An application having been dluly ma~de puirsuant to aind inl full
compliance with the provisions of Title I of the National Industrial
Recovery Act, approved June 16, 1933, for approval of an nmend~-
ment of a Code of Fair Competition for th~e Gasoline Pumip M~anu-
facturing Industry, and as contained in a Published Notice of
Opportunity to Be Heard, Admlinistrative Order No. 26--10, dated
August 20, 19;34, and no objections having been filed as providedl
in said Pubjlished Notice, and the annexed report. on said amlendlment,
containing findings w~ithl respect thereto, having been made and
directed to the President,
NOW, THEREFORE, on behalf of the President. of the ULnitedZ
States, I, Hugh S. Johnson, Administrator for Industr~ial Re~covery,
pursuant. to authority vested in mie by Executive Ordcers of the Presi-
dent, including Executive Order 6543-A, da~tedl December 30, 1933,
and otherwise; do hereby incorporate, by reference, said annexed
report and do find that said amendment and the Codle as constituted
after being amended comply in all respects with the pertinent pro-
visions and will promote the policy and purposes of said Title of
saidi Act., and do hereby order that said amendment be and it is
hereby approved, and that the previous approval of said Code is
hereby modified to include an approval of saidl Code in its entirety
as amended, such approval and such amendment to take effect t~en
(10) days from t~he dlate her~eof, unless good cause to the contrary is
shown to the Adm~inist~rator before that time and the A~dminist~rat~or
issues a subsequent orders to that effect.

Sm: Tlhis is a report on an amendment to the Code of Fair
Competition for the Gatsoline Pump Ma~nufacturing Industry, in
accordance with Article XIII of said Code asj approved on Septem-
ber 18, 1933.
The amendment provide~s for a change in the wording of Article
XC to provide for a Code Aiut.horit.y of seven members, instead of
five members as at present. Notice of Opportunity to Be Heard
waCrs gEiven from Augaust 20,. 1934, to September 4, 1934; no objections
weefiled.
FINDI NGS

The Deputy Administrator in his final report to me on said amend-
meent ito said Code haing: found as herein set. forth and on the basis
of all proceedings in this matter;
I findl that:
(a) The amendment of said Code andi the Code as amended are
wTell designed to promote the policies and purposes of Title I of the
National IZndustrilal Recov~ery Act., including the removal of obstruc-
tions to the free flow of interstate' andl foreign commerce which tend
to d~iminish the amount thereof, and will provide for the general
w~elfar~e by' promoting thie organization of industry for the purpose
of 'ooperat~livel action am)onlg trade groups, by indlucing and main-
taining ~unit~ed action of labor andl management. under adequate
governlmental sanction andr~ supernision, by eliminating unfair com-
petitive p~rat~ices, by promo~tingr t.he fullest possible utilization of the
present. productive capacity of industries, by' av-oid.ing undue restric-
ti~on, of production (except as may be temporarily required), by
increasing t~he consumption of industrial and agricultural products
through increasingv prcirhasi;ng power, by reducing and relieving
unemployment, byv imiproving standards of labor, and by otherwise
rehabilitating ind~usatry..
(b) The Code as amlended complies in all respects with the
pertinent prois\iiionis of said Title of said Act, including without
limitation Subsection (a) of Section 3, Subsection (a) of Sjection 7,
and Subsection (b) of Section 10 thereof.
(c) The amendment and t~he C'ode as ameneddc are not designed
to and will not permit, monopolies or monopolistic practices.
(d) The amendment and the Codle as amended are not designed to
and will not eliminate o~r oppress small enterprises and will not
operate to discrimninute against them.

(e) Those engaged in others steps of t~he economic process have not
been deprived of the right to be heard prior to atpprovnl 'of said
amendment.
For these reasons, this amendment has been approvedl by me
subject to a ten (10) day stay and opportunity~ to be heard b l
