Maunufactuingin and M~etal Finishing and Mletal Conting IndustryT,
to incorporate pr1ovisions whetreby~~ mnemblers of the Stalc-ndad Steel
Barrel and Drum Mannufacturing Inldustr~y are prohibited from
quoting prices or offering to sell on terms which ar~e inconsistent with
their open filed price. The Amelrndment. has been submlittedl in ac-
cordanlce with thie provisional of Section 2 of A"rticle VI of the Sup-
plemlentary Code and a Notice of Opportunit-y to be heard was
p)ublish~ed on Feibrurary 19 for a period of twenty (20) days.
FINDINGS

(a) The Supplementary Code is wPell do ~igned~ to prom-,lote the
policies anld purposes of Title I of the Nation~al Industrial Rte-
covery Act, including the removal of obstructions to the free~t flowv
of interstate and foreign. commier~ce which tend to diminishn the
amount, thereof, and will provide for the general we~lfarle by pro-
mnoting the or~ganization of industry for the purpose of c~oopcrantive
action among trade groups~, by indneing the manintiningit unlited ac-
tion o~f labor anld mnagnoement u~nder adlequalte governmental nne-
tiron aInd' supervision, by elun~inatingr unfair comnpetitive p~rac~tices,
by promoting the fullest possible utilization of thne pre ent~ll produc-
tive capacity of industries, by avoidingr undue res~tr~cictin of produlrc-
tion (except as may be temporarily requlired,) by incree~lilgr the
consumption of industrial andl agricultural products throlugh in-
creasing purchasing power, by redlucing an eivn nmly
mecnt, by improvring standards of labor and by otherwise rethabili-
tati~rrine dustlry.
(bf The Supplementary Code, as ame~ndedl, comlplies in all rej-
spcswith thle pertinent provisions of said Title of said -Act, in-
cludin w pitlhout limlitation Sub~sectionn (a) of S~c~tio-n 3, Subsc~itio, n
()of Section 7, and~ Subsiectiorn (b) of Sectio~n 10 theireo~f.

sponsoring this amnendment, waTs and is an indusltr~ial association.

membership therein.
(d)! The amendment as proposed wRill tend to eliminate certain
practices which are unju1stifiable and not in accolrdance with. the~
purposes of the National Industrial Recovery Act; specifically, to
prohibit the quotation or the discussion of termsi by a member of








the Ind~ustr~y with a customer which are inconsistent with the prices
filed b~y hlim pursuant to the provisions of Article V, Rule A of the
Supplementnr~y Code.
(e) The amlenhnlent; wcill not change the fundamental economic
condition of thle Indcustr~y, will not obdrus~1~t, any sound economic
practice in the Industry and will further the economic pr~ogrless of
any member of the Industry and others directly or indirectly
concerned.
(f) T~he amendment and the Supplemnentary Code as amended are
not desig~nedi to permit monopolies or monopolistic practices.
(g) Those engragedl in other steps of the economic process have not
been deprived of the right to be heard prior to approval of said
amendment.
For these reasons, therefore, this amendment has been approved.
