An applientio-n having been duly made pursuanlt to and in full
compliance with the provisions of Title I[ of the National Industrial
Recovery Act, approved June 16, 1933, for approval of an amend-
ment to a Supplementary Code of Fair Competition for the Sheet
M~et~al Distributing Trade to the Code of Fair Competition for the
Wholesaling or Distributing Tradec, anld opportunity ob er
having been afforded all members of said Trade nthaned
report on. said amaendmenrt, containing findings with respect t'hereto,
having been made and directed to the President;
NOWF, T'HEREFORE, on behalf of the President of the United
States, the NTational Industrial 1Recov~eryT Board, pursuant to author-
ity vested in it by Executive Orders of the President, including
Execuxtiv~e Order 6859, dated Septemlber 27, 1934, and otherwise;
does hereby incorporate, by reference, said annexed report and does
find that said amendmentll~t and the Supplementaryr Code as conrsti-
tut~ed after being amended comply in all respects with the pertinent
provisions and will promote the policy and purposes of said Title
of said ACct, and does hereby order that said amendment be and it
is hereby approved, and that the previous approval of said Supple-
mentary Code is thereby amended to include an approval of said
Supplementary Code in its entiretyt as amended.

Th~is Supplemelnntur~y Code has: been ame~rndedlr byr subsctitutinga in
Sec.tionl 4 of Article fIII, the w\ords~j "L three! or more Mhembler~s "' for
the previous wo(rd'ing( "no1t mlore thantT three M~emrbers'" thereby
authoizc~ingl the Divisio~lnal Code Authority to select RIiegional Com-
mittees consisting of more than three membllers in such territorial
areas as compr~ise a numbler of states, and which would~ be too large
for a Reg~io~nal Collnuittee of only three to admninister in securig
comnpliance w~ith the prolvisionsl of the Supple lemntary Code.
T'he D~eputy Administrator in his final report to thre National
Ind~ustr~ial Rtcover~y Board on said amendment to said Supple-
mentary Code having found as herein set forth and on the basis of
all the proc-eedlings in this matter;
The Board finds~ that:
(a) 'The amlendmlent to said Supplemenntary Code and the Sup-
pleme~~ntary~ Code as amnde~r ld are well d~esigned to promllotete
policies andl I~lpu~rpo of Title I of the Nationral Inustral R~ecovery
Ac~t including the removal of obstructions to the free flow of inter-
state and for~eign~ rconune~crce which tendt to diminish thec amnount
thereof, and will provide for the gecneral welfare by procmoting the
orgarnization of industry for the p~urplose of coop~erative action of
labor andl management under adequate govecrnmental sanction and
superv~isioln, elimiinating~ unfair competitive practices, pro-
motingr the f lest possible utilization of the present pro uctive
capacity of industries, by avoiding undue restriction of production
(except, as may be tem~poralrily requ~iredl), by increasing the con-
sumption of ind~ustrial and agricultural products through increasing
purchansing powetr, by re~ducingr and reilieving unemployment, by
Iimproving standards of labor, and by othecrwise rehabilitating

(b) ~tThe; Supplementury Code as amecnded complies in all respects
with the peCrtinent provisions of snidi Title of said Act, including
without limiitatio~n S~ubsection (a) of Section 3, Subsection ()o
Section 7, and Subsecction (b) of Section 10 thereof.

is a tradre associatio n truly repLr~esentativ7e of thle aforesaid Trade

and that said associntion imposed and imposel~ts no inequitable re-
strictions on admission to mzem~bership th~erein. and consents to this

(d) Tlhe amndlctmelt and the Supplllementary3 Code as nownd~red are
not decsiglnated to and will not permit, monopolies or monopolistic
practices.
(e) The nmnlldmen~lt and the Supplementary Code as amended
are not designed to and will not eliminate or oppress-; small enter-
prises and will not operate to discr~im~ilnate against them.
(f) T'hose e1ngage in other steps of the economic process have not
beenl de~r~ived of the right to be heard~l prior to the approval of this
amecndmnt~l to, the Supplemnentary Code t.
Fior these reasons this amendment to the above-named Supple-
mentary Code has been appl~,rove.

Th~e Supplemlentaryy Code~ of Fair Compllettiton for the Shleet
MeItal Distributing Trade, a division of the Whlolesaling or Dis-
tribuxting T1rade, is hereby amlendedt by sublstitulting; the words three
(3) or more M~embers "~ for the wiordcs lnot mlor~e than three (3)
M~emlbers "', in line two of Ar~ticle II[I, Section 4, so thlat. Section 4
reads as follows:
SECTION 4. The Divisional Code Authority shall cause to be
selected a R~griornal Conunmittee of thrlee. (3) or more Memllbers for
each of such retgionall areas as it ma1;y establish to act as its agent
in handcling such matters as may be referredci to such Conunittee
provid~ed~ that no-thing~ herein shall relieve~ th~e Divisional Code
Authority of any of its responsibilities under this Supp~lemelntal
Code or ulnder~ the General Code and provided furlth~er that such
Regional Committee shall at all times be subject to and complly w~ithl
the pro"vi ionls hereof.
