SPEECH NUMBER 323

VOLUME XXII

REMARKS OF:

BEFORE:

CHESTERFIELD SMITH
LAWYER
MIAMI, F.0 fRA

DADE COUNTY BAR ASSOCIATION
1991 SUNER LAW CLERKS

PLACE:

INTER-CONTIMENTAL HOTEL
MIAMI, FLORIDA

DATE:

TUESDAY, JULY 23, 1991

15 MINUTES

TIME:

ONE THING IS CLEAR TO ME -- THE UNIQUE

HALLMARK OF THE LEGAL PROFESSION IS -- AND

ALWAYS HAS BEEN AND WILL BE -- ITS COMMITMENT

TO PUBLIC SERVICE. NO OTHER PROFESSION HAS

SO EXTENSIVE A COMMITMENT. LAWYERS

EVERYWHERE -- LEGITIMATELY MDA PROPERLY -- DO

SEEK FROM THE PRACTICE OF LA MWEALTI AND

PERSONAL POWER -- BUT THOSE WHO SEEK ONLY

THOSE TWO PERSONAL REWARDS WILL MISS MUCH.

LIKE OTHERS OF MY TIME -- I -- NOT

SURPRISINGLY -- AM INCREASINGLY CONCERNED

THAT THE EVER-ACCELERATING ATTENTION OF

YOUNGER LAWYERS TO THE MONETARY RETURNS OF

LAW PRACTICE IS HAVING A DAMPENING EFFECT ON

THAT SPIRIT OF VOLUNTEERISM; -- ON THE

COMMITMENT BY LAWYERS TO PRO-BONO

PROFESSIONAL WORK.

WHEN I WAS A YOUNG BEGINNING LAWYER--

MOST LAWYERS THAT I KNEW WELL ROUTINELY

FOCUSED ALWAYS ON THE TRADITIONAL

OBLIGATIONS OF THE ADVOCATE:

THE OBLIGATION OF PUBLIC SERVICE;

THE OBLIGATION OF SERVICE TO THE

PROFESSION;

THE OBLIGATION OF IMIPROVING OUR

SYSTEM OF JUSTICE.

NOW IT OFTEN SEEMS TO ME THAT THE PRINCIPLE

OBLIGATION OF MOST LAWYERS IS TO BE

SUCCESSFUL FINANCIALLY.

THOSE CONCERNS OF NINE ABOUT THAT

PERCEIVED BURGEONING BOTTOM LINE MENTALITY OF

LAWYERS -- IF TRUE -- WILL NOT BE EASILY

RESOLVED AND I NOW PUT THEN ASIDE FOR LATER

CONSIDERATION. FULLY RECOGNIZING THE

LEGITIMATE INTEREST OF INDIVIDUAL LAWYERS IN

DOING WELL FINANCIALLY I UNABASHEDLY

OFFER TO YOU WHO JUST ARE ENTERING THE LEGAL

PROFESSION NW THOUGHTS ABOUT OTHER RE lARDS--

OTHER BENEFITS -- ASSOCIATED WITH BEING A

LAWYER. THOSE REWARDS -- THOSE BENEFITS--

HAVE SHAPED MY LIFE AS A LAVER -- AND I

WOULD DO IT ALL AGAIN ABOUT THE SANE WAY.

FIRST -- I THINK -- TO BE A GOOD LAWYER

-- A PERSON SHOULD ENJOY UTILIZING CREATIVE

ABILITIES AND IMAGINATION IN THE SOLUTION OF

DIFFICULT AND CHALLENGING INTELLECTUAL

PROBLEMS. AS I SEE IT -- THE GREATEST

PROFESSIONAL PLEASURE THAT CAN CONE TO A GOOD

LAWYER IS TO SEE HARD THIKINM TRANSLATED

INTO FAVORABLE RESULTS FOR TUE CLIENT.

SECOND -- I BELIEVE THAT A LAWYER SHOULD

-- MUST -- PICTURE HIMSELF OR HERSELF ALWAYS

AS A RESPECTED AND INDEPEEFESSONAL

-- A PERSON OF INTEGRITY WHO HAS ESTABLISHED

PROFESSIONAL STANDARDS FOR DECIDING NtAT SHE

OR HE WILL DO -- AND MILL NOT DO -- AS A

LAWYER. A GOOD LAWYER NEVER COMPROMISES

PROFESSIONAL QUALITY -- STRIVING TO DO THE

BEST WORK POSSIBLE FOR ITS Ni SAKE -- AND

PERSONAL SATISFACTION. INDEED -- EACH

LAWYER ALWAYS MUST BE READY TO BE JUDGED BY

THE LEGAL PROFESSION -- BY THE PUBLIC -- AND

BY HER OR HIS PEERS -- FOR THOSE PROFESSIONAL

DECISIONS -- AND FOR WORK QUALITY.

THIRD -- I CONTEND THAT A LAWYER

CONTINUOUSLY SHOULD BE IN THE FOREFRONT OF

THOSE SEEKING NEEDED CHANGES OR EFOMS IN

LAWS -- IN LEGAL PROCESSES -- IN TIE LEGAL

PROFESSION -- AND IN THE SOCIETY. AN

EXPERIENCED LAWYER WELL KNOWS THAT ALMOST

EVERY MAJOR SOCIETAL OR PUBLIC ISSUE INVOLVES

LAW -- AND HE OR SHE ALSO REOrNuTTFS TMAT A

LAWYER CANNOT GOT THROUGH LIFE WITi BLINDERS

FOCUSSING ON NARROW ISSUES. A CUMITTED

PROFESSIONAL SHOULD WORK AT THE TOTAL AFFAIRS

OF LIVING -- ARTS -- SORTS -- POITICS--

CURRENT EVENTS -- COMMUNITY AND CIVIC AFFAIRS

-- CHURCH -- BOOKS -- FIGHTING ALWAYS AGAINST

THE DISEASE OF COHPARTMENTALIZATIN.

