prmlcipl~ ofic~e the n~ame.C addressc-, and jurisdiction of seach bid
depository established as here~in pr~ovided, and all dtermin altions,
rules and regullatio~ns perltaining thereto establishled pu~rsuant to
any p~ovision hereilnabov~, or purrsunntt to an~y prIovision of Section
7, Article V, of this Chlapter, and shall supply uplonl request infor-
moation with respect thereto for any jurrirrdiction or area.
1. Any reg~ionall and/or local admriinistr~ative committee estab-
lished by? the D~iv'iiond1~ Code AL~uthority shall maintainl on file the
namle, nildlress, and jurisdiction of each bid depository estab~lish~ed
w-ithlin its respective ter~rit~r~y a~nd all determinations, rules anld
regulations establisihedl pur ulnnt to any provisionl hereinabov e or
pursuant to any! povision of Sectior 7, A~rticle ~V, of this Chaplter,
per~taining to such depository, and(' shanll sulpply up~on re~quest infor-
mlation with r~espc~ct the~retO for any such bid dep~ository.
(d) Thle Divisiionall Colde Authiority shall useo depo-itory fees,
im~posed' as providled in Secti~n '7, Alrticle VC of this Chlapter, solely
to pa"y theP ep'Penss of onpraRtingr btidl deositories.
1. Accounts of the receipts and exspendituress of said decpositor~ies
shall be kept and the sReIII shall be open for inspc~lc:tion~ by the
National TIndurstrial Recoveryl Board or a repr~eserlntatie there~of.

RECTION 7. TO fail to com ply wtith. the following r~ules:
(a) Eachi member of thiis Divisio-n submnittingS any bidl, comiipeti-
tive orn non-compe~titive, for an amount in excess of the sumn of









Se~venty-five ($75) Dollars for work or services to be performed
within the Division, shall submit such, bid only in. writing, and each
such member shall file, as hereinafter provided, a sealed duplicate
copy thereof (and of all revisions) with the Di~visional Code Autho~r-
ity or an impartial depository designated by such Divisional Code

(b) riVl~ting shall consist of netuall delivery to thle Divisional Code
Authority or the designated depository at least two hours prior to
submitting the bid, or of manilingr such copy of said bid, accompanied
in either case by th~e proper fe~e; provided, if mailed, the envelope
be properly stampedl and addre edlj l and bear a p~ostmuark dated not
later than twoP hours, prior to theA submit~ting of such bid;
(c) In case of all combination bids (including revisions thereof)
the bid (or revision) for work not includedi in this Division sh~all be
sepzrat~e and dlistinct from any bid for works within this Division;
(d) For thre purpose of this section idenltical (except for name~c
and address of recipients) copies of the same bid given to different
persons for the same job shall be considered as one bid;
(e) Each copy of a bid filed in atccordanzce with rules herein
established shall be accompanied by a depository fee: pursuant to the
following schedule:

Provided, however, that the above schedule of fees may be modified
by the Divisional Code Authority pursuant to the powers, con-

(f) iA bid as used in this Section or in Section 5, Article IV, of
this Chapter, shanll be construed to mean any offer or estimate, in
competition o~r otherwise, or anly revision thereo~f, submitted by a
member of this Division to an awar~ding authority or purchase, or
anly agent thereoi~lf, for the execution of a specific project or a part
thereof, or the rendition of a specific service, w~ithin this Division;
(g) Anny prownt~I: or future member of this Division submitting a
h~id~ as definled in this Section for any w~ork or services within this
Division, knowing of nio bid deposnitory having jurisd~ic~tion, of the
job or project, shall makie inquiry of the D9ivisional Code Authority
or the regional or local adlministrati-ve committee as to such facts as
Salid Divisional Code Authority or committee is rqiredliic- to maintain
under the. provisions of Section 5, Article IV7, of this Cha p-ter, con-
cerningr the existence of establishment of a bid depository and all
duly established rules for th~e area or areas in which the job or
project is located.
(h) The bid depository or the Divisional C~ode Authority shall
hold said cop~y sealed and confidcential until at least t wenlty-four (C94)
hours after the bid is dule, or until after the letting of theF contract,
follow\iing which tabsulations of all copies of bids in competition may
be disclosed to each bidder.
