Delete Section 5 of ArJticle II: and in lieu threreof insert:
5. (a) It being found necessa c~y in order to support the admlinis-
tration of this Code and to maintain thze standards of fair comrpeti-
tion established hlereundlcer and to effectuazte the policy of th~e Act, the
Code A~uth-ority is authorized:
1. To incur such reasonallel~i olbligrations as are necessary an~ld
proper for the foregoing purposes, and to meet such obligations
out of funds which may be raisedi as hereinafter provided and
which shall be held in trust for the purposes of the Codle.
2. To submit to the National Industrial Rtecovery Board for
its approval, subject to such. notice and opportunity to be heard
as it may d3eern necessary (a) an itemlrizedl budget of its estimalted'
expenses for the foregoing purposes, and (b) an eqluitablel basis
upon wIhich the funds necessary to support such budget shall bje
co-ntributlled by mlembhers of the Industry.
3. After such budget and basis of contributions hvTe, b~ee~n
alpprovedl by the National Industrial Rrl-overy'S Board, to det~er-
mine and obtain equitable contribution as above set forth by
all members of the.Industry, andi to thazt end, if neceanryrl~y to
instituted legal proceedings therefore in its owvn name.
(b) Each members of the Industry shall pay his or its eq~uitable
'onltr'ibutlion to the ~lexpenses of the maintenance of the Code ~Author-
itiy, determinedly as hereinabove provided, and subject to rules an1d reg-
ulations per~ltiningll thereto issuled by the National Industrial Re-
covEery Boardl. Only members of the ICndustry complying with the
Co~e: and contributing to the expecnses of its a intllilistra~tionl as here-
inabove provided, unless duly exempted from making .uhcontri-
butions, shall be enltitled~ to parn1ticipate in the selection of Ilenlemers
of the Code Authority or to receive the blenefits of any of its volun-
tar~y ac~tivitie~s or to make use of any emlbleml or insignia of the Na-
tional Recovery ~Administration.
(c) The Code Atluth`ority shall neither incur nor pay any ob~lign-
tion substantially in excess of the amolunt thereof as estimalted- in
its app'rcroed budget, and shall in no event exc~eedl the total amlountt
contained in the approved budget, except; upon approval of thre Na-
tional Indlustr~ial Recovery Boardl; and no subsequent budget shall
contain any defcicincy3 item for expend~l it ures~ in excess of prior budget
est~imates except those wrhich- the National Industrial Recov,\ery\ Board
shall have so approved.