FOURTH -- I KNOW THAT MAY LAWEERS -- IN

DADE COUNTY AND THROUGHOUT FLORIDA -- HAVE

ALREADY PLAYED SIGNIFICANT ROLES IN S AND

CIVIL RIGHTS ISSUES. BUT I REITERATE--

THE LEGAL PROFESSION -- AS IT BECOMES EVER

MORE ORIENTED TO THE BOTTOM LINE -- TRULY IS

UNDERGOING FUNDAMENTAL MODIFICATION. AS LAW

PRACTICES GET LARGER AND LARGER -- AS THE

COMPETITION FOR LEGAL BUSINESS GETS FIERCER

-- AND AS PRESSURES INCREASE TO FIND

ALTERNATIVES TO LITIGATION FOR RESOLVING

DISPUTES -- I BELIEVE TIAT LMAEES MUST

CONTINUE TO TAKE THE LEAD IN 1BE COUNTY PRO

BONO PUBLIC IN THE AREAS OF CIVIL AND HUMAN

RIGHTS -- AND THAT A NUMBER OF LAYERS SIMPLY

ARE NOT DOING THAT. DADE COUNTY LAWYERS IN

THE PAST HAVE RIGHTLY EARNED A REPUTATION AS

A WHOLE FOR SUCH WORK -- TRADITIONALLY

REPRESENTING PEOPLE WITH DIFFICULTIES AND

FEARS THAT OVERWHELM THEN --REPRESENTING

FREELY AND OFTEN THOSE ENMESMED IN

FRIGHTENING LEGAL AREAS WHO ARE EITHER

UNREPRESENTED OR UNDERREPRESErED. WE MUST

CONTINUE THAT TRADITION. A D LAWYER

QUICKLY LEANS THE VERY SPECIAL SATISFACTION

THAT CAN COME WHEN SHE OR HE nTri FS THE

UNIQUE RESPONSIBILITY OF PRVIDIG LEGAL HELP

TO PEOPLE MOST IN NEED OF COETENT LEGAL

SERVICES AT THE TIME OF TWEIR GREATEST

VULNERABILITY.

FIFTH -- WHILE PERHAPS BOTH TRITE AND

SMUG AS AN OBSERVATION -- A GOOD DADE COUNTY

LAWYER ABOVE ALL MUST KNOW -- MUST APPRECIATE

-- THAT IF SHE OR HE -- AND THEIR PEERS--

WHO HAVE CAST THEIR TOTAL PROFESSIONAL LOT

10

I

WITH THE ADVERSARY SYSTEM OF JUSTICE -- DO

NOT INDIVIDUALLY DISCHARGE TEAT UIQOUE

OBLIGATION TO MAKE THE PROCESSES OF JUSTICE

WORK -- NO ONE ELSE -- ANYMERE -- WILL

ACCEPT THAT RESPONSIBILITY. THE COURTS

SHOULD DISPENSE JUSTICE -- BUT EVEN MORE

SIGNIFICANTLY -- LAWYERS BEST KMU THAT THE

COURTS MUST BE PERCEIVED BY CITIZENS

EVERYWHERE -- BY LITIGANTS EVERUWERE -- TO

DISPENSE JUSTICE. IT IS -- AND LONG HAS

BEEN -- AN OBLIGATION OF A DADE COUNTY LAWYER

TO MAKE THAT PERCEPTION A REALITY BY FIGHTING

ALWAYS TO ENHANCE JUDICIAL AND LAWYER

11

EFFICIENCY AND COMPETENCY. DADE COUNTY

LAWYERS MUST CONTINUE THAT UN _atM a FIGHT.

SIXTH -- ADMITTEDLY -- ME AS LAWYERS

ARE -- AND FOR SOMETIME HAVE CONCERNED

THAT ALL -- OR SOME -- OF TE BEST -- THE

BRIGHTEST -- THE MOST IDEALISTIC OF THOSE WHO

TYPICALLY IN THE PAST HAVE ENTED THE LEGAL

PROFESSION MIGHT HENCEFORh COOSE OTHER

WAYS TO MAKE A LIVING. CERTAINLY I KNOW SOME

WONDERFUL YOUNG PEOPLE WHO NW HEAR BUGLES

OTHER THAN LEGAL PROFESSIONALISM. PERHAPS

IT IS TIME THAT LEGAL CODES OF ETHICS AND

RULES OF LAWYER CONDUCT MOVE SMIBIAT CLOSER

12

TO REALITY BY FREELY AND FRANKLY REMRING AN

ACKNOWLEDMENT THAT THOSE iRABM DUTIES

OF LAWYERS ARE OBLIGATORY. WHILE THE BEST

LAWYERS ALWAYS HAVE RECOGNIZED TUAT EARNING A

LIVING OF NECESSITY HAS TO BE A IRECCUPATION

- PERHAPS IT NOW WOULD ATTRACT IDEALISTIC

YOUNG PEOPLE AGAIN TO THE LEGAL PROFESSION IF

THE ORGANIZED BAR AFFIRMATIVELY ENSURES THAT

EACH LAWYER FINDS TIME FOR OTHER SOURCES OF

SELF-FULFILLMENT WHILE STILL EARNING THAT

VERY GOOD LIVING. WE IN DADE COUNTY MUST

CONTINUE -- AS WE TRADITIONALLY NAVE -- TO

AFFIRM THAT A PERSON WILL BE MEriEcav AS A

13

GOOD LAWYER ONLY IF THAT PEM IS ALSO A

RESPONSIBLE CITIZEN.

SEVENTH -- REGRETTABLY -- TWE IESTION

MOST ANSWERED FOR CLIENTS BY LASVES TODAY

IS: IS IT LEGAL? -- NOT: IS IT

RIGHT? AS CURRENT EVEMIS ff THE

WORLD SHOW -- A LEGALISTIC SOCIETY WHICH

IGNORES ALL VALUES OTHER THAN LAW IS A

SOCIETY WHICH ULTIMATELY WILL WITHER AWAY AND

DISAPPEAR. NO STATE CAN LONG SURVIVE IF

ITS PEOPLE ASSUME THAT CONDUCT MOT FORBIDDEN

BY LAW IS ACCEPTABLE CONDUCT -- AND A LAWYER

MUST NEVER MAKE THAT ASSUMPTION. LAW

ADDRESS OF:

BEFORE:

CHESTERFIELD SMITH
LAWYER
MIAMI, FLORIDA

NATURAL ZATION
CEREMONIES, DADE COUNTY
AUDITORIUM
MIAMI, FLORIDA

DATE OF DELIVERY: TUESDAY, OCTOBER 1,
AT 10:30 A.M.

TITLE:

1991

REQUIREMENTS OF GOOD
CITIZENSHIP

TEN MINUTES

/

TIME:

YOU HAVE WORKED LONG AND HARD TO

EARN YOUR CITIZENSHIP. YOU HAVE EVERY REASON

TO BE PROUD AND I CONGRATULATE EACH OF YOU

ON THIS SIGNIFICANT ACHIEVEMENT.

