Recovery Act, approved June 16, 19)33, for approval of an amendment
to a Code of Fair Comipetition for the Steamn Heating Equipmlent
Industry, andl opportunity to b~e hear~d havinga been aff'ordced all1
members of said Industry and no objections having been filed with
the Aldministration and thle annexed report on saidl amendlment,
containing findings with respect thereto, having been mnade and
directed to the President.:

States, I, Hugh S. Johnson, Admiinistratori for Indlustrial Recovery,
pursuant to authority vestedl in mle by Execuitive O~rders of th~e
President, including Executive Ordler A0. 6543-A, datedl December
30, 1933, and otherwiise; do hereby incorporate, by reference, saidl
annexed report and do find that said amnendlment. and the Code as
constituted after being amlendled comply inl all respects with the
pertinent provisions and will promote the policy and puirposes of
said Title of said Act, and do hereby order that saidl amendment
be and it is hereby approved, and that the previous approval of said
Code is hereby modified to include an approval of saidl Code in its
entirety as amended.

Smr: This is a report on an amendment of Section 3 of Article VI:
of the Codel of ~Fair Comnlpetitiorn for t~he Steam Heanting Equipment
Industry. This Code was approved by me on Fliebruary 12, 19341.
The purpose of this amendment is to make it possible for the
recognition of the Code Authority even though the non-associationi
members do not choose to elect a representative.
FINDINGS

The Deputy Admninistrartor in his final report to mec on said amend-
mnent to said Code having found as herein set forth and on the basis
o~f all thei proceedings in this matter:
I find that:
(a:) The amendment to said code and the Clode as amended are well
designed to promote the policies and purposes of Title I of the N~a-
t~ional Industr~ial Recovery Act including the remnoval of obstructions
to the free flow of interstate and foreign commerce which tend to
diminishh thle a~mount. thereof, and will p~rovidie for the general welfare
b:y promoting the organnizationl of industry for the purpose of co-
operativec action of labor and management under adequate govern-
mlental sanction and supervision, by eliminating unfair competitive
puractices, by promoting the fullest possible utilization of the present
productive capacity of industries, by avoiding undue restriction of
production (except. as miay be temporarily requlired),_ by increa~i~ng
the consumption of industrial and agriculturn' products thrlough in-
c:reasing purchasinga power, by reducing and relieving unemploym~emt,
by impr~oving standlar~d of labor, and by othlerw-ise rehabilitating
indu str.tg
(b) The Code as ame~nded complies in al'l respects with the pert~i-
nent prov-isions of said Title of said Act, including without l~imita-
tion sub-section (a) of Section 3, sub-section (a) of Section 7 and
sub-section (b) of Section 10 thereof.
(c) The Steamii Heatingr Manufactur~ers' Association was and Is an
induistriall association truly representative of the aIforesaid Industry
and that saidl association imposed and imposes -no inequitable re~str-ic-
tionis o~n admission to miembetrship therein and has applied for this
amend men t.
(d)j The amendment and the Code as amended are not. designed
to andl wTill not permit monopolies or monopolistic practices.
(e) The amiendmnent and the Code as amended are not designed
t~o and wTill not elimlinate or oppress small enterprises and will not
operate to discriminate against them.









(f) Those engaged in other steps of the economic prorcess have not
been deprived of the right to be heardt prior t.o~ appr~ova l of said
amendment.
For these reasons, therefore, I: have approved this amiendmnent.

MlODIFICATION OF CODE OF FAIR COMPETITION FOR
THE STEAMY HEATING EQUIPMiENT INDUSTRY

PURPOSE

Pursuant to Article X, Section 3 of the Code of Fair Competi-
tion for the Steaml Heating Eqluipment Industry, duly approved by
the Administrator on February 12, 19341, and further to effectuate
t~he policies of Title I of the National Industrial Recovery Act, the
follwingmodification is established as a part of said C~ode of Fair
Colompeit~d~io and~ shall be binding upon every member of the Steamn
Heating Equipment Ind-ustry.

MTODIFICATION

Modify Article V'I, Section 3 by adding to it thie following para-
graph :
In the event the nonmembers of the association fail to elect the
member-at-large, t~he Code Authority shall consist of the members
of the Board of Directors of the Association, until such time as the
nonmembers shall elect a memnber-at-large in the manner prescribed
in this Section 3 of Article VI.
