trial Recovery Act, app~oved June 16;, 1933. and in accordance with

SmR: This is a report on the modification of the Code of Fair Com-
petition for the Plumbing Fixtures Industry, incorporating as a di-
vision the Range Boiler Manufacturing Industry, and on the hiear-
ing conducted thereon in Washington, D.CI., March 20, 1934, in
accordance with the provisions of Title I of the National Industrial
Recovery Act.
GENERAL L SITAT'EMENTI

The Range Boiler Manufacturing Industry being truly represent-
ative of thiis division of the Plumbing Fixtures Industr~y has elected
to avail itself of the option of becoming a division, by wholly adopt-
ing the provisions prescribed in the Plumbing Fixtures Industry
approved by you on the thirteenth dlay of January, 1934.
MODIFICATIZON OF THE CODE

Article I states the annexed division for Range Boiler MnuInlfac-
turing Industry.
Article II defines the term Range Boiler.
Article VI provides for representation in code administration.

FINDINGS

The Deputy Adtministrator in his final report. to mie on said modi-
fication, having foundl as herein set forth and on the basis of all the
proceedings in this matter:
I find that:
(a) The mlodificationn of said Code and the Code as miodified are
well designed to promote the policies andi purposes of Title I of
the National Industrial Recovery Act including the removal of
obstructions to the free flow of interstate and foreign commerce
which tend to diminishl the amount. thereof, and will provide for
the general welfare by promoting the organization of the industry
for the purpose of cooperative action among trade groups, by indue-
ing and maintaining united action of labor and management under
adequate governmental sanction and supervision, byl eliminatingB
unfair competitive practices, by promoting the fullest possible: utili-
zation of the present productive capacity of industries, by avoid-
ing undue restrictions of production (except as mayl be temporarily
requiredd, by increasing the consumption of industrial and agricul-
tural products through increasing purchasing power, by reducing and
relieving unemiplo~yment, by improving standards of labor, and by
otherwise rehabilitating industry.

(b) The Code as modified complies in all respects with the per-
tinent provisions; of saidl Title of saidl Act, including without limita-
tion Subsection (a) of Section 3, Suibsection (a) of Section 7, and
Subsection (b) of Section 10 thmereof.
(c) Thle Range Boiler M~anufacturers Association was and is an
industrial association truly representatives of the aforesaid Industry
and that said Association imposed and imposes no inequitable restric-
tions on admission t~o membership therein and has applied for or
consents to this modification.
(d) The modification and the Codle as modified are not designed
to and will not permiit monopolies or monopolistic practices.
(e) Thme mnodifiention and th-e Code as modified are not designed
to and wrill not eliminate or oppress small enterprises and will not
operate to discriminate against them.
(f) Those engaged in other steps of the economic process have
not been dlep~iverd of the right to be heard prior to approval of
said modification.
For these reasons th~is modification has been approved.