I WISH MORE AMERICANS COULD WITNESS

THESE NATURALIZATION CEREMONIES. IN DOING SO

-- MORE CITIZENS WOULD CONSIDER WHAT IT

MEANS TO BE AN AMERICAN CITIZEN. CITIZENSHIP

NOT ONLY INVOLVES THE GAINING OF RIGHTS BUT

IT ALSO IMPOSES CERTAIN RESPONSIBILITIES ON

EACH PERSON. OFTEN WE CITIZENS ONLY REMEMBER

THE RIGHTS AND THOUGHTLESSLY FORGET THE

RESPONSIBILITIES. SUCH FORGETFULNESS CAN BE

DISASTROUS. THE BLESSINGS OF LIBERTY AND

DEMOCRACY CAN BE SEVERELY JEOPARDIZED UNLESS

DEVOTED AND ENLIGHTENED EFFORTS BY ALL

CITIZENS IN MEETING THOSE RESPONSIBILITIES

ARE EVER PRESENT.

IN A WAY YOU HAVE A REAL ADVANTAGE

OVER AMERICANS WHO ARE BORN IN AMERICA. THEY

DID NOT HAVE TO EARN THEIR CITIZENSHIP.

INSTEAD IT CAME TO THEM BY BIRTH. YOU ON

THE OTHER HAND KNOW THAT AMERICAN

CITIZENSHIP IS NOT A MERE FORMALITY OR

ACCIDENT OF BIRTH WHICH INSURES YOUR

RESIDENCY. BECAUSE OF THE LONG PROCESS AND

DIFFICULT STUDY THAT WAS NECESSARY TO SECURE

YOUR CITIZENSHIP I KNOW THAT YOU WILL TAKE

YOUR DUTIES AS CITIZENS MORE SERIOUSLY THAN

MANY NATIVE BORN AMERICANS. UNFORTUNATELY-

TOO MANY AMERICANS TAKE THEIR CITIZENSHIP

LIGHTLY -AND ARE CARELESS ABOUT THEIR CIVIC

DUTIES.

MANY AMERICANS ARE IGNORANT OF HOW

OUR POLITICAL SYSTEM WORKS. THEY DO NOT

KNOW HOW TO MAKE THEMSELVES HEARD AS

CITIZENS. MOST AMERICANS CANNOT NAME THE

UNITED STATES SENATORS FROM THEIR OWN STATE.

MOST DO NOT KNOW THEIR OWN CONGRESSMAN'S

NAME. THEY THUS HAVE LITTLE CHANCE

EFFECTIVELY OF LETTING SENATORS AND

CONGRESSMEN

LEGISLATION

N KNOW HOW

- WHETHER 1

OTHER MEANS OF EXPRE5

ALL TOO M

PARTICIPATE IN THE

IMPROVING OUR LEGAL

;SING

ANY

JOB

AND

THEY HAVE NO IMPACT UPON

THEY DO NOT UNDERSTAND OR

GOVERNMENT WORKS. THEY

ENOUGH TO BECOME EFFECTIVE

NOT EVEN VOTE.

THEY FEEL ABOUT

THROUGH LETTERS OR

THEIR OPINION.

AMERICANS DO NOT

OF MAINTAINING AND

POLITICAL SYSTEMS.

GOVERNMENT BECAUSE

APPRECIATE HOW OUR

OFTEN DO NOT CARE

CITIZENS. THEY DO

GOOD CITIZENSHIP REQUIRES MORE. OF

COURSE ALL CITIZENS ARE EXPECTED TO STAY

OUT OF TROUBLE WITH THE LAW AND TO PERFORM

MINIMAL ACTS -- SUCH AS PAYING TAXES AND

PARTICIPATING AS A JUROR WHEN CALLED UPON BY

OUR COURTS OF LAW. BUT GOOD CITIZENSHIP-

DEMANDS MORE.

THE AMERICAN PEOPLE SHOULD BE

CONCERNED KNOWLEDGEABLE AND ACTIVE

CITIZENS IF OUR SYSTEM OF GOVERNMENT IS TO

WORK. AS CITIZENS YOU MUST WORK AS HARD

AT THE DUTIES OF CITIZENSHIP AS YOU DID HERE

TO WIN YOUR CITIZENSHIP.

CONCERNED CITIZENS ARE THOSE WHO

CARE DEEPLY ABOUT WHAT HAPPENS IN THEIR

COUNTRY. THEY REALIZE THAT IN A DEMOCRACY-

THE GOVERNMENT CAN NEVER BE ANY BETTER-

WISER OR MORE JUST THAN ITS CITIZENS. THEY

WORK HARD TO MAKE GOVERNMENT MORE RESPONSIVE

TO THE BEST ELEMENTS OF SOCIETY AND TO

IMPROVE THE BAD ELEMENTS.

KNOWLEDGEABLE CITIZENS ARE THOSE WHO

KEEP WELL INFORMED ABOUT THEIR SYSTEM OF

GOVERNMENT. THEY KEEP ABREAST OF CURRENT

EVENTS AND IMPENDING PUBLIC DECISIONS. THEY

KNOW WHO IS RUNNING FOR OFFICE AND WHAT THE

CANDIDATES SAY ABOUT THE ISSUES. THEY KNOW

HOW THEY -- THE AVERAGE CITIZENS -- CAN HAVE

AN INFLUENCE CAN CHANGE THE DIRECTION OF

THEIR COMMUNITY STATE OR NATION FOR THE

BETTER BY ACTIVE PARTICIPATION IN GOVERNMENT

BY LOBBYING AND BY VOTING.

ACTIVE CITIZENS ARE THOSE WHO MAKE A

REAL EFFORT TO FULFILL THE DUTIES OF

CITIZENSHIP. PERHAPS THEY SUPPORT

PARTICULAR

SUPPORT OF

THEY EVEN

CANDIDATES AND TRY TO WIN THE

THEIR FELLOW CITIZENS. PERHAPS

STAND FOR OFFICE THEMSELVES.

CERTAINLY THEY WILL VOTE IN ALL ELECTIONS-

THEY KNOW WHAT BILLS THEIR LEGISLATURE AND

CONGRESS IS CONSIDERING lAKE THEIR OPINIONS

KNOWN TO THEIR REPRESENTATIVES AND TRY TO

INFLUENCE THE OPINION OF THEIR FELLOW

CITIZENS. THEY KEEP UP WITH PROBLEMS SUCH AS

CRIME ENVIRONMENTAL POLLUTION AND

POLITICAL CORRUPTION AND SEE TO IT THAT THEIR

ELECTED REPRESENTATIVES ACT RESPONSIBLY IN

DEALING WITH THEM.

