APPROVING THE APPROVED CODE FOR TH-E STEL CASTNG INDUSTRY ALS
THIE CODE OF IFAIR COMPETITION FOR THE MANGANESE STEEL CASTING
SUBDIV'ISION OF SAID Ih'brsTur, AND AMCENDING TH-E DEFINITION OF
THE TERMI INDUSTRYY IN SAID CODE
An ap~plica~tion having been made pursuant to Administrative
Order No. X--61_, dated Jul~y 10, 1934, by the Manganese Steel Cast-
ing Subdivision of the Steel Casting Industry for codification by
consolidation under the approved Code of Fair Competition for said
Industry, for the approval of said Code as the Code of Fiair Competi-
t~ion for saidt Subdivision as defined in thne annexed report on said
Code, containing findings with respect thereto and for the amend-
m~ent of th~e definition of the term "' Industry '" in. said Code so that
said application is in full comuplianzce with Title I of the Nliational
Industrial Recovery A3ct and that said annexed report having been
made and directed to the President:
NOW\, THEREFORE, onl behalf of the President of the United
rStates, I, Hugfh S. Johnson, Administrator for Industrial Recovery,
pursuant to authority vested in me by Executivded O deers ofth rei
dent, including Executive Order N.64-,dtdDcme 0
1933, andl otherwise, do hereby
(a) incorporate by reference said annexed report,
(b) find that said Code complies in all respects with the
pertinent provisions and will promoted~ the policy and purposes of
said Title of said Act,
(c) order that said Subdivision be and it hereby is consoli-
dat~edl ith said Industry, and
(dl) order that said Code be and it thereby is ap~proved as the
Code o~f Fair Competition for the Manganese Steel Casting
Subdivision of the Steel Casting Industry, as said Subdivision
is defined in said annl~~exe report,
(e) order that the definition of the term "( Industry in said
Code be and it is hereby amended as follo-ws:

Amend Aertief II, Section 3 by deleting in the last sentence
the word "L t'wo and~ substituting therefor the word "' three ",
and after the wordl speecialties delete the period and substitute
therefore a comman and adld the followring: and M~anganese

F'urth~er, amend A~rticle: II by adding the following new Sec-
tion to be known as Sec~tionl 14:
SECTIox 14. T~he term "' Mangannese Steel Casting means that
group of steel casting~s commlonly known in t.he trade under that
namne and having n maingarrnese conten-t of not less than 10?o.
PROVIDED, HOW\EV'ER, that the continued par~ticipation of
the Mangannese Steel Fo:undlers' Soc~iety in thle Code Authority after
thirty days from the effective dlate of thlis Ordler shall be contingent
upon its amending its Constitution andc By-Law~s to the satisfaction
of the Adm:~ninistrator.
This Order shall become effective 10: tlays fromi the date hereof
unless prior to that time good cause to, thle contrary) is s~owrn to mne
anrd I, by my further order, othelrwise dlirec't.

SmI: Tlhis is n report. on the Order approving the Code of F~air
Competition for the Steel Casting Industryr as the Code of 1Fair Com~-
pet~ition for the Mlanganese Steel Casting Subdivision of said Indus-
try, and amending the definition of thne term Industry in the
Steel Casting Codte.
A Notice of Op~port~unit~y to be Heard has be~en pulblished to all
interested parties, andi unless due cause to the contrary is shown
and I issue subsequent order to thaat effect, this Order shall take effect
ten d~ays after date hereof.
Th~e termn manganese steel castings means that group o~f steel
castings comlmonly known in the trade under that name and having a
mnga~inese content of not less than tenl percent.
It is my opinion that these are kindred industries and the Mian-
ganese Steel C'asting G~roup should properly be a subdivision under
the approved Code of F~air Com~petition for the Steel Canstinga
Indlust ry.
Thle Assistant Deputy Administrator in his final report to me on
said Code hav~ingr found as herein set forth and on thne basis of all
th~e proceedings in this matter;
I find that:
(az) Said Code is well designed to promote the policies and pur-
poses of Title I: of the National I~ndulstrial Recov~ery Act, including
removal of obstructions to the free flow of interstate and foreign
commerce which tend to diminish. the amount thereof and wo9ill pro-
videe for the general welfare by promoting the organization of indus-
try for the purpose of cooperative action among the trade groups,
by inducing and maintaining united action of labor and management
und-er adequate governmental sanctions and supervision, by elimni-
nnatingr unfair competitive practices, by promoting the fullest possible
utilization of the present productive capacity of industries, by avo~id-
ingi undue restriction of production (except as may be temporarily
requir~ed), by increasing thne consumption. of indlustr~ial and agfricul-
tulral products through increasing purchasing powcper, by reducing
and relieving unemployment, by improving standards of labor, and
byr otherwisce rehabilitating industry.
(b) Said Industry normally employs not more than 50,000 em-
p~loy'ees; and is not classified by me as a major industry.
(c) T~he Code as azpproved complies in all respects with the perti-
nent provisions of said Title of said Act, including without limita-
tion Subsection (a) of Section 3, Subsection (a) of Section '7, and
Subsection (b) of Section 10 th~ere~of; and that the applicant group
is an industrial group truly representative of the atforesaid Industry;








and that said group imposes no inequitable restrictions on admis-
sion to memnber~ship ther~em.
(d) The Code is not designed to and will not permit monopolies
or monopolistic practices.
(e) Thle Code is not designed to and wFill not eliminate or oppress
small enterprises and will not opecrate to discriminate against thlem.
(f) Throse engaged in other steps of the economic process hlave
not been, depr~ived of thne right to be hear~d pr~ior to approval of said
Code.
For thlese reasons, therefore, I have approved t-his Order.
