SmR:Provision #3 in the Order approving the Code of F~air Com-
pe't it ion for the Beater and Jordan and Allied- Equipmlent Sjubdivi-
sion of Ma~ch'linery and Allied Products Industry approved by mne on
May 14, 1934 provides that the provisio:ns of Ar~ticle V'III, Section
(e) be and they hereby are stayed pending the submission of satis-
fu!.tlr~y evidence (IIConcerningb distribution of the pr~oductl s of the ~Sub-
divisionl to the Admlinist r~tor. This Section (ei) of Article VIII
reads as follows:
"'No employer shall sell to or through any distr~ibultor ho shall
fail to agrree to resell in accordance woiith Articled V'II, VIII and IXi
of this Su;pplemnental Code."

basis of all the prcee~ttdings in this matter; I find that:
(a) The Modification of saidl Code arnd thne Codle as modified are
well designed to promote the policies and purpose.- of Tit~le I of t~he
National Industrial Recovery Act including the r~emoval of obstrue-
tions to the free flow of in~tersitate and foreign comme~rrce which tend
to diminish the amount thereot~cf, and will provride for the general
welfare by promoting the organization. of industryv for the purpose
of cooperative action among trade groups, by ind~ucing and mnain-
taining united action of labor and managuiement under adequate gov-
elrnmen~rtal sanction and supervision, by eliminating unfair comnpet.i-
tive practices, by promoting the fullest possible utilization of the
presen~rt productive capacity of indus~ltries, by avo~iding undue restric-
tion of production (exsceplt. as may be temlporarily requiredd, by in-
creasing the consumption of industrial anid agr~iculturaal products
through increasing purchasing powercl, by reducing and relieving un-
employment, by improving standards of labor? and by otherwise
(b) The Code as modified complies in all respects w~ith the p~erti-
nent provisions of said TIitle; of said A5ct, includlingr wit.hout limita-
tion Suzbsection (a) of Section 3, Subsectioln (a) of Section 7, and
Subsection (b) of Section 10 thereof.
(c) The Modification and the Code as mnodifiedl are not designed to
and will not permit monopolies or monopolistic pract~ices.
(d) The Modification and the Code as modified~ ar~e not designed
to and wFill not eliminate or oppress small enterprises and will
not operate to discriminate against them.
(e) Those engaged in other steps of the economic process have
not been dteprived of the right to be heard prior t.o approval of said