ONE CITIZEN CAN MAKE A REAL

DIFFERENCE. IN COMMUNITIES AROUND THE

COUNTRY THE WATCHFULNESS AND CONCERN OF

MANY INDIVIDUAL CITIZENS HAVE LED TO

REDUCTIONS IN CRIME AND LAWLESSNESS. THE

SINGLE VOTER IS DRAMATICALLY BROUGHT HOME.

THERE IS MUCH THAT A GOOD CITIZEN

CAN DO AND I HOPE THAT YOU ARE CONVINCED

THAT GOOD CITIZENSHIP TAKES TIME AND EFFORT.

GOOD CITIZENSHIP IS NOT EASY. NOTHING REALLY

WORTH HAVING EVER IS. I BELIEVE THAT YOU

KNOW THIS. SOME OF YOU LEFT NATIONS WHICH

HAVE DESTROYED INDIVIDUAL FREEDOMS OR EVEN

NEVER REALLY HAD THEM. FROM THE HEART -- YOU

THUS KNOW HOW PRECIOUS LIBERTY AND DEMOCRACY

ARE.

10

BE MODELS FOR ALL OTHER CITIZENS.

IF MANY OF OUR NATIVE BORN CITIZENS APPEAR TO

TAKE THEIR CITIZENSHIP FOR GRANTED ARE LAZY

ABOUT THEIR CIVIC DUTIES OR NO LONGER TRY

TO HAVE AN IMPACT ON THEIR GOVERNMENT -MAKE

EVERY EFFORT TO INSURE THAT THEY LEARN FROM

YOU AND THAT THEY SEE WHAT A GOOD CITIZEN

CAN -- AND SHOULD -- BE.

THIS IS A DAY OF GREAT CELEBRATION-

AND ALL AMERICANS SHARE WITH YOU YOUR JOY AT

RECEIVING THE PRECIOUS PRIVILEGE OF

CITIZENSHIP. BUT THAT JOY SHOULD NOT OBSCURE

AN IMPORTANT FACT. YOU LIKE ALL AMERICANS

11

- MUST NOW BRING TO CITIZENSHIP A LIFELONG-

STEADY DEDICATION. I HOPE YOU WILL PROVE

EQUAL TO THIS GREAT CHALLENGE AND I HOPE

THAT YOUR EXAMPLE WILL REMIND ALL OF US THAT

CONCERNED KNOWLEDGEABLE AND ACTIVE

CITIZENS CAN CONTINUALLY HELP STRENGTHEN AND

IMPROVE THIS NATION WE LOVE SO DEARLY.

SPEECHES OF CHESTERFIELD SMITH

SPEECH NUMBER 326

VOLUME XXII

ADDRESS OF:

BEFORE:

PLACE:

CHESTERFIELD SMITH
LAWYER
MIAMI, FLORIDA

PRESENTATION OF THE
PORTRAIT OF UNITED STATES
DISTRICT COURT SENIOR
JUDGE HOWELL MELTON

U.S. DISTRICT COURT
JACKSONVILLE, FLORIDA

OCTOBER 25, 1991
3:30 P.M.

SIX MINUTES

TIME:

IN A SOCIETY AS SATURATED IN LAW AS

OURS -- IN A STATE WITH A BURGEONING

POPULATION -- IN A STATE AS LITIGIOUS AS

FLORIDA HAS BECOME -- THE CHOICE OF WHICH

FLORIDA LAWYER IS TO SIT ON THE FEDERAL BENCH

AT ANY LEVEL HAS PARTICULAR IMPORTANCE FOR

THOSE OF THE GENERAL PUBLIC WHO ARE TO BE

JUDGED BY THE LAWYER SO SELECTED. AS THE

ULTIMATE BULWARK OF OUR LIBERTIES AND AS THE

FINAL ARBITER IN ITS MOST CONTROVERSIAL

ASPECTS OF OUR SUPREME LAW -- THE

CONSTITUTION -- THE IDEAL FOR WHICH THOSE

LAWYERS WHO DO SERVE AS FEDERAL JUDGES OUGHT

IN THEORY TO STRIVE -- IS A COMBINATION OF

CRAFTSMANSHIP -- WISDOM -- PHILOSOPHICAL

VISION AND THE EXPERIENCE OF LIFE IN THIS

STATE AND COUNTRY THAT BRINGS SOCIAL

UNDERSTANDING. FLORIDA NOW FOR MANY YEARS

HAS BENEFITTED FROM A FEDERAL JUDGE WHO HAS

HAD THE TEMPERAMENT -- CHARACTER -- AND

INNATE ABILITY TO MEET SUCH IDEALS -- THE

SENIOR JUDGE WHOM WE HONOR TODAY -- HOWELL

MELTON.

WHEN HE WAS APPOINTED TO THE FEDERAL

BENCH -- HE WAS RECOGNIZED AS BEING IN THE

FRONT RANKS OF THE LAWYERS IN ALL OF FLORIDA

-- AND HE WAS UNIVERSALLY ACCLAIMED AT THAT

TIME AS THE RIGHT AND PROPER PERSON FOR THAT

EXACTING JOB.

WE ALL KNOW WHAT WE WANT IN OUR

FEDERAL JUDGES: WE WANT WISE AND GOOD WOMEN

OR MEN WHO -- BEFORE ASSUMING JUDICIAL ROBES

-- HAVE DISTINGUISHED THEMSELVES BOTH IN THE

FIELD OF LAW AND IN THE WIDER PUBLIC

CONSTITUENCY -- FOR THAT ESSENTIAL

COMBINATION OF WISDOM -- JUDGMENT AND

FAIRNESS THAT MUST GOVERN A VIABLE LEGAL

SYSTEM. WE KNOW THAT THE WORK OF A FEDERAL

JUDGE IS BASICALLY REFLECTIVE AND THAT THE

CASES BEFORE HER OR HIM ARE RARELY

FLAMBOYANT. WE KNOW THAT THE DESIRABLE

JUDICIAL QUALITIES INCLUDE MODESTY--

SCHOLARSHIP -- BALANCE -- DIGNITY--

RESTRAINT -- AND REFLECTION.

