An1 application having been duly made pursuant to and in full
comp'lianlc~e with the provisions of Title I of the Nationall Indunstrial
Recovery Act, approved June 16, 1933, for approval of an amnendi-
ment to a Code of Fair Competition for the? Marine Aiuxiliary
Machinery Industry, and opportunity to be heard having been
noticed to all interested persons, and no objections thereto having
been filed, and the annexed report on said amlendfment, containing
findings with respect thereto, having been made and directed to thle
NOW.tT THERLEFlORE, on. b~ehalf of the President of thle U~nite~d
States, the National Industrial Rtecovery Board, pursuant to author-
ity vested in it by Executive Orders of the President, including
Executive Order No. 685i9, dated September 27, 1934, and otherwise,
does hereby incorporate, by r~efer~ence, said annexed report and does
find that said amendment and the Code as constituted after being
amended comply in all respects with the pertinent provisions and
will promote the policy and purposes of said Title of said Act, and
does hereby order that said amendment be and it is hereby approved,
andi that the previous approval of said Code is herebyv amended to
include an approval of said Code in its entirety as amlendedj.

on January 30, 1934. An opportunity to be heard was noticed to all
urtctjteeded persons in accordance with TCitle I of the National Indus-
tria~l Reco~very Act. N-o objections were filed.

AMENDMENT T'O CODE OF FAIR COMPETITION FOR THE
MRI~.R NE AUXILIARY MACHINERY INDUSTRY
Delete Section itj3 of ALrticle VI and substitute inl lieu thereof the
SE~CTION; 3. (a) It being found nectessaryv in order to support the
administration of this code and to maintain the standards of fair
competition establ~lished herclnnaer and to effectuate the policy of
the Act, the Code Authority is author~ized :
(1) To incur such reasonable obligations as ar~e necessary and
p~roper for thle fol''citkrain purpose'.~-, and to meet such obligations out
of funds which mlay be raised as hereinafter provided and which
shall be held in trust for the purposes of the Code:
(2) To submit to the National Industr~ial Recoveryr Board for its
approval, subject to such notice and opportunity to be heard as it
may deemi necessary (1) an itemnizedl budget ofits estimated ex-
pel~n es4 for the foregroingr purposes, and (2) an equ~itablee E~ncis upon
which the funds necessary to support such budget shall be con-
tributed by members of thle industry:
(3) After such budgtcrl and basis of contribution have been ap-
provedt by the National Industrial Rtecovery Board, to determined and
obtain equitable contribution as above set forth by all members of the
industry, and to that end, if necessary, to institute legal prceedct~tings~
therefore in its own name.
(b) Each nrruenther of the industry shall pay h~is or its equitable
contribution to the expenses of the mal~inte.nalce of the Code Author-
ity, decterminedl as hereinabove provcidedc, and sutbject to rules and
regulations pertaining thereto issued by the Nationlrl1 Industrial Re-
coverly Board. Only members of the Industry complying with the
codep and contributingr to the exposes; of its admninistration as hlere-
inabove providedc, (unless du~ly exempted from maklling~ -I1('h con-
tributions,) shall be entitled to p~artiCip~ate in t~he selecttion of nwm11-
bers of the Code Authlority or to receive the benefits of any of its
voluntary activities or to makie use of any embilem~i or iniig~ini of
the Njationni;7 Reco~veryV ~Administration.
(c) T'he Code Auth~ority shalll n~eitherl incur nor payv anry obllign-
tion substantially in ecescvs of the amount therecof as estimated in
