TION FOR THE PAINTING, PAPERHANGING AND DECORATING
INDUSTRY
A DIVISION OF THE CONSTRUCTION INDUSTRY
An .application having been duly made pursuant to and in :full
compliance with the provisions of Title I of the National Industrial
Recovery Act, approved June 16, 1933 for approval of a mlodifica-
tion to a Supplementary Code of Fair competition for the Painting,
Paperhanging and Decorating Division of the Construction Industry,
and due notice and opportunity to be heard having been given thereon
and the annexed report on said modifications, containing findings wCith
respect thereto, having been made and directed to the President:
NOW, THEREFORE, on behalf of the President of the United
States, I, Hugh S. Johnson, Administrator for Indust~rial Recovery,
pursuant to authority vested in me by Executive Orders of thie
President, including Executive Order No. 6543--A, dated December
30, 1933, and otherwise; do hereby incorporate, by reference, said
annexed report and do find that said modification and the Code as
constituted after being modified comply in all respects with t~he perti-
nent provisions and will promote the policy and purposes of said
Title of said Act, and do hereby order that said modification be and
it is herebyI approved, and that the previous approval of said Code
is hereby modified to include an approval of said Code in its entirety
as modified.

SmR: This is a report on a. modification of the Supplemnentary Code
of Fair Competition for the Painting aehnigadDcrt
ing Division of the Construction I~ndustpry hanich wasd aprov b
you on February 17, 19341.
The effect of this amendment will enable the Code Aiuthorit~y to
submit a budget, and basis of assessment and give it thne power to
institute legal p~roceedlings, if necessary, for th~e collection of said
aSSeSSmlents.
The Depulty Administrator in his final report to~ me on said mnodi-
fication of said Code having found as herein set forth and on the
basis of all the proceedings in this matter:
I find that :
(a) TI~he modification of said Code and the Code as 1\fodified are
well designed to promote the policies and pur~poses of Title I of the
National Industrial Recovery Act includingr the remloval of obstr~ue-
Itions to the free flow of interstate and foreign commerce which tend
to diminish the amount thereof, and will provide for the general
welfare by promoting the organization of industry for the purpose
of coop~era~tive action of Inbor and management under adequate gov-
ernlmental sanction and supervision, by eliminating unfair com-peti-
tive practices, by promoting the fullest p~ossible utilization of the
pr~resenlt, produlctive e~~npnity of industries, by avonid-ing unldue rest ric-
ton. of production (excepti as may be temnporarlyl requiredd, by in-
creasingr the co~nsuimption of industrial and agricultural products
through increasing purchasing power, by reducing and relieving un-
emiployrment, by imlprovinga standards of labor, and by otherwise
rehabl i itadting r ind ust ry.
(b) The C-de as m'od-ified complies in all respects w~ithi the perti-
nent provisio~s of said Title of said Act, including without limita-
tion sub-section (a~ of Section 3, sub-section (a) of Section 7 and
sub-section (b) of beetion 10 thereof.
(c) Thme modlification and the Code: as modified are not designed to
and will not permit monopolies or monopolistic practices.
(d) The modification and~ the Codle as modified are not, designed
to and will not eliminate or opplr~ess small enterprises and will not
operated to discriminate against thiemi.
(e) Those engnged in otherl steps of the economic process h~ave not
been deplr~ive~d of the r~ighit to be heardl prior to approval of said
mod~cifientionr.

~MODIFICATION OF SUPPLElIlENTARY' CODE OF FAIR
COMPETITION FOR THE PAINTING, PAPERHANIGINGG
AND DECORATING INDUSTRY

A DIVISION OF THE CONSTRUCTION INDUSTRY

Modify Article III by deleting paragrraph (b) of Section 2; add
the following as Section 3 ":-
ARIrrCLE III-ADMIINISTRATION

SECTION 3. It being found necessary, in order to support the ~Ad-
ministration of thisi Chapter andi to maintain the standards of fair
competition establishedl by this C'ode and to effectuate the policy of
the Act, the Divisional Code Authority is authorized, subject to the
approval of thie Administrator:
(a) To incur suich r~easonable obligations as ar~e necessary and
proper for the: foregoing p~urp~os-es andl to meect sulchl obligations out
of funds which may be raised~ as hereinwfter prIovided and which
shall be hieldl in trust for the purpiloses of the C'hapter.
(b) To submit to the Admninis~trator r for his appr>1oval, subject to
such notice and opp~ortunity to, be heard as he mayv deeim nlece~ssary,,
(1) an itemized budgFet of its estima~ted~ expenses for the for~egoingr
purposes, and (r2) ani eqlittablee basis uponl whlich~ the funds necessaryy
Dto .supp~ort suich budi~get shall be conltributedl by miembersl of this
DIVISIOn.
(c) After such budget anl b~asisi of conltribiution have becen ap-
provedl by the Admlinistrantor, to determine and- secure equitable con-
tr~ibutions asi ab~ove set~ forth by\ all such~ memblllerss of this Divisionr
and to that end, if necessary, t >) institute legal Pr'oce'edings th~erefor
in its ow~n name~.
Each M~ember o-f th~is Division shall pay his or its equitable contri-
bution to the expenses of the maintenance of thle D~\iviio:nal Code
Authority, determiined as hereinabov\e pr1oviddc, andl subject to rules
andc~ regulationsj pertaininlg there~to issuedl by thle Aidministrator.
Only memnber~s of thiis D~iviion compllying w\ith the Code and con-
tribuiting to the expernses of its namllinistratio n as provided inr Section
3 of this A~rticle (uinless duly exemnptedl from making such contribu-
tion), shall b~e entitledl to participated inl the selection of the Members
of t~he D~ivis~ional C'ode Authorityl or to receive the benefits of its
activitie~s or to use any~ embllem or insigr~ni of the Natio-lnal Recovery
Administration.
Th~e Divisional Code Aulthority shall neither incuir nor pay any
obligation in excess of the amount thereof as estimated in its ap-
provecd budget, except upon approval of the Admlinis~trantor; and no
subsequent budget shall contain any~ deficiency item for expenditures
in excess of prlior b~udget estimate except those whichl the Adminis-
trator shall have so approved.