WE THOUGHT THEN THAT HOWELL MELTON

POSSESSED THOSE QUALITIES AT THAT LONG AGO

TIME WHEN HE ASSUMED FEDERAL JUDICIAL OFFICE

-- BUT WE ALSO KNEW THAT EVEN A VERY GOOD

LAWYER COULD NOT WITH CONFIDENCE AS THAT

LAWYER ENTERED JUDICIAL OFFICE BE CALLED AN

EXCELLENT JUDGE. THAT WAS THEN -- AND IS

NOW -- A TITLE WHICH CAN ONLY BE EARNED--

EARNED BY YEARS OF DEDICATED SERVICE. THUS

-- IT IS ONLY APPROPRIATE NOW -- TO CALL HIM

WHAT HE NOW IS -- AN EXCELLENT FEDERAL TRIAL

JUDGE. I DO SO. HE IS AN EXCELLENT--

SUPERIOR -- FEDERAL TRIAL JUDGE. TO FAIL

TO RECOGNIZE HIM FOR WHAT HE IS WOULD BE

FLAGRANT INGRATITUDE FROM WE WHO HAVE SO

BENEFITTED FROM HIS DILIGENT -- HIS SUPERIOR

-- PERFORMANCE.

KNOWINGLY -- WE ASSEMBLED

PARTICIPATE IN THIS CEREMONY HONORING THIS

NOBLE FEDERAL JUDGE -- BELIEVING THAT IN A

UNIQUE AND MARKED DEGREE -- YET DIFFERENT--

HE SEEMS TO US TO POSSESS THOSE RARE AND

PRECIOUS QUALITIES WHICH THROUGH HIS YEARS OF

FEDERAL JUDICIAL SERVICE IN THIS RENOWN COURT

HAVE MADE HIM A TRULY REMARKABLE FEDERAL

JUDGE.

BY EXPERIENCE -- BY APTITUDE -- BY

TEMPERAMENT -- BY DEMONSTRATED CHARACTER--

BY DILIGENT AND ARDUOUS LABOR -- BY THE VERY

NATURE OF HIS BEING -- HOWELL MELTON APPEARS

TO US AT THIS TIME AND AT THIS PLACE TO HAVE

SERVED THIS COURT AND THIS NATION IN SUCH A

WAY THAT HE HAS NOW IN HISTORY JOINED THE

MOST MAGNIFICENT OF THE JUDGES WHO -- OVER

THE YEARS -- HAVE GRACED THIS RENOWN FEDERAL

BENCH.

HOWELL MELTON WAS ASKED LONG AGO BY

OUR GOVERNMENT TO PROVIDE JUDICIAL REMEDIES

FOR THOSE SITUATIONS IN WHICH SOCIETY HAD

FAILED. WE ASKED MUCH -- AND HE RESPONDED

ABUNDANTLY -- AS THE GREAT WISE AND WARM AND

GRACIOUS PERSON WE ALREADY KNEW HIM TO BE.

AS A FLORIDA LAWYER AND A FLORIDA

CITIZEN -- AS ONE WHO KNOWS -- AND HAS KNOWN

-- CATHERINE AND HOWELL MELTON QUITE WELL FOR

MANY -- MANY YEARS -- I AM PERSONALLY PLEASED

TO BE A PARTICIPANT HERE -- BECAUSE -- AS YOU

MUST BY NOW KNOW -- I LIKE EACH OF THEM--

JOINTLY AND SEVERALLY -- VERY MUCH -- VERY

MUCH INDEED.

THANK YOU.

DR. GRANT BEGLARIAN A WINNER WITH

THE TRADITIONAL CHARACTERISTICS OF THE PERSON

WHO ALWAYS GETS RESULTS HAS A GREAT

INSTINCT FOR STRATEGY A PHENOMENAL CAPACITY

FOR WORK BOUNDLESS CONFIDENCE AND AN

ABILITY TO TURN THE RIGHT PHRASE. HIS STYLE

WAS AND IS DIRECT SPECIFIC AND

UNEQUIVOCAL. HIS OVERALL CONTRIBUTIONS AS

AN ACADEMIC AND ELEEMOSYNARY LEADER TO THE

DEVELOPMENT AND ENHANCEMENT OF ARTISTIC

TALENT BY HIGHER EDUCATIONAL INSTITUTIONS IS

UNSURPASSED IN AMERICA. OF COURSE -HE IS

BEST KNOWN IN MIAMI AS THE FOUNDING PRESIDENT

OF THE NATIONAL FOUNDATION FOR ADVANCEMENT IN

THE ARTS. THEREAFTER HE SERVED AS ITS

LEADER AND CHIEF FOR ALMOST TEN YEARS WITH

SINGULAR DISTINCTION. BUT IT IS HIS

CONTINUING UNYIELDING AND UNCEASING

DEVOTION OVERALL TO ARTISTIC HIGHER EDUCATION

THAT CAUSES THE NATIONAL FOUNDATION FOR

ADVANCEMENT IN THE ARTS TO RECOGNIZE HIM

TONIGHT ON THIS OCCASION WHICH HE LONG AGO

INAUGURATED AS TRULY A GREAT PERSON.

WHAT HAS GRANT BEGLARIAN CONTRIBUTED TO

THE NATIONAL FOUNDATION FOR ADVANCEMENT IN

THE ARTS:

FIRST HE SET A CLEAR ARTISTIC DIRECTION

DEFINING ITS MISSION IN SUPPORT OF EMERGING

ARTISTS THROUGHOUT THE NATION AND HE

INSTITUTED PROGRAMS OF THE HIGHEST STANDARDS

TO FULFILL THAT MISSION.

SECOND HIS INTEGRITY AND HIS SINCERE

PASSION FOR THE IDEALS OF THE FOUNDATION

ENABLED HIM TO LEAD IT FROM ITS HUMBLE

INCEPTION TO A PROMINENT NATIONAL PLACE AMONG

THOSE ORGANIZATIONS WHICH CONTRIBUTE SUPPORT

TO ARTISTS.

THIRD HE WAS A STRONG AND PERSUASIVE

LEADER WHO WAS ABLE TO ATTRACT MANY PROMINENT

SUPPORTERS ARTISTS AND EDUCATORS WHO

EARLY ON JOINED THIS CAUSE AND WHO CONTINUE

HERE TONIGHT AND THROUGHOUT AMERICA TO

PROVIDE INVALUABLE BACKING.

FOURTH HIS BOUNDLESS ENERGY AND

INTENSITY PERMEATED EVERY ASPECT OF THE

FOUNDATION'S LIFE AND TRANSLATED INTO

EXCELLENCE IN THE CONDUCT OF ITS AFFAIRS.

FIFTH AND LAST HIS VISION OF THE

FOUNDATION AS AN INVALUABLE NATIONAL RESOURCE

FOR ARTISTS AND HIS DETERMINED EFFORTS TOWARD

THAT GOAL HAVE EARNED AND MERITED NATIONAL

RECOGNITION.

