REPORT TO TH~E PRESIDENT

The Whit% House.
Sml: This is a report on the Amendmlent to the Supplemlentary
Code of Fair Competition for the Steel Package MaI~;111facrturingr In-
dustrly, a division of the Fabricated M~etal Products Manufacturinfg
and Metal Finishing and Mletal Coating Industry, to incorporate
provisions whereby members of the Steel Package M~anufacturing
Industry are prohibited from quoting prices or offering to sell on
terms which are inconsistent with their open filed prices. The
Amendment has been submitted in accordance with the provisions
of Section 2 of Article VI of the Supplementary Code and Notice of
Opportunity to be Heard was published on M~arch 16, 1935, for a
period of twenty (20) days.
FINDINGS

(a) The Amendment is well designed to promote the policies and
purposes of T'itle I of the National Industrial Recovery Act, in-
cluding the removal of obstructions to thle free flow of interstate and
foreign commerce which tend to diminish the amount thereof, and
provide for the general welfare by promotingi the organization of
Industry for the purpose of cooperative action among trade groups,
by inducing and maintaining unlited( action of labor and manage-
metnt under adequate governmental sanction and supervision, by
elimninating unfair competitive pnrrati~cs byr promotingr the fullest
possible utilization of the presenlt productive caIpacity of industries,
by avoiding undue restriction of production (exceptll,t as may be tem-
porarily7 requiredd, by increasing the consumption of industrial and
agricultural products through increasing purchasing power, bly re-
dtucing and relieving unemployment by improving standards of
labo, an by otherwise rehabilitating industry.
(b) Thean Supplementary Code, as amended, complies in all re-
spects with the pertinent provisions of said Title of said Aict, in-
cluding without limitation, Subsection (a) of Section 3, Subsection
(a) of Section 7, aind Subsection (b) of Section 10 thereof.
(c) The Supplemlentary Code empowers the Agent of thne Supple-
me~ntary Code Authority to present the aforesaid Amnendment on
behalf of the Industry as a whole.
(d) The Amendment as proposed will tend to elimlinate certain
practices which aire unjustifiable and not in accordance with the pur-
poses of the National Industrial Recover~y Act; specifically, to pro-
hibit the quotation or thle discussion of terms by a member of the
Indu~stry with a customer which are inconsistent with the prices
file byhim ursnntto the provisions of Article V7, Rule A, of the
Sup~plementary- Code.

Amelndment.t
For these reasons, therefore, this Amnelndm~ent has been approved.

V, following the fourth paragraph of Rule A which deals w-ith the
subject of filing price lists:
No member of the Induistry shall sell or exchange, or offer to sell
or exchange, any products of the! Industry for which prices and
other conditions of sale have been filed by himl p)ursuant to thle pro-
visions of this Article, except in acordance with such prices and
other conditions of sale.