WITH ALL OF THAT GRANT BEGLARIAN DOES

NOT HAS NOT SOUGHT ACCOLADES. INSTEAD

- HE CONTINUES TO ACCEPT ASSIGNMENTS OF HIGH

RESPONSIBILITY ONLY IF HE DETERMINES THAT

THOSE ASSIGNMENTS WILL CONTRIBUTE TO THE

ACCOMPLISHMENT OF GOALS THAT HE PERSONALLY

CHERISHES.

BUT FIRST AND FOREMOST TO ME AND MANY OF

THOSE HERE TONIGHT DR. GRANT BEGLARIAN IS A

FRIEND. HE ACTS AND DOES AS WE PERSONALLY

WANT A FRIEND TO ACT AND DO. HAPPILY FOR

ALL OF US HE HAS USED HIS TALENTS HIS

SKILLS TO EFFECTUATE A BETTER ARTISTIC

WORLD FOR THOSE AROUND HIM.

ALWAYS HE HAS BEEN HIS OWN PERSON AND

HIS PAST INDICATES THAT HE WILL BE SO IN THE

FUTURE. DR. GRANT BEGLARIAN VERILY

EXEMPLIFIES THE BEST A PERSON WHO SOMETIMES

IS LONELY AND EXHAUSTED BUT ONE WHO NEVER

IS UNWILLING TO WALK ANOTHER MILE TO REACH

THE DESIRED DESTINATION. HE MERITS THE

PLAUDITS OF ALL OF US.

THREE MINUTES

IT IS MOST PLEASANT TO TESTIFY FOR

A PERSON WHOM I ADMIRE ENJOY AND LIKE

VERY MUCH.

JACK GORDON I SUGGEST IS

SOMEONE WHOM EACH ONE HERE ALWAYS WILL

REMEMBER. HE IS A POLITICIAN A PRAGMATIC

GRASS-ROOTS ACTIVIST; BUT HE IS ALSO AN

INTELLECTUAL. HE IS TRULY A STATESMAN IN A

TIME WHEN TRUE STATESMANSHIP IS DISAPPEARING.

AS A PUBLIC SERVANT HE ABHORS A

HAS ABHORRED DISCRIMINATION ON

OF RACE COLOR RELIGION -

LND ALWAYS

THE BASIS

GENDER-

NATIONAL ORIGIN SEXUAL ORIENTATION AGE-

HANDICAP OR MARITAL STATUS.

THROUGHOUT HIS 30 YEAR PUBLIC

CAREER JACK GORDON HAS FOCUSED ON MATTERS

THAT MOST PUBLIC SERVANTS WOULD NOT

UNDERTAKE BECAUSE THOSE PROJECTS WERE TOO

CONTROVERSIAL OR TOO UNPOPULAR OR SIMPLY

LOST CAUSES. ON HIS FIRST DAY AS A

LEGISLATOR JACK GORDON WAS THE LONE

DISSENTER IN THE 39-1 VOTE IN SUPPORT OF THE

CALL FOR RE-ENACTING THE DEATH PENALTY.

LATER JACK GORDON SUCCESSFULLY LED THE

FIGHT AGAINST THE EFFORTS TO FURTHER

REGULATE A WOMAN'S RIGHT TO FREEDOM OF

CHOICE.

AS A PUBLIC SERVANT PURSUING

SOCIAL AND POLITICAL CHANGE IN FLORIDA JACK

GORDON POSSESSES A FIERCE COMPETITIVENESS A

CHESS-PLAYER'S INSTINCT FOR STRATEGY A

THOROUGH GRASP OF THE GOVERNMENTAL PROCESS-

A PHENOMENAL CAPACITY FOR WORK BOUNDLESS

CONFIDENCE POLITICAL FEARLESSNESS AND

THE FACILE ABILITY TO TURN A PHRASE. HIS

STYLE WAS AND IS BONA FIDE -DIRECT SPECIFIC

- AND UNEQUIVOCAL.

JACK GORDON DAILY HAS IN MIND THE

INTEREST OF THE DESPISED THE POOR THE

HOMELESS THE DEPRIVED AND THE UNPOPULAR.

HE IS COMMITTED TO CIVIL RIGHTS AND CIVIL

LIBERTIES TO PREVENTING GOVERNMENT FROM

TRESPASSING WHERE THE CONSTITUTION FORBIDS IT

TO GO. NOT SURPRISINGLY HE HAS ALREADY

FILED IN THE 1992 FLORIDA LEGISLATURE SENATE

BILL 72 ESTABLISHING STATE REMEDIES FOR

UNLAWFUL DISCRIMINATORY PRACTICES AND I

KNOW THAT HE WILL FIGHT UNTIL IT BECOMES LAW.

JACK GORDON EPITOMIZES THAT WHICH

IS VERY GOOD ABOUT THE FREE AND INDEPENDENT

PART-TIME PUBLIC SERVANT. HE HAS BEEN HIS

OWN PERSON AND HIS PAST INDICATES THAT HE

WILL BE IN THE FUTURE. SOMETIMES SENATOR

JACK GORDON HAS BEEN LONELY BUT HE HAS NEVER

SHIRKED STANDING ALONE. HE NEVER WILL.

TITLE:

THOUGHTS ABOUT ETHICS

THIRTY MINUTES

TIME:

THE DEVELOPMENT OF ETHICS IN

BUSINESS ORGANIZATIONS IS INCREASINGLY A

MAJOR CONCERN -- PARTICULARLY AS CORPORATIONS

-- LARGE AND SMALL BUSINESSES -- ARE BEING

SUBJECTED TO INCREASING ATTACK ON THE GROUNDS

THAT THEY ARE LESS AND LESS RESPONSIVE TO THE

PUBLIC GOOD -- THAT THEY ARE INIMICAL TO THE

TRUE NEEDS OF SOCIETY -- THAT THEY TYPICALLY

HAVE A CULTURE THAT IS NOT PROPERLY MANAGED

WITH RESPECT TO ETHICAL CONCERNS.

PRODUCTIVITY AND PROFITABILITY ARE QUITE

PROPERLY THEIR MOST DOMINANT VALUES.

WHILE THOSE ARE GOOD AND RIGHT VALUES -- IT

IS INCREASINGLY APPARENT THAT AN

ORGANIZATION'S ROLE MUST EXCEED A PURELY

ECONOMIC ONE -- BUSINESS HAS OTHER DUTIES--

AND OTHER OBLIGATIONS -- TO ITS SEVERAL

PUBLIC CONSTITUENCIES.

I SUGGEST THAT LONG RANGE PROFITS

CAN BEST BE REALIZED FROM AN ENTERPRISE THAT

HAS CONTINUITY AND DURABILITY. LONG RANGE

BUSINESS EXISTENCE IS DEPENDENT UPON PUBLIC

APPROVAL OF THAT BUSINESS' OPERATING

STANDARDS. THE PUBLIC NEEDS TO PERCEIVE THE

BUSINESS AS ABIDING BY ETHICAL STANDARDS--

STANDARDS THAT CONTRIBUTE TO THE ECONOMY AND

PROMOTE THE OVERALL GOOD FOR THEIR

COMM UNITIES. THE PUBLIC WANTS CORPORATIONS

AND OTHER BUSINESS ENTITIES TO BE CONCERNED

ABOUT ETHICAL CONSIDERATIONS.

PROFITABILITY AND ETHICS FOR A

BUSINESS ENTERPRISE ARE NOT SEPARATE GOALS -

- THEY ARE INTERTWINED AND MUST BE

CONSIDERED TOGETHER IN DECISION MAKING BY TOP

MANAGEMENT. THE GOALS OF PROFITABILITY

AND ETHICS BECOME DIVERGENT PRIMARILY IN

TIMES OF STRESS FOR BUSINESS ENTITIES.

INDEED -- IT IS NOT UNCOMMON TO SEE UNETHICAL

BEHAVIOR WHEN THAT ENTERPRISE IS FAILING

ECONOMICALLY TO SUCCEED. IF j

ENTITY -- A CORPORATION ASPIRES TO

A LONG TIME -- AS MOST SURELY

CLEARLY MUST BE SENSITIVE TO I

PROFITS.

A BUSINESS

EXIST

DO --

MORE 1

FOR

IT

FHAN

INCREASINGLY BUSINESS ENTITIES ARE

BEING CLOSELY SCRUTINIZED FOR FAILING TO

MAINTAIN THEIR SOCIAL OBLIGATIONS AND

RESPONSIBILITIES TO THEIR CONSTITUENCIES-

INCLUDING CUSTOMERS -- EMPLOYEES -- AND THE

COMMUNITY AS A WHOLE. CERTAINLY THOSE

RESPONSIBILITIES INCLUDE GIVING EMPLOYEES A

SENSE OF JOB SECURITY -- PROTECTING THE

ENVIRONMENT -- SUPPORTING LOCAL COMMUNITY

NEEDS WITH A FAIR SHARE OF THE TAX BURDEN--

AND MAKING A PROFIT TO ENSURE THE CONTINUED

EXISTENCE OF THE BUSINESS ENTERPRISE AND TO

REWARD THEIR INVESTORS.

THE PUBLIC'S DEMAND FOR RESPONSIBLE

CORPORATE ACTIONS PRESUMES A STANDARD OF

BEHAVIOR THAT IS ACKNOWLEDGED AND ACCEPTED BY

BUSINESS CORPORATIONS AND THE COMMUNITIES IN

WHICH THEY EXIST. CORPORATIONS ROUTINELY

ARE EXPECTED TO BE GOVERNED BY THE SAME RULES

THAT GOVERN AN INDIVIDUAL'S GOOD BEHAVIOR IN

OBTAINING ITS GOALS. TOO MANY

ORGANIZATIONS TODAY ARE PREOCCUPIED WITH

COMPLIANCE WITH THE LETTER OF THE LAW AS THE

NECESSARY STANDARD FOR BEHAVIOR -- WITHOUT

REACHING FOR STANDARDS ABOVE THAT SOCIETAL-

SET MINIMUM.

JUST BECAUSE A BUSINESS ORGANIZATION

HAS THE LEGAL RIGHT TO DO SOMETHING DOES NOT

NECESSARILY MEAN THAT IT IS THE RIGHT THING

TO DO. YET -- RARELY DOES ANY BUSINESS

CORPORATION OR OTHERWISE -- TODAY READILY

ADMIT BLAME FOR ANY CONDUCT NOT VIOLATIVE OF

THE LAW. CORPORATIONS SIMPLY DO NOT TAKE

RESPONSIBILITY FOR ANY ACTION THAT IS NOT

ILLEGAL.

SELF-DEFENSE BY CORPORATION OR OTHER

BUSINESS ENTITIES AGAINST UNETHICAL BEHAVIOR

USUALLY IS: "WE MET ALL FEDERAL -- STATE AND

LOCAL REQUIREMENTS -- WE HAVE DONE NOTHING

ILLEGAL." BUT THE PROBLEM--IN MANY IF NOT

MOST INSTANCES -- IS NOT WHAT IS ILLEGAL;-

- IT IS WHAT IS PERFECTLY LEGAL. WITH MANY

-- ANYTHING GOES AS LONG AS CRIMINAL CONDUCT

IS AVOIDED. CULPABILITY IS NO LONGER

SYNONYMOUS WITH LIABILITY. SIMPLE

MATTERS OF CONSCIENCE ARE LESS AND LESS

IMPORTANT. BLATANT -- SHAMELESS STANDARDS

OF CONDUCT THAT VIOLATE GOOD SENSE -- GOOD

TASTE -- AND GOOD CONDUCT ARE FREELY AND

CYNICALLY FOLLOWED BY HIGH AND LOW -- IF NOT

AGAINST THE LAW. YET OUR REMARKABLE LEGAL

PRESUMPTION OF INNOCENCE WAS NEVER DESIGNED-

- OR EVEN INTENDED -- TO ELIMINATE JUDGMENTS

BY BUSINESS MANAGEMENT TO DECIDE WHAT IS

MORALLY RIGHT AND PERMISSIBLE -- AND WHAT IS

MORALLY WRONG AND IMPERMISSIBLE.

IT SEEMS TO ME THAT THERE IS LITTLE

OR NO PUBLIC SUPPORT FOR PURPOSEFUL STANDARDS

OF ETHICAL AND MORAL RECTITUDE BEYOND THE

MINIMUM SET BY LAW. MANIFESTLY -- TO

ACCEPT THE LAW AS THE APPROPRIATE STANDARD OF

CONDUCT RELIEVES ORGANIZATIONS OF ALL

RESPONSIBILITY FOR BEHAVIOR NOT FORBIDDEN BY

LAW. AS AN INEVITABLE COROLLARY -- THOSE

MINIMUM LEGAL STANDARDS ARE OFTEN USED BY

ORGANIZATIONS TO ADVANCE THEIR OWN PURPOSES

-- LEADING TO A WIDELY HELD AND JUSTIFIED

SUSPICION BY CUSTOMERS -- EMPLOYEES -- OWNERS

-- AND THE GENERAL PUBLIC -- OF BOTH THE LAW

AND THE LEGAL SYSTEM. THE LAW -- ONCE

VIEWED AS THE MINIMUM REQUIREMENTS FOR

ACCEPTABLE BEHAVIOR -- IS NOW EVOKED AS THE

"CEILING" -- AS AN EXAMPLE OF GOOD BEHAVIOR.

MEET THE MINIMUM -- AND NO MORE.

WHY HAS CORPORATE AMERICA -- IN

RECENT TIMES -- SEEMINGLY SHIFTED EMPHASIS

FROM THAT WHICH IS RIGHT -- ETHICAL -- AND

PROPER TO THAT WHICH IS LEGAL? WHAT ARE

10

OUR CHANCES FOR REVERSING THIS TREND?

ADMITTEDLY -- ALMOST ALL LEADERS WHO

EMPHASIZE OR POINT OUT SOCIETAL SHORTCOMINGS

SIMULTANEOUSLY URGE THAT SUCH DEFICIENCIES BE

RECTIFIED BY PASSING "CORRECTIVE" NEW LAWS.

HOW IS THAT OVERWHELMING RELIANCE ON

LEGISLATIVE AND JUDICIAL SOLUTIONS FOR

SOCIETAL PROBLEMS TO BE MITIGATED OR

CURTAILED?

THE BEST RESPONSE -- AND PERHAPS THE

ONLY EFFECTIVE RESPONSE -- IS FOR BUSINESS

ORGANIZATIONS PROMPTLY TO DEMONSTRATE THAT

11

THEY -- THEMSELVES -- WHILE HONORING THE

RULE OF LAW -- ARE ALSO CAPABLE OF SELF-

DISCIPLINE. NO MATTER HOW THOUGHTFULLY

CONCEIVED -- THE LAW CANNOT PROVIDE OR EVEN

ATTEMPT TO PROVIDE A RESPONSE TO ALL SOCIAL

PROBLEMS. HISTORICALLY -- THE LAW IN

ADDRESSING SOCIAL AND ECONOMIC INJUSTICE MOST

OFTEN TRAILS RATHER THAN LEADS. THE TREND

TODAY IS FOR THE LAW TO LAG EVER FURTHER

BEHIND.

THE EMERGENCE OF A NEW BUSINESS

PRACTICE OFTEN CREATES A LARGE RISK IN OUR

12

LEGALISTIC SYSTEM. WITHOUT SPECIFIC LAWS

TO GOVERN CORPORATE BEHAVIOR IN THESE NEW

AREAS -- NOVEL ETHICAL QUESTIONS OFTEN ARISE.

WE RELY UPON BUSINESS CORPORATIONS

THEMSELVES TO OBSERVE THEIR SOCIAL

RESPONSIBILITIES AND TO REGULATE THEMSELVES

WHEN CONFRONTED WITH NEW AREAS OF ETHICAL

VULNERABILITY. EFFORTS TO OBTAIN MINIMUM

ADHERENCE TO THE RULE OF LAW -- EVEN IF

SUCCESSFUL -- WOULD NOT ASSURE A PEACEFUL AND

FRUITFUL CORPORATE LIFE. THE LAW DOES NOT

ANTICIPATE ALL

OFTEN REACTIVE

SITUATIONS.

TO PAST EVENTS

LEGISLATION IS

AND IS LIMITED

13

IN ANTICIPATING A FUTURE UNKNOWN.

PERSONALLY

AMERICA W

MANAGEMENT

BUT ABOVE

ESTABLISH

BUSINESS 0

TOTAL AT

BELIEVE THAT AN IDEAL CORPORATE

ILL ONLY BE OBTAINED IF TOP

RESPONDS NOT ONLY TO THE LAW--

THE LAW. TO PERMIT LAW TO

THE ENTIRE MORAL CRITERIA OF

ORGANIZATIONS CAN ONLY RESULT IN A

ROPHY OF THEIR SOCIETAL

RESPONSIBILITY.

EACH ORGANIZATION SHOULD GIVE MORE

FORCEFUL ATTENTION TO THE ESSENTIAL ROLE OF

MORALITY -- ASPIRE FOR HIGHER STANDARDS THAN

14

THOSE IMPOSED BY GOVERNMENTAL STATUTE.

INDEED -- THE TRUE ROLE OF LAW -- INCLUDING

WRITTEN STANDARDS OF CONDUCT -- ENVISIONS

INTERNAL MORAL CHECKS WITHIN EACH BUSINESS

ORGANIZATION AS A NECESSARY COMPLEMENT TO THE

EXTERNAL RESTRICTIONS OF LAW. ONLY THIS

COMBINATION OF AN INTERNALIZED VALUE SYSTEM

AND EXTERNAL CONSTRAINTS CAN ASSURE THAT

BUSINESS ENTITIES AND CORPORATIONS ACT

RESPONSIBLY.

I AM CONFIDENT THAT TOP MANAGEMENT

CAN PROVIDE THE ETHICAL LEADERSHIP TO GUIDE

15

EMPLOYEES IN AREAS OF VULNERABILITY. WHILE

NEW BUSINESS PRACTICES ADMITTEDLY INTRODUCE

UNCHARTERED STANDARDS OF CONDUCT FOR

EMPLOYEES -- MANAGEMENT CAN -- AND SHOULD--

INITIATE PROGRAMS TO EDUCATE THOSE EMPLOYEES

IN APPROPRIATE RESPONSES TO THE ETHICAL

ISSUES PRESENTED BY NEW BUSINESS

ENTERPRISES.

IT IS APPARENT THAT DEVELOPMENTS IN

BUSINESS ENVIRONMENT IN RECENT TIMES HAVE

SUBSTANTIALLY INCREASED THE TIME AND

ATTENTION DEVOTED TO COMPETITOR INTELLIGENCE

16

GATHERING. COLLECTING INFORMATION ON A

COMPETITOR HAS ALWAYS BEEN A LEGITIMATE

BUSINESS INTEREST --BUT MORE AND MORE IT IS

BECOMING A SEEMINGLY ESSENTIAL FUNCTION OF

BUSINESS. CERTAINLY -- THERE ARE BUSINESS

ADVANTAGES TO KNOWING WHAT YOUR COMPETITOR IS

DOING. INDISPUTABLY -- INTELLIGENCE

INFORMATION IS NOW SYSTEMATICALLY AND WIDELY

ACCUMULATED AND GATHERED BY THE ENTIRE

BUSINESS COMMUNITY -- LARGE AND SMALL.

GIVEN THE COST OF RESEARCH AND

DEVELOPMENT CORPORATIONS ARGUABLY CAN
